HomeMy WebLinkAbout03-04-1963 21 AUBURN, WASHINGTON MONDAY MARCH 4, 1963 Regular meeting of the City Counci I of the City of Auburn, held at 8:00 p. m. in the Counci I Chambers at the City Hal I. The meeting was cal led to order by Mayor Shaughnessy. Councilmen present: Aaby, Lea, Kammeyer, Fitzsimmons, Sonnemann, Knechtel, and Gaines. Munutes of the previous meeting held February 18, 1963 were approved as mai led. PUBLIC HEARING ON IRA GREGG'S PETITION TO REZONE I The Mayor declared public hearing on Ira Gregg's Petition for a Special Property use open. He stated that due to provisions of the present Zoning Ordinance the city was not in a position to consider the granting of a special property use at this time. LETTER AGAINST THE GRANTING OF A SPECIAL PROPERTY USE ON PROPERTY OWNED BY IRA A. GREGG A letter from Burton C. Waldo, Attorney for Mr. and Mrs. Cas Adair, informed the counci I that after carefully examing the City of Auburn's Zoning Ordinance No. 1428 they were unable to find any provision therein authorizing the granting of the Special Property use sought by Mr. Gregg. SUGGESTED Ah\ENDMENTS TO ZONING ORDINANCE George Schuler, Planning Director, submitted, for consideration by the Counci I, a letter containing suggestions for a number of amendments !o Zoning Ordinance No. 1428, which the Planning and Bui Iding Department felt were necessary for more precise control of a number of sections of our Zoning Ordinance. They felt that the proposed amendments were necessary for the overal I development of the City of Auburn. LUTHER C. MARTIN, ATTORNEY, SPOKE IN FAVOR OF GRANTING A SPECIAL PROPERTY USE FOR IRA GREGG Luther C. Martin, Attorney, spoke in behalf of Ira Gregg on the proposed granting of I a special property use for land described as Lots 13, 14, and 5, Block B, French's Addition to the Town of Slaughter. He submitted to the Counci I plans for a nineteen unit two bedroom apartment bui Iding to be placed on the above described property if a Special Property use is granted. Burton C. Waldo was present to represent those opposing granting of petition. It was moved by Gaines and seconded by Fitzsimmons that the public hearing on Ira Gregg's petition to rezone be closed. MOTION CARRIED It was moved by Fitzsimmons and seconded by Kammeyer that the petition for a Special property use on Ira Gregg's property be denied as the City cannot legally grant a Special Property use under the present zoning laws for the City of Auburn. ~OTION CARRIED It was moved by Fitzsimmons and seconded by Kammeyer that the Planning Director's recommended amendments to the zoning Ordinance of the City of Auburn be turned over to the Planning Commission for consideration. MOTION CARRIED It was moved by Gaines and seconded by Knechtel that the Counci I expedite the matter. MOTION CARRIED I CORRESPONDENCE PETITION TO REZONE PROPERTY OWNED BY CHARLOTTE R. NELSON A petition from Charlotte R. Nelson requested the rezoning of property described as the West 10 feet of the N 283.09 feet of the W! of N. E. ~ of the S. W. ! of the N. E. ! located in Section 19, Township 21 N, Range 5 E. W. M. from R-3 to C-I with Special Property use for Recreational Purposes. This petition was signed by two owners of property lying within a 200 foot radius of the above described property, stating they have no objections to the proposed zoning. Thor, Chairman, Advisory Board Edward James Chapter Order of DeMolay, requested permission be granted them to take possession of City Offices, in mock, for Tuesday, P. M. March 19, 1963. It was moved by Aaby and seconded by Lea that the request of Edward James Chapter Order of De^~lay be granted for Tuesday, March 19, 1963 from 2:00 p. m. until 4:00 p. m. MOT I ON CARR I ED I OREN K. SROUFE COMPLAINr Oren K. Sroufe entered a complaint as to the condition in which their property at 2711 "R" Street Southeast was left following the resurfacing of uR" Street last summer. Counci Iman Lea said that this matter had been taken care of by the Street Department. MONTHLY REPORT OF MUNICIPAL COURT The monthly report of the Municipal Court was presented to the Counci I, showing that $3,197.25 was turned into the City Treasurer for the month of February. WORK ON L. I. D. #142, 143, & 146 A letter from Tom E. Bolton, Water Superintendent, certified that the work had been completed on L. I. D. #142, 143, and 146 and recommended acceptance of these projects. He also recommended that the fifteen percent retained on L. I. D. 142, 143, and 146 be paid Glenn Rockey in the amount of $1189.77. It was moved by Kammeyer and seconded by Fitzsimmons that Glenn Rockey Construction Co. be paid $1189.77 which was the 15% retained on L. I. D. #142, 143, and 146. MOT I ON CARR I ED I ADDITIONAL HELP FOR CITY ATTORNEY A letter from Luther C. Martin made the suggestion that additional help be given the City Attorney as the burdens of this job were becoming too great. Mayor Shaughnessy referred this matter to the Finance Committee and Counci Iman Aaby with request to report back at the next Counci I meeting. ANNUAL REPORT OF THE STREET SUPERINTENDENT The annual report of the Street Superintendent was submitted to the Counci I. PROGRESS ESTIMATE #1 SEWAGE IMPROVEMENT PROJECT SCHEDULE I I - POND GRADING Richard E. Wolff, Consulting Engineer, submitted progress estimate #1 of Sewage Improvement Project Schedule I I - Pond Grading to the Counci I. The estimate showed amount due W. A. McConnachie, for work done on the project, $6,702.49. It was moved by Kammeyer and seconded by Gaines that W. A. McConnachie be paid $6,702.49 as specified in Progress Estimate #1, as submitted to the Counci I by Richard E. Wolff, Consulting Engineer. It was moved by Kammeyer and seconded by Gaines that Glenn Rockey Construction Company be paid $970.56 amount due for work done on L. I. D. #144. He said the Beautification Committee had taken no action on this matter as yet. WATER COINv\1 TTEE Counci Iman Kammeyer presented two right-of-way easements, for the construction, operation and maintenance of a trunk sewer line on property owned by John W. Greggs and property owned by Elnora E. Overturf. It was moved by Kammeyer and seconded by Knechtel that the Mayor and City Clerk be authorized to sign the right-of-way easements with John W. Greggs and Elnora E. Overturf. MOTION CARRIED LI GHT COMMI TTEE It was moved by Gaines and seconded by Fitzsimmons that a 6000 Lumen Light be instal led at 501 26th Street Southeast, and that the five lights in front of the Auburn High School be changed to Lumen Mercury Vapor. MOTION CARRIED POL ICE COM\\I TTEE Counci Iman Sonnemann reported that the Police Committee had met with Chief Darby and Archie Fry, Architect in regard to additional jail facilities. It was moved by Sonnemann and seconded by Lea that the City Clerk be instructed to cal I for bids on the construction of an addition to the police and jai I faci Ii ties, bids to be opened at 4 p. m. Wednesday, March 27, 1963, blue prints and specifications to be obtained from the office of Archie Fry, Architect, and each bid to be accompanied by a certified check or bid bond equal to five precent of the bid price. MOT I ON CARR I ED OLD BUSINESS TREE TOPPING IN PIONEER CEMETERY The matter of topping trees in the pioneer cemetery was discussed. It was moved by Aaby and seconded by Sonnemann that the Counci I postpone making a decision on bid for the topping of trees in the pioneer cemetery pending further estimates. MOTION CARRIED I CITY HALL PARKING LOT It was moved by Kammeyer and seconded by Aaby that the City Clerk and Mayor be authorized to sign an agreement with Ed Ester for the rent of property next to the City Hal I for parking lot purposes. MOT I ON CARR I ED REPORT ON TRAFFIC COURT CONFERENCE Bob Smythe, City Attorney, thanked the Counci I for giving him the opportunity to attend the Traffic Court Conference in San Francisco, as he felt he would more fully benefit the city after having attended this conference. HAUGE PROPERTY It was moved by Gaines and seconded by Knechtel that Mr. Hauge be given a thirty day notice to vacate the property on Main Street, which was purchased from him by the city. MOTION CARR I ED CLAIMS I It was moved by Fitzsimmons and seconded by Kammeyer that the fol lowing claims against the City, al I having previously been passed and signed by the Purchasing Committee, be approved and the City Clerk be authorized to draw warrants in payment.
