CALL TO ORDER -
Chair Gene Cerino called the meeting to order at 5:00 PM in Conference Room 3
located on the second floor of Auburn City Hall, 25 West Main Street, Auburn,
WA. Members included: Chair Gene Cerino, Vice Chair Rich Wagner and
Member Bill Peloza. Staff members present included: Mayor Pete Lewis, Police
Chief Jim Kelly, Fire Chief Russ Vandver, Finance Director Shelley Coleman,
City Attorney Dan Heid, Planning and Community Development Director Paul
Krauss and Police Department Secretary Martha Larsen. Others in attendance
included: Airport Manager Jamelle Garcia and Auburn Medical Center employees
Sean McDonald and Katie Lott.

ORDINANCES AND RESOLUTIONS
A. Ordinances
Ordinance No. 5829
An Ordinance of the City Council of the City of Auburn, Washington
relating to Dangerous Dogs.
City Attorney Dan Heid reported that the draft ordinance that is currently
proposed for adoption has been discussed, evaluated and revised in
various different Council committee meetings, as well as individual
evaluations by staff and council members. The language of a prior draft
was also subject of a significant amount of public comment at the City
Council meeting of May 19, 2004. The proposed (current draft)
ordinance is the product of significant consideration and is the product of
an effort to hold dog owners accountable for the conduct of their dogs
without being breed or weight specific. The regulation imposes a greater
responsibility on owners of dogs that are either known to have
dangerous propensities or that pose a greater risk of danger or harm to
persons or pets. Although earlier alternatives developed in connection
with dangerous dog ordinances for the City of Auburn did include breed
specific language and weight considerations, it was decided that these
options were not, at this point, necessary for the City for several
reasons, including the fact that many types of dogs, not just those that
are more typically identified in breed specific ordinances, can cause
injury or loss of life to persons or pets. Similarly, the size of dogs may
not translate to a dog of a particular size being necessarily more
dangerous than other dogs of a smaller size. The ordinance provides
two key categorizations of dogs: "potentially dangerous dogs" and
"dangerous dogs." The potentially dangerous dog category is an initial
threshold that imposes upon owners of dogs falling into that category of
greater responsibility to guarantee that the dog does not run loose or
attack persons or pets. Dangerous dogs, however, goes further in that
not only is there a responsibility on the part of the dog owner to meet
what is required for potentially dangerous dogs, there are other options,
including micro chipping, muzzle requirements, confinement in secure
kennels, etc. Furthermore, the dangerous dog designation would be the
product of a particular "declaration" by the City (it would not be
automatic), which declaration could be questioned, challenged or
appealed and subject to due process considerations. The proposed
ordinance also includes language that could afford the owner of what
might otherwise be a dangerous dog the chance to avoid that declaration
if the owner takes and completes a course or program designed to
instruct about the issues of responsible dog ownership. However again,
unless a dog is declared to be dangerous, that category would not
automatically apply.

The "declaration" requirement affords the City some flexibility in terms of
dogs that might be potentially dangerous but haven't done anything that
is deemed to rise to the level of the dangerous dog category. However,
on the same token, dogs that do cause the concern that prompts
dangerous dog declarations could have that declaration applied to them,
therefore providing the intended level of protection to the citizenry and
community from dogs that have been specifically declared dangerous.
While there may be several different options that are available to the City
of Auburn, the proposed ordinance seeks to address dangerous dog
ordinances without employing breed specific or size criteria. At the
same time, the dangerous dog ordinance does seek to address
responsibility in a way that should alleviate some concerns and should
provide some level of protection that may not currently be available.
Vice Chair Wagner noted the date on the Agenda Bill was incorrect.
Chair Cerino assured Attorney Heid that he had very carefully reviewed
the document.
Vice Chair Wagner moved and Member Peloza seconded to
recommend approval of Ordinance No. 5829.
MOTION CARRIED UNANIMOUSLY. 3-0.
Ordinance No. 5841
An Ordinance of the City Council of the City of Auburn, Washington,
amending Sections 10.36.205, 10.36.255 and 10.36.360, of the Auburn
City Code relating to parking enforcement
This ordinance would add language pertaining to vehicles with switched
license plates and/or tabs and it would address vehicles that are parked
so they are blocking mailbox access.
Vice Chair Wagner moved and Member Peloza seconded to
recommend approval of Ordinance No. 5841.
MOTION CARRIED UNANIMOUSLY. 3-0.
B. Resolutions
1. Resolution No. 3673
A Resolution of the City Council of the City of Auburn, Washington,
authorizing the Mayor and City Clerk to execute a one-year extension of
the lease of property to King County Department of Public Health for the
King County Paramedic Program.
Vice Chair Wagner moved and Member Peloza seconded to
recommend approval of Resolution No. 3673.

INFORMATION/DISCUSSION ITEMS
A. Runway Improvements Contract Award
Finance Director Coleman announced that ICON Materials submitted
the Iow bid that was well under the engineer's estimate. She reported
that one grant has been received and another is expected to cover most
of the cost and the work will commence in late August and will be done
in 9 phases.
Member Peloza questioned the amount of downtime for the airport and
Chair Cerino asked for an overview of the phases of construction.
Member Wagner would be in favor of the resolution if the second grant
were obtained.
B. Auburn Reqional Medical Center's Parking Proposal
Mr. Sean McDonald from the Auburn Regional Medical Center (AMC)
has requested a 2-hour limit on parking on Division Street between 2nd
Street and 3rd Street and 2nd Street between Division and A Street NW.
At present those spaces have no time limitation.
Vice Chair Wagner recalled that AMC had originally stated before the
recent expansion that the expansion would not cause an increase in
patients, employees or parking. However, since this is not the case,
Vice Chair Wagner would prefer to have a parking forecast by AMC of
patients and employees expected before making any decisions.
Planning and Community Development Director Paul Krauss reminded
the Committee that there are future plans for parking development that
should relieve some of parking congestion.
Vice Chair Wagner requested that the Planning Department develop a
parking permit plan that would be functional.
