CALL TO ORDER Chair Nancy Backus called the meeting to order at 6:30 p.m. in the Council Conference Room located at City Hall, 25 West Main Street, Auburn, Washington. Committee members present were: Chair Backus, Vice Chair Lynn Norman, and Member Roger Thordarson. Also present during the meeting were: Mayor Peter B. Lewis, Human Resources/Risk Management Director Brenda Heineman, City Attorney Daniel B. Held, Accounting Manager Craig Violante, and City Clerk Danielle Daskam. APPROVAL OF MINUTES Minutes of the January 5, 2004 Finance Committee meeting. Member Thordarson moved and Vice Chair Norman seconded to approve the January 5, 2004 minutes. MOTION CARRIED UNANIMOUSLY. 3-0. CONSENT ITEMS A. Vouchers Claims F4.9.5 Claims check numbers 327278 through 327559 in the amount of $843,734.86 and claims check numbers 326560 through 327709 in the amount of $1,831,690.31 and dated January 14, 2004. Payroll F4.9.2 Payroll check numbers 507062 to 507161 in the amount of $37,846.31 and electronic deposit transmissions in the amount of $16,613.04 for a grand total of $54,459.35 for the pay period covering January 1, 2004 to January 14, 2004. Vice Chair Norman moved and Member Thordarson seconded to approve the consent items. MOTION CARRIED UNANIMOUSLY. 3-0. ORDINANCES AND RESOLUTIONS Am Ordinance No. 5819 F4.3 An Ordinance of the City Council of the City of Auburn, Washington, amending Sections 13.06.511, 13.20.440, 13.40.050, 13.41.030, 13.48.330, 13.48.340, 13.48.420, 15.56.020 and 15.56.030 of the City Code relating to fees and charges, and amending the City of Auburn Fee Schedule City Attorney Heid presented Ordinance No. 5819. The ordinance includes and updates various fees in the Auburn Fee Schedule. Member Thordarson moved and Vice Chair Norman seconded to recommend Council approval of Ordinance No. 5819. MOTION CARRIED UNANIMOUSLY. 3-0. DISCUSSION ITEMS Ordinance No. 5802 An Ordinance of the City Council of the City of Auburn, Washington, amending Chapter 2.06 of the Auburn City Code, titled "City Council" and approving the rules of procedure of the City Council of Auburn, Washington City Attorney Heid presented Ordinance No. 5802 establishing Council rules of procedure. Committee members briefly discussed the proposed rules. Vice Chair Norman moved and Member Thordarson seconded to recommend Council approval of Ordinance No. 5802. MOTION CARRIED UNANIMOUSLY. 3-0. Page 2 Finance Committee Minutes January 20, 2004 Bm Year End Investment Portfolio Accounting Manager Violante presented the City's year-end investment portfolio for Committee information. Currently, the City has approximately 75% of its investments in the state pool. The remaining investments are in general government-backed securities. He noted that the current six-month treasury rate is 0.99%, the current state pool rate is 1.08%, and Auburn's blended rate is 1.40%. The City's higher blended rate has resulted in approximately $250,000 more in revenue because of investments outside the state pool. Water Utility Charges - Customer Liability Accounting Manager Violante reported to the Committee that a utility customer has complained of the law that provides unpaid utility bills become a lien on the property. Apparently the subject property's previous owner's unpaid utility bill was not included in escrow and has now been added to the new owner's utility bill. Public Defense Contract Director Heineman presented a proposal to amend the current public defense contract to provide public defender services on a standby' basis during the Municipal Court's arraignment calendar. Director Heineman presented a Washington State Bar Association article written by Robert Boruchowitz regarding indigents rights to counsel and his observations of court operations across the state. Mr. Boruchowitz visited the Auburn Municipal Court and recommended to the Court that counsel be provided at time of arraignment. The addition of standby public defender services would increase the current public defense contract by $1,500 per month. Director Heineman proposed implementing standby public defense service through the end of the year. The contract will be presented at the next meeting for recommendation. It is expected that the majority of this additional cost will be offset through efficiencies by having the public defender present at arraignment, and it is planned that court staff will be more aggressive in recouping public defense fees. Port of Seattle Payment Accounting Manager Violante reported the City has received the final payment from the Port of Seattle for wetland mitigation.
