Background Summary:
Among the goals of the Auburn Environmental Park is to provide open habitat for birds and an opportunity
for the citizens of Auburn to enjoy passive recreation in their urban environment. Part of this vision
includes the construction of a bird viewing tower, to allow people a view of open water, the birds utilizing
this site in their natural habitat, and Mt. Rainier. Many groups, including the Rainier chapter of Audubon
were involved with site selection and design of this birding tower. After working closely with our
consultants on the design of the birding tower, we are prepared to open bid and award this construction
contract, with the goal of construction prior to the end of this year.
Construction is projected to start at the end of September 2008, and be complete by late October 2008.
Because the bid opening will not be held until September 25, 2008, staff is requesting authorization for
the Mayor to award this contract to the Lowest Qualified Bidder. This approval would be contingent on the
bid being within budget, and would avoid delay of the project and allow construction to take place prior to
the end of this year.
The Birding Tower project is one component of the total Auburn Environmental Park budget. Funding for
the Auburn Environmental Park budget includes $578,000 from the 2007-2008 Budget and a matching
$578,000 in grant money from the state Recreation and Conservation Office. The Birding Tower piece of
this budget is approximately $235,000 (this includes design and construction).

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
AUBURN, WASHINGTON, AUTHORIZING THE MAYOR AND
CITY CLERK TO EXECUTE AN AGREEMENT BETWEEN
THE CITY OF AUBURN AND THE LOWEST QUALIFIED
BIDDER FOR CONTRACT NUMBER 08-21, PROJECT
NUMBER C412130, AUBURN BIRD VIEWING TOWER
WHEREAS, the City Council of the City of Auburn has previously created
the Auburn Environmental Park for the purpose of creating an urban green space
with passive recreational amenities such as birding towers, informational kiosks,
and trails; and
WHEREAS, a project Bid Opening for the construction of the first Auburn
Bird Viewing Tower is scheduled to take place on September 16, 2008; and
WHEREAS, the City of Auburn Planning and Public Works Departments will
assess the bids received and identify the Lowest Qualified Bidder following the Bid
Opening; and
WHEREAS, it is in the public interest for the parties to enter into an
agreement for construction of C412130, Auburn Bird Viewing Tower with due
expediency, in order to complete the project prior to the end of this year.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
KING COUNTY, WASHINGTON, HEREBY RESOLVES as follows:
Section 1. The Mayor of the City of Auburn and the Auburn City Clerk
are hereby authorized to review bids, award, and execute an Agreement between
Resolution No. 4398

the City of Auburn and the Lowest Qualified Bidder for Project Number C412130,
Contract Number 08-21, Auburn Bird Viewing Tower, which agreement shall
conform with the Bid Documents, provided that the bid amount does not exceed the
budgeted amount.
Section 2. The Mayor is hereby authorized to implement such
administrative procedures as may be necessary to carry out the directives of this
legislation.
Section 3. This Resolution shall be in full force and effect upon passage
and signatures hereon.
