HomeMy WebLinkAbout06-20-2000HEARING EXAMINER MINUTES JUNE 20, 2000 The meeting of the Auburn Hearing Examiner was held on June 20, 2000 at 7:00 p.m. in the Council Chambers of the Auburn City Hall. Those in attendance were as follows: HEARING EXAMINER: Diane L. VanDerbeek STAFF: Lynn Rued and Patti Zook Ms. VanDerbeek called the meeting to order at 7:00 p.m. explaining the order of procedures and swore in staff and those in the audience intending on testifying. PUBLIC HEARINGS: 1. APPLICATION NO. CUP00-0002 Hearing Examiner opened the public hearing. Assistant Planning Director Rued presented the staff report. Jeff Woodward and Jim Cox have requested a conditional use permit to allow the construction of three duplexes on property located at 2121 "D" Street SE. The R-3 zoning district allows duplex development. He described the zoning requirements and parking requirements. An issue might be the water line which could requirement improvements. He reviewed the three conditions. Staff recommends approval of the conditional use permit. Hearing Examiner asked if the applicant is required to post a landscape bond. Assistant Planning Director Rued replied that a maintenance bond will be necessary. The applicants were present, but did not speak. There was no public testimony and the public hearing was closed. Hearing Examiner indicated the written decision will be issued within 10 days. 2. APPLICATION NO. CUP00-0003 Hearing Examiner opened the public hearing. Assistant Planning Director Rued presented the staff report. Cliff and Cheryl Dechand have requested a conditional use permit to allow a drive through espresso stand to be located in the side yard located adjacent to "D" Street SW. Their property is located at 410 West Main. The property is zoned C-1 and altows drive through facilities if a conditional use permit is issued. The home will be maintained as is and a new structure will be built for the espresso stand. He described access to the site. There is room on the property for the espresso stand. Staff-- recommends approval with four conditions. Hearing Examiner asked if there is a sidewalk adjacent to the walk up window. Assistant Planning Director Rued said a public sidewalk is located within 15 feet of the stand. Cheryl Dechand, the property owner and applicant, wants to sell good coffee drinks. There was no public testimony and the public hearing was closed. Hearing Examiner indicated the written decision will be issued within 10 days. 3. APPLICATION NO. MIN0001-99 Hearing Examiner opened the public hearing. PAGE I HEARING EXAMINER MINUTES JUNE 20, 2000 Assistant Planning Director Rued presented the staff report. La Pianta Limited Partnership has requested a mining permit to continue mining operations at the Meade Pit located at 1740 Auburn Black Diamond Road. He referred to an aerial photograph and pointed out the mining site, adjacent mining operation by Miles, Auburn Way South, and the Muckleshoot Casino. This-has - been a mining site since 1980 and the 10 year permit expired. Additional mining is needed to reclaim the site and approximately 10 years are left to mine the site. Three million cubic yards of gravel have been removed since the original permit issued in 1980. Using the aerial photo, he described the adjacent uses and pointed out a subdivision adjacent to the site. Existing vegetation adjacent to the subject subdivision will remain. Soils reports were reviewed and no concerns were expressed about storm drainage. He pointed out the haut route. He pointed out an existing gravel berm between Miles and Segale properties. The two property owners left the berm as a buffer between the two operations. They need to agree how to remove the berm so that it remains stabilized. Staff recommends approval of the surface mining permit with two conditions. Hearing Examiner referred to condition 1, required permits for berm removal, and inquired if permits are needed from agencies in addition to the City and Department of Natural Resources (DNR). Assistant Planning Director Rued indicated that DNR approves only the reclamation plans. The City approves the operation plans. Final grades are approved by DNR. Mark Hancock, representative for the application, stated their agreement with the staff report and two conditions. Their engineers are present to answer questions. He confirmed that the mining site has not been active recently. Hearing Examiner asked Mr. Hancock if it is likely that no wells will be affected. She wondered about the chance of water wells being affected. Assistant Planning Director Rued replied that the City has a municipal well to the west on M Street. A study was required to make sure the additional excavation would not affect the aquifer. The study established that there is no impact to the well or the aquifer. There was no public testimony and the public hearing was closed. Hearing Examiner indicated the written decision will be issued within 10 days. APPEAL HEARING: CASE NO. HAP00-0001 An appeal filed by Miles Sand and Gravel Company appealing the Planning Director's decision to issue a Final Mitigated Determination of Non-Significance for continued mining operations at the Meade Pit located at 1740 Auburn Black Diamond Road. - Hearing Examiner confirmed that this case is removed from the agenda.
