Minutes of the previous meeting held January 20, 1964 were approved as mai led. I Bids for concrete cylinder pipe for the Coal Creek Project were opened at 4:00 p. m. February 3, 1964. MOTION CARRIED I CaRR E S PO NDE NCE PETI TION AGAINST THE REZONING OF PROPERTY AT THE CORNER OF M ST. N.E. AND E. MAIN A petition signed by eleven property owners, residing within 200 ft. of Block #12 French's Add. to City of Auburn, commonly known as the Dave Botting property at the corner of M St. N.E. and E. Main, asked that the Mayor and City Counci I of Auburn set aside the zoning of this property from R-3 to N.S. as they felt sufficient consideration was not given to their property rights. 169! AUBURN, WASHINGTON MONDAY FEBRUARY 3, 1964 The petition stated that the plot plan as shown at, the Planning Commission's Public Hearing of Jan. 2nd had been changed from a super market of 10,500 sq. ft. and three supporting store bui Idings to a super market of 11,000 sq. ft. and eight supporting stores. This petition also stated that post card notification for the Planning Commission Public Hearing had not been received by property owners within 200 ft. of the Property, as required by the Zoning Ordinance. George Schuler, Planning Director, stated that upon request of the Planning Commission the tentative plot plans had been changed due to the location of the bui Idings on the property. E., said he had been informed that no changes would be made in the original plans. Roy Gustaves, 1043 East Main, stated that the public hearing was held on the original plot plan and he felt an additional public hearing should be cal led to review the final plot plan. George Bodine, 15 N Street N. E., stated that he had not received a notice of public hearing, and he owns property within a 200 foot radius of the Dave Botting property. It was moved by Fitzsimmons and seconded by Sonnemann that this petition be turned over to the Planning Commission, with a recommendation that a public hearing be held on the final plot plan as submitted to them. MOTION CARRIED GREEN RIVER INTERCHANGE SUPPLEMENT I Kenneth Weeks, member of the Val ley Regional Planning Commission, requested the Counci I adopt a Resolution prepared by the Val ley Planning Commission in support of an additional off ramp from Freeway at South 153rd between 82nd and 84th Avenue So. Mayor Shaughnessy requested that this Resolution be read later in the meeting. , ~ REQUEST FOR TEENAGE DANCES Jim DeMarre, president of the Gearlords Car Club, asked why teenagers in the City of Auburn were not al lowed to hold public dances. Counci Iman Fitzsimmons stated that teenagers could hold public dances in the City of Auburn if they complied with the City of Auburn Ordinance governing public dances. Mrs. Griffin spoke in favor of the dances in Auburn. Counci'man Fitzsimmons said that applications to hold public dances could be obtained from the office of the City Clerk and should then be submitted to the License Committee. Chief Darby stated that certain specifications for holding public dances had been set up by the License Committee and in order for teenagers to hold dances they must be wi I ling to comply with these rules. I ODOR OF PIPE COATING CŒ^PANY John Frankhauser resident at 2107 D Street Southeast asked what had been done in regard to the odor being given off from Pipe Coating Inc. and was told this matter would be taken up in committee reports later in the meeting. COAL CREEK WATER PROJECT A letter from Richard E. Wolff, Consulting Engineer, gave a short summation of his thinking at the present time regarding the Coal Creek water project. A letter from Pichard E. Wolff, Consulting Engineer, recommended for consideration and decision several desirable features which he felt should be accomplished whi Ie the Coal Creek Springs are out of service during replacement of the deteriorated wood stave line. t 7 0AUBURN, WASH I NGTON MONDAY FEBRUARY 3, 1964 Counci Iman Kammeyer stated that action would be taken on this in committee reports later in the meeting. ~, o """< t:: REQUEST TO ATTEND INTERNATIONAL CONFERENCE OF BUILDING OFFICIALS AND USE OF CITY VEHICLE -~ ---' A letter from Jack V. Lange, Bui Iding Inspector City of Auburn, requested permission to participate in the program outlined by a letter from the International Conference of Bui Iding Officials in which he was appointed a member of the Fire Extinguishing System Subcommittee which wi I I meet in Portland, Oregon. A second letter from Lange, requested permission to use the City's vehicle to I attend the symposium on Quality Control of Concrete conducted by the American Concrete Institute in the Olympic Hotel, February 8, 1964. It was moved by Kammeyer and seconded by Fitzsimmons that the Counci-I concur with the two requests of Jack V. Lange. MOTION CARRIED STATEWIDE RETIREMENT RESOLUTION ON CONTRIBUTIONS A letter from Statewide City Employees Retirement System stated that a new resolution was approved by the Board of Trustees at the January 24th board meeting in which it was determined that the 25% of uniform personnel contributions retained when such personnel leave city service, shal I be credited to the participating city's released matching funds. This letter was referred to the Finance Committee and Police Committee. PROGRESS ESTIMATE ON L.I .D. #154 Clinton W. Cote', City Engineer, submitted Progress Estimate #3 on L.I.D. #154 Harvey Road and 12th Street N., showing the amount due Glenn Rockey Construction Company as $826.87. It was moved by Kammeyer and seconded by Hough that $826.87 be paid Glenn Rockey Construction Company for work done on L.I .D. #154 as shown in progress estimate #3. Cote', former City Engineer, listed number of hours overtime he had put in over the past two years, and requested the Counci I acknowledge the time due him. This matter was referred to the Street Committee and the City Attorney. FHA REQUEST FOR RENEWAL OF LEASE A letter from Wi Ibur E. Bowen, County Supervisor Farmers Home Administration, inquired as to whether the City plans to renew the lease with them for office space in the City Hal I at expiration of present contract June 30, 1964. This matter was referred to the Finance Committee. APPLICATION FOR SPECIAL PROPERTY USE PE~AIT BIBLE BAPTIST CHURCH A application for special property use permit from the Bible Baptist Church for the bui Iding of a new church & educational unit at 12th Street S.E. between Enumclaw Highway & M Street was submitted to the Counci I. I This application was referred to the Planning Commission. ZONE CHANGE APPLICAI ION G. E. ODEGARD AND LETAH M. ODEGARD A zone change application from G. E. Odegard and Letah M. Odegard requested their property on Hi-Crest Drive be rezoned from R-I to R-3. This zone change application was referred to the Planning Commission AUBURN, WASH I r~GTON MONDAY 171t FEBRUARY 3, 1964 1./ AUBURN CHM\BER OF COIN^ERCE STREET DECORATION COfN^'TTEE - A letter from Waldo Carlson, Manager Auburn Chamber of Commerce, stated the Chamber is most appreciative of the splendid job done by the Fire Department and the City Street Department in the recent street decoration program for Christmas. MONTHLY REPOrH OF tl.UNIC I PAL COURT I The monthly report of the h\unicipal Court was submitted to the Counci I by George Fiori, Jr. Judge, Auburn Municipal Court, showing total amount paid City Treasurer as $3,878.05. ANNUAL REPORTS OF THE WATER DEPT., POLICE DEPT., FIRE DEPT., AND CITY CLERK Elisabeth Heritage, City Clerk, reported that the city has on fi Ie the annual report of the Auburn Water Department for 1963; the Income Profit and Loss Statement of the Water Sewer Department; the annual report of the Police Department; the annual report of the Fire Department and the City Clerk's Annual Report of Budgetary expenditures and balances. Copies of these reports were given to each of the Counci 1- men and the Mayor. ENGINEER'S REPOF<T FOR 1962 AND 1963 Clinton W. Cote', Civi I Engineer, submitted a report for 1962 and 1963 of the accomplishments with future recommendations which would be in keeping with the City's long range plans as prepared by Clark-Coleman and Associates. SIX YEAR ARTERIAL STREET PROGRAM George Schuler, Planning Director, submitted for consideration the amended six year Arterial Street Program as recommended by the Street Committee, and requested that the necessary Public Hearing be cal led for as specified by law. I It was moved by Lea and seconded by Kammeyer that the City Clerk be instructed to cat I for a public hearing to be held March 2, at 8 p. m. to consider the ammended six year arterial street program of the City. MOTION CARRIED FINAL ASSESSMENT ROLLS ON L. I . D. if 149, 150 and 153 George Schuler, Planning Director City of Auburn, submitted for adoption the final assessment rolls for t.I.D.'s 149, 150, and 153. It was moved by Lea and seconded by Kammeyer that the City Clerk be instructed to cal I for a public hearing to be held March 2, 1964 at 8 p. m. on L.r .D. if149, 150, 153 and that she send notices to all owners of property to be assessed by these L.r.D.'s. MOT I ON CARR I ED AUDIENCE None CONMITTEE REPORTS PURCHASING CONMITTEE I No Report FIRE COIN'I\ I TTEE No Report LICENSE CONMITTEE Counci Iman Fitzsimmons stated that the License Committee had gone through Pipe Coating Inc. and had looked over their fi Itering process. He said that they had also gone to "D" Street and the home of Mr. Frankhauser to check on the odor in this area. He also reported that he had looked over the Kinsley Company report on air pol fution at Pipe Coating Inc., and this report showed there was notning of tar origin in the fat lout from this company. 172 AUBURN, WASHINGTON MONDAY FEBRUARY 3, 1964 iI\.:J o ~ It was moved by Fitzsimmons and seconded by Hough to hord this problem in abeyance subject to a report from the University of Washington as to whether there is anything toxic in the fal lout from Pipe Coating Inc. .- '--- :~~'J Robert Smythe, City Attorney~ said he felt a questionnaire should be taken around to al I the people in the area of Pipe Coating Inc. in order to determine whether this problem constitutes a public nuisance. IVi I liam Key said he understood the tests to be made by the University of Washington were going to be on the water at Brister's Trailerama instead of on the fal lout from Pipe Coating Inc. It was moved by Fitzsimmons and seconded by Hough that the motion be amended to instruct the City Clerk to contact the University of Washington or the Air Pollution Control Commission to make tests on air pollution at Pipe Coating Inc., tests to be made whi Ie the plant is in operation. STREET CONIId TTEE No Report WATER COlN^' TTEE Counci Iman Kammeyer asked the City Attorney to read the contract from Richard E. Wolff, Consulting Engineer, for engineer's services on the Coal Creek Project. Robert Smythe, City Attorney, read the contract. It was moved by Kammeyer and seconded by Fitzsimmons that the City Clerk and Mayor be authorized to sign the contract between Richard E. Wolff and the City of Auburn for engineering services. The following roll call vote was recorded: Aaby, I yes; Lea, yes; Kammeyer, yes; Fitzsimmons, yes; Sonnemann, yes; Hough, yes; and Gaines, yes. MOTION CARRIED BIDS ON PIPE It was moved by Kammeyer and seconded by Gaines that United Concrete Pipe Corp. be awarded the bid on concrete cylinder pipe for the coal creek project, at $93,298.46. The following roll call vote was recorded: Aaby, yes; Lea, yes; Kammeyer, yes; Fitzsimmons, yes; Sonnemann, yes; Hough, yes; and Gaine$, yes. MOTION CARR I ED It was moved by Kammeyer and seconded by Gaines that the City Clerk be instructed to return the bid bonds to the unsuccessful bidders. MOTION CARRIED CALL FOR BIDS ON COAL CREEK PROJECT I t was moved by I<arrmeyer and seconded by Fi tzsimmons that the Ci ty Clerk be instructed to cal I for bids on the replacement of the gravity supply line to the City pumping station and on cement-mortar lining of 24-inch steel pipe, bids to be received by the City Clerk by 4:00 p. m., February 17, 1964. The committee had decided that no changes would be made at present. MOTION CARRIED OLD BUSINESS A & M CONSTRUCTION COMPANY Robert Smythe, City Attorney, reported on a letter written to Richard E. Wolff, Consulting Engineer, by A & f~ Construction Company. The letter from A & M Construction Company said they wi I I not replace any concrete which has settled on the Enumclaw Highway. This matter was referred to the Water-Sewer Committee to come back with a recommendation for the next meeting. NEW BUSINESS ANNUAL REPORT OF CITY ATTðr~NEY I Robert Smythe, City Attorney, submitted the 1963 annual report of the City Attorney's office of the City of Auburn, which contains a brief reSume of the operations of said department. Jessie Luther, who owns 2/3 of the parking lot leased by the City from the Auburn Parking Association and designated as Parking Lot No. I. Mrs. Luther's lease with the A.P.A. having expired, the discussion centered on a temporary rental agreement and possible negotitation for the purchase of the lot as part of the Parking L.I .D. George Schuler stated the appraiser hired by the City on behalf of the Parking L.I.D. had appraised Mrs. Luther's lot at $30,000. Mrs. Kelly stated her motherls asking price was $75,000. Mrs. Kef Iy indicated they were not interested in negotiating a rental price at a figure the city could offer. I It was then moved by Kammeyer, seconded by Aaby, that the City remove the meters, bumpers and other city owned equipment from the Luther lot and return same to the owners. MOTION CARRIED It was moved by Fitzsimmons, seconded by Gaines, that the Mayor appoint a committee to negotiate further for the purchase of the Luther lot. MOTION CARRIED Mayor Shaughnessy appointed Aaby, Chairman; Fitzsimmons and Gaines to work with George Schuler, in attempting to negotitate the purchase of the Luther lot.
