CALL TO ORDER Chair Gene Cerino called the meeting to order at 5:00 PM in Conference Room No.3, located on the second floor of Auburn City Hall, 25 W. Main Street, Auburn, WA. Council members included: Chair Gene Cerino, Vice Chair Bill Peloza and Member Rich Wagner. Staff members present included: Mayor Pete Lewis, Police Chief Jim Kelly, Commander Greg Wood, Fire Chief Russ Vandver, Battalion Chief Parry Boogard, Captain Tim Day, Planning & Community Development Director Paul Krauss, Assistant City Attorney Joe Beck, Finance Director Shelley Coleman, Public Works Director Dennis Dowdy, Traffic Engineer Laura Philpot and Administrative Assistant Tamie Bothell. Others in attendance included: Airport Manager Jamelle Garcia, Dave Ward & John Voday from NW Hangars. II. AGENDA MODIFICATIONS There were no agenda modifications. III. CONSENT ITEMS A. Approval of Minutes 1. Minutes of the May 2, 2005 Municipal Services Committee meeting. Vice Chair Peloza moved and Member Wagner seconded to approve the Consent Agenda. MOTION CARRIED UNANIMOUSLY. 3-0 IV. ORDINANCES AND RESOLUTIONS A. Ordinances 1. Ordinance No. 5915 An Ordinance of the City Council of the City of Auburn, Washington, creating a new Section 10.12.125 of the Auburn City Code relating to the speed limit in school zones - when children present Public Works Director Dennis Dowdy reviewed the proposed language changes. City Engineer Laura Philpot and Assistant City Municipal Services Minutes May 16, 2005 Attorney Joe Beck discussed the intent and definition of the signage language. In conclusion, the Committee recommended amending the signage to read "if lights have been installed in conjunction with any school zone and such lights are flashing or "when Children are present" per ACC 10.12.125." Vice Chair Peloza moved and Member Wagner seconded to recommend approval of Ordinance No. 5915 as amended. MOTION CARRIED UNANIMOUSLY. 3-0 2. Ordinance No. 5916 An ordinance of the City Council of the City of Aubum, Washington, repealing Chapter 5.90 of the Auburn City Code relating to condominium conversion Planning and Community Development Director Paul Krauss reported that this ordinance has not been amended since the 1970's. The language needed to be updated to meet current construction codes. Vice Chair Peloza moved and Member Wagner seconded to recommend approval of Ordinance No. 5916 as amended. MOTION CARRIED UNANIMOUSLY. 3-0 3. Ordinance No. 5918 An Ordinance of the City Council of the City of Auburn, Washington, amending Section 9.08.010 of the Auburn City Code, relating to aggressive begging Chair Cerino questioned the no loitering signage he has witnessed in other cities and inquired if this was more enforceable than the aggressive begging ordinance. Chief Kelly responded that it was up for interpretation but that the intent of loitering is eliminating standing around without a lawful purpose. A discussion ensued and the Committee concurred that the aggressive begging language gave the police more of an enforcement tool for aggressive begging, which has become a community concern. Vice Chair Peloza moved and Member Wagner seconded to recommend approval of Ordinance No. 5918 as amended. MOTION CARRIED UNANIMOUSLY. 3-0 Page 2 Municipal Services Minutes May 16, 2005 B. Resolutions There were no Resolutions for the Committee's review. V. INFORMATION/DISCUSSION ITEMS A. Ordinance 5919 - Leaving Children Unattended in Vehicle with Keys in the Ignition Chair Cerino asked if there was a difference with today's entertainment technology in vehicles between leaving the doors locked or unlocked while the children are playing games on these entertainment systems. The Committee discussed the issues and the main factor is the age of the child. This language is intended for any child under the age of 12 years old. The Committee also discussed the proposed language with the word "minor" and how the age intent of "minor" will be enforced. The Committee felt that the age should be changed to 11 years of age and that the word "minor child" be removed from the language. The Committee recommended that the City Attorney return with the recommended changes to Ordinance 5919 at the next meeting. B. Airport Land Lease Finance Director Shelley Coleman distributed current land appraisals and a grid map reflecting the land between the two properties, NW Hangars and Auburn Flight Services. The Committee had requested at the last meeting to have the opportunity to review old files from previous appraisals, which were provided in the agenda packet. A discussion ensued regarding how often an appraisal should be done. Airport Manager Jamelle Garcia advised the Committee that an appraisal should be completed every five (5) years. The Committee recommended we move forward with an appraisal to include a contingency and a cap that would not exceed 20% or $.48 a sq. ft. Director Coleman will bring forward an agreement when it is mutually acceptable between the two parties. C. Firing Range Policies Police Chief Kelly updated the Committee members on recent changes that they are reviewing after several citizen complaints were received. The Chief is currently evaluating outside agencies that currently use the range, hours of operation and the training hours for the larger caliber guns, which are the loudest. The Committee recommended that the first changes needed to be the hours of operation. The Committee felt a reasonable time was from 9:00 Page 3 Municipal Services Minutes May 16, 2005 a.m. to 7:00 p.m. Second, that we notify the outside agencies that we need to lower the amount of shots during the day and lower the caliber of gun power fired. If complaints continue, we will have to reevaluate all our outside contracts at that time. D. Treatment Release Human Resources/Risk Management Director Brenda Heineman reported on the success of the Treatment Release Program. She reported that in 2001, the total Auburn jail population was at 182. The first six offenders were released to treatment through the Auburn Treatment Release Program, and as of this report, a total of 555 treatment releases have been completed and today's jail population is 98. Ms. Henieman also noted that the City contracts with just one inpatient agency, the flexibility of the treatment release program has enabled releases to be effected through more than 20 separate agencies, normally at no cost to the City. She is also looking a similar program for a mental health issues. The Committee thanked Ms. Heineman for her report and thought it was a successful and cost effective program. E. Basic Life Support Transport RFP Fire Chief Russ Vandver reported that the Fire Department has been working several years on getting private transports for citizens to the hospital to meet the demand for service. They have been working in conjunction with other cities that have an established a transport Request for Proposal (RFP) with private ambulance. Chief Vander would like the Committee's review and input to finalize the RFP. The Committee members asked several questions and the following recommended changes were made: 1. Section 18. Insurance - Get opinion from WCIA 2. Section 4. Definitions - Region - add Pierce County under definition of region F. Bicycle Regulations Chair Cerino reported that he was investigating the bicycle code and it appears that our City Codes on bicycle requirements are very outdated. They do not address the safety helmet or light requirements currently in effect. The Committee recommended that the City Attorney's office update this section of the Auburn City Code and return to one of the meetings in June with the revisions. G.
