RESOLIITION NO. 2 2 8 4 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN, 3 WASHINGTON, REPEALING RESOLUTION NO. 1089 PASSED MAY 5, 1980 THAT AUTHORIZED CERTAIN EASEMENTS AND AGREEMENTS BETWEEN THE 4 CITY AND ROBERT B. McLEAN, M.D. AND JANET K. McLEAN, HIS WIFE. 5 6 WHEREAS, City of Auburn Resolution No. 1089 passed May 5, 7 1980 granted ROBERT B. McLEAN, M.D. and JANET K. McLEAN, his 8 wife, (hereinafter "McLEAN") permission to construct a O 9 building on their real property located on "R" Street S.E. and co 10 East Main Street, Auburn, Washington, over an easement and M 11 sewer utility line owned by the City of Auburn which is N ~ O 12 described more particularly as follows: tT The East 15 feet of Lot 1, Block 1, 13 John Dailidenas lst Addition to 14 Auburn, King County Washington; and 15 WHEREAS, in return for said permission, in the event said 16 sewer became inoperable, McLEAN was required to pay for and 17 cause the replacement and rerouting of said existing sewer 18 line within an alternate easement which was more particularly 19 described in Resolution No. 1089; and 20 WHEREAS, the above-described sewer line has been rerouted 21 Within the alternate easement and such easement has been 22 previously recorded; and 23 24 25 26 Resolution No. 2284 February 26, 1992 Page 1 1 2 WHEREAS, the City of Auburn is in receipt of FIVE 3 THOUSAND DOLLARS ($5,000.00) paid to the City of Auburn by 4 ROBERT B. McLEAN as required for such replacement and 5 rerouting. 6 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, 7 WASHINGTON, IN A REGULAR MEETING DULY ASSEMBLED, HEREWITH 8 RESOLVES THAT: 9 Section 1. Resolution No. 1089 is hereby rescinded and 10 the provisions of Resolution No. 1089 are herein voided 11 thereby voiding the easement on the McLEAN property more 12 Particularly described as follow: 13 The East 15 feet of Lot 1, Block 1, John Dailidenas lst Addition to 14 Auburn, King County, Washington. . 15 Section 2. Upon the passage of this Resolution, the City 16 Clerk of the City of Auburn shall record this Resolution with co 17 the King County Auditor. 18 Section 3.
