The meeting was cal led to order by Mayor Shaughnessy. Counci Imen present: Counci Iman absent: Lea, Kammeyer, Fitzsimmons, Sonnemann, Knechtel, and Gaines. Aaby. Minutes of the previous meeting held January 7, 1963 were approved as mai led. No. 140, 141, 142 and 143, was submitted to the Counci I for approval. It was moved by Kammeyer and seconded by Gaines that a Public Hearing be cal led for 8 p. m. February 18, 1963 on assessment rolls for Local Improvement Districts 140, 141, 142, and 143. MOTION CARRIED REQUEST PERMISSION FOR CHIMES IN CHURCH A letter received from the White River United Presbyterian Church requested permission from the City Counci I to instal I cari lion chimes in their Church at 526 12th Street Southeast. It was moved by Fitzsimmons and seconded by Lea that the Counci I grant permission to the White River United Presbyterian Church to instal I and use the chimes referred to in their letter. MOT I ON CARR I ED PLANNING COMMISSION REPORT MIKE A BETSCHART PETITION TO REZONE The Planning Commission recommended the approval of the request of Mike A. Betschart to rezone from A-I to M-I property described as the South 1266.5 feet of the West 461.5 feet of the H. C. Jones Donation Claim Number 39. Tax Lot I I, Section 6-21-5. It was moved by Kammeyer and seconded by Sonnemann that the Counci I concur with the recommendation of the Planning Commission to approve the request of Mike A Betschart to rezone from A-I to M-I the above described property. MOTION CARRIED DAVID MORGAN PETITION TO REZONE The Planning Commission recommended the denial of the request of David Morgan to rezone from R-2 to a Special Property Use property described as the East 94 feet of the North 165 feet of the West 660 feet of the Southwest quarter of the Southeast quarter, Section 19, Township 21, Range 5, E.W.M. less roads. It was moved by Fitzsimmons and seconded by Kammeyer that the Counci I concur with the recommendation of the Planning Commission. MOTION CARRIED 6, " AUBURN, WASHINGTON MONDAY JANUARY 21. Gregg to rezone from R-2 to a Special Property Use on property described as Lots 13, 14, and 5, Block B. French's Addition to the Town of Slaughter, King County, Washington wi 1/ be continued by the Auburn Planning Commission until the next Planning Commission Meeting. ~ ~ SIGNS FOR POST OFFICE BUILDING A letter from Ben L. Morse, Acting Postmaster, Auburn, Washington, requested the I City place several signs in the City to direct patrons to the new post office building which wi II be in operation soon. Councilman Lea reported that the Street Department was working on these signs at the present time. QUARTERLY REPORT OF POLICE JUDGE ZANE B. JOHNSON The quarterly report of Police Judge Zane B. Johnson was received by the Council for the period of October, 1962 through December, 1962. The total turned into the City Treasurer for the three month period was $15296.25. L.I.D. 6/40 COMPLETED A letter from Clinton Cote', City Engineer, reported that R. L. Moss Construction Company had completed "R" Street S.E.; "J" Street S.L & 2nd Street S.E., L.I.D. 6140 according to terms of their contract with the City of Auburn. The retained percentage is now due and payable according to the law governing Municipal Contracts. It recommended that siad retained percentage be paid to the above firm and any surety or bond be returned for cancellation. It was moved by Lea and seconded by Sonnemann that R. L. Moss Construction Company be paid the retained percentage on L.I .0. 6140 and any surety or bond be returned for cancellation. I MOTION CARRIED ANNUAL REPORT OF WATER DEPARTMENT FOR THE YEAR 1962 The Annual Report of the Water Department was presented to the Counci I for the year 1962. AUDIENCE None COMMITTEE REPORTS PURCHASING COMMITTEE .. It was moved by Sonnemann and seconded by Kammeyer that the City Clerk be instructed to call for bids on the purchase of radio equipment for the City. Specifications to be picked up at the Office of the City Clerk. Bids to be opened at 4 p. m. February 4, 1963. MOTION CARRIED FIRE COMMITTEE No Report LICENSE COMMITTEE I No Report STREET COMMITTEE No Report WATER COMMITTEE No Report AUBURN, WASHINGTON MONDAY 7 JANUARY 21, 1963 LIGHT COMMITTEE It was moved by Gaines and seconded by Fitzsimmons that 6000 lumen Lights be instal led at 21st & H Street and 21st & K Street. MOTION CARRIED Counci Iman Gaines reported that Mr. McMasters, of the Muckleshoot Trai ler Park, had requested the City Enter into a contract with him in order that he be able to get some I ighting on his property. He would pay the City of Auburn $33.00 per light a year in advance. At the present time this is the only way he can get lighting on his property as Puget Sound Power & light do not have a set-up for services of this type. I It was moved by Gaines and seconded by Sonnemann that the City Attorney be instructed to draw up an agreement between the City of Auburn & Mr. McMasters with the approval of Puget Sound Power & Light for lighting in the Muckleshoot Trai ler Park, this contract to be presented to the Council for approval at the next Counci I Meeting. MOTION CARRIED POLICE COMMITTEE No Report WATER SUPERINTENDENT No Report STREET SUPERINTENDENT No Report CITY ENGINEER No Report PLANNING DIRECTOR I George Schuler, Planning Director, reported that several annexations to the City are being worked on at the present time. These annexations wi I I help to even up the boundries of the City. Counci Iman Gaines asked George Schuler what new developments there were on the Central Business District Plan. George Schuler, Planning Director, reported that another meeting would be held for a final signature drive on the Central Business District Plan. PARK SUPERINTENDENT No Report ORDINANCE NO. 1583 It was moved by Kammeyer and seconded by Knechtel that Ordinance No. 1583 entitled, "AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, AMENDING SECTION 10.08.320 OF THE CITY OF AUBURN C09E, SAID SECTION 10.08.320 RELATING TO THE TIME FOR PAYMENT OF WATER SERVICE CHARGES FOR All CLASSES OF WATER USERS WITHIN THE CORPORATE LIMITS OF THE CITY OF AUBURN, PURSUANT TO SECTION 32 OF ORDINANCE NO. 1366 OF THE CITY OF AUBURN.", be introduced and adopted, with the fol lowing rol I cal I vote being recorded: Lea, yes; Kammeyer, yes; Fitzsimmons, yes; Sonnemann, yes; Knechtel, yes; and Gaines, yes. MOTION CARRIED I ORDINANCE NO. 1584 It was moved by Sonnemann and seconded by Knechtel that Ordinance No. 1584 entitled, "AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR THE REZONING OF CERTAIN PROPERTY IN THE CITY OF AUBURN, CHANGING THE ZONING CLASS OF SAID PROPERTY FROM A-I TO M-I." be introduced and adopted, with the fol lowing rol I cal I vote being recorded: leal:yes; Kammeyer, yes; Fitzsimmons, yes; Sonnemann, yes; Knechtel, yes; and Gaines, yes. MOTION CARRIED 8 AUBURN, WASHINGTON MONDAY JANUARY 21, 1963 Robert Smythe, City Attorney, reported to the Counci I that he had finished briefing an opinion of the moving of houses into area where the adjoining property owners were in opposition to it. He said that, if the houses that were moved in were in accordance with the zoning and bui Iding codes of the City, there was no legal way the City could prevent these homes from being moved into the area. The only way that houses could be kept out of an area would be if there were some Civi I Restriction. l\;J o f-(' --. '-- ,~] It was moved by Kammeyer and seconded by Fitzsimmons that in view of the information given by the City Attorney, the Counci I instruct the Engineering Department to issue any Permits for the moving of houses as long as they are in conformity with the Zoning and Building codes of the City of Auburn. QUIT CLAIM DEED I Robert Smythe, City Attorney, reported that he had a quit claim deed from the Catholic Archbishop of Seattle for Street purposes. This quit claim deed wi I I give the City additional right of way on 17th Street Southeast. It was moved by Gaines and seconded by Knechtel that the City Attorney be instructed to record the quit claim deed for right of way on 17th Street Southeast MOTION CARRIED EASEMENTS FOR RIGHT OF WAY PURPOSES Robert Smythe, City Attorney, reported that he had two easements for right of way purposes for the Sewer trunk line. The first easement from Olga A Peterson and Edith Peterson wi I I cover the West 10 feet of property described as that portion of the W~ of N. E. ~ of S. W. ~ of N. E. ~ lying east of County Road EXCEPT the N283.09 feet and EXCEPT the S 50.0 feet al I located in Section 19, Township 21 N, Range 5 E. W. M. The second easement is from Charlott R. Nelson and wi I I cover the West 10 feet of property described as the N 283.09 feet of the W~ of N. E. ~ of the S. W. ~ of the N. E. ~ located in Section 19, Township 21 N, Range 5 E. W. M. In return for these easements, the people involved wi I I be exempt from any assessments in relation to the Sewer Project. It was moved by Kammeyer and seconded by Gaines that the City Clerk and Mayor be authorized to sign the easements with Olga A Peterson, Edith Peterson and Charlott R. Nelson exempting them from any assessments in relation to the Sewer Project. I MOTION CARRIED ANNUAL REPORT OF CITY ATTORNEY The annual report of the City Attorney was presented to the Council for the year 1962. Robert Smythe, City Attorney, reported that most of the Police Court cases were offenses of drunk driving. He said the new court hàd jurisdiction to fine up to $500.00 and give a penalty of 6 months in jai on cases of drunk driving. He said that the City shoud look into revising their own City Ordinance so that it would comply more closely with the jurisdiction of the court. Mayor Shaughnessy instructed the City Attorney and Police Committee to look into the above mentioned matter. OLD BUSINESS None CLAIMS I It was moved by Sonnemann and seconded by Kammeyer that the fol lowing claims against the City, al I having previously been passed and signed by the Purchasing Committee, be approved and the City Clerk be authorized to draw warrants in payment.
