PUBLIC HEARING ON VACATION OF STREETS & AllEYS The Mayor declared public hearing open on the request of Tradewél I Stores, Inc., to vacate al I streets and alleys lying within those portions of Government lot 4, Section I 18, Township 21 North, Range 5 East, \V.M., and of River View Addition to Auburn, Volume 9 of Plats, page 10, in King County, Washington, lying northerly of the northerly line of the right-of-way of Northern Pacific Rai Iway Company; southerly of the southerly line of Cross Street; westerly of the westerly line of C Street S.E.' and easterly line of A Street S.E., al I within the City ôf Auburn; EXCEPT: (a) The al ley area generally described as the south 100 feet of the north 150 feet of the east 15 feet of the west 165 feet of said Government Lot 4. (b) That portion of 4th Street S.E. generally described as lying within the westerly 165 feet of said Government Lot 4. (c) Such easements of record within said streets and alleys as may be necessary to serve areas outside of the area described aforesaid. It was moved by Aaby and seconded by Kammeyer that the public hearing on the vacation of streets and alleys aforesaid mentioned be closed, and the City Attorney be instructed to draw up the necessary Ordinance to implement the vacation of these streets & alleys. GARRISON A petition from Ethel M. Garrison requested the rezoning of property located at 1820 "E" Sfreet Southeast from R-2 to R-4. The petition was signed by twelve owners of property lying within a 200 foot radius of the property stating they have no objections to the proposed zoning. This petition was referred to the Planning Commission. I PETITION FOR STREET LIGHTS ON "0" STREET S.E. A petition signed by twelve persons residing on "0" Street Southeast requested the installation of an additional street light on "0" Street S.E., between 2nd and 4th Streets Southeast. This petition was referred to the Light Committee. ClA I M FOR DANiAGES MRS. BERTHA C. SCHWENDER A claim for damages against the City of Auburn in the amount of $81.00. fi led Apr i I 5, 1963, by f¡'¡rs. Ser t ha C. Schwender was read. This claim was referred to the City's liaói lity Insurance Company. COMPLAINT AGAINST HORSES IN CITY A letter from C. W. Radtke informed the Counci I that horses were being kept immediately west of "H" Street Northeast at the intersection of 7th SI-reet Northeast, and that he objected to animals of this dimension being kept within the City. This letter was referred to the Bui Iding Inspector. MONTHLY REPORT OF MUNICIPAL COURT I The monthly report of the Municipal Court was presented to the Counci I by George Fiori, Jr., Judge, Auburn Municipal Court, showing the total to City Treasurer of $3,562.50. PLANNING COfN^ISSION REPORT ON PUBLIC HEARING HELD APRil 12, 1963 ESTEllA MAHN PETITION TO REZONE The Planning Commission recommended the approval of Estell Mahn's petition to rezone lots 3 & 4, Block I, Hartman's First Addition from R-3 to C-I. It was moved by Kammeyer and seconded by Aaby that the Counci I concur with the recommendation of the Planning Commission. MOTION CARRIED CHARLOTTE R. NELSON PETITION TO REZONE The Planning Commission voted to hold in abeyance, the petition of Charlotte R. Nelson to rezone the N 283.09' of the West ~ of the Northeast ~ of the Southwest ~ of the Northeast ¡~ locai"ed in Section 19, Township 21 North, Range 5, EViN'. from R-3 to C-I, for further study. PETITION OF MARK CAVELlO I It was moved by lea and seconded by Kammeyer that the Counci I concur with the recommendation of the Planning Commission. MOT ION CARR I ED PETITION TO REZONE - BLANCH M. COLE The Planning Commission recommended the approval of Blanch M. Cole's petition to rezone al I that portion of Gov. Lot 6 lying Southwesterly of the Enumclaw- Auburn Road, in Section 19, Township 21, North, Range 5 EVlM. from R-3 to C-3. MOT I ON CARR I ED 4~2 AUBURN, WASHINGTON MONDAY APR I L 15, 1963 PETITION TO REZONE - IRA GREGG "''''' ,",,- ~ -- ~ t::;. 1"""] The Planning Commission's recommendation was as fol lows: The Auburn Planning Commission recommends to the City Counci I that the Planning Commission has reconsidered the request of the City Counci I of Mr. Gregg's petition to rezone from R-2 to R-4 and recommends that the R-4 zoning be granted and that the covenant submitted by Mr. Gregg be made a part of the bui Iding permit and that said covenant be recorded. A covenant to City of Auburn signed by Ira F. Gregg & Helen Gregg certified the signers agreement to construct said apartment of Masonry or brick veneer according to architect's plan on fi Ie with City of Auburn designated as alternate plan or plan #2. Cas Adair objected to the Counci I taking action on this rezoning as he was not notified of a public hearing on same. I Robert Smythe, City Attorney, said his recommendation was that a new petition to rezone should have been resubmitted to the Planning Commission, which would have cal led for a public hearing. It was moved by Gaines and seconded by Knechtel that the Counci I concur with the Planning Commission's recommendation. It was moved by Knechtel and seconded by Gaines that the request of be granted subject to the approval of Ken Calkins, Fire Chief. H. I MOTION CARRIED CITY ENGINEER No Report PLANNING DIRECTOR No Report POLICE CHIEF No Report FIRE CHIEF Chief Calkins stated he felt a few points should be cleared up in regard to the H. Johnson request to erect a tent for sales purposes before a permit could be issued; particularly in regard to issuance of a bui Iding permit; assurance as to length of time tent would be used and whether surrounding residents had been contacted for permission. I Mr. Johnson stated the tent was to be a 40 by 80 foot fire proof tent to be erected on black topped area which wi I I eventually be the parking area for the new store; that lighting wi 1 I be in accordance with Fire Dept's. requirements; that a 24 hour guard would be kept at the tent and that he was confident the new bui Iding would be ready within the 120 days requested. He also stated he had just received the architect's drawings but had no price estimates as yet. BUS I NESS VALLEY PLANNING CONMISSION Mayor Shaughnessy reported the organization of the new Val ley Planning Commission (former Valley Industrial Commission) had been practically accompl ished. The group would function as a self-governing group with up to six representatives from each city instead of the limitation of two first contemplated. Mayor Shaughnessy requested an opinion of the City Counci I in regard to the new group. It was moved by Aaby, seconded by Kammeyer that the Counci I go on record sanctioning the new Valley Planning Commission as outlined by the Mayor. MOTION CARRIED HAUGE PROPERTY Counci Iman Gaines asked what procedure should be taken in regard to having Hauge vacate the property on fAain Street, now that the thirty day notice time has elapsed. I City Attorney, Smythe, informed the Counci I that an unlawful retainer action should now be instituted. It was moved by Gaines and seconded by Knechtel that the City Attorney be authorized to institute an unlawful retainer action.
