Background Summary: In 1990 the City of Auburn adopted Ordinance 4412 to set fees for the Auburn Golf Course. In 1996, the first amendment (Ordinance 4919) was adopted authorizing the Director of Parks and Recreation to set reasonable fees and charges, and to establish policies upon which fees and charges are set. The golf course has seen many improvements and is operated as an Enterprise. It is very important that the fees charged are market driven. In addition, staff must have the flexibility to maximize both revenues and participation. The current ordinance provides "Policies upon which fees and charges are set" as well as a strict criteria and procedure of requiring a comparison of eight area golf courses. The pricing for the Auburn Golf Course must be at "an average of fee charges" for said courses. The policy also sets strict parameters as to when Junior and Senior rates will be offered and at what fee. Additionally, the proposed change, changes the language of the Ordinance from "No fee will be charged to the Auburn School District and Green River Community College" to "the Director is authorized to provide discounted fees and charges to the Auburn School District and Green River Community College". There is no financial impact to this legislation. Proposed Ordinance 6206 will make current operational practices consistent with the ordinance. Information Services Action: Committee Approval: ?Yes ?No Council Approval: ?Yes ?No Call for Public Hearing Referred to Until Tabled Until Councilmember: Cerino Staff: Faber Meetin Date: November 3, 2008 Item Number: VIII.A.1 AUBURN *MOPE THAN YOU IMAGINED ORDINANCE NO. 6 2 0 6 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AMENDING SECTIONS 3.72.010, 3.72.020, 3.72.030 AND 3.72.040 OF THE AUBURN CITY CODE RELATING TO GOLF COURSE FEES AND CHARGES AND ESTABLISHING POLICIES FOR OPERATING THE AUBURN GOLF COURSE WHEREAS, the Auburn Golf Course, ("Golf Course") managed by the Auburn Parks, Arts, and Recreation Department, generates revenue through green fees and associated charges for use of the Golf Course Facilities; and WHEREAS, competition has greatly increased over the past 10 years, with the development of many new publicly-owned golf facilities that offer a wide variety of incentives to encourage the use of their facilities. Peak rates, twilight rates, winter rates and other discounts based on seasons, time of day, and day of the week have become commonplace in the industry and are necessary to operate a viable program; and WHEREAS, the City's recreation program, including the golf program, are market-based activities. The golf marketplace requires flexibility in setting fees in order to remain competitive, adapt to changing market conditions, and balance revenue needs with customer demands. Rate changes recommended by the Director of the Parks, Arts and Recreation Department and the Parks and Recreation Board and adopted by resolution instead of by ordinance will protect the public interest and allow the flexibility necessary to operate the program on an efficient and profitable basis; and Ordinance No. 6206 October 28, 2008 Page 1 of 5 WHEREAS, the City Council wishes to keep the Golf Course fees and charges lower than privately-owned courses and comparable to the average charge of other publicly-owned golf courses in the area. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN as follows: Section 1. Amendment to City Code. That Section 3.72.010 of the Auburn City Code, as most recently amended by Ordinance No. 4919, be and the same hereby is amended to read as follows: 3.72. 010 Authorization. The d+restOF Director of the Parks Arts and Recreation Department ("Director"), upon recommendation of the Parks and Recreation Board, is hereby authorized to set reasonable rg eens fees, public and private golf cart and charges for the use of the Auburn Golf Course. Such fees shall be based on policies established by this chapter and such fees shall not exceed those approved by Resolution be approved by the maye . (Ord. 4919 § 1, 1996; Ord. 4412 § 1, 1990.) Section 2. Amendment to City Code. That Section 3.72.020 of the Auburn City Code, as most recently amended by Ordinance 4919, be and the same hereby is amended to read as follows: 3.72.020 Establishment of fees and charges. At least once e€ach year prior to April 1st, the fees and charges shall be established in accordance with the standards for setting fees and charges as set forth in this chapter. Once the fees and charges have been established, said fees shall be posted at the Auburn Golf Course. (Ord. 4919 § 2, 1996; Ord. 4412 § 2, 1990.) That Section 3.72.030 of the Auburn City Code, as most recently amended by Ordinance 4919, be and the same hereby is amended to read as follows: 3.72.030 Exclusions. A. The Director is authorized to establish fl=ees and charges for pro-shop food, golf merchandise, rentals, and other items covered in other golf course- related contracts. . Such fees and charges do not need to be approved by the Parks and Recreation Board or the City Council, but shall be posted at the Golf Course. B. The Director is authorized to provide discounted fees and chargese fee wide Ghafged-to the Auburn School District or Green River Community College golf teams for scheduled practices or matches during their season. Each year a written request for use of facilities must be presented for park board review and the team coach must be present during practice. (Ord. 4919 § 3, 1996; Ord. 4412 § 3, 1990.) Section 4. Amendment to City Code. That Section 3.72.040 of the Auburn City Code, as most recently amended by Ordinance 4919, be and the same hereby is amended to read as follows: 3.72.040 Standards for setting fees and charges. The setting of fees and charges for the AubuFR Golf Course shall be based on market conditions in accordance with generally accepted golf _course management practice. Section S. Implementation. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Section 6. Severability. The provisions of this ordinance are declared to be separate and severable. The invalidity of any clause, sentence, paragraph, subdivision, section or portion of this ordinance, or the invalidity of the application thereof to any person or circumstance shall not affect the validity of the remainder of this ordinance, or the validity of its application to other persons or circumstances.
