MINUTES
I. CALL TO ORDER
The meeting was called to order at 5:00 p.m. Those in attendance were Committee Chairman Rich
Wagner, Council/Committee member Fred Poe, and Council/Committee member Gene Cerino.
Staff in attendance were Public Works Director Dennis Dowdy, City Engineer/Assistant Director
Dennis Selle, Assistant City Engineer Ingrid Gaub, Utilities Engineer Duane Huskey, Traffic
Engineer Laura Philpot, Project Engineer Brian Coleman, Project Engineer Bill Helbig, Project
Engineer Jennifer Dvorak, and Administrative Services Supervisor Pam Miller.
Guests in attendance were Nancy Backus and Bill Peloza.
II. CONSENT AGENDA
A. APPROVAL OF MINUTES
It was moved by Councilmember Poe, seconded by Councilmember Cerino, that the Committee
approve the Public Works Committee minutes for June 9, 2003, as submitted. Motion carried.
RIGHT-OF-WAY USE PERMIT 24-03, NORTHWEST RACING ASSOCIATES (EMERALD
DOWNS) FOR FIREWORKS DISPLAY
It was moved by Councilmember Poe, seconded by Councilmember Cerino, that the Committee
approve Right-of-Way Use Permit 24-03. Motion carried.
C. CONSULTANT AGREEMENT NO. AG-C-149 WITH ECS ENGINEERING FOR WORK
RELATED TO PROJECT NO. C313A, CONTROL SYSTEM REPROGRAMMING
In response to questions from the Committee, Utilities Engineer Huskey discussed the project
and responded that the work should be done by the end of the year.
It was moved by Councilmember Poe, seconded by Councilmember Cerino, that the Committee
recommend Council approve Consultant Agreement No. AG-C-149. Motion carried.
D. INITIATION OF PROJECT NO. C314A, WELL 4 - COAL CREEK SPRINGS EMERGENCY
CHLORINATION POWER IMPROVEMENT
Utilities Engineer Huskey explained that the project was in the 2003 budget; however, in the
mid-year budget adjustment, the project title was expanded.
It was moved by Councilmember Poe, seconded by Councilmember Cerino, that the Committee
approve initiation of Project No. C314A. Motion carried.
E. PERMISSION TO ADVERTISE PROJECT NO. C304A, K STREET SE STORM
IMPROVEMENTS
It was moved by Councilmember Poe, seconded by Councilmember Cerino, that the Committee
recommend Council approve advertisement of Project No. C304A. Motion carried.

F. PERMISSION TO ADVERTISE PROJECT NO. C302A, WEST VALLEY HIGHWAY
RECONSTRUCTION
It was moved by Councilmember Poe, seconded by Councilmember Cerino, that the Committee
recommend Council approve advertisement of Project No. C302A. Motion carried.
G. PERMISSION TO ADVERTISE PROJECT NO. C225A, ORAVETZ ROAD SLOPE REPAIR
AND GUARDRAIL
It was moved by Councilmember Poe, seconded by Councilmember Cerino, that the Committee
recommend Council approve advertisement of Project No. C225A. Motion carried.
SETTLEMENT AGREEMENT AND FINAL PAY ESTIMATE NO. 17 TO CONTRACT 01-04
WITH IMCO GENERAL CONSTRUCTION AND ACCEPT CONSTRUCTION OF PROJECT
NO. PR629, COAL CREEK SPRINGS AND FULMER FIELD CORROSION CONTROL
TREATMENT FACILITIES
This item was placed on the agenda via an agenda modification.
It was moved by Councilmember Poe, seconded by Councilmember Cerino, that the Committee
recommend Council approve the settlement agreement with IMCO General Construction and
Final Pay Estimate #17, and accept construction of Project No. PR629. Motion carried.
III. ISSUES
A. RESOLUTION NO. 3623 ADOPTING GUIDANCE BY THE AMERICAN ASSOCIATION OF
STATE HIGHWAY TRANSPORTATION OFFICIALS FOR CLEAR ZONE STANDARDS
Project Engineer Dvorak explained the relationship between adoption of the American
Association of State Highway Transportation Officials (AASHTO) clear zone standards and the
PSE franchise with the City. These standards are also a WSDOT requirement for the City's
Auburn Way South project, which is Federally funded. It was noted by Traffic Engineer Philpot
that the City has used these guidelines previously, but never formally adopted them.
Discussion was held on PSE poles in the right-of-way (ROW). For current and future projects,
PSE will have to move their poles that are in the existing ROW to conform with the AASHTO
clear zone guidelines. Traffic Engineer Philpot also pointed out that the City Engineer has the
authority to decide on variances and would be able to grant deviations from the AASHTO
guidelines. The current City Code also sets forth an appeal process for a decision of the City
Engineer.
It was moved by Councilmember Poe, seconded by Councilmember Wagner, that the
Committee recommend Council adopt Resolution No. 3623. Motion carried.
IV. DISCUSSION AND INFORMATION
A. WATER RIGHTS LEGISLATIVE UPDATE FOR 2003
Utilities Engineer Huskey distributed a memo outlining three bills that were recently approved by
the Legislature: 2E2SHB 1338, which reforms municipal water law; ESSB 5028, which bars the
State from using water quality laws to restrict use of a water right, and substantially increases
penalties for wasting water; and 2E2SHB 1336, which authorizes grant funding and provides

guidance for implementation of watershed plans. Governor Locke has said that he intends to
sign all three bills.
Attached to the memo was an overview of SHB 1338, Municipal Water Rights Bill, which
Utilities Engineer Huskey reviewed for the Committee.
B. CAPITAL PROJECT STATUS REPORT
The following projects were briefly discussed:
#11, 41 St SE to A St SE Capacity Improvements. Assistant City Engineer Gaub explained that
the King County Assessor's map showed part of the property as belonging to the Storm Utility;
however, it has been discovered that it is actually BNSF property. BNSF has indicated verbally
that they are willing to surplus the property to the City, and the City is currently waiting for a
letter to confirm this. It is not expected that acquiring the right-of-way will significantly affect the
project budget.
#20, A Street SW Loop. In response to a question regarding why the project won't be
advertised until January 2004, if design is at 90%, Assistant City Engineer Gaub responded that
the project is at 90% design because it was designed as part of the 3rd Street SW project. The
project has a January advertisement date because the City is still in the process of obligating
the Federal funds, and due to staff workload to get other projects to construction this year.
Thus far, staff have not had comments from commuters regarding traffic problems in the area.
There has been traffic backed up on 2® Street that may be alleviated by the loop.
Chairman Wagner asked about an undergrounding project being done at 12th and Auburn Way
South. Traffic Engineer Philpot responded that the work is being done by the phone company,
and the City's inspection staff has worked with the contractor to make sure work is not
underway during peak times for amphitheater traffic. The next concert scheduled at the
amphitheater is on July 12.
Chairman Wagner also inquired about a project at 37th Street NE, north of Emerald Downs.
Director Dowdy stated that staff would look into it and report back to the Committee via e-mail.
Director Dowdy also reported that he will be on vacation from June 30 through July 11,
returning to the office on July 14. During that time, Dennis Selle will be Acting Director.
V. ADJOURNMENT
There being no further business to come before the Public Works Committee, the meeting was
adjourned at 5:40 p.m.
