Background Summary: City Council to award contract CP0720 to ICON Materials, on their low bid of $2,461,430.16, including sales tax, for the construction of the Auburn Municipal Airport Parallel Taxiway A Reconfiguration project. This contract will be funded 95% by grants from the Federal Aviation Administration which have been awarded as follows: * AIP Project No. 3-53-003-013 in the amount of $300,006 on August 6, 2007. "AIP Project No. 3-53-003-014 in the amount of $221,379 on June 16, 2008. "AIP Project No. 3-53-003-015 in the amount of $2,458,464 on June 2, 2008. " AIP Project No. 3-53-003-016 in the amount of $48,693 on February 2, 2009. Grants currently applied for and awaiting Grant offer from the Federal Aviation Administration: 'AIP Project No. 3-53-003-017 in the amount of $161,074. The State of Washington will fund 2.5% of this project for a total dollar amount of $61,536 and the remaining 2.5% will be funded by the City to be used from Airport fund 435. The primary objective of this project is the establishment of a new parallel taxiway system that is in conformance with current FAA criteria. It will consist of the construction of a new asphalt taxiway approximately 3,400' in length, a new taxiway edge lighting system, a new runway edge lighting system, relocation of various lighted signs and modifications to the storm drainage system in the vicinity of the new taxiway construction. WITNESSETH: That, in consideration of the terms and conditions contained in the Contract Documents entitled "CP0720, AUBURN MUNICIPAL AIRPORT PARALLEL TAXIWAY A RECONFIGURATION," which are by this reference incorporated herein and made a part of this Contract, the parties hereto covenant and agree as follows: 1. The CONTRACTOR shall do all work and furnish all tools, materials and equipment for Project CP0720, AUBURN MLJNICIPAL AIRPORT PARALLEL TAXIWAY A RECONFIGURATION for a unit bid price of $Two Million Four Hundred Sixty-One Thousand Four Hundred Thirty Dollars & 16/100 ($2,461,430.16). This price is for Basic Bid Schedules A and B, including Washington State Sales Tax, of $1,776,715.59 (Schedule A) and $684,714.57 (Schedule B) in accordance with and as described in the Contract Documents which are by this reference incorporated herein and made a part hereof, and shall perform any alterations in or additions to the work provided under this Contract and every part thereof. This Contract shall be executed by the Contractor and returned to the City within 15 calendar days after the receipt of the dated notification of award and the Contract time shall commence within 5 working days after execution of the Contract by the City and so designated on the Notice to Proceed. Physical completion shall be as stated in Section 00801. If said work is not completed within the time specified, the CONTRACTOR agrees to pay liquidated damages to the CITY OF AUBURN, as specified in 00710 FAA General Provisions. The CONTRACTOR shall provide and bear the expense of all equipment, work and labor of any sort whatsoever that may be required far the transfer of materials and for constructing and completing the work provided for in this Contract and every part thereof, except such as are mentioned in the Contract Documents to be furnished by the CITY OF AUBURN. II. The CITY OF AUBURN hereby promises and agrees with the CONTRACTOR to employ, and does employ the CONTRACTOR to provide the materials and to do and cause to be done the above described work and to complete and finish the same according to the Contract Documents and the terms and conditions herein contained and hereby contracts to pay for the same according to said Contract Documents and the aforesaid proposal hereto attached, at the time and in the manner and upon the conditions provided for in this Contract. III. The CONTRACTOR for himself, and for his heirs, executors, administrators, successors, and assigns, does hereby agree to the full performance of all the covenants herein contained upon by part of the CONTRACTOR.
