APRIL 16, 2002
The meeting of the Auburn Hearing Examiner was held on April 16, 2002 at 7:00 p.m. in the Council Chambers of
the Auburn City,Hall. Those in attendance were as follows:

STAFF: Lynn Rued and Patti Zook
Ms. VanDerbeek called the meeting to order at 7:00 p.m. explaining the order of procedures and swore in staff and
those in the audience intending on testifying.

PUBLIC HEARINGS:
1. APPLICATION NO. CUP02-0001
Hearing Examiner opened the public hearing.
Assistant Planning Director Rued presented the staffreport. The Church of the Nazarene has requested a
conditional use permit to allow the church to expand their services to an adjacent building located at 1235 29t~ Street
SE. The site is zoned R-3, Duplex. There is an existing 4-plex structure adjacent to the church which will be
converted to administrative offices for the church. The Zoning Code allows churches and professional offices in the
R3 zone as long as a conditional use permit is issued. The lot is large has a hole which will be filled in. Staff
recommends approval with conditions.
Hearing Examiner inquired about the hole and Assistant Planning Director Rued said it used to be a drainage swale
that was never filled in and is approximately 10 feet x 40 feet in size.
Ray Wetmore, church business manager, indicated they followed the City's requirements. The church already owns
the adjacent property and no impacts will occur to the area. The church filled in a portion of the property, but the
hole was not on their property and was not filled in. The church will have offices in the building.
There was no public testimony and the public hearing was closed. Hearing Examiner indicated receipt of one
comment letter from Leonard Couch in support of the proposal. The letter was made part of the record, not a
separate Exhibit. Hearing Examiner will issue the written decision within 10 days. She indicated that she will
recommend approval of the conditional use permit.
2. APPLICATION NO. REZ02-0001
Hearing Examiner opened the public hearing.
Assistant Planning Director Rued presented the staff report. George Thurtle has requested to rezone property from
its existing P1, Public Use and R-2, Single Family to R-3, Duplex and to R-4, Multi Family. The property is located
south of South 277~ and east of I Street NE. The parcel is 42 acres in size. The Comprehensive Plan was amended
in 2000. There have been a number of changes in the area which warrant the rezone. This is a non-project rezone
and any subsequent proposal will require additional environmental review.
Dana Mower, DBM Engineers, indicated concurrence with the staff report.
There was no public testimony and the public hearing was closed. Hearing Examiner will issue the written decision
within 10 days. She indicated that she will recommend approval of the conditional use permit.
3. APPLICATION NO. VAR02-0001

Assistant Planning Director Rued presented the staff report. Curtiss L. Johnson has requested to allow an existing
deck to encroach into the rear yard setbacks. The home is located at 5017 Mill Pond Loop SE. The deck expansion
was built without building permits and the applicant wants the expansion to remain. A building permit for the home
was issued in 1984, and the site plan does not show a deck. However, the site plan has language related to
permitting a 14 feet by 14 feet deck which was constructed. The smaller deck has been in place for a number of
years. The current property owners assumed they could expand the smaller deck. However, the deck addition is
inconsistent with Zoning Code. He remarked that the current owner built the deck and a stop work order was
issued. Mr. Johnson wants a variance to allow the deck expansion to remain. The expansion does not meet the
variance requirements. Staff recommends denial of the variance. The City overlooked the original deck and will
not take issue with the 14 feet by 14 feet deck. The new deck should be removed in order to be cofisistent with
zoning criteria.
Para Johnson, wife of the applicant, apologized for not getting the required building permit. They did not know a
permit was needed for the deck addition. Their home is located on.the back end of the lot and does not have a back
yard which is which is why they wanted to increase the size of the deck. A neighbor down the street has increased
their deck. She does not understand why the City is unsupportive of the deck expansion.
Hearing Examiner asked how far along the deck construction is and Mrs. Johnson replied that the flooring is laid.
Assistant Planning Director Rued did not have additional comment, and suggested that the record be left open and
the case continued to next month in order to allow Mr. Johnson to provide more information. Hearing Examiner
indicated the hearing will be continued to the May 21, 2002 meeting. She advised Mrs. Johnson about the criteria
that must be met in order to approve the variance.
ADJOURNMENT:
With no further items to come before the Hearing Examiner, the meeting was adjourned at 7:25 p.m.
