HomeMy WebLinkAbout10-02-2001MINUTES OF THE PLANNING COMMISSION MEETING OCTOBER 2, 2001 The regular meeting of the Planning Commission was held on October 2, 2001 at 7:00 p.m. in the Council Chambers of the Auburn City Hall. Those in attendance were as follows: MEMBERS: Dave Peace, Bill Taylor, Garna Jones, Peter DiTuri and Ronald Douglass STAFF: Lynn Rued, David Osaki, Duane Huskey, Jeff Roscoe, Tim Osborne, and Patti Zook The following members were absent: Karen Ekrem and Renee Larsen . The meeting was called to order by Chairman Dave Peace. APPROVAL OF MINUTES: It was concurred by the Planning Commission that the minutes of the September 5, 2001 meeting be approved as mailed. PUBLIC HEARING · Case Number CPA01-0002 - Year 2001 Comprehensive Plan Amendments Principal Planner Osaki informed the audience of the process for tonight's hearing. Planning Commission has received two comment letters and the TIP sheet. CPM # 1 - Amend Potential Annexation Area Principal Planner Osaki briefly explained and gave background of the property including information related to Bonney Lake. He spoke about the settlement agreement. Matthew Sweeney, attorney for Prium Development, thought the City would approve the request. He is in negotiations with Bonney Lake to see if they are willing to reverse their decision. He thanked Principal Planner Osaki and asked Planning Commission to give consideration to their request. If Planning Commission would recommend approval except for settlement agreement, he will redouble efforts with Bonney Lake. It is unknown if Bonney Lake knew the settlement agreement boundary bisected their property. Their project received sewer approval from the City and water service is coming from Bonney Lake. He read a portion of August 16 letter from Michael Knapp. Commissioner DiTuri asked about any issues with the pipeline. Mr. Sweeney said there are recorded easements for pipeline crossings for platting. CPM #2 - Amend Comprehensive Plan Map from High Density Residential to Single Family Residential Principal Planner Osaki described the change and certain issues were researched. He reviewed a comparison chart and spoke about the setbacks. Two lots would become nonconforming, but could still be built and this should not inhibit development of the two lots. Chairman Peace asked about a house being rebuilt if it burns down. Assistant Planning Director Rued said that the nonconforming chapter of the Zoning Ordinance has exceptions for houses on nonconforming lots. The house can be rebuilt on the same footprint. Principal Planner Osaki then spoke about lot coverage in the R4 zone versus R2. He spoke about restrictions on building accessory buildings if in the R2 zone. Joan Green lives in the Velvet Square development and submitted a petition in support of the change and signed by residents. -1- MINUTES OF THE PLANNING COMMISSION MEETING OCTOBER 2, 2001 Pfr # 1 - Amend Auburn North Business Area Plan (ANBAP) Principal Planner Osaki briefly described and said the applicant's language is comparable to C2 zone language in the Zoning Ordinance for fuel dispensing facilities with the main exception of one criteria. He spoke with the applicant regarding the criteria and applicant said that on comer lot it may be hard to implement. They now expect to be able to meet the standards because Safeway was able to comply. Applicant also wants a change related to siguage and this change is reasonable. Chairman Peace wondered about no requirement for a conditional use permit and if any facility in the C3 zone could put in gas station. Principal Planner Osaki said the Plan was to be an extension of downtown and prohibit gas. Fuel dispensing facilities are now allowed in C3 across the City and it is reasonable to allow in C3 within the ANBAP subject to criteria. Mike Bocatch, 111 H Street SE, is concerned about the impacts to the senior housing facility behind Fred Meyer. He is concerned about traffic in the area since the seniors walk back and forth to Fred Meyer. He is also concerned about fumes from cars affecting seniors. Brace Creager, Barghausen Engineers, and Charles Mosley, with Fred Meyer Real Estate Division, reviewed the staff report and discussed the changes. They are in support of the revisions. The northeast portion of their site fronting on Auburn Way North will be development of the fuel facility which will receive vigorous State and Federal review. Pfr #2 - Kent School District Capital Facilities Plan (CFP) Principal Planner Osaki briefly described. There was no public testimony on this subject. P/T #3 - Auburn School District CFP Principal Planner Osaka briefly described. Commissioner Douglass asked if there is any change in the impact fees from last year. Principal Planner Osaki thinks there were changes in the net fee obligation in the School District's CF?, but the City does not collect the entire net fee identified in the School District's CF? and said what the collected impact fee is. The City is collecting the same as last year. Mike Newman, Assistant Superintendent for Auburn School District, said they are not requesting additional impact fees. They appreciate the City collecting fees on their behalf. The fees are $2,500 for single family homes and $1,000 on multi-family. There was no public testimony on this subject. Pfr/14 - Dieringer School District CFP Principal Planner Osaki briefly described. There was no public testimony on this subject. P/T #5 - Sewer Plan Principal Planner Osaki briefly described. Chairman Peace asked Sewer Utility Engineer Roscoe about the comment letters and Sewer Utility Engineer said the letters contained no substantive comments and were not detrimental to the Plan. They were more clarification type comments and will not hold up the Plan's approval. Commissioner Jones asked Sewer Utility Engineer about the cooperative effort between Auburn and King County relating to sewer lines and Sewer Utility Engineer replied that King County has provided information regarding -2- MINUTES OF THE PLANNING COMMISSION MEETING OCTOBER 2, 2001 amendments to the King County Plan and items were clarified. Policy F245 is for the King County Health Department. The City has been provided information regarding septic tank failure when installing sanitary sewer. There was no public testimony. P/T #6- Water Plan Principal Planner Osaki briefly described and gave background of this from last year. The appendices this year included the comments and response to comment letters and how comments were responded to in the Plan. There was no public testimony. P/T #7 - Various Text Amendments Principal Planner Osaki briefly reviewed the changes to Chapters 3, 5, 7, 9, 14 and 15. He described the change to Chapter 7 because Councilmember Sue Singer wanted this policy revisited. There is concern about when dead end streets are opened. The word 'substantially' is too vague and there is no assurance of when this policy will be used. Commissioner DiTuri commented that if traffic studies are done and if able to do simulation, can use traffic modeling to see what flow might be for comparison. There needs to be a comparison or some index to see if there is impact from the development. Principal Planner Osaki said there were thoughts of defining 'substantially' by road capacity and that would be the threshold. The Planning Commission could advance this idea if more quantitative approach is desired. Commissioner DiTuri said yes and spoke of the need to understand traffic patterns more and take into account the multi-facets when the street is opened. Principal Planner Osaki pointed out the TIP sheet and the amendment incorporates the adopted TIP into the Plan. Chapter 9 policy language references portion of State law, but is not referenced correctly and needs to be changed to maintain consistency with State law. He reviewed changes to Chapter 14 and 15. Michael Bocatch referred to peripheral development and said that during SuperMall hearings the issue was peripheral development and this would interfere with blue heron sanctuary. Regarding P/T #6, he spoke about the roundhouse at BNILR property and expressed concern about what is buried under the BNRR ground. He thinks there are fuel and waste storage tanks buried there and is concerned about this not being monitored. Chairman Peace closed the public hearing. DISCUSSION/DELIBERATIONS/RECOMMENDATIONS CPM # 1 - Amend Potential Annexation Area Chairman Peace wanted to go on the record that he believes the request is frae, but is very concerned about the settlement agreement with Bonney Lake. Commissioner DiTuri wanted to convey that at this particular time the request cannot be approved due to the settlement agreement with Bonney Lake. Commissioner Jones believes the request should not be approved. If in the future, after resolution of issues with Bonney Lake have been worked out, the applicant could come back and make his request. Principal Planner Osaki commented that it is his opinion that changes with the Bouney Lake settlement agreement could not be processed in six weeks. Bouncy Lake has elections coming up, no Planning Director and other staff shortages. There is the possibility that a party could try to renegotiate other language in the settlement agreement. Commissioner Taylor made a motion, seconded by Commissioner Jones, to recommend denial of the request. No motion passed 5-0. -3- MINUTES OF THE PLANNING COMMISSION MEETING OCTOBER 2, 2001 CPM #2 - Amend ComprehenSive Plan Map fxom High Density Residential to Single Family Residential Commissioner Douglass made a motion, seconded by Commissioner DiTuri to approve the request. The motion passed. P/T #1 - Amend Auburn North Business Area Plan Principal Planner Osaki summarized the changes by clarifying that fuel dispensing facility is not considered auto service. The reference to conditional use permit process can be deleted. He reviewed the additional proposed changes. Commissioner Jones made a motion, seconded by Commissioner Taylor to accept amendment as proposed by Planning Department with additional changes as proposed by Principal Planner Osaki. The motion passed. The following were acted on together: P/T #2, Kent School District CFP; P/T #3, Auburn School District CFP); and P/T #4, Dieringer School District. Commissioner Taylor made a motion, seconded by Commissioner DiTuri, to recommend approval. The motion passed. P/T #5 - Sewer Plan Commissioner DiTuri made a motion, seconded by Commissioner DiTuri to recommend approval. The motion passed 5-0. Commissioner Jones asked Sewer Utility Engineer if the utilities committee goes over the document page by page. Sewer Utility Engineer said the Public Works Committee reviews the Plan in depth. P/T #6 - Water Plan Chairman Peace was surprised that no one was in the audience to speak about this policy/text amendment. Commissioner Taylor made a motion, seconded by Commissioner DiTuri, to recommend approval. The motion passed. Commissioner DiTuri appreciated Public Works staff effort on the Plan. P/T #7 - Miscellaneous Text Amendments Commissioner Jones referred to Item B and believes this should be kept because it may be appropriate in a certain case. She strongly believes it should not be deleted. She thinks the policy will provide additional protection for the City. Chairman Peace thinks Item B is next to impossible to enforce. Commissioner DiTuri said there is a question about what is meant by 'cumulative effect' and this could be taken subjectively and could possibly lead to litigation. An earlier comment about the SuperMall does not relate to this at all. Item A Commissioner Douglass made a motion, seconded by Commissioner DiTuri to recommend approval. The motion passed 5-0. Item B Commissioner Taylor made a motion, seconded by Commissioner DiTuri, to recommend approval. Commissioner Jones voted no. The motion passed. Item C Planning Commission recommended no revisions to this item. Item D Planning Commission recommended approval. Item E Planning Commission recommended approval. Item F Planning Commission recommended approval. Item G Planning Commission recommended approval. CALL FOR PUBLIC HEARING: Assistant Planning Director Rued distributed an agenda bill with proposed Zoning Ordinance amendments and Planning Commission needs to decide if the public hearing will be on November 6 (election day) or November 7. He provided background on why the amendments are proposed. City Council has asked staff and Planning -4- MINUTES OF THE PLANNING COMMISSION MEETING OCTOBER 2, 2001 Commission to look at this provisions in the CI zone and see about allowing taller buildings in C1 areas other than the North Auburn Business District. There are questions about the outright use of multi-story buildings. Staffdoes recommend moderate changes to the C 1 zone. The changes will not affect the Howard Road project because it is vested. Planning Commission consensus was for the meeting to be held on Wednesday, November 7 instead of November 6 which is election day. Assistant Planning Director Rued said the next meeting will be November 7 and property owners and adjacent property owners will be notified. A large crowd is expected for the November 7 meeting.
