The meeting was called to order by Mayor Sbaughnessy. Councilmen present: Aaby, lea, Kammeyer, Fitzsimmons, Sonnemann, Hough, and Gaines. Minutes of the previous meeting held December 2, 1963 were approved as mailed. PUBLIC HEARING--lARBERG HANSEN PETITION I The Mayor declared the public hearing open on the petition of Saide larberg, William H. Hansen and William H. larberg to vacate the alley lying between East Main Street and First Street N. E. and "0" Street N. E. No one in the audience wished to be heard in regard to the vacation of this alley. It was moved by lea and seconded by Kammeyer that the Public Hearing be closed. MOTION CARRIED It was moved by lea and seconded by Kammeyer that the request of Sadie larberg, Wi Iliam H. Hansen, and William H. larberg to vacate the alley lying between East Main Street and First Street N. E. and "Oil Street N. E. be denie.d. MOT I ON CARR I ED AWARDING OF BID FOR lANDSCAPING & SPRINKLING SYSTEM AUBURN PUBLIC lIBRARY A letter from Ed R. Cavanaugh, Chairman, landscape Committee, recommended that the I bid for landscaping and sprinkling system for the new Library be awarded to le Blanc, Gardens of Kent in the amount of $12,934.27,. It was moved by Gaines and seconded by Hough that the recommendation of the library Board be accepted and le Blanc Gardens of Kent be awarded the bid for landscaping and sprinkling system for the new library. The following roll call vote was recorded: Aaby, yes; Lea, yes; Kammeyer, yes; Fitzsimmons, yes; Sonnemann, yes; Hough, yes; and Gaines, yes. MOTION CARRIED It was moved by Kanmeyer and seconded by Gaines that H. D. Fowler be awarded the bid on Brass Fittings for the Water Department for the year 1964. I MOT I ON CARR I ED CORRESPONDENCE REQUEST FOR LIGHTS ON PARK AVENUE A letter from Don & Vera Allison requested the Council consider replacing the preseat lighting system on Park Avenue as it does not function properly and is inadequate. REQUEST FOR liGHTS AT CORNER OF HEMLOCK ST. AND AUBURN-ENUMCLAW HWY. & FIX ROAD A petition signed by twenty persons requested the city install a street light at the corner of Hemlock street and the Auburn-Enumclaw Highway. It .Iso requested the Council to take action to fix the road to Hemlock Street. Mayor Shaughnessy siad the requests for lights would be taken care of later in the meeting, and referred the request to fix the road to Hemlock Street to the Street Committee. REQUEST OF MR. FOOK HONG WONG FOR COUNCIL APPROVAL OF CLASS H LICENSE I A letter from Fook Hong Wong, owner of the New Moon Cafe at 9 East Main Street, requested the license committee and Council approve their request for a Class H License and notify the State liquor Control Board by letter of this decision. Counci Iman Fitzsimmons said that the City has no jurisdiction over the Liquor Control Board. Mayor Shaughnessy said he would confer with the Police Department in regard to the matter, and appointed the License Committee to work with him. ZONE CHANGE APPLICAI ION A zone change application from David A. Botting & Ruby S. Botting requested a change in zoning on property described as Block 12, French's Addition to the City of Auburn, less portion of M Street N. E. from R-3 Residential to NS - Neighborhood Shopping. Referred to the Planning Commission. PAYMENT DUE RAINIER ASPHALT PAVING COMPANY FOR SURFACING OF PARKING LOT An invoice from Rainier Asphalt Paving Company was presented to the Council for approval showing amount due as $2,912.00. Clinton Cote', City Engineer, certified the work as being completed. I It was moved by Aaby and seconded by lea that the Council authorize payment of $2,912.00 to Rainier Asphalt Paving Company for the surfacing of a parking lot located on the SE corner of W. Wolff, Consulting Engineer, submitted Progress Estimate No. 7 to the Council. Ihe amount due Field Construction Company at this time as $5,340.27. It was moved by Kammeyer and seconded by Gaines that the amount due Field Construction Company be paid as outlined in Progress Estimate No.7 as submitted by Richard E. Wolff, Consulting Engineer, and the work done by Field Construction Company be accepted, and after thirty days the retained percentage be paid if no liens are filed. ARCHITECT'S CERTIFICATE OF PAYMENT R. D. ANDERSON COMPANY A letter from Donald l. Allison, AlA, certified the amount due R. D. Anderson Company, Contractor of Auburn Public Library as $26,208.00. It was moved by Aaby and seconded by Sonnemann that R. D. Anderson be paid $26,208.00 as certified by Donald L. Allison, AlA, for construction of Auburn Public Library. MOTION CARRIED ESTIMATE NO. 154 GLENN ROCKEY CONSTRUCTION COMPANY Clinton Cote', City Engineer, submitted Estimate No. I - l. I. D. No. 154 showing amount due Glenn Rockey Construction Company for work done on the 12th Street N. E. Sewer as $2,569.56. It was moved by Kammeyer and seconded by Sonnemann that Glenn Rockey Construction Company be paid $2,569.50 as outlined in Progress Estimate No. I - L. I. D. No. 154. MOTION CARR I ED AUDIENCE VIRGIL SWANSON - DAMAGE TO lAND Virgil Swanson requested the Council take some action to settle his claim for damages to his property caused by contractors on the city sewer project. Councilman Kammeyer stated that the City would settle any claim for damages within the 30 foot easement, and Frank Coluccio Construction Company would settle any claim for damages outside the 30 foot easement. Mayor Shaughnessy referred this matter to the Water Committee and Richard E. Wolff, Consulting Engineer, for study and possible settlement with the Swansons. Councilman Fitzsimmons reported that the Solicitation Ordinance was ready for introduction by the Council. AUBURN, WASHINGTON MONDAY 155: DECEMBER 16, 1963 STREET CONN" TTEE CALL FOR BIDS ON TRUCK FOR STREET DEPARTMENT It was moved by Lea and seconded by Sonnemann that the City Clerk be instructed to call for bids on a truck for the Street Department, bids to be opened January 6, 1964 at 4:00 p. m., specifications to be obtained from the office of the City Clerk. MOT I ON CARR I ED I WATER CONMITTEE liQUID CHLORINE - VAN WATERS & ROGERS, INC. Councilman Kammeyer reported that he had received a contract from Van Waters & Rogers, Inc., for supplying liquid chlorine for the Water Department for one year. It was moved by Kammeyer and seconded by Gaines that the Mayor be instructed to sign the contract with Van Waters & Rogers, Inc. for supplying the Water Department with liquid chlorine for one year. The following roll call vote was recorded: Aaby, yes; lea, yes; Kammeyer, yes; Fitzsimmons, yes; Sonnemann, yes; Hough, yes; and Gaines, yes. MOTION CARRIED LI GHT CONNlITTEE Councilman Gaines requested the Council consider the need for lights on Harvey Road and Park Avenue, and make any suggestions they might have to him. It was moved by Gaines and seconded by Aaby that the following lights be installed. (I) 20,000 Lumen Light (I) 20,000 lumen Light (3) 7,000 Lumen light (I) 20,000 Lumen Light (I) 7,000 Lumen Light Chinook School Intersection of Enumclaw Hwy. & Hemlock St. 37th Street Southeast Enumclaw Highway & 12th Street Southeast Behind Johnson Hardware on a dedicated street. I MOTION CARRIED POtlCE CONNlITTEE No Report WATER SUPERINTENDENT No Report STREET SUPERINTENDENT No Report CITY ENGINEER No Report PLANNING DIRECTOR George Schuler, Planning Director, reported that two proposals for changing the traffic patterns have been discussed by the Street Committee, and copies of the proposals have been made available to the Council and can be obtained from the office of the City Engineer. I CERTIFIED CHECK RETURNED TO SMITH CORONA MARCHANT Councilman Aaby reported that the bookeeping machine for the Clerk's Office had been returned. It was moved by Aaby and seconded by Lea that the certified check which accompanied the bid for the bookkeeping machine be returned to Smith Corona Marchant. MOTION CARRIED ORDINANCE NO. 1662 It was moved by Lea and seconded by Gaines that Ordinance No. 1662 entitled tlAN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON AMENDING SECTION 9.22.190 OF THE AUBURN CITY CODE, SAID SECTION 9.22.190 RELATING TO AND DESIGNATING TWO-HOUR NON~ETERED PARKING ZONES WITHIN THE CORPORATE LIMITS OF THE CITY OF AUBURN, PURSUANT TO SECTION 19 OF ORDINANCE NO. 1465 OF THE CITY OF AUBURN; AND REPEALING ORDINANCE NO. 1560 OF THE CITY OF AUBURN, AND ALL OTHER ORDINANCES OR SECTIONS OF ORDINANCES INSOFAR AS THEY ARE IN CONFLI CT WITH THE PROV I S IONS OF TH I S ORD I NANCE," be introduced. MOTION CARRIED ORD I NANCE NO. 1663 I Robert Smythe, City Attorney, read the title of Ordinance No. 1663. Councilman Sonnemann inquired whether it was necessary to read the entire ordinance as the councilmen had each been earlier furnished copies for reading and study, and copies were available to those in the audience. Mayor Shaughnessy inquired whether those present desired the reading of the entire ordinance and as no one requested this be done, Attorney Smythe then read those portions wherein changes, corrections or additions had been made in the previous zoning code ordinance. It was moved by Sonnemann and seconded by Fitzsimmons that Ordinance No. 1663 entitled "AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON AMENDING ARTICLE 2 - SECTION 2, ARTICLE 4 - SECTION 7, ARTICLE 5 - SECTION 10, AND ARTICLE 6 -,SECTION 12, ALL IN ORDINANCE NO. 1428 OF THE CITY OF AUBURN: ' SAID ORDINANCE NO. i428 BEING AN ORDINANCE ESTABLISHING A COMPREHENSIVE ZONING PLAN FOR THE CITY OF AUBURN BY ESTABLISHING VARIOUS USE DISTRICTS IN SAID CITY, AND PRESCRIBING CERTAIN REGULATIONS FOR EACH OF SAID USE DISTRICT, AND REPEALING ALL ORDINANCES OR SECTIONS OF ORDINANCES INSOFAR AS THEY ARE INCONSISTENT WITH THE Œ'ERMS OF THIS ORDINANCE," be introduced and adopted.
