CITY COUNCIL
MEETING MINUTES
APRIL 20, 2009 7:30 PM
I.
CALL TO ORDER
A. Flag Salute
Mayor Peter B. Lewis called the meeting to order at 7:30 p.m. and
led those in attendance in the Pledge of Allegiance.
B. Roll Call
Mayor Lewis and the following Councilmembers were present:
Rich Wagner, Sue Singer, Gene Cerino, Nancy Backus, Lynn
Norman and Virginia Haugen. Councilmember Peloza was
excused.
Staff members present included: Information Services Director
Lorrie Rempher; Chief of Police Jim Kelly; Building Official Rick
Hopkins; Public Works Director Dennis Dowdy; Planning, Building
and Community Director Cindy Baker; Parks, Arts and Recreation
Director Daryl Faber; Assistant City Attorney Steven Gross; Human
Resources/Risk and Property Management Director Brenda

There was no announcement.
D. Agenda Modifications
Agenda modifications included a revised bid tabulation under Item
IV.D.2 for Project CP0762, Les Gove Neighborhood Improvements;
a revised page 4-24 of the Shoreline Master Program transmitted
under Ordinance No. 6235; and the addition of Ordinance No.
6237 to the agenda.

II. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE
A. Public Hearings
No public hearing was scheduled for this evening.
B. Audience Participation
This is the place on the agenda where the public is invited to speak
to the City Council on any issue. Those wishing to speak are
reminded to sign in on the form provided.
Bill Morchin, 1345 East Main Street, Auburn
Mr. Morchin spoke regarding the application from T-Mobile relating
to the installation of cellular wireless communication antennas on
the roof of an existing church at 100 N Street SE which is near his
home. Mr. Morchin expressed concern regarding interference with
his television reception and the antenna’s danger to the public. Mr.
Morchin presented information to the Council regarding cellular
frequency and channel discussion.

Matt Dekerrie of Allied Waste, 32016 225 Avenue SE, Kent
Mr. Dekerrie, representing Allied Waste, spoke regarding Allied
Waste’s children’s art contest for its service customers on Lea Hill
and West Hill. Mr. Dekerrie announced that the contest has been
extended through the end of the month to allow more children to
participate. The winner of the children’s art competition will receive
one year of free garbage service for his or her family.
C. Correspondence
There was no correspondence for Council review.
III. COUNCIL COMMITTEE REPORTS
A3.7.6
A. Municipal Services
Chair Cerino reported the Municipal Services Committee met April
13, 2009. The Committee approved Ordinance No. 6234 relating
to graffiti and malicious mischief. The Committee also discussed
Ordinance No. 6229, Resolution Nos. 4465 and 4469, an animal
control contract addendum, helicopter activities at the airport and
minimizing noise from helicopters. The next regular meeting of the
Municipal Services Committee is scheduled for April 27, 2009 at
4:00 p.m.

B. Planning & Community Development
Chair Norman reported the Planning and Community Development
Committee met April 13, 2009. The Committee approved consent
items including Resolution No. 4474, the Brannan Park lighting
project final pay estimate, and a contract amendment related to the
Comprehensive Water Plan. The Committee also received an
update from Councilmember Peloza on the progress of the
Farmer’s Market. The Committee approved Resolution No. 4464
relating to an address change, Ordinance No. 6229 regarding the
Farmer’s Market Advisory Board, Ordinance No. 6232 relating to
open space taxation in Pierce County, Ordinance No. 6235
amending the Shoreline Master Program, Ordinance No. 6230
regarding amendments to the Downtown Urban Center Zone,
Ordinance No. 6231 relating to residential conversions to
commercial, and Resolution No. 4472 extending the conditional
use permit moratorium. The Committee also discussed cultural
diversity activities, the City’s carbon footprint, and the code update
project. Chair Norman announced that the Planning and
Community Development Committee will hold a special meeting on
April 23, 2009 at 7:30 p.m. to discuss the code update project with
the Planning Commission. The next regular meeting of the
Planning and Community Development Committee is scheduled for
April 27, 2009 at 5:00 p.m.
C. Public Works
Chair Wagner reported the Public Works Committee met this
afternoon at 3:00. The Committee approved consent items
including contract administration items to award bids for the A
Street SE Pedestrian Improvements Project and the Les Gove
Neighborhood Improvements Project. The Committee also
approved Resolution No. 4473 increasing the scope of the contract
with Carollo Engineers for work on the Comprehensive Water Plan.
The Committee discussed Ordinance No. 6235 relating to the
Shoreline Master Program, Resolution No. 4474 regarding an
environmental study for the A Street NE corridor, and Resolution
No. 4472 extending the moratorium on conditional use permits.
The Committee also received a briefing on web based utility
payments, pavement conditions of designated truck routes and
future truck routes, the Auburn Way North local access study,
underground wiring policies, and design standards. The next
regular meeting of the Public Works Committee is scheduled for
May 4, 2009 at 3:00 p.m.

D. Finance
Chair Backus reported the Finance Committee met this evening at
6:30. The Committee approved consent items, including claims
and payroll vouchers, and Resolution No. 4465 adopting an
identify theft program “Red Flag Rules.” The Committee also
discussed Ordinance No. 6234 amending the code relating to
graffiti and malicious mischief, Ordinance No. 6237 relating to
parking in residential zones, and utility bill web payments. The
next regular meeting of the Finance Committee is scheduled for
May 4, 2009 at 6:30 p.m.
E. Community Center
Chair Wagner reported the Community Center Committee has not
met since the last Council meeting. The Committee will next meet
April 24, 2009 at 9:00 a.m.
F. Downtown Redevelopment
Chair Norman reported the Downtown Redevelopment Committee
has not met since the last Council meeting.
IV. REPORTS
At this time the Mayor and City Council may report on significant items
associated with their appointed positions on state, regional and local
organizations.
A. From the Council
Deputy Mayor Singer reported on her attendance at the annual
employees’ luncheon, regional meetings for the Puget Sound
Regional Council, and economic development efforts to bring
Federal stimulus money to Auburn.
Councilmember Norman reported that the task force for the
boundless playground held their first meeting last week. A
boundless playground provides access to children with special
needs and is accessible for all children.
Councilmember Cerino reported that he attended the Puget Sound
Regional Council Transportation Committee meeting where
Committee members discussed airport needs for the region in the
future. Councilmember Cerino also reported on his attendance at
the Pierce County Review Council meeting.

B. From the Mayor
Mayor Lewis reported that City Hall had visitors from the Tiger
Cubs and high school students participating in a job shadowing
project last week. Mayor Lewis announced that the state
legislature passed Senate Bill 5045, the Local Infrastructure
Financing Tool (LIFT) Program for tax increment financing. The
bill represents $6.2 million in tax increment financing for downtown
infrastructure. Additionally, the City will receive a Federal
economic development agency grant in the amount of $3 million for
the promenade infrastructure.

All matters listed on the Consent Agenda are considered by the City
Council to be routine and will be enacted by one motion in the form listed.

Number CP0741, “A” Street SE Pedestrian Improvement, to
Evergreen Landscape and Construction on their low bid of
$158,903.50.
Deputy Mayor Singer moved and Councilmember Wagner seconded to
approve the Consent Agenda.
Councilmember Haugen commented that she did not receive a full
Finance Committee packet that contains a full listing of the claims
vouchers. Finance Director Coleman stated that in order to save costs
and promote “green” practices, staff is providing full agenda packets for
Committee members only. A full copy of the packet is available in the City
Clerk’s Office.
MOTION CARRIED. 5-1. Councilmember Haugen voted no.

Code relating to shoreline management administrative and
permitting procedures, and amending the adopted Auburn

Councilmember Norman moved and Councilmember Backus
seconded to introduce and adopt Ordinance No. 6235.
Councilmember Haugen indicated she would vote no on
Ordinance No. 6235..
MOTION CARRIED. 5-1. Councilmember Haugen voted
no.

An Ordinance of the City Council of the City of Auburn,
Washington, amending Section 6 of Ordinance No. 6211
adopted on November 17, 2008, relating to parking in
residential zones

Washington, authorizing the City to expend funds to abate
the litter, debris and junk nuisance at 2115 Elm Street SE in

4. Resolution No. 4472

Washington amending and extending the moratorium
established by Resolution No. 4357 and extended by
Resolution No. 4412 on the filing of applications for
Conditional Use Permits (CUPs) in property located within
the R2 Single Family Residential District, the R-3 Two-
Family (Duplex) Residential District and the C-1 Light

Commercial District, and setting a public hearing for the 4
day of May, 2009, to consider the amendment and extension
of the moratorium on the filing of applications for specified
CUPs within specified zoning districts

Councilmember Norman moved and Councilmember Backus
seconded to adopt Resolution No. 4472.
Councilmember Backus moved to amend Section 1 in order
to keep the C-1 Light Commercial District included in the
moratorium so that Section 1 reads “The City Council
hereby amends the moratorium established on May 19,
2008 by Resolution No.4357 and extended by Resolution
No. 4412 for an additional period of six months from and
after the date hereof on the filing of applications for
specified conditional use permits (CUPs) for property
located within certain land use zoning districts within the
City” and amend the title of Section 2 to remove the words
“as Modified.” Motion was seconded by Councilmember
Norman.
MOTION CARRIED. 5-1. Deputy Mayor Singer voted no.
MOTION TO ADOPT RESOLUTION NO. 4472, AS
AMENDED, PASSED. 6-0.

IX. EXECUTIVE SESSION
Mayor Lewis recessed the meeting to executive session at 8:16 p.m. for
approximately thirty minutes in order to discuss real estate matters
pursuant to RCW 42.30.110(1)(b) and to closed session to discuss labor
negotiations pursuant to RCW 42.30.140(4)(b). No action is anticipated
following the executive session.
Mayor Lewis reconvened the meeting at 8:31 p.m.

ADJOURNMENT
There being no further business to come before the Council, the meeting
adjourned at 8:31 p.m.
