The meeting was called to o~de~ by Mayo~ Gaines. Counci Imen p~esent: Hoyt, Lea, Kline, Fitzsimmons, Calkins, Aaby, and Sonnemann. Minutes of the p~evious meeting held Ma~ch I, 1965 were app~oved as mai led. PUBLIC HEARING I The Mayo~ declared the public hea~ing open on the petition of Joe Starkovich to vacate a po~tion of C St~eet Southeast lying between 8th and D Streets Southeast, desc~ibed as follows: Beg. at the NW co~ne~ of Lot 4, Block I, Hartman's Fi~st Addition; th N 45°00'00" E to a point 55.0 ft. SWly of the cente~line of State Highway No.5 (sign ~oute No. 167); th SEly pa~al leI to the centerline of State Highway No.5 to the extended E line of Lot I, Block I, Ha~tman's First Addition; th SWly along the extended E line of aforesaid Lot I to the NE corne~ of Lot I, Block I, Ha~tman's Fi~st addition; th NWly along the N line of Lots I thru 4, Block I, Hartman's Fi~st Addition to the pob. The City of Aubu~n shal I retain an easement oVe~, across and underneath the above described property for the purpose of maintaining, laying and se~vicing public uti lities. The Aubu~n Planning Commission recommended this ~equest be granted. It was moved by Calkins and seconded by Hoyt that the public hearing be closed. MOT ION CARR I ED It was moved by Fitzsimmons and seconded by Aaby that the Counci I concur with the Aubu~n Planning Commissions ~ecommendation and vacate this portion of C Street Southeast lying between 8th and D Streets Southeast, with the City of Aubu~n retaining an easement over, across and underneath the property for the purpose of maintaining, laying and servicing public utilities. MOT ION CARR I ED III It was moved by Sonnemann and seconded by Lea that the City Attorney be instructed to draw up the necessary Ordinance to implement this vacation. MOTION CARRIED CORRESPONDENCE The Council received a petition signed by 139 residents of Southeast Auburn requesting the City withhold city services of water, sewage and garbage disposal to a 24 ac~e area bordered on the North by Howard; on the West by R Street Southeast and on the South by Southdale unless this area is restricted to residential use. City Engineer, Harold Hagestad, said the lessee of this property had not submitted any plans of what is proposed to be bui It on this property and that the city can place no restrictions on this property as it is located on the Indian Reservation. Gi Ibert Jay of 1805 25th Street Southeast Southdale Addition spoke in favor of the City withholding city services on this 24 acre area, and asked questions regarding the City's position in this matter. Mayo~ Gaines asked that this matter be tabled unti I later in the meeting. The Counci I received the revised P~eliminary Plat of Sportsman's Paradise Estates from IIIAlex Sonnichsen. This was referred to the Planning Commission, and the Counci I were asked to fami liarize themselves with the plat. Counci Iman Ted Lea submitted his resignation as member of the Auburn Planning Commission. It was moved by Sonnemann and seconded by C Ikins that the Counci I accept Counci Iman Ted Lea's resignation as membe~ of the Auburn P?anning Commission. Wolff submitted progress Estimate No.5 in favor of the Austin Construction Co. showing an amount of $7,686.87 due as of Ma~ch 5, 1965, from the Water-Sewe~ Construction Fund. ¡-< l::', 1"""" ~ -'" It was moved by Fitzsimmons and seconded by Sonnemann that Austin Const~uction Co. be paid $7,686.87 from the Water-Sewer Construction Fund. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED III The Auburn Cemetery Board submitted for approval the Schedule of Prices for plots in the 4th Addition of the Auburn Cemetery. It was moved by Aaby and seconded by Kline that the Counci I concur with the schedule of prices for plots in the 4th addition of the Auburn Cemetery as recommended by the Auburn Cemetery Board. MOT ION CARR I ED The ~eport and recommendations of the Auburn Planning Commission were ~ead: I. The Auburn Planning Commission recommended the request of Pete l. Scherting to rezone from R-3 (Residential, two-fami Iy dwel lings) to C-3 (Heavy Commercial) property located at 15th and A Streets Southeast be granted. It was moved by Sonnemann and seconded by Calkins that a public hearing be held Apri I 5, 1965, at 8 p. m. in the Counci I Chambers of the City Hall on the Pete L. Scherting request. MOT ION CARR I ED 2. The Auburn Planning Commission recommended the request of Elmer Spencer to rezone f~om C-I (Light Commercial) to C-3 (Heavy Commercial) property located at the Southwest Co~ne~ of the West Valley Highway and Peasley Canyon Road be granted. It was moved by Sonnemann and seconded by Calkins that a public hea~ing be held I Ap~il 5, 1965, at 8 p. m. in the Counci I Chambe~s of the City Hal Ion the Elme~ Spence~ request. MOT ION CARR I ED 3. The Auburn Planning Commission ~ecommended the ~equest of John D. Wadkins for a Special Property Use Pe~mit fo~ rec~eational purposes on prope~ty located at the Bowling Alley, which p~operty is presently zoned C-I be granted. It was moved by Sonnemann and seconded by Calkins that a public hearing be held Ap~il 5, 1965, at 8 p. ffi. in the Counci I Chambers of the City Hal Ion the ~equest of John D. Wadkins for a Special P~operty Use Permit. MOTION CARRIED 4. The Aubu~n Planning Commission recommended the ~equest of the First Baptist Church fo~ a Special P~operty Use Permit for Church purposes on p~ope~ty which is presently zoned R-2 be g~anted. It was moved by Sonnemann and seconded by Calkins that a public hea~in9 be held Apri I 5, 1965, at 8 p. m. in the Counci I Chambe~s of the City Hal I on the First Baptist Chu~ch request for a Special Property Use Permit. MOT I ON CARR I ED John Lea of 1240 25th Street Southeast asked questions conce~ning the activities of City Commissions. The annual report of the Auburn Lib~ary Boa~d fo~ the year 1964 was ~eceived and placed on fi Ie in the office of the City Clerk. I Engineer Ha~old Hagestad submitted to the Counci 1 the Final Estimate in favor of the Val ley Cement Construction Co. fo~ g~ading, bal lasting and surfacing curb and gutter on F Street Southeast between 19th and 21st Street showing $1632.59 due f~om LID #156 Fund and $54.92f~om LID #157 Fund. I t was moved be paid $1632.59 estimate.
