HomeMy WebLinkAbout07-09-2001MINUTES OF PLANNING AND COMMUNITY DEVELOPMENT COMMITTEE JULY 9, 2001 The regular meeting of the Planning and Community Development Committee was held July 9, 2001 in the Council Work Area. Those members in attendance were as follows: MEMBERS PRESENT: Trish Borden, and Fred Poe, Pete Lewis STAFF PRESENT: Patti Zook Paul Krauss, Lynn Rued, Dave Osaki, Bill Mandeville, Dick Deal, Dennis Dowdy, and ALSO PRESENT: Mayor Booth; Denny Holt The meeting was called to order by Committee Chair Borden at 6:30 p.m. ACTION: 1. Parks Department Surplus Items · .~ ,?,: ?-,:!:. u/ P~ks and Recreation Director Deal reviewed a list of items ready for su~lus and Co~i~ee concurred wit~ the request. DISCUSSION: 1. Scootie Brown Park Parks and Recreation Director Deal distributed a draft agreement with Green River Professional Center located on 8th Street NE to modify the park to accommodate extra parking for the professional center. Staff met with the two adjacent neighbors. He explained how the park would benefit from new parking and facilities being proposed. Denny Holt, representative for the professional center, showed an original site plan. The professional center is pausing in its design until an agreement related to parking is reached. Certain items are not being addressed until the agreement is finalized. Councilmember Lewis likes the proposed park use plan and Parks and Recreation Director Deal spoke about what would change at the park. Mr. Holt spoke about the next step in the process and that they will show the plan to the neighbors. He hopes to have an agreement for action at the next Committee meeting. 2. Single Family Uses Planning Director Krauss remarked that the Committee wanted a discussion about this and different materials related to the topic were in the agenda packet to facilitate discussion. Chairman Borden believes that the court cases seem to support group living situations. Planning Director Krauss cautioned that the City cannot discriminate between those people who are related and those who are not related and what is considered a family. Also, handicapped people can live together. Councilmember Poe wondered if this applied mainly to licensed group homes. Assistant Planning Director Rued remarked that two subjects were in the materials. The City an license group homes as an institution, but cannot discriminate who will live in the group home. Councilmember Poe understands the difficulty in determining if someone is following the regulations, and referred to an example. He wondered what ability the City has to determine what is going on at a particular residence. Councilmember Lewis saw the definition for boarding house and wondered about permitted use. Planning Director Krauss said that if someone has a home and rooms are rented, it is considered a boarding house. Assistant Planning Director Rued clarified that if people are sharing ownership or sharing rent, then any number of people can live together. However, if someone is collecting rent for the bedrooms, this would describe a boarding house. Councilmember Lewis sees the difference now between a single family home and boardinghouse and difference in how the owners and renters act. Planning Director Krauss advised that it is almost impossible to prove if a house is a single family house or boarding house because the City does not have right of entry. If there is a visible problem, such as number of cars or a nuisance, this could lead to an enforcement action. Chairman Borden said that adult family homes do not cause problem and wondered if they are licensed. Assistant Planning Director Rued said that up to six people are allowed, but if more than that they have to get approval from the City. Councilmember Lewis confirmed that the problem surrounds gaining right of entry to a residence. Chairman Borden reiterated that the information gathered was very helpful. 2001 Comprehensive Plan Amendments Principal Planner Osaki informed Committee that the amendment process has started and two applications were received which were described. The Comprehensive Sewer Plan needs to be acted on this year, as well as the Comprehensive Water and Storm Drainage Plans to be revisited because these were not adopted. The Airport Master Plan may also be ready. Principal Planner Osaki pointed out C-N areas which may be amended, and spoke about text amendments. He asked if the Committee is interested in initiating any amendments. Chairman Borden does not want the C-N designation changed. Councilmember Lewis talked about the proposed seven story apartment building on Howard Road and Wondered ifa development of this type should be on a Committee's agenda to review. He is concerned about multi-fmnily development on the edge of single family residential. He thinks the development should come through a Committee versus just the SEPA process. He does not want to review every proposal, just certain ones. Planning Director Krauss advised that the C-1 designation is an appropriate designation for the area. The height of the apartments are allowed because additional setbacks are provided. Assistant Planning Director Rued remarked that the C-1 and C2 districts are written with multi family as a permitted use with first floor retail and upper stories as multi family. If multi family and no first floor retail, then the conditional use process is used. Councilmember Lewis is concerned about a multi story building adjacent to single family neighborhood without public process. Currently there does not seem to be a method for public process. There is the perception that this type of project goes through without public notification. Planning Director Krauss informed Committee about the SEPA appeal process. The developer could do a one story shopping center which would have significantly more traffic associated with it. Assistant Planning Director Rued informed Committee about the Notice of Application (NOA) that is sent to all adjacent property owners within 300 feet of the proposal. The Proposed Mitigated Determination of Non-Significance was issued today. He explained the NOA process and posting process Councilmember Lewis wants to know when the NOA is sent to the adjacent property owners and Planning Director Krauss said that copies of all NOAs and other SEPA notices will be given to Council in the future. PAGE 2 MINUTES OF PLANNING AND COMMUNITY DEVELOPMENT COMMITTEE JULY 9, 2001 AmeriCorps Interlocal Agreement with Auburn School District Planner Mandeville said that Kip Herren, with the School District, was not present tonight and he requested that the presentation occur at the next meeting. Mr. Herren will talk about the District's assumption of AC. No changes are proposed to the Interlocal. Revisions to the budget will be reviewed in more detail at the next meeting. He explained the District's new responsibilities. He pointed out the budget comparisons in the table. He reviewed the new duties of District and the City. Planning Director Krauss mentioned that the City thought it could ease out during the three year cycle. Mr. Herren is very positive about the program and District will make every effort to continue. Councilmember Poe wanted to see information about past participants and what they achieved with money received for education. Army Corps of Engineers Ecosystem Program Dennis Dowdy has been attending the management committee in preparation for the next forum meeting. The Corps and King County are making a pitch for the next step in the program which he described. He is seeking authorization to proceed for design of project. The Corps is trying to narrow the list to 20 projects. Two of the projects are in Auburn - Olson Canyon and north Goedeke site. The Corps has done preliminary estimates for the 20 designs. King County wants cities behind the process to help reimburse costs. He is seeking Committee input regarding upcoming meetings. He explained the Corps and City scope. He described the improvements to the Goedeke and Olson Canyon sites. This program will parallel the WRIA planning: It is important to get the two City projects on the list and in the design because this helps with grants. Planning Director Krauss commented that the City owns both sites and leverage cots. SAMP is the guidance document. Councilmember Poe wanted to know about the Tribes' involvement in the process. Civil Engineer Dowdy said the Tribes are on the technical committee. PCDC consented to move forward.
