CALL TO ORDER
Chair Singer called the meeting to order at 5:02 PM in Conference Room 3
located on the second floor of Auburn City Hall, 25 West Main Street, Aubum.
Members present included: Chair Sue Singer, Vice Chair Rich Wagner, Member
Stacey Brothers and Mayor Pete Lewis. Staff members present included: Police
Chief Jim Kelly, Assistant. Fire Chief Russ Vandver, Finance Director Shelley
Coleman, Planning Director Paul Krauss, Deputy .City Clerk Cathy Richardson,
City Attomey Dan Heid and Police Administrative Services Secretary Martha
Larsen. Others in attendance included: Mike Mordsette, Jan Cavanaugh, Bill
Peloza, Nancy Backus and Virginia Haugen. The meeting was tape recorded.

City Council to approve Final Pay Estimate ¢f4 to Contract 02-17 with
Weatherguard, Inc. and accept construction of Project No. C223A, Aubum
Municipal Airport Hangar No. 2, Hangar No. 7 Roof Replacements.
Vice Chair Wagner moved and Member Brothers seconded to approve the
Consent Agenda.
MOTION CARRIED UNANIMOUSLY. 3-0.

A.
Ordinance No. 5754 Amendinq Business Re,qistration Requirements,
Establishinq instead a Business Licensin,q Pro.qram
City Attorney Dan Heid reported on the City's current business registration
process. Since 1984, the City has required businesses to register their
business with the City. The registration process was established to insure
that businesses made the City aware of their operation and gradually
became the tool by which compliance with applicable zoning and safety
codes were assured. The current registration program has a number of
limitations. Although mandatory, the use of registration rather than
licensing implied that compliance was voluntary. Furthermore, the
program of reviewing business registration requests was not established
in a manner that supported adequate code enforcement in some
instances.
Attomey Heid explained that the existing ordinance does not recognize
multi-family rental housing as a business and therefore did not support a
separate ordinance that could result in the loss of a license in cases where
the owner did not maintain rental units in a reasonable condition. He
added that the fee for a business license would be $50, an increase from
the present $25 registration fee. Any organization providing proof of non-
profit status is exempt from the registration fee.
Chamber of Commerce CEO Mike Morrisette spoke in support of this
ordinance, which the Chamber of Commerce drafted.
Member Brothers questioned if an owner occupied one unit of a triplex,
would it still qualify as a 3-unit rental and have to be licensed. He also
questioned the validity of the $1,000 daily penalty for non-compliance.
The actual language of the penalty reads "up to $1,000 daily" which would
not necessarily mean the maximum penalty.
Chair Singer questioned the language in Section 5.10.020, which states if
a business is based outside the city but does business in the city, it is
required to have a city license. CEO Morrisette responded that a city
license would give more control of the quality of the business. Chair
Singer asked that "by the City of Auburn" be added to the end of 5.10.020
(G). Chair Singer also inquired if an amnesty program had been
developed for non-registered business owners. Attorney Heid responded
that although one has not been developed, it was an idea to' consider.
Vice-Chair Wagner questioned using the King County Code in 5.10.130 A-
2 and requested a simplified version. City Attorney Held explained that
Section 5.10 would be implemented for filling out a business license form
and Sections 5.15 and 5.30 would be applicable if there were any
concerns with the license.

Attomey Heid will redraft the ordinance with the recommended language
presented by the Chamber of Commerce and the Committee and bring a
drafted ordinance for the Committee's recommendation in May 2003.
Committee to approve a contract with W & H Pacific for desiqn and
construction services for the runway repavin.q project.
Planning & Community Development Director Paul Krauss explained that
by choosing to utilize an engineering firm for 3 year periods for
construction and repair projects at the airport, the need to seek out a new
firm for each new project is avoided. W & H Pacific had supported the
airport in this role in recent years. Due to the end of the previous 3-year
cycle, the City solicited Requests for Qualifications from several firms
having expertise in this area. The Committee members recommended
continuing to use W & H Pacific as their engineering consultant.
C. A.qreement for Administration & Manaqement of Cemetery. Pre-
Arrangement Sales Contracts
Because the Indemnification POrtion of this agreement was in question,
this item was pulled from the agenda.
