WASHINGTON MONDAY NOVEMBER 18. 1963 ~~) C:',~ Regular meeting of the City Council of the City of Auburn, held at 8:00 p. m. in the Counci I Chambers at the City Hall. The meeting was called to order by Mayor Shaughnessy. Councilmen present: Aaby, lea, Kammeyer, Fitzsimmons, Sonnemann, Hough, and Gaines. Elisabeth Heritage, City Clerk, noted a correction in the mailed copies of the November 4, 1963 Counci I Minutes stating Counci Iman lea had voted "No" on the awarding of garbage collection contract to C. V. Erath. With this correction the min~tes'of the previous meeting held November 4, 1963 were approved as mailed. PUBLIC HEARING ON ODEGARD PETITION I The Mayor declared the public hearing open on the petition of G. E. and letah M. Odegard to vacate a portion of 64th Avenue South. There were no objections to the proposed vacation and it was moved by Gaines, seconded by Kammeyer that the Public Hearing be closed. MOT! ON CARR I ED It was moved by lea and seconded by Kammeyer that the City Attorney be instructed to draw up the necessary Ordinance to implement the vacation of the described portion of 64th Avenue South. Heisserman Fuel PS300 I .3.63 per barrel CORRESPONDENCE OONTHL Y REPORT OF MUN I C I PAL COURT The Monthly Report for October of the Municipal Court was presented to the Council showing the total amount paid the City Treasurer as $3,947.75. PETITION FOR VACATION OF ALLEY A petition from Sadie Larberg, William Hansen, and William Larberg requested the alley lying between East Main Street and First Street N. E. between "0" Street N. E. and "E" Street N. E. be vacated. It was moved by Lea and seconded by Hough that the City Attorney be instructed to drew up the necessary Resolution calling for a Public Hearing on this petition to be held December 16, 1963. MOT ION CARR I ED CLAIM FOR DAMAGES LINDA BARR A claim for damages was submitted by Linda Barr for damage caused her car when lene backed out of her driveway into a large hole on Harvey Road. The claim was in the sum of $8.00 tow charges. This claim ~as referred to the City's Insurance Company. MARTIN O. ENSLEY REPORT ON FLOODED BASEMENT A letter from Martin O. Ensley stated that his basement at 1432 East Main Street was flooded with 14 inches of water, due to inadequate and plugged up storm sewers. It stated the letter was filed in case any damage might show up in the near future. PLANNING COMMISSION PUBLIC HEARING HELD November 14, 1963 The Planning Commission held a Public Hearing November 14, 1963 on the following requests. ARMSTRONG CONSTRUCTION REQUEST TO REZONE The Planning Commission recommended the approval of the request of Armstrong Construction to rezone from R-2 to R-4 property described as Lots A, I, 2, 3, 4, 5, 6, and 7, Auburn Evergreen Park Addition to Auburn, Section 30, Township 21 N, Range 5, E.W. M. It was moved by Kammeyer and seconded by Aaby that the Council concur with the IPlanning Commissions recommendation, and instruct the City Attorney to draw up the necessary Ordinance to implement same. MOT!ON CARRIED PRELIMINARY PLAT OF GOARD'S FIRST ADDITION The Planning Commission recommended the approval of the request of Mr. Ralph Goard to accept the Preliminary Plat of Goard's First Addition to the City of Auburn, described as the north 630 feet of the west 330 feet of the southwest 4 of the southwest 4; County Tax Lot 41, less the east 140 feet in Section 21, Township 21M, Range 5, E. W. M. It was moved by Gaines and seconded by Fitzsimmons that the Council concur with the Planning Commissions recommendation. MOT! ON CARR I ED 1.4,2 AUBURN. MOTION CARRIED PRELIMINARY PLAT OF CANTEBURY ADDITION The Planning Commission recommended the approval of the request of Fox Construction to accept the Preliminary Plat of the Cantebury Addition to the City of Auburn, described as the east! of the northeast 4 of the northwest 4 of the northeast 4 of Section 30, Township 21 N, Range 5 E. W. M. I t was moved by Gaines and seconded by Kanrneyer that the Counci I concur wi th the I Planning Conrnissions recommendation and the City Attorney be instructed to draw up the necessary Ordinance to implement same. MOTION CARR I ED The Planning Commission recommended the approval of Amendments to the Zoning Ordinance No. 1428 provided that the assessment in lieu of parking be increased to $1,000 per parking space. It was moved by Lea and seconded by Gaines that the Council table any action on this matter until the next Council Meeting. MOTION CARR I ED AUBURN INVESTMENT OBJECTION TO PARKING L. I. D. Luther C. Martin, Attorney, on behalf of Auburn Investment submitted a letter objecting to the proposed L. I. D. It was moved by Kammeyer and seconded by Aaby that the City Attorney be instructed to read Ordinance No. 1652. MOT I ON CARR I ED Attorney Martin wanted it made a matter of record that legal description of proposed parking lots were asked to be read. Later withdrew request. ORDINANCE NO. 1652 I Robert Smythe, City Attorne-y, read Ordinance No. 1652 entitled "AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR THE ACQUISITION AND CONSTRUCTION OF CERTAIN FREE OFF-STREET PARKING FACILITIES WITHIN THE CORPORATE LIMITS OF THE CITY OF AUBURN IN ACCORDANCE WITH PETITIONS SIGNED BY A MAJORITY OF THE AFFECTED PROPERTY OWNERS AND FILED WITH THE CITY CLERK OF SAID CITY; AND A CERTIFICATION OF THE CITY ENGINEER OF SAID CITY HAVING BEEN FILED CERTIFYING THAT A MAJORITY OF THE AFFECTED PROPERTY OWNERS HAVE SIGNED THE PETITIONS AND THAT ALL OF THE FACTS SET FORTH IN SAID PETITIONS ARE TRUE AND THAT THE ESTIMATED COST TO THE PROPERTY WILL NOT EXCEED THE LIMIT ESTABLISHED BY LAW: CREATING AN ENLARGED LOCAL IMPROVEMENT DISTRICT TO BE KNOWN AS LOCAL IMPROVEMENT DISTRICT NO. 155; PROVIDING FOR THE NECESSARY PROPOSED IMPROVEMENTS: PROVIDING FOR THE METHOD OF ASSESSMENT IN SAID DISTRICT, AND PROVIDING FOR THE ISSUANCE AND SALE OF LOCAL IMPROVEMENT DISTRICT WARRANTS REDEEMABLE IN CASH AND LOCAL IMPROVEMENT DISTRICT BONDS." Luther C. Martin, Attorney, stated his objections to the proposed L. I. D. for off- street parking. Thomas E. Agee, Attorney for Roy M. Hawkins and the Hawkins Pontiac Company, H. H. Bothell and the Bothell Chevrolet-Cadillec Inc.; A. R. Walter and the Auburn Investment Company., Anne Fife-Smith and Mary Fife-Smith Coultas, Katie M. Bisse", Leah Bissel and Thomas E. Agee, Mabel Ames Whipple, and the Estate of Anna E. Truesen, deceased, filed a protest to the passage acceptance of Ordinance 6 1652 of the Ordinances of the City of Auburn on behalf of these people. Thomas E. Agee, Attorney, stated his objections to the proposed l. I. D. for off- street parking. I Eddie Ryan, James Weese, Jim Warren, Ray Kettman, AI Laughlin, Joe Beierlein, George Nickelsen,and Don Rottle urged the Council to pass Ordinance No. 1652. A . R. Walters, president of the Auburn Investment Company, Howard Bothell, and Roy Hawkins spoke in opposition to the proposed off-street parking plan, and protested the passing and accepting of Ordinance 61652. 143' AUBURN, WASH I NGTON MONDAY NOVEMBER 18. 1963 It was moved by Gaines and seconded by Fitzsimmons that Ordinance No. 1652 be adopted. MOTION CARRIED BY UNANIMOUS VOTE COMMITTEE REPORTS PURCHASING COMMITTEE I It was moved by Aaby and seconded by Sonnemann that Auburn Globe News be awarded the bid for Legal Advertising for the City of Auburn in the year 1964, with the provision affidavit stating they meet the requirements of a legal newspaper. The following roll call vote was recorded: Aaby, yes; Lea, yes; Kammeyer, yes; Fitzsimmons, yés; Sonnemann, yes; Hough, yes; and Gaines, yes. MOT I ON CARR I ED It was moved by Aaby and seconded by Sonnemann that Shell Oil Company be awarded the bid for Gasoline for the City of Auburn in the year 1964. MOT I ON CARR I ED It was moved by Aaby and seconded by Hough that Helsserman Fuel Company be awarded the bid for Light Fuel Oil for the City of Auburn in the year 1964. MOTION CARRIED I It was moved by Aaby and seconded by Gaines that the City Clerk be instructed to call for bids for shelving, furniture and equipment for the new Auburn Public Library, bids to be opened 4:00 p. m. December 2, 1963 in the City Hall. Specifications to be obtained in the office of the Architect, Don Allison & Associates. MOTION CARRIED It was moved by Aaby and seconded by Kammeyer that bids on the I-ton truck for the Park Department be recalled due to an error in the specifications, and the City Clerk be instructed to call for bids on the 1 - ton truck for the Park Department a second time, bids to be opened 4 p. m. December 2nd, specifications to be obtained from the office of the City Clerk. MOTION CARRIED STREET CONMITTEE No Report WATER CONMITTEE It was moved by Kammeyer and seconded by Aaby that bids on L. I. D. "54 for the construction of a ten inch sanitary sewer, manhole and lateral, on 12th Street, Northeast between the Green River trunk and Harvey Road be recalled due to an error in the specifications, and the City Clerk be instructed to call for bids on L. I. D. I 6154 a second time, bids to be opened 4 p. m. December 2nd, specifications to be obtained from the office of the City Engineer. MOT I ON CARR I ED It was moved by Kammeyer and seconded by Gaines that the Mayor be authorized to offer Verne S. Jones $17,500.00 for his home at 106 30th Northeast. MOTION CARRIED Attorney Smythe stated he had a right of way easement for sewer purposes from Steve Lone for an area involved in 12th Street Sewer Line. It was moved by Kammeyer and seconded by Sonnemann that Attorney Smythe be instructed to have this easement recorded. MOT ION CARR I ED Attorney Smythe read a letter from City Attorney of Enumclaw regarding details of the City of Auburn's agreement with City of Enumclaw. I This matter was referred to the Police Committee. It was moved by Sonnemann and seconded by Fitzsimmons that the Planning Director be authorized to obtain at least a six month option on property designated for parking in the off-street parking L. I.
