HomeMy WebLinkAbout12-02-2002 - Minutes - MUNICIPAL SERVICES COMMITTEE MEETING December 2, 2002 PRESENT: Councilmembers Singer, Wagner and Brothers; City of Auburn Staff: Jim Kelly and Bob Lee, Police; Russ Vandver and Dave Smith, Fire; Paul Krauss, Planning; Shelley Coleman, Finance; Sharon Conroy, Public Works, Dennis Dowdy, Engineering; Lon Hurt, 3H Communications; Ben Morris and Chris Kealy, Freddie's Club of Auburn. Minutes of the meeting were tape recorded and are available for review for six (6) years from the date of the meeting. Please submit items for the agenda no later than 5p.m. the }Vednesday prior to a meeting so packets can be assembled and distributed Thursday afternoon. CALL TO ORDER Sue Singer, Chairperson, called the meeting to order at 5:00 PM. APPROVAL OF MINUTES The minutes of the previous meetings were approved as written. CONSENT Ordinance 5703 - Gambling Tax Rate - Chris Kealy (who is in the process of purchasing Freddie's Club) spoke to the committee, asking that the increase in tax rate for gambling fees not be increased from 12% to 15%. He contends that the increase would make the business, as presently run, unprofitable. He provided a profit and loss handout for January through October 2002. Several figures on the handout were questioned. Mayor Lewis provided copies of a letter received from Kealy with projections for 2003. The committee chose not to recommend the ordinance to council, and it will be brought forward at a later date. Surplus Patrol Radio 0012100407 - Chief Kelly described the radio as having been damaged beyond use. Moved to pass, seconded, and approved recomm6nding Council surplus the radio. Ordinance 5719: Amendment to Waste Management Contract - Sharon Conroy presented this ordinance to the committee. The verbiage in paragraph B, last sentence, was modified to read "Residents can request a tenant release form only once a year while they are at that address." Moved to pass, seconded, and recommended City Council approve ordinance with modification. Ordinance 5708, Public Way Agreement with Touch America - Dennis Dowdy introduced Lon Hurt, 3H Communications, who answered several questions from committee members. Rich Wagner questioned some of the language in Section 7, specifically the "waiver of immunity" in the next to the last sentence of the next to the last paragraph and "sole negligence" in the last sentence of the last paragraph. The response was that the language is the same as in previous agreements. He also questioned #14 of attachment 2, which shows one foot of separation for any and all city utilities. The opinion expressed was that this may not be enough. The committee moved to pass, seconded, and recommended Council approve the ordinance. They also asked that the separation issue be revisited to determine whether it is adequate. Municipal Services Meeting Minutes December 2, 2002 Page I Resolution 3553 - Authorization for City of Auburn to Join the Regional Disaster Plan for Public and Private Organizations in King County - Russ Vandver reiterated several points that were brought forth in thc formal presentation of the plan done by Laurel Nelson at the last meeting. Moved to pass, seconded and approved recommending the City Council approve the City of Auburn be a participant in thc plan. Ordinance 5716 - False Alarm Fees - Jim Kelly briefly discussed the ordinance, but requested it be pulled pending review by Dan Heid. Resolution 3552 - Agreement w/Benton County for Use of Jail Facilities - Following a brief discussion, committee moved to pass, seconded and approved recommending Council approve the resolution. Ordinance 5718 - Litter Control - Jim Kelly explained that this ordinance basically adopts the state statue level, with a few adjustments. The committee moved to pass, seconded and approved recommending Council approve the ordinance. Ordinance 5715 - Amendment to City Fee Schedule - In Dan Heid's absence, Paul Krauss distributed a handout showing fees charged by several nearby municipalities. The committee recommended rounding the fees upward to the nearest $10 interval and proposed seeking public input sometime in the spring. Moved to pass, seconded and approved recommending Council pass the ordinance. INFORMATION/DISCUSSION: Code Enforcement Update - Paul Krauss will get together with Sue Singer to discuss updates. Letter/Maintenance Checklist to FAA - Krauss said that the daily inspection of basins near the airport is minimizing their attraction to waterfowl and accomplishing the intended objective. Letter from Firefighter's Union - Chair Singer asked if the committee members had responded to the letter received by the Firefighter's Union. She has spoken with Mr. Connelly and was invited by Mayor Lewis to attend a meeting with union representatives on December 5. She is not able to attend, but will contact them for alternative dates.
