Counci Imen present: Hough, Lea, Kline, Fitzsimmons, Calkins, Aaby. and Sonnemann. Minutes of the previous meeting held Apri I 20, 1964 were approved as mal led. Minutes of the special meeting held Apri I 29. 1964 were approved as read. PUBLIC HEARING - L.I.D. HI51 I The Mayor declared the public hearing open on the Final Assessment Rol I for Local Improvement District No. 151. Letter from W. F. Ingram stated he had sold his property to Mrs. Pearl Ki I Ii an. Letter from Loren Payne stated he was opposed to assessments on L. I. D. HI51 & L. I. D. H154. Letter from Pearl Ki I lian stated she was opposed to assessments on L. I. D. H151. It was moved by Lea and seconded by Hough that the public hearing on l. I. D. HI51 be closed. MOT 1 ON CARR I ED It was moved by Kline and seconded by Lea that the assessment rol I be confirmed and the city attorney be instructed to draft the necessary Ordinance to implement L. I. D. HI51 MOT 1 ON CARR I ED PUBLIC HEARING - L.I.D. HI52 The Mayor declared the public hearing open on the Final Assessment Rol I for Local Improvement District No. 152. It was moved by Calkins and seconded by Hough that the public hearing on L. I. D. HI52 be closed. I MOTl ON CARR 1 ED It was moved by Kline and seconded by Fitzsimmons that the assessment roll be confirmed and the city attorney be instructed to draft the necessary Ordinance to implement L. I. D. 6152. MOT I ON CARR I ED PUBLIC HEARING - L.I.D. HI54 The Mayor declared the public hearing open on the Final Assessment Rol I for local Improvement District No. 154. Letter from H. E. Barkey protested the assessment on L. I. D. 6154. It was moved by Calkins and seconded by Aaby that the public hearing on L. I. D. HI54 be closed. MOTION CARRI ED It was moved by Kline and seconded by Hough that the assessment rol be confirmed and the city attorney be instructed to draft the necessary Ordinance to implement l. I. D. H154. MOT I ON CARR I ED I PUBLIC HEARING - VACATION "B" ST. S. E. The Mayor declared the public hearing open on a petition for vacation of a portion of "B" Street S. E. immedi ately North of Safeway Store. A petition signed by W. M. Nelson, R. W. Bolton, and Robert Nelson opposed this vacation. W. M. Nelson and Robert Nelson asked questions concerning the vacation and Robertson, representative of Safeway Stores, explained their plans for the portion of street to be vacated. Mayor Gaines declared the publ ic hearing open for vacation of a portion of "H" Sf. S. E. lying between 26th and 27th Streets S. E. There being no objections, it was moved by KI ine and seconded by Hough that the public hearing on the vacation of a portion of "H" Sf. S. E. lying between 26th and 27th Itreets S. E. be closed. MOT I ON CARR I ED Mayor Gaines referred the matter to the street committee for further study. BIDS - PARK PROPERTY Bids opened at 4 p. m. Apri I 29, 1964, for Landscaping and Development of Terrace Park were as fol lows: G. C. Casebol t Co., Tacoma $72,505.00 Base Bid Chas. R. Mayor Gaines said these bids have been turned over to the Park Board for study. CORRESPONDENCE HEALTH, EDUCATION AND WELFARE I Letters from Dept. of Health, Education and welfare stated remaining amount of ederal Grant due city $20,770.00, making the total grant to the city $131.170.00. Mayor Geines turned these over to the water-sewer committee for their study and recommendation. A & M CONSTRUCTION EQUIPMENT COMPANY Letter from A & M Construction Equipment Co. was relative to their obligation on work done on 21st and 22nd Streets. Mayor Gaines referred this matter to the city attorney. and asked that the Engineering Department work with him. DOG NUISANCE Letter signed by 10 residents of I St. S. E. complained about the dog nuisance in the city. Letter from Mr. & Mrs. E. Halsey asked for a dog leash lew in the City of Auburn. ElRoy Chi Ids stated he had problems with cats. VACATION OF ALLEY I Petition of Reinhart Klein, Wal lace S. Wood. and Murray A. Campbel I was for vacation f a portion of the alley lying between East Main Street and "0" Sf. N. E. It was moved by Fitzsimmons and seconded by Calkins that the City Attorney be instructed to draft the necessary Resolùtion cal ling for a public hearing to be held on this vacation at June I, 1964. MOTION CARRIED 214 AUBURN, WASH I NGTON MONDAY MAY 4, 1964 ZONE CHANGE APPLICATION ", o ~ 1::: ("] Application of R. O. Bain, John W. Greggs and D. Roger lanrud requested a change of zoning from R-2 to C-I and C-3 on land located between the Enumclaw Highway and 17th St. S. E. and between M and K Streets. This application was turned over to the Planning Commission. ZONE CHANGE APPLICATION Application of Alfred Schoenbachler requested 8 change of zoning from A-I to C-3 I for land located adjacent to west side of river across from Green River Golf and Country Club. This application was turned over to the Planning Commission. PETITION TO CREATE l. I. D. A petition was submitted requesting the creation of a Local Improvement District on M Street S. E. between East Main and Enumclaw Highway for curb and gutter and sanitary side sewers. It was moved by Lea and seconded by Hough that the city attorney be instructed to draft the necessary Ordinance to implement the setting up of a Local Improvement District on M St. S. E. between East Main and Enumclaw Highway. MOT I ON CARR I ED QUIT CLAIM DEED Deed for fi ling--Ruby Gray to City, land for street purposes. It was moved by Hough and seconded by Sonnemann that the city attorney be instructed to fi Ie the quit claim deed. MOTION CARRIED MINUTES OF BOARD OF ADJUSTMENT MEETING I The Auburn Board of Adjustment at their publ ic hearing. Apri I 30. 1964. granted George D. Wolff, owner of No-Bar Ranch and Mr. Carl Spratley, president of The Outlaws (saddle club) ð Special Permit to use a portion of Wolff's property as headquarters for their saddle club for a period of one year. MONTHLY REPORT OF MUNICIPAL COURT Monthly report of the Municipal Court showed a balance of $3.007.00 turned over to the City Treasurer for April, 1964. REQUEST FOR HOLIDAYS Letter from James J. Hogan, employee in the Water Dept., requested that the three holidays deleted from the regular paid holidays during the previous administration be restored to the city employees. (lincoln's Birthday, Feb. 1 I; Veterans Day, Nov. I I; Columbus Day, October 12) Mayor Gaines tabled this request. OBJECTIONS TO OFF-STREET PARKING L. I. D. letter from Thomas E. Agee presented objections to the off-street parking L. I. D. and advised the city that the right of the City of Auburn to condemn property for off-street parking under this proposal wi I I be contested. Mr. Agee stated that he I represents several individuals and concerns in the City of Auburn. This letter was turned over to Robert Smythe, City Attorney. PROGRESS ESTIMATE NO. 1 - JOHN W. SCHADE Progress Estimate No. I in favor of John W. Schade, Contractor, was presented by Richard E. Wolff, Consulting Engineer, for approval. The estimate showed the amount due Schade as of Apri I 30, 1964, for work on the Coal Creek Project. less the 15% reta i nage as $9,453.96. 215' AUBURN. A letter from Richard E. Wolff, Consulting Engineer for the Coal Creek Project, stated that the United Concrete Pipe Corporation has completed delivery of al I of the 14 inch Shot-Cote Concrete Cylinder pipe. Mr. Wolff recommended payment of the total ess 10 percent or $83,593.66 at this time. It was moved by Fitzsimmons and seconded by Sonnemann that $83,593.66 be paid United Concrete Pipe Corporation. . The Final Estimate for work done by the United Concrete Pipe Corporation for lining 878 lineal feet pipe was submitted by Engineer Wolff showing the amount due as of Apri I 30, 1964, less 15% retainage as $6,907.75. Mr. Wolff recommended payment of this amount. It was moved by Sonnemann and seconded by Hough that $6,907.75 be paid United Concrete Pipe Corporation. I - AUSTIN CONSTRUCTION Progress Estimate No. I in favor of the Austin Construction Company for work done on Ithe Pump House Revision contract showed a net amount due contractor at this time, less 15% retainage, as $5,171.40. Mr. Wolff recommended payment of this amount. It was moved by Fitzsimmons and seconded by Hough that $5,171.40 be paid Austin Construction. WOLFF, ENGINEER A statement submitted by Richard E. Wolff, was in the amount of $2.938.64 for engineering on the Coal Creek Springs due as of Apri I 29. 1964. It was moved by Fitzsimmons and seconded by Hough that $2,938.64 be paid Richard E. Wolff. Consulting Engineer, for engineering on the Coal Creek Springs, The fol lowing rol I cal I vote was recorded: Fitzsimmons, yes; Calkins, yes; Aaby, yes; Sonnemann, yes; Hough, yes; Lea, yes; and Kline, yes. MOT I ON CARR I ED FINANCING FOR l. I. D. #155 letter from McLean & Company, Inc. stated they would buy up to $400,000 par value of legally issued warrants to bear interest at the rate of 4% per annum in order to provide the interim financing for Local Improvement District No. 155. II Alva long discussed the issuance of these warrants with the Council and City Attorney. It was moved by Fitzsimmons and seconded by Calkins that the Counci I accept the offer of McLean & Company, Inc. to buy up to $400,000 par value of legally issued warrants to bear interest at the rate of 4% per annum in order to provide the interim financing for Local Improvement District No. 155, and instruct the Mayor and City Clerk to sign the necessary documents to implement same. The fol lowing roll cal I vote was recorded: Fitzsimmons, yes; Calkins, yes; Counci Iman Aaby stated that he had formerly had an interest in Auburn Boosters, one of the sellers of two of the lots in local Improvement District H155, but that he had devested himself of any and al I interest in said corporation prior to this date. However, in view of the fact that some comment has been made about ~is former interest in this corporation he felt that he should abstain from voting on any matter relating to the sel ling of the properties in the local Improvement District; Sonnemann, yes; Hough, yes; Lea, yes; and K line, yes. MOTION CARRIED 216· AUBURN,WASHINGTON MONDAY MAY 4, 1964 APPOINTMENT OF A SALARY & BENEFITS COMMITTEE Mayor Gaines appointed the for lowing counci Imen to a Salary & Employee Benefits Committee: Counci Iman Aaby, Chairman, Counci Iman Lea and Counci Iman Hough. Mayor Gaines referred the letter from James J. Hogan, Water Employee, to this corrmittee. APPOINTMENT OF CITY'S HISTORIAN Mayor Gaines appointed Roberta Morley as the City's Historian. APPOINTMENT OF INDUSTRIAL COMMITTEE Mayor Gaines appointed the fol lowing people to a Industrial Committee. Fitzsimmons, Myron Massey, Kenneth lane, R. M. Doherty, and Gene Kasper. Kenneth COMMITTEE REPORTS LIGHT COMMITTEE - CHARLES HOUGH Counci Iman Hough reported he had met with Phi' Aspinwal I, of Puget Sound Power and light, and would be ready with a request for lights at the next meeting. FIRE COMMITTEE - CHARLES HOUGH No Report PURCHASING COMMITTEE - RAY SONNEMANN No Report LICENSE COMMITTEE - BRIAN CALKINS No Report STREET COMMITTEE - TED LEA Counci Iman Lea reported that the request of Mike Wood for more adequate entrances and exits in front of his store on Auburn Avenue had been worked out with assistance of Street Department. It was moved by Lea and seconded by Sonnemann that the Mayor be instructed to write a letter to the District Director of Highways requesting them to widen the Enumclaw Highway from 9th Street Southeast to 17th Street Southeast from two lanes to four lanes. MOTION CARRIED WATER-SEWER COMMITTEE - KENNETH FITZSIMMONS Counci Iman Fitzsimmons reported that the Engineering Department has been instructed to contact General Services Administration in regard to negotiations for purchase of water, sewer and other properties by the city. POLICE COMMITTEE - BOB KLINE Counci Iman Kline reported that the Police Committee had investigated the complaint of H. L. Baldwin against the pasturing of two horses at 924 M Street Southeast, and had informed Mr. Baldwin of his rights in the matter. Herb Baldwin asked that the communications regarding this problem be read. Elisabeth Heritage, City Clerk, read a letter from Dr. Naomi Pettingill. City Health Officer, and a letter from J. V. Lange, Sanitation Supervisor, regarding this metter. Herb Baldwin stated that he had been informed that he must sign a complaint against the pasturing of these horses before any action could be taken by the city. However, it was his opinion that the city should take action on this problem themselves. Mayor Gaines turned this matter over to Jack Lange, Sanitation Supervisor. ORDINANCE NO. 1661 Robert Smythe, City Attorney, asked that Ordinance No. 1661 be tabled unti I action has been taken on it by the State Department of Highways. ORDINANCE NO. 1691 It was moved by Fitzsimmons and seconded by Kline that Ordinance No. 1691 entitled "AN ORD I NANCE OF THE CITY OF AUBURN, WASH I NGTON, AMEND I NG SECT' ONS 1.30.0 10 AND 1.30.020 OF THE AUBURN CITY CODE, SAID SECTIONS 1.30.010 AND 1.30.,020 RELATING TO PUBLIC CONTRACTS AND PURCHASES OF THE CITY OF AUBURN AND THE NECESSARY ADVERTISING AND BID PROCEDURE FOR THE SAME, PURSUANT TO SECTIONS I AND 2 OF ORDINANCE NO. 653 OF THE CITY OF AUBURN.", be adopted. MOTION CARR I ED OLD BUSINESS DOG POUND LOCATION Counci Iman Sonnemann reported for his committee on plans for a new dog pound. I He stated that his committee had met with the Water Committee and had secured their approval of a new location for the dog pound on the Northwest ~orner of the Sewer Disposal Property. Counci Iman Sonnemann reported that George S~uler, Planning Director, was working on plans for the new dog pound, and they would be ready to cal I for bids next meeting. MUNICIPAL AIRPORT Robert Smythe, City Attorney. reported no furtherprogr'ess on the Municipal Airport. Mayor Gaines appointed Hal Hagestad. City Engineer. to the Municipal Airport Committee.
