MINUTES
1. CALL TO ORDER
Chair Nancy Backus called the meeting to order at 6:30 p.m. in the
Council Conference Room at Auburn City Hall, located at 25 West Main
Street in Auburn. Chair Backus, Vice Chair Sue Singer and Member Bill
Peloza were present. Present during the meeting were Mayor Peter B.
Lewis, Finance Director Shelley Coleman, City Attorney Daniel B. Heid,
Employee Relations and Compensation Manager John Fletcher, Principal
Planner Elizabeth Chamberlain, and City Clerk Danielle Daskam.
Members of the audience included Troy Humphrey of Alpert International.
II. APPROVAL OF MINUTES
A. Minutes of the September 15, 2008 Finance Committee
meeting.
Vice Chair Singer moved and Member Peloza seconded to approve
the September 15, 2008 minutes.
MOTION CARRIED. 3-0.
III. CONSENT ITEMS

Committee members reviewed the consent items and briefly discussed
vouchers 378732, 378627, 378636, 378656, 378660, 378764, 378771,
378778, 378780, 378900, 378933, 378936, 378972, 379047, and
379108.
Vice Chair Singer moved and Member Peloza seconded to approve the
consent items.
MOTION CARRIED. 3-0.
IV. ORDINANCES AND RESOLUTIONS
A. Ordinances
1. Ordinance No. 6182
An Ordinance of the City Council of the City of Auburn,
Washington, amending Sections 10.02.120, 12.64A.060,
13.41.070, 15.68.150, 19.04.080, relating to appeals
Mayor Lewis explained that Ordinance No. 6182 and the
following four ordinances move the City Council away from
quasi-judicial roles much like many municipal jurisdictions
across the state.
Vice Chair Singer moved and Member Peloza seconded to
approve Ordinance No. 6182.
MOTION CARRIED UNANIMOUSLY. 3-0.
2. Ordinance No. 6184
An Ordinance of the City Council of the City of Auburn,
Washington, amending Sections 14.02.020, 14.02.090,
14.03.030, 14.03.040, 14.03.050, 14.13.020, and 14.20.120
of the Auburn City Code relating to appeals
In response to questions from Member Peloza, City Attorney
Heid explained that even with the adoption of the ordinances
on the agenda this evening regarding quasi-judicial roles,

the City Council would still retain the responsibility for some
quasi-judicial actions mandated by state statute, for example
site specific rezones and final plats.
Vice Chair Singer moved and Member Peloza seconded to
approve Ordinance No. 6184.
MOTION CARRIED UNANIMOUSLY. 3-0.
3. Ordinance No. 6185

5. Ordinance No. 6187
An Ordinance of the City Council of the City of Auburn,
Washington, amending Sections 14.02.040, 14.08.010 and
16.10.030 of the Auburn City Code, and repealing Chapter
14.21 of the Auburn City Code relating to development
agreements

In response to questions from Member Peloza, City Attorney
Heid explained that the ordinance repeals Chapter 14.21 of
the City Code relating to development agreements. It may
be that as a result of the ongoing code development review,
either planned unit development or development agreement
provisions may be proposed for adoption at a later date.
Vice Chair Singer moved and Member Peloza seconded to
approve Ordinance No. 6187.
MOTION CARRIED UNANIMOUSLY. 3-0.
B. Resolutions
There was no resolution for Committee consideration.
V. DISCUSSION ITEMS
A. Resolution No. 4401
A Resolution of the City Council of the City of Auburn, Washington,
authorizing the Mayor and City Clerk to execute an agreement
between the City of Auburn and Alpert International, LLP for a
Master Plan Development Agreement
Committee members reviewed Resolution No. 4401. A revised
master plan development agreement was distributed during the
meeting. City Attorney Heid explained that at the request of the
Public Works Committee a change was made to page 2 of the
agreement so that it is clear that the development agreement
option exists for the Alpert development.
Committee members briefly discussed the computation for the
annual inflator for the purchase price of City parcels. Finance
Director Coleman stated the rate is consistent with the City's
research studies and negotiations with other developers.
Vice Chair Singer moved and Member Peloza seconded to support
Resolution No. 4401.
MOTION CARRIED UNANIMOUSLY. 3-0.
B. Resolution No. 4402
A Resolution of the City Council of the City of Auburn, Washington,
authorizing the Mayor and City Clerk to execute a contract for

public defense services for calendar years 2009 - 2010 between
the City of Auburn and The Stirbis & Stirbis Law Firm
Director Heineman presented Resolution No. 4402 which
authorizes a contract with The Stirbis & Stirbis Law Firm for public
defender services for the two-year term beginning January 1, 2009.
Employee Relations and Compensation Manager Fletcher reported
that five proposals were received. Four of the applicants were
interviewed by a panel which included Councilmember Backus and
District Court Judge Phillips.
C. Streamlined Sales Tax
Finance Director Coleman presented a memo dated October 6,
2008 regarding streamlined sales tax or destination based sales
tax. Director Coleman stated that the City received its first sales
tax distribution post streamlined sales tax in September 2008
(which is for July 2008 receipts). A comparison of the July 2007
receipts to the July 2008 receipts reveals a $200,000 decrease in
sales tax revenues for those industries to be mitigated for
streamline sales tax. The State Department of Revenue estimated
that the City of Auburn would lose approximately $1.2 million of
retail sales tax when the source change occurred. The first
mitigation payment from the State is expected in December.
D. Ordinance No. 6177
An Ordinance of the City Council of the City of Auburn,
Washington, amending Section 3.41.010 of the Auburn City Code
relating to solid waste excess funds to be moved to the General
Fund
Finance Director Coleman presented a revised Ordinance No.
6177 for discussion. The ordinance provides for the
interdepartmental transfer of excess solid waste funds.
