CALL TO ORDER
The meeting was called to order at 8:00 a.m. Those in attendance were Mayor
Lewis, Committee Chairman Rich Wagner, Council/Committee member Fred Poe,
and Council/Committee member Gene Cerino. Staff in attendance were Public
Works Director Christine Engler, City Engineer Dennis Dowdy, Storm Drainage
Engineer Tim Carlaw, Sewer Utility Engineer Jeff Roscoe, Traffic Engineer Michael
Fuess, Transportation Planner Joe Welsh, Civil Engineer Costa Philippides, Senior
Project Engineer Ingrid Gaub, Project Engineer Scott Nutter, City Attorney Dan Held,
Assistant Finance Director Lee Hall, and Administrative Services Supervisor Pam
Miller.
Guests in attendance were Tom Pitman and Jim Ciecko, Lydig Construction; Paul
Walker, Muckleshoot Indian Bingo; Howard McOmber; Chris Johnson; Tayloe

II. CONSENT
A. APPROVAL OF MINUTES
It was moved by Councilmember Poe, seconded by Councilmember Cerino, that
the Committee approve the Public Works Committee minutes for July 8, 2002, as
submitted. Motion carded.
B. RIGHT-OF-WAY USE PERMIT 29-02, RESTORATION OF TOWNHOUSE
APARTMENT BUILDING
It was moved by Councilmember Poe, seconded by Coun¢ilmember Cerino, that
the Committee approve Right-of-way Use Permit 29-02. Motion carried.
C. RIGHT-OF-WAY USE PERMIT 26-02, HUGHES CHIROPRACTIC HEALTH
CENTER, FOR KIDS DAY AMERICA
It was moved by Councilmember Poe, seconded by Counciimember Cerino, that
the Committee approve Right-of-way Use Permit 26-02. Motion carried.
D. RIGHT-OF-WAY USE PERMIT 28-02, MUCKLESHOOT INDIAN BINGO, FOR
CAR SHOW
It was moved by Councilmember Poe, seconded by Councilmember Cedno, that
the Committee approve Right-of-way Use Permit 28-02. Motion carried.
E. PERMISSION TO AWARD CONTRACT NO. 01-09, PROJECT NO. C1005,
2002 SANITARY SEWER IMPROVEMENTS, TO RODARTE CONSTRUCTION,
ON THEIR LOW BID OF $958,921.86 (INCLUDES WSST)
It was moved by Councilmember Poe, seconded by Councilmember Cerino, that
the Committee recommend Council approve award of Contract No. 01-09 to

Rodarte Construction. Motion carried.
F. AMENDMENT TO i998 DESIGN AND CONSTRUCTION STANDARDS,
PROVIDING FOR STORM DRAINAGE IMPROVEMENTS ON CLAY AND
WESTERN STREETS
For the purpose of these minutes, this item was discussed after Issue Item B.
It was moved by Councilmember Poe, seconded by Councilmember Cerino, that
the Committee approve amendment to the 1998 Design and Construction
Standards. Motion carried.
G. RIGHT-OF-WAY USE PERMIT 30-02, PIPE EXPERTS LLC, TO CLEAN AND
CCTV 133 SANITARY SEWER SYSTEM LOCATIONS
This item was transmitted to the Committee via Agenda Modification.
It was moved by Councilmember Poe, seconded by Councilmember Cerino, that
the Committee approve Right-of-way Use Permit 30-02.
III. ISSUES
A. RESOLUTION NO. 3502, INTERLOCAL AGREEMENT WITH THE
MUCKLESHOOT INDIAN TRIBE FOR OPERATION OF A TEMPORARY
SEWAGE LIFT STATION
Sewer Utility Engineer Roscoe discussed the schedule for a City project
proposed for this area. Chairman Wagner noted that most agreements with the
Tribe include language regarding waiver of sovereign immunity and suggested it
be added to this agreement.
It was moved by Councilmember Poe, seconded by Councilmember Cerino, that
the Committee recommend Council adopt Resolution No. 3502, provided
language is added to the agreement regarding waiver of sovereign immunity.
Motion carried.
B. ORDINANCE NO. 5684, DEVELOPMENT AGREEMENT BETWEEN THE CITY
OF AUBURN AND SAFEWAY, INC., FOR DEVELOPMENT OF SAFEWAY'S
DISTRIBUTION FACILITY
For the purpose of these minutes, this item was discussed after Consent Item E.
Director Engler explained that the ordinance was not ready for the Committee
meeting, but would be in the Council agenda packet. It was the consensus of the
Committee to concur with the memorandum from Director Engler, which outlined
the credits to the storm drainage System Development Charges (SDC). It was
noted that the language in the draft agreement as presented in the Committee's
packet would be revised to address the storm drainage SDC and reflect that

Safeway would be paying all ordinary monthly utilities (water, sewer, storm, and
solid waste). Tayloe Washburn distributed a revised agreement, and Director
Engler noted that it had not yet been reviewed by City staff.
Mr. Washburn presented a drawing of Safeway's proposed plan for
'C' Street SW, and thickness of overlay was discussed.
It was moved by Councilmember Poe, seconded by Councilmember Cerino, that
the Committee recommend Council adopt Ordinance No. 5684, provided
corrections are made to the agreement relative to monthly water, sewer, storm,
and solid waste charges. At the request of City Attorney Held, Chairman Wagner
amended the motion to reflect the Committee's recommendation to Council to
adopt whichever is appropriate, either an ordinance or resolution, approving the
Developer Agreement with Safeway. Motion carried.
IV. INFORMATION OR DISCUSSION
A. SANITARY SEWER MODEL -AUBURN WAY SOUTH
Sewer Utility Engineer Roscoe gave an update on the Sanitary Sewer Model. He
stated that the Right-of-way Use Permit 30-02, approved by Committee at this
meeting, would allow the County to identify causes of inflow and infiltration (l&l)
in the Academy area. The County has committed $1 million to reduce and
minimize I&l in this basin. Roscoe also discussed the need for moving forward
on the Auburn Way South sewer project that was shelved approximately two
years ago.
B. STORM DRAINAGE ClP RANKING
Storm Drainage Engineer Carlaw presented a map that indicated flooding
complaints over the last several years, along with 21 proposed storm projects.
At this time, the discussion on Storm Drainage ClP Ranking was paused to
address an issue raised by Brad Plemmons, representing Gaines Construction.

For the purpose of these minutes, discussion regarding the Storm Drainage CIP
Ranking resumed following the Executive Session.
The first 21 projects of the Storm Drainage CIP were discussed individually, with
the Committee making recommendations as to the priority of the projects.
Following discussion and receiving comments from the Committee, Cadaw
stated that he would revise the list of projects per Committee discussion, and
give the list to the consultant so that they could move forward with the Storm
Drainage Comprehensive Plan.

C. CAPITAL PROJECT STATUS REPORT
For the purpose of these minutes, this discussion took place after Other
Discussion.
Senior Project Engineer Gaub stated that the signal at the intersection of
'C' Street SW and West Main will be changed tomorrow to modify the order of
left-turn movements, which will improve traffic on Main Street. Chairman Wagner
expressed concern about signage related to the 3rd Street project. Gaub'
discussed the second tier of signage that was recently added, and stated that
completion of striping in the area will reduce confusion. She also stated that the
ribbon cutting is on schedule and will be held August 8.
In response to a question from Councilmember Poe, Gaub stated that progress
toward opening the roadway is continuing on the South 277th Street project.
The Committee called for Executive Session.
V. OTHER DISCUSSION
For the purpose of these minutes, this discussion took place after introductory
comments made regarding Information/Discussion Item B.
Brad Plemmons, representing Gaines Construction, discussed his concerns
regarding a street vacation that was initiated by Mr. Frank Gaines in May of 2001.
Staff discussed difficulties encountered determining ownership of the right-of-way to
be vacated, and stated that the street vacation request is in the process of being
circulated for comments so that a Staff Report can be developed prior to scheduling
a public hearing. City Attorney Held discussed the statutory process required for
street vacations, and the Committee acknowledged that the process could be
cumbersome. Mr. Plemmons stated concern that his building permit would expire
prior to the street vacation being brought to Council. Chairman Wagner requested
Director Engler to check with the Building Division to find out what is required to
keep the permit valid.
VI. EXECUTIVE SESSION
Executive session to discuss potential litigation convened at 9:04 a.m. and ended at
9:30 a.m.
VII.ADJOURNMENT
Prior to adjournment, Councilmember Poe asked about a recent memorandum
received from Assistant City Engineer/Utilities Duane Huskey regarding Wells 5A,
5B and 5C. Director Engler responded that the Mayor requested detailed
information concerning the supplemental water rights applications for Wells 5A, B
and C. The Mayor wished to communicate with the Muckleshoot Indian Tribe
concerning these applications and to ask that the Tribe not oppose the permits.

Councilmember Poe also commented on recent striping on 15th Street NW between
West Valley Highway and the bottom of the west hill. City Engineer Dowdy stated
that the City had gotten complaints from businesses in the area about people
parking on 15th Street, creating sight distance hazards for people exiting driveways
in that area. 15 th Street has been striped as four lanes, continuing all the way up the
hill on Terrace View, which seems to have slowed drivers down. Councilman Poe
mentioned that a kidney dialysis center is located in the area, and the only place a
truck and trailer driver could park was on 15th Street. He asked if it's not signed,
does the intermittent 4-lane striping legally preclude parking. Director Engler
answered yes, but stated she would check Auburn City Code to make sure there is
no conflict.
There being no further business to come before the Public Works Committee, the
meeting was adjourned at 10:35 a.m.
