CALL TO ORDER The meeting was called to order at 5:35 p.m. Those in attendance were Mayor Booth, Committee Chairman Rich Wagner, Council/Committee member Don Kurle and Council/Committee member Pat Burns. Staff in attendance were Public Works Director Frank A. Curde, City Engineer Dennis Dowdy, Senior Engineer Dennis Selle, Utilities Engineer Dwight Holobaugh, Water Quality Compliance Officer Chris Thorn, Utilities Technician Dave McPherson, Building Division Manager Tony Baca, Assistant Fire Marshal Dave Smith, Finance Director Victor Thompson, and City Attorney Michael Reynolds. Guest in attendance was John Raeder from the Chamber of Commerce. City Attorney Michael Reynolds briefed the Public Works Committee/staff members and guest on the meeting that was held City staff, representatives from the Racetrack and Washington State Department of Transportation (WSDOT). The City Attorney discussed the proposed Agreement, the City would release the State funds if Northwest Racing gives its 56-acre wetlands mitigation site to the City; known as the Thormod site. The amount of $1.3 million is part of a $5 million package of State grants. The City agreed to evaluate whether the benefit of the proposed transfer of property to the Arterial Street Fund substantiates the $1.3 million value. City Attorney Mike Reynolds also discussed the pending law suit brought forth by Burlington North Railroad (BNRR) challenging the City's Comprehensive Plan and zoning of M-2. He will continue to keep the Public Works Committee informed of the status. The next item discussed was II. ISSUE D. through G. and IV. INFORMATION OR DISCUSSION D., Ordinance No. 4759, adding new sections to make payback agreements consistent for all utilities. The City Attorney has reviewed and approved the revisions. Being satisfied with the revision, the Public Works Committee recommended approvals oflI. ISSUES D. E.,F. andG. H. ISSUES A. RESOLUTION NO. 2660, PAYBACK AGREEMENT WITH HENDERSON HOMES Utilities Engineer Dwight HolobaUgh described in detail the Payback Agreement with Henderson Homes. A concern about the City's liability for failure to collect was addressed by staff to the Committee's satisfaction. Being satisfied, the Public Works Committee recommended approval to the City Council at their August 7, 1995 meeting. PUBLIC'WORKS COMMITTEE MINUTES JULY 24, 1995 PAGE 2 OF 3 B. RESOLUTION NO. 2661, PAYBACK AGREEMENT WITH DAVID WARMENHOVEN Utilities Engineer Dwight Holobaugh presented the Payback Agreement for David Warmenhoven. (This Agreement is essentially identical to II. ISSUE A.) Being in agreement, the Public Works Committee recommended approval to the City Council at their August 7, 1995 meeting. C. RESOLUTION NO. 2659, TO TERMINAl STREET DELAY AGREEMENTS BETWEEN THE CITY OF AUBURN AND THOSE CERTAIN PROPERTY OWNERS ALONG 37TH STREET SE BETWEEN "A" STREET SE AND "M" STREET SE ASSOCIATED WITH ROADWAY IMPROVEMENT PROJECT NO. 502, LID 341 City Engineer Dennis Dowdy explained that the completion of the 371h Street LID project and the approval of the Final Assessment Role completes the obligations of the Street Delays being released; therefore, as a matter of housekeeping, it is now necessary to release these Street Delays. The Public Works Committee recommended approval at their August 7, 1995 meeting. D. ORDINANCE NO. 4759, ADDS NEW SECTIONS TO AUBURN CITY CODE CHAPTER 13.40 UTILITY EXTENSIONS TO CLARIFY AND INSURE CONSISTENCY IN PAYBACK AGREEMENTS FOR ALL UTILITIES Approved. See page 1. E. ORDINANCE NO. 4760 AMENDS AUBURN CITY CODE CHAPTER 13.08 WATER MAIN EXTENSIONS TO INSURE CONSISTENCY FOR PAYBACK AGREEMENTS IN ALL UTILITY EXTENSIONS Approve& See page 1. F. ORDINANCE NO. 4761 AMENDS AUBURN CITY CODE CHAPTER 13.20 SEWERS TO INSURE CONSISTENCY FOR PAYBACK AGREEMENTS IN ALL UTILITY EXTENSIONS Approved. See page 1. G. B. RIGHT-OF-WAY USE PERMIT 19-95 FOR THE ANNUAL SIDEWALK SALE EVENT The Public Works Committee approved. C. RIGHT-OF-WAY USE PERMIT 17-95 FOR THE ANNUAL GOOD 'OL DAYS EVENT The Public Works Committee approved. IV. INFORMATION OR DISCUSSION A. DRAFT PROPOSED CHANGES TO BUILDING AND FIRE CODES Building Division Manager Tony Baca presented a draR of the Building and Fire Codes. The draf~ will be presented to Municipal Se~ices for approval. B. DISCUSS PR 513, SIDEWALK PROGRAM FUNDING City Engineer Dennis Dowdy discussed with the Public Works Committee the reasoning for going back out to bid and dividing the bids into three separate bid packages. Residential, Auburn Way North, and Wheelchair Ramps. C. CAPITAL PROJECT STATUS P,.EPORT Senior Engineer Dennis Selle answered questions from the Public Works Committee on the status of projects. D. RESOLUTION NO. 2659, TO TERMINATE STREET DELAY AGREEMENTS BETWEEN THE CITY OF AUBURN AND THOSE CERTAIN PROPERTY OWNERS ALONG 37TH STREET SE BETWEEN "A" STREET SE AND "M" STREET SE ASSOCIATED WITH ROADWAY IMPROVEMENT PROJECT NO. 502, LID 341 Finance Director Victor Thompson asked for Committee approval to file the final assessment roll for collection and proceed to issue bonds for the unpaid assessments despite the protests on the Magnuson and Olsen assessments. The alternative would be to wait for resolution of the protests with possible adjustment to the final assessment role, which was not recommended as a practical solution. Thompson also pointed out that the City would have to guarantee payment to the bond purchasers of the Magnuson and OIsen assessments if the protests are not resolved before the bond sale. The Committee agreed on this course of action and agreed to recommend such payment guarantee to the Council in connection with the Bond Ordinance. REF. H:NENGINEER~E95~E95-833A
