The meeting was cal led to order by Mayor Shaughnessy. Counci Imen present: Aaby, Lea, Kammeyer, Fitzsimmons, Sonnemann, Knechtel, and Gaines. Minutes of the previous meeting held March 4, 1963 were approved as mai led, with correction as fol lows: Melvin Buel, not Burton Waldo, was present to represent those I opposing granting of Ira Greggs petition. CORRESPONDENCE FINAL PAYMENT ON L. I. D. #144 A letter from Tom E. Bolton certified that work had been completed on L. I. D. #144, and recommended the 15% retained amounting to $406.33 withheld on contract. The fol lowing rol I cal I vote was recorded: Aaby, yes; Lea, yes; Kammeyer, yes; Fitzsimmones, yes; Sonnemann, yes; Knechtel, yes; and Gaines, yes. MOT I ON CARR I ED WERNER v. CITY OF AUBURN A letter from Hugh R. McGough informed City Attorney Smythe that the case of Werner v. City of Auburn had been settled by payment of $1500.00 to the plaintiffs. PETITION FOR L. I. D. A petition signed by eleven property owners requested the Counci I create an L. I. D. on Fi fth Street, Northeast, east of "H" Street, Northeast to the Auburn Ci ty Park for the construction of Asphaltic Concrete paving to a width of thirty-four (341) feet and Standard Curb and Gutter and necessary catch basins and inlets to be connected to existing storm sewer. I A letter from Clinton W. Cote' certified that 68.07% of the benefitted property owners in favor of the proposed improvement had signed the petition. It was moved by Lea and seconded by Knechtel that the City Attorney be instructed to draw up the necessary Ordinance to implement the L. I. D. MOT I ON CARR I ED PETITION TO REZONE FRANK COVELLO A petition to rezone property located at M Street Southeast and described as So. 100' of Lots 25 and 26, East Auburn Acres from R3 to R4 was presented to the Counci I by Frank Covello. The petition was signed by six owners of property lying within a 200 foot radius of the above described property, stating they have no objections to the proposed zoning. The petition was referred to the Planning Commission. PETITION TO REZONE ESTELLA MAHN A petition to rezone property located at the Southeast corner of 9th & C Street Southeast from R-3 to C-I was presented to the Counci I by Estella Mahn. The petition was signed by eleven owners of property lying within a 200 foot radius, stating they have no I objections to the proposed zoning. The petition was referred to the Planning Commission. PETITION TO REZONE BLANCHE N.. COLE A petition to rezone property located at 1155 Enumclaw Highway from R-3 to C-3 was presented to the Counci I by Blanche M. Cole. The petition was signed by eleven owners of property lying within a 200 foot radius of the property, stating they have no objections to the proposed zoning. The petition was referred to the Planning Commission. 2~< AUBURN, WASHINGTON MONDAY MARCH 18, 1963 PLANNING COMMISSION REPORT ON PUBLIC HEARING fAARCH 15, 1963 DAVID MORGAN PETITION TO REZONE ~ ~ - ~ t:=: l) A letter from the Planning Commission recommended the approval of the petition of David fAorgan to rezone from R-3 to C-I on property described as Lots 13 & 14, Block I, Walnut Lawn Addition to Auburn. It was moved by Lea and seconded by Gaines that the Counci I concur with the Planning Commission recommendation. MOTION CARRIED I WHITE RIVER BUDDHIST CHRUCH PETITION TO REZONE The Planning Commission recommended the approval of the petition of the White River Buddhist Church to rezone from A-I to a Special Property Use for Church purposes property described as the North 270.60 feet of the fol lowing described tract; City of Auburn. Beginning at the Southwest corner of the H. H. Jones Donation Land Claim, thence East 1518 feet thence North 445 feet, thence West 12 feet, thence North 1842.56 feet, more or less, to the North line of the South half of the D. L. C.: thence West to a point 808.5 feet East of the West line of the D. L. C.; thence South 541.2 feet, thence West 347.0 feet; thence South 1716.6 feet, thence West 461.5 feet; thence South 30 feet to the point of þeginning. Less State Road. It was moved by Sonnemann and seconded by Kammeyer that the Counci I concur with the recommendation of the Planning Commission. MOT I ON CARR I ED PLANNING COMMISSION REPORT ON PUBLIC HEARING MARCH 18, 1963 The Planning Commission recommended the approval of the fol lowing amendments to Zoning Ordinance 1428: Article 4, Section 7, Item B-Ia, Paragraph 7, Paragraph 8; Article 4, Section 7, Note I, Item 14; Article 4, Section 7-B-2a; Article 5, Section 7, Note 9, Sub-paragraph E; Article 5, Section 7, Note 9, Sub-paragraph A.; Article 4, Section 7, B-4-b; Article 4, Section 7, B-1 I, with correction of Article 4, Section 7, I Item B-Ia, Paragraph 8 of the above amendments as fol lows: Swimming pools of a permanent type shal I be considered as an accessory bui Iding and shall be located no closer to the side lot lines than the required side yard set back for the main bui Iding for the district in which it is located. (Addition of main bui Iding) Every permanent outdoor swimming pool shal I be surrounded by a fence or wal I of not less than forty-two inches in height, which shall be constructed as non-climbable, (addition of non-climbable). City Attorney Smythe stated that in his opinion some changes should be made in the recommended amendment Article 5, Section 7, Note 9, Sub-paragraph E to insure its legality. It was moved by Gaines and seconded by Lea that the Counci I concur with the Planning Commissions recommendation on the above amendments to Zoning Ordinance 1428, with the provision that a special committee be appointed to work with the City Attorney on changes to Article 5, Section 7, Note 9, Sub-paragraph E necessary to insure its legality. MOTION CARRIED Mayor Shaughnessy appointed the Purchasing Committee and Bob Gaines with power to act to work with the City Attorney on the changes necessary in Article 5, Section 7, Note 9, Sub-paragraph E. It was moved by Gaines and seconded by Kammeyer that the Purchasing Committee and Bob Gaines with power to act be authorized to bring an Ordinance to the next Counci I meeting for consideration on the amendments to Zoning Ordinance No. 1428. MOTION CARRIED I COMMITTEE REPORTS PURCHASING COMMITTEE Counci Iman Aaby reported that the radios have arrived. FIRE COfyWd TTEE Counci Iman Knechtel read a letter from Chief Calkins requesting that his captains and he be granted permission to attend a Command School held at Yakima, Apri I 1-4. It was moved by Knechtel and seconded by Gaines that the Fire Chief and his captains be granted permission to attend this school in Yakima, Apri I 1-4. MOTION CARRIED 29' AUBURN, WASHINGTON MONDAY MARCH 18, 1963 LICENSE COMMITTEE No Report STREET COMMITTEE It was moved by Lea and seconded by Fitzsimmons that the City Clerk be instructed to cal I for bids on a Highway Mower for the Street Department. Bids to be opened on Apri I I, 1963 at 4 p. m. in the Counci 1 Chambers at the City Hal I. AI I bids must be on a firm bid I basis. Specifications to be picked up in the office of the City Clerk. MOTION CARRIED WATER COMMITTEE Counci !man Kammeyer reported that the Water Committee with the Water Superintendent had met with Richard E. Wolff, Consulting Engineer on plans for the trunk sewer line, and these plans had been approved and were now out for bids. He said that curb & gutter, concrete paving and the replacing of some I sidewalks had been completed on "0" Street between Main Street & 2nd, and IIA" Street Northeast between 2nd and 3rd Street had been widened to 39' and curb and gutter had been i ns t a I I ed . MOT I ON CARR I ED AUBURN, WASH I NGTON MONDAY MARCH 18, 1963 M1 30-A OLD BUSINESS ADDITIONAL HELP FOR CITY ATTORNEY Counci Imðn Sonnemann reported that the Finance Committee with Counci Iman Aaby had met in regard to supplying the City Attorney with additional help, and Ordinance No. 1600 was the outcome of that meeting. NEW BUSINESS SURVEY SITE FOR AIRPORT Counci Iman Gaines reported that he had conferred with the General Services Administration lin regard to acquiring the property on C?treet Southwest INhich has been occupied by tracks, for the purpose of establishing a City owned airport there. --- It was moved by Gaines and seconded by Fitzsimmons that the City Attorney be instructed to submit a new survey site for an Auburn airport to the F. A. A. MOT I ON CARR I ED It was moved by Gaines and seconded by Fitzsimmons that the City Attorney be instructed to look into the feasibi lity of acquiring this property. MOT I ON CARR I ED MEMBERS OF DE MOLAY GREETED fÂayor Shaughnessy greeted the members of the DeMolay who were attending the Counci I Meeting. PLANNING DIRECTOR Planning Director, George Schuler, reported that Clinton W. Cote', City Engineer, and he had attended a meeting of the Park Board, Y. M. C. A., and Library Board. OFF-STREET PARKING George Schuler, Planning Director, reported that a meeting wi' I be held on the Off- .Istreet Parking project Monday night. He said that a new proposal wi I I be presented to the group in the hope that a plan can be found which wi I I suit al I the people concerned. CITY ENGINEER REPORTED ON L. I. D.s City Engineer, Clinton W. Cote', reported that the new L. I. D.s would be put out for bid together, as this would help to lower the contract prices. COMPLA I NT AGA I NST "NA TER ON SIDEWALK IN FRONT OF JACK SPRINGER'S OFFICE Counci Iman Knechtel reported that he had received a complaint in regard to a hole in the sidewalk in front of Jack Spnenger1s office which was reported to be fi I led with water. The complaint came from a person who had fa'len at this location. This matter was referred to the Bui Iding Inspector.
