HomeMy WebLinkAbout07-22-2003HEARING EXAMINER MINUTES JULY 22, 2003 The meeting of the Auburn Hearing Examiner was held on July 22, 2003 at 7:00 p.m. in the Council Chambers of the Auburn City Hall. Those in attendance were as follows: HEARING EXAMINER: Diane L. VanDerbeek STAFF: David Osaki, Jeff Dixon, Shirley Aird and Patti Zook Ms. VanDerbeek called the meeting to order at 7:00 p.m. explaining the order of procedures and swore in staff and those in the audience intending on testifying. PUBLIC HEARINGS APPLICATION NO. VAR03-0006 The request of Jeremie Byerly for a variance to reduce the required setbacks on property located in the 1500 block of 3rd Street SE. Hearing Examiner announced that the applicant or representative are not in attendance; however, two neighbors are in attendance. Community Development Administrator Osaki suggested that Hearing Examiner open the public hearing, hear the staff report, take testimony, leave the record open to the August 14 meeting. Staff will contact the applicant and inform him of the continued hearing date. Hearing Examiner offered the neighbors the opportunity to either testify or ask questions and opened the public hearing. A neighbor did not have any objection to the language in the staff report. Planner Aird presented the staff report. The applicant proposes to construct a duplex similar to the existing adjacent duplexes. She reviewed the findings of fact and criteria. Staff recommends approval with one condition. In response to Hearing Examiner's questions, Planner Aird advised that the applicant will be required to build the access easement to 30 feet as part of the building permit. A neighbor wanted to confirm that applicant is only putting in a duplex and Hearing Examiner explained the variance request. Hearing Examiner will leave the record open, asked staff to contact the applicant to let him know what happened this evening. If Mr. Byerly wants to submit additional information, he can do so by end of business on July 25. Her decision will be issued after that. APPLICATION NO. VAR03-0007 The request of Norris Homes, Inc., to reduce the required front yard setback from 25 feet to 20 feet and reduce the required rear yard setback from 25 feet to 17 feet. The property is located at Lot E2 of City of Auburn Short Plat No. SPL00-0011 located on 111th Court SE (south of SE 320th Street). Hearing Examiner opened the public hearing. Community Development Administrator Osaki presented the staff report, reviewed the findings of fact and conclusions. This home is consistent with adjacent homes. Staff recommends approval with one condition. A comment letter was received from Rawhide and Diane Papritz which raised concerns about another lot, E4, that is not the subject site. Irregular shaped lots have different means of establishing setbacks. The house on lot E4 will meet the standards regarding setbacks and will not be in violation. James Kerby, representative for Norris Homes, is present but did not speak. Rawhide Papritz, 32037 112t~ Place SE, said they have been impacted by the four lots being built. The houses are three story houses that are closer to property lines than they should be. These houses look PAGE 1 HEARING EXAMINER MINUTES JULY 22, 2003 down into their yards. Hearing Examiner suggested that Mr. Papritz contact the Planning Department to receive information on lot calculations. Mr. Kerby said that his company builds a lot of houses on Lea Hill. If they were building houses in King County, the minimum set back is five feet. There was no other testimony and the public hearing was closed. Hearing Examiner will issue the written decision within 10 days. APPLICATION NO. CUP03-0005 The request of Valley Cities Counseling and Consultation for a conditional use permit to allow an existing structure to be used as an employment center for clients. The property is located at 915 - 26th Street NE. Hearing Examiner opened the public hearing. Planner Dixon presented the staff report, reviewed the findings of fact and conclusions. Staff recommends approval with conditions. Al Keimeg, Keimeg and Associates, asked for a waiver from required landscaping. They are in the process of trying to develop the entire site. He asked for the new site plan to be entered into the record. It is counter productive to require that landscaping be installed now and can be re-evaluated later. The converted house will be used on an interim basis while trying to develop other portion of the site. Hearing Examiner asked about a time line for the new development. Mr. Keimeg said they may apply for conditional use permit by end of 2003, with permits issued in mid-2004, then the existing residence would be removed. Hearing Examiner asked if the City has any response to Mr. Keimeg's request for landscape waiver. She can leave the record open to allow City time to review the new site plan. Planner Dixon is uncertain what the site plan specifically shows since it was just presented tonight. The landscape and parking requirements are part of the City Code. The only process for relief from these would be through the variance process. He understands from the applicant that the building is temporary and will be removed. Hearing Examiner said that since the new site plan was provided tonight, she will leave the record open until end of business on Friday, July 25. This will allow staff and the applicant to meet and attempt to come up with an agreed condition regarding the landscape issue. If not, then staff will submit the City's position to the Hearing Examiner. If no agreement by July 25, then the applicant has until July 30 for response and the decision making time will begin July 31.
