HomeMy WebLinkAbout02-19-2003HEARING EXAM1NER MINUTES FEBRUARY 19, 2003 The meeting of the Auburn Hearing Examiner was held on February 19, 2003 at 7:00 p.m. in the Council Chambers of the Auburn City Hall. Those in attendance were as follows: HEARING EXAMINER: Diane L. VanDerbeek STAFF: David Osaki, Jeff Dixon, Shirley Aird and Patti Zook Ms. VanDerbeek called the meeting to order at 7:00 p.m. explaining the order of procedures and swore in staff and those in the audience intending on testifying. PUBLIC HEARINGS: 1. APPLICATION NO. VAR03-0001 Hearing Examiner opened the public hearing. Planner Dixon presented the staff report. Auburn Regional Medical Center has requested a variance to allow the revised location of trees due to installation of utilities. The hospital is located at 202 North Division Street. He described the landscape requirements and the reason for these requirements. Staff recommends approval of the variance with three conditions. Lynn William Horn, landscape architect, is available to answer any questions. He is agreeable with the conditions. He will submit a revised landscape plan. Hearing Examiner closed the public heating. She will approve the variance request and will issue the written decision within 10 days. 2. APPLICATION NO. REZ02-0002 Hearing Examiner opened the public hearing. Planner Aird presented the staff report. Alonzo P. Cole, Jr., has requested to rezone property located at 301 West Main Street from C-3, Heavy Commercial to C-2, Central Business. The site is fully developed and in use as a permitted use. Applicant is not proposing to redeVelop or expand. Staff recommends approval of the rezone. Mr. Cole commented that the staff report covers what he wanted to say. Hearing Examiner closed the public hearing. She indicated that she will recommend approval of the rezone and issue the written decision within 10 days. 3. APPLICATION NO. CUP03-0001 Hearing Examiner opened the public hearing. Planner Dixon presented the staff report. Ron Hallissey, on behalf of Vern Benson, has requested a conditional use permit to allow a go-cart track in an existing building. The building is located at 2302 West Valley Highway, Building B, Suite 100. The applicant has a comparable business in Enumclaw. Staff recommends approval With two conditions. Hearing Examiner asked about the speed of the go carts. The report says that the vehicles have catalytic converters and mufflers, but there is no condition about maintaining the mufflers. Planner Dixon said the zoning district has standards to not exceed the State noise levels which is already a City requirement. He PAGE 1 HEARING EXAMINER MINUTES FEBRUARY 19, 2003 had discussion with the applicant regarding the noise. He does not expect the noise to be heard outside the building. Vern Benson, Kart King, Inc., said the vehicles go 25 to 30 mph. Hespoke to adjacent businesses who wrote letters of support that were submitted with the application. Parking is adequate and no changes will occur to the outside of the building. The doors will be closed and noises cannot be heard outside the building. Go carts are a fun and safe sport. The vehicles have roll bars and seat belts. In response to Hearing Examiner questions, Mr. Benson said that up to 12 vehicles can go around the track at the same time, no one under 15 is allowed to drive the go carts, and the track will be used by people of all ages. Bill Carl affirmed that they got support letters from adjacent businesses. Most noise heard through the ceiling fans is the squealing of tires. More noise is heard from SR 167. Don VVilliams said he is into go cart racing and this is a family fun sport. Josh Williamson said go carts are very fun and a safe sport. This will be good entertainment for the City of Auburn. Hearing Examiner closed the public hearing. She indicated that she will recommend aPproval and will issue the written decision within 10 days.
