CALL TO ORDER The meeting was called to order at 4:30 p.m. Those in attendance were Mayor Booth, Committee Chairman Rich Wagner, Council/Committee member Fred Poe, and Council/Committee member Pete Lewis. Staff in attendance were Public Works Director Christine Engler, Planning Director Paul Krauss, City Engineer Dennis Dowdy, Assistant City Engineer Dennis Selle, Storm Drainage Engineer Tim Cadaw, Water Utility Engineer Tim Osborne, Solid Waste Supervisor Sharon Con roy, Special Projects Engineer Jack Locke, Project Engineer Scott Nutter, Assistant Project Engineer Laura Philpot, Assistant Project Engineer Evelyn Choe, and Administrative Services Supervisor Pam Miller. Guests in attendance were Jay Smith and Tony Melone, Tetra Tech/KCM Consultants; Consulting Engineer Dwight Holobaugh. II. CONSENT A. CHANGE ORDER #5 TO CONTRACT 99-25 WITH C.A. CAREY, PROJECT NO. C9009, WELL 2JWELL 6 CONSTRUCTION Change Order #5, in the amount of $22,806, is required to pay for placing the Contractor, CA Carey, on suspension for seven weeks (including de-mobilization and re-mobilization costs) while the City of Auburn repaired and redeveloped Well 2. A budget adjustment of $22,806.00 from the Water Utility Fund will be required to fund this change order. In reviewing the project budget, Council/Committee member Poe questioned the use of Corrosion Control Treatment Facilities (CCTF) project funds for the Well 2/Well 6 project. Director Engler clarified that some CCTF project funds are being used for the Well 2/Well 6 project in order to rehabilitate the pumping equipment and other related aspects required for the CCTF to work as a whole; however, no CCTF funds were used for Change Orders ~ and #5. It was moved by Poe, seconded by Lewis, that the Committee recommend Council approve Change Order #5 to Contract 99-25. Motion carded. B. FINAL PAY ESTIMATE #4 TO CONTRACT 99-18 WITH R.W. SCOTT CONSTRUCTION, AND ACCEPT CONSTRUCTION OF PROJECT NO. C9013, J STREET- STREET IMPROVEMENTS Project No. C9013 provided a paved roadway for local access to Les Gove Park, the new King County Library, and several businesses. The roadway functions as a non-residential local access, but is modified to emphasize the local access aspect of the road with enhanced landscaping and pedestrian facilities. REET funds in the amount of $17,236.82 are not required to support the project. There was no discussion. It was moved by Poe, seconded by Lewis, that the Committee recommend Council approve Final Pay Estimate #4 to Contract 99-18 and accept construction of Project No. C9013. Motion carded. PUBLIC WORKS COMMITTEE MINUTES OCTOBER 23, 2000 Page 2 of 11 C. FINAL PAY ESTIMATE ~4 TO CONTRACT 00-02 WITH GARY MERLINO CONSTRUCTION, AND ACCEPT CONSTRUCTION OF PROJECT NO. C8001, TERRACE DRIVE ILLUMINATION AND WALKWAY Project No. C8001 provided a concrete pedestrian walkway (sidewalk) on the north side of Terrace Drive from the existing walkway on 15"~ St. NW to the existing sidewalk located approximately 250 feet east of 'W' St. NW. Also eleven luminaires were provided along the lower part of Terrace Drive to complete the street light system. A project contingency of $61,580.90 remains in the Unrestricted Street Revenue fund. There was no discussion. It was moved by Poe, seconded by Lewis, that the Committee recommend Council approve Final Pay Estimate #4 to Co_ntract 00-02 and accept construction of Project No. C8001. Motion carried. III. ISSUES A. RESOLUTION NO. 3270 AUTHORIZING A PAYBACK AGREEMENT WITH GEONERCO, INC., FOR WATER AND SEWER FACILITIES Resolution No. 3270 authorizes the Mayor and City Clerk to execute a Payback Agreement with Geonerco, Inc. Geonerco, Inc. completed the Facility Extension (FAC0003-97) for water and sanitary sewer facilities to serve a new plat (Royal Hills). The water and sanitary sewer utilities were extended to and through their property, and provide benefit to adjacent parcels. The City of Auburn has established a Payback Agreement to provide reimbursement to the developer for the benefit received by the adjacent property owners. There was no discussion. It was moved by Poe, seconded by Lewis, that the Committee recommend Council adopt Resolution No. 3270. Motion carded. B. RESOLUTION NO. 3274, AGREEMENT AND EASEMENT FOR WATER PIPELINE WITH PUGET SOUND ENERGY Resolution No. 3274 authorizes the execution of an Agreement and Easement for Water Pipeline with Puget Sound Energy. The pipeline is related to a developer project (FAC99- 0037), and the City will be reimbursed for the fee of $3,400 by the developer. This.permit will provide for construction of a water pipeline in PUget Sound Energy right-of-way in the vicinity of S. 277"" St. to serve City water to properties developing in the area of this property. There was no discussion. It was moved by Poe, seconded by Lewis, that the Committee recommend Council adopt Resolution No. 3274. Motion carried. C. RESOLUTION NO. 3276 AUTHORIZING AN AGREEMENT BETWEEN THE PARTICIPATING JURISDICTIONS WITHIN THE GREEN/DUWAMISH WATERSHED RESOURCE INVENTORY AREA (WRIA 9) Resolution No. 3276 authorizes the execution of an Agreement between the City and the other participating jurisdictions within the Green/Duwamish Watershed Resource Inventory PUBLIC WORKS COMMITTEE MINUTES OCTOBER 23, 2000 Page 3 of 11 Area (WRIA 9) for the purpose of participating in the joint funding, development, review and approval of a WRIA-based watershed recovery plan. The budget impact of participation in the plan is estimated to be approximately $21,000, which has been budgeted in the City's 2001 general fund budget. It was moved by Poe, seconded by Lewis, that the Committee recommend Council adopt Resolution No. 3276. Motion carried. D. ORDINANCE NO. 5445, CONDEMNATION Of PROPERTY (PARCEL # 16), SOUTH 277TM STREET PROJECT The City is currently working on the design and right-of-way acquisition for Project No. PR 562, South 277b Street. The project involves the acquisition of easements, purchase of properties, and relocation of inhabitants following the policies and procedures as governed by federal legislation. The City has completed acquisition of five properties to date. It is essential to the success of this project that the purchase of these properties and securing of easements be handled in an efficient and expeditious manner. Therefore, staff is recommending Council grant the City Attorney the authority to prepare petitions for condemnation, should the negotiation process tail to reach agreement. Prior to discussing the ordinances related to condemnation, Chair Wagner asked if the City had hired a negotiator. Assistant City Engineer Selle responded that Universal Field Services is the City's on-call consultant for property acquisition. Universal has assigned a primary negotiator for the purchase of the land rights and an additional person who is handling the relocation of owners and tenants. Project Engineer Nutter distributed a copy of a letter from the City of Kent outlining their concerns about the project related to their proposed assumption of lead agency status, and requesting the City of Auburn to expedite right-of-way acquisition. As the ordinances were discussed, Nutter used a map of the project area to show each parcel as he gave a status of negotiations. Status of negotiations for Issue Items D and E were discussed simultaneously, since the parcels have the same owner. City staff has attempted to negotiate with the owners of the above parcel with limited success. The property owners have indicated that they do not wish to sell unless the City will agree to pay above the City-approved "Just Compensation" value provided by the City's review appraisers. The property owners have made no attempt to obtain their own appraisal to evaluate the City's offer. The owner made a statement to the City's representative that they are in no hurry to settle, as the City has delayed this project for several years. Status of negotiations for Issue Items F and G were discussed simultaneously since the parcels have the same owner. City Staff has attempted to negotiate with the owners of the above parcel with limited success. ORDINANCE NO. 5464, CONDEMNATION OF PROPERTY (PARCEL # 33), SOUTH 277TM STREET PROJECT Ordinance No. 5464 authorizes the City Attorney to prepare a petition for condemnation for the King County Superior Court for the acquisition of easements for tax parcel number: 000680-0006 for the construction of PR 562, South 277th Street Reconstruction Project. City Staff has attempted to negotiate with the owners of the above parcel with limited success. This agenda item was discussed with Issue Item T. V. APPROVAL OF THE OBLIGATION AND EXPENDITURE OF STATE TIB GRANT FUNDS FOR PR 562, SOUTH 277TM STREET RECONSTRUCTION PROJECT This issue was added to the agenda by agenda modification. The State Transportation Improvement Board (TIB) approved funding in the amount of $8 million for PR 562, of which the City is proposing to use $1.1 million for right-of-way. An ordinance and funding agreement for $1.1 million will be provided at the Council meeting on November 6. There was no discussion. It was moved by Poe, seconded by Lewis, that the Committee recommend Council adopt the ordinance that will be presented to them on November 6, authorizing obligation and expenditure of State TIB grant funds for PR 562. Motion carded. IV. INFORMATION OR DISCUSSION Prior to the Information/Discussion agenda, the Mayor distributed copies of a letter to Sound Transit regarding the parking garage, asking for concurrence from the Committee pdor to sending the letter. Special Projects Engineer Locke stated that Sound Transit has selected the firm of PCL to design and build the parking garage. PCL has estimated that for an additional $650,000 another floor of 120 parking stalls could be added to the garage, which is much less, per stall, than normal parking space prices. Sound Transit was informed that the City wanted to exercise their option to include the extra floor on the garage, however, there was a misunderstanding, resulting in the Sound Transit Finance Committee eliminating the extra floor. The purpose of the letter is to ask the Sound Transit Board to add the extra floor back into the plans for the garage. In response to a question from Chair Wagner as to whether or not Council was being asked to authorize money for the garage, Planning Director Krauss responded that staff is still working on the issue and will be coming to Council in November with a proposal. He stated that he and Finance Director Supler had met with Attorney Hugh Spitzer to discuss the issue of funding parking spaces at the garage, and he distributed copies of a memo to the Mayor and Council outlining a possible proposal. PUBLIC WORKS COMMITTEE MINUTES OCTOBER 23, 2000 Page 9 of 11 Discussion was held on how parking spaces purchased by the City could be financed and used, and the issue of using the ground floor for parking versus retail space was discussed. Council/Committee member Poe expressed his reservations about including retail space in the garage, voicing his concerns about potential financial liability. Following discussion, Chair Wagner and Council/Committee member Lewis concurred that the Mayor should send the letter to Sound Transit, while Council/Committee member Poe abstained. A. LIGHTING IN DOWNTOWN AUBURN Due to time coqstraints, this item was deferred until the next meeting. B. STORM DRAINAGE COMPREHENSIVE PLAN For the purpose of these minutes, this item was discussed after Information/Discussion Item D. Storm Drainage Engineer Tim Carlaw introduced Tony Melone and Jay Smith from Tetra Tech/KCM, the consulting firm that has been working on the City's Storm Drainage Comprehensive Plan. Cadaw stated that unlike the Water and Sewer Comp Plans, the Storm utility does not have a mandated regulatory requirement to prepare the Plan. Mr. Melone stated that Tetra Tech/KCM has been working on the Plan for the past two years. As manager of KCM's Stormwater Management Program, he has worked on a number of City projects since 1994. Mr. Smith is the project engineer on the City's Comp Plan and did the data gathering, computer modeling, and quantitative analysis, working closely with City staff. Mr. Melone gave a brief history, stating that the City's Storm Utility was formed in 1986, and a Storm Drainage Comprehensive Plan was developed in 1990. He reviewed the reasons for the new plan and gave an overview of what the City has implemented to comply with Department of Ecology (DOE) mandates, what is currently being worked on, and what still needs to be done. Mr. Smith presented a map showing the 19 urban sub-basins and six rural and annexation sub-areas that were studied, and reviewed the analysis that went into the Plan. He reported that the computer model that was developed in 1990 was updated to a new version and new GIS information was entered into the model. Problem areas were identified and from one to four alternatives were developed to address water quantity and quality problems in each sub-basin. Smith explained the evaluation matrix used to select the preferred altematives, which were prioritized to develop a six-year capital improvement program, at a cost of approximately $2.5 million per year. Copies of the Plan were distributed to the Committee. Carlaw stated that the Plan has been submitted for SEPA review, and a public hearing on the Plan is scheduled for November 7. The Committee was asked to review the Plan over the next four weeks, at which time discussion will be held on policy issues arising' from the Plan. WELL 5 Water Utility Engineer Osborne distributed a status report, proposed scope of work, and cost estimate for investigating entrained air problems being experienced at Well 5. The problems surfaced in August of this year, but the City was waiting until fall, when Well 5A would be able to handle the lower demand. The City plans to enter into an agreement with Pacific Groundwater Group, who will remove and inspect the pump, video log and rehabilitate the well, reinstall the pump, and perform testing and analysis. The investigation is expected to take about two weeks, during which time the City will purchase water from Bonney Lake to serve the area, if water from Well 5A proves insufficient in quantity to meet demand. Do SHORELINE MANAGEMENT ACT LAWSUIT For the purpose of these minutes, this agenda item was discussed after the Sound Transit Parking Garage discussion. Planning Director Krauss brought the Committee's attention to a letter included in their agenda packet from the Association of Washington Cities (AWC) regarding a potential lawsuit against the state. The Department of Ecology has developed a set of new Shoreline Management Act (SMA) rules. Krauss explained flaws in the rules and said that while compliance with the SMA update will be costly to counties and cities, legislators have been unwilling to provide funds. According to the letter from AWC, the City of Chelan is considering taking the lead in an unfunded mandate suit against the state. AWC is asking cities to consider supporting the lawsuit. Krauss' recommendation was that if other communities are supporting the lawsuit, then Aubum should also. Krauss handed out copies of a list of issues and questions that need to be discussed regarding the YMCA's Community Center proposal. He stated that a kickoff meeting was recently held, and that the next meeting would be held on Monday, October 30. Krauss distributed copies of the Statement of Qualifications from DLR Group, along with copies of a proposed contract between the City and DLR. The consulting firm was chosen by the City to conduct a planning study to define the City's needs for public safety facilities. Krauss asked Committee members to review the contract and forward their comments to him. E. KING COUNTY'S REGIONAL INFILTRATION/INFLOW CONTROL PROGRAM - LOCAL AGENCY WORKSHOP For the purpose of these minutes, this item was discussed after Information/Discussion Item B. Public Works Director Engler distributed information about a Local Agency Workshop being held by King County regarding their Regional Infiltration/Inflow Control Program.
