The meeting of the Auburn Hearing Examiner was held on September 17, 2002 at 7:20 p.m. in the Council
Chambers of the Auburn City Hall. Those in attendance were as follows:
HEARING EXAMINER: Diane L. VanDerbeek
STAFF: David Osaki, Shirley Aird and Patti Zook
Ms. VanDerbeek called the meeting to order at 7:00 p.m. explaining the order of procedures and swore in staff and
those in thc audience intending on testifying.
PUBLIC HEARING:
1. APPLICATION NO. VAR02-0002
Hearing Examiner opened the public hearing.
SA presented the staff re.port. Charles M. DuBreuil has requested a variance to allow the construction of a storage
shed to encroach into the side yard setback on his property located at 1902 37~ Way SE. The applicant wants to
consln~ct a garden shed to be 12 feet by 7 feet 2 inches and 8 feet tall. She briefly reviewed the eight findings of
fact and ten conclusions. She spoke of the site's constraints due to its location adjacent to the White River. She
mentioned the Shoreline Management Program and its requirements related to public access to the shoreline. A
letter from the applicant's neighbor, Randy Goodson, was submitted with the application. Mr. Goodson did not
object to the variance request. No building permit is required for the shed. She reviewed the conditions.
Mr. DuBreuil, the applicant, agrees with the staff report. The shed at this location is the least intrusive. He spoke
about the City walking path. If the shed is located anywhere else on the property, it obstructs his river view and is
more visible to the neighbors. There is no other practical use for this portion of his property.
There was no public testimony; therefore, the public hearing was closed. Hearing Examiner will issue the written
decision within 10 days. She indicated that the variance will be approved.
ADJOURNMENT:
With no further items to come before the Hearing Examiner, the meeting was adjourned at 7:35 p.m.
