The meeting was called to order by Mayor Gaines. Counci Imen present: Hoyt, lea, Kline, Fitzsimmons, Calkins, Aaby, and Sonnemann. Minutes of the previous meeting held March 15, 1965 were approved as mailed. 1\.9\ </ .-, -- ""'< t= lJ PUBLIC HEARING Mayor Gaines declared the public hearing open on the request of Pete l. Scherting 1- to rezone from R-3 (Residential, two-fami Iy dwellings) to C-3 (Heavy Commercial) property located at 15th and A Streets Southeast. The Auburn Planning Commission recommended this request be granted. It was moved by Calkins and seconded by Hoyt that the public hearing be closed. NDTlON CARR ED It was moved by Sonnemann and seconded by Calkins that the request of Pete l. Scherting to rezone from R-3 to C-3 property located at 15th and A Streets Southeast be granted and that the City Attorney be instructed to draw up the necessary ordinance to implement same. NDT ION CARR I ED Mayor Gaines declared the public hearing open on the request of Elmer Spencer to rezone from C-I (light Commercial) to C-3 (Heavy Commercial) property located at the SW corner of the West Val ley Highway and Peasley Canyon Road. The Auburn Planning Commission reco~ended this request be granted. It was moved by Aaby and seconded by Calkins that the public hearing be closed. The following persons spoke against the granting of a Special Property Use Permit for a skating rink: Armin Rosin, 1335 21st Street Southeast; lee Carel, 132521st Street Southeast; Joseph Albright, 1225 21st Street Southeast; Don Thompson, 131521st Street Southeast; Donald Greggs, 1215 21st Street Southeast; Mrs. Armin Rosin, 1335 21st Street Southeast; John lea, 1240 25th Street Southeast; Mrs. John lea, 1240 25th Street Southeast and Mrs. James Schmitt, 1224 25th Street Southeast. Mr. May representative of Wright Construction Company who wi II be bui Iding the new skating rink showed the council a piece of paneling which is the type they wi II use in the construction of this bui Iding. He said this paneling wi II completely sound proof the building. The following persons spoke in favor of the granting of a Special Property Use Permit for a skating rink: John Wadkins, owner of the property; Mrs. Burillo; ElRoy Childs, 1410 23rd Street Southeast; Phylis Mowrey and Ruth Adams. APR Il 5. 1965 It was moved by Calkins and seconded by Fitzsimmons that the request of John D. Wadkins for a Special Property Use Permit for Recreational purposes on property located at the Auburn Bowling AI ley, which is presently zoned C-I be granted subject to the second plot plan submitted to the Planning Commission which located the bui Iding and parking lot in the north west corner of the total area owned by Mr. Wadkins, and the City Attorney be instructed to draw up the necessary ordinance to implement same. NOTION CARRIED I Mayor Gaines declared the public hearing open on the request of the First Baptist Church for a Special Property Use Permit for church purposes on property which is located on the NW Corner of 25th and M Sts. S.E., and M Sts. S.E., and is presently zoned R-2. The Auburn Planning Commission recommended this request be granted. Rev. Buren Higdon, G. E. Odegard, Rev. Douglas Feazel, and Mrs. C. W. Ritchey spoke in favor of the request. A petition submitted to the Planning Commission signed by 78 residents from 24th & 25th streets between "M" Street & "R" Street objected to the bui Iding of a church on this site. Mr. John lea of 1240 25th Street Southeast and Mrs. JoAnne Schmitt of 1224 25th Street Southeast listed the fol lowing reasons against the building of a church on the corner of I'M" and 25th Street Southeast: I. We bought, purchased or moved to a residential area and we want to keep it that way; 2. Too much traffic for weekends when there Is no school; 3. Too much traffic for narrow residential streets; no adequate thoroughfare leading to property except through residential streets. It was moved by Calkins and seconded by Sonnemann that the public hearing be closed. MOTION CARRIED I It was moved by Sonnemann and seconded by Aaby that the request of the First Baptist Church for a Special Property Use Permit for church purposes on property located on the NW Corner of 25th and M Sts. S. E., presently zoned R-2 be granted, and the City Attorney be instructed to draw up the necessary ordinance to implement same. Mayor Gaines stated that these bids had been referred to the Water-Sewer Committee and Engineering Department. CORRESPONDENCE A letter from the Washington Surveying and Rating Bureau stated they have extended N. B. Class 5 to entire City. 35~. C~ A letter was received from Mr. and Mrs. Elmer R. Nearing expressing their appreciation for the off-street parking areas. The Washington State Pollution Control Commission submitted copies of HEW Form 441, Civi I Rights Agreement, for Green River Community College project for Mayor and City Clerk's Signature. It was moved by Fitzsimmons and seconded by Sonnemann that the Mayor and City Clerk be authorized to sign the Civi I Rights Agreement HEW Form 441. I MOT I ON CARR I ED Engineer's Estimate No. I, submitted by City Engineer Harold Hagestad for Counci I approval showed the amount of $2,016.00 payable from the Street Fund to Rainier Asphalt Paving Co. for asphalt paving on B Street S. E. between Main and Second Streets. It was moved by lea and seconded by Sonnemann that Engineer's Estimate No. I be approved and Rainier Asphalt Paving Company be paid $2,016.00 from the Street Fund. ROll CALL VOTE: All Councilmen voting YES. MOTION CARRIED Commercial Welding Company submitted an invoice in the amount of $295.78 for welding anchor straps on lea Hi II tank job. Richard E. Wolff, Consulting Engineer, approved payment of this invoice. It was moved by Fitzsimmons and seconded by Calkins that Commercial Welding Company be paid $295.78 from the Water-Sewer Construction Fund for welding anchor straps on lea Hi II tank job. Wolff, Consulting Engineer, submitted invoice for inspection on I lea Hi II Water System, showing amount due at this time as $2,029.51. It was moved by Fitzsimmons and seconded by Calkins that Richard E. Wolff be paid $2,029.51 from the Water-Sewer Construction Fund for inspection on lea Hi II Water System. It was moved by Sonnemann and seconded by Aaby that Pittsburg-Des Moines Steel Company be paid $9,998.00 from the Water-Sewer Construction Fund as per Engineer's Progress Estimate No.2. MOTION CARRIED Norman Mi Iler and Donna Mi Iler submitted a Zone Change Application to the Counci I requesting rezoning from R-2 (Residential) to C-I (Commercial) on property located at 3625 Enumclaw Highway. Hagestad, City Engineer, submitted final assessment rol Is for local Improvement Districts No. 156, 157, 158 & 159 to the Council for approval. It was moved by Kline and seconded by Aaby that the City Clerk be instructed to call for a public hearing on Local Improvement Districts No. 156, 157, 158 and 159 to be held May 3, 1965 at 8 p. m. in the Council Chambers at the City Hall, notices of public hearing to be mai led to all property owners in these districts. NíJTION CARRIED The Auburn Municipal Court submitted their Quarterly report to the Counci I showing $8850.66 turned over to the city for the quarter ending March 31, 1965. This report has been placed on fi Ie in the clerk's office. Oario S. Cugini submitted a request for a Special Property Use on property situated on the NE corner of PS HIghway #5 and Dogwood Street S. E. for the Construction of a service station. This request was referred to the Planning Commission. A letter was submitted to the Counci I by 17 owners or co-owners of Taverns requesting the City return to tolerance policy. This matter was referred to the license Committee. Alex Sonnichsen & Associates submitted a letter to the Counci I regarding requested revisions in the revised preliminary plat of Sportsman's Paradise. This letter was referred to the Street Committee. Richard Haag Associates submitted estimate for contract payment to East Val ley Construction Company, showing amount due less 10 percent retainage as $1603.74 from the Municipal Park Construction Fund. It was moved by Sonnemann and seconded by Calkins that East Val ley Construction Company be paid $1603.74 from the Municipal Park Construction Fund. ROll CAll VOTE: AI I Councilmen voting YES. NDTION CARRIED MAYOR'S PROCLAMATIONS & APPOINTMENTS Mayor Robert E. Gaines proclaimed Apri I 5 to Apri I 10, 1965 as Venture Week in the City of Auburn. Mayor Gaines appointed Dr. George Nickelsen, Frank Natsuhara and A. Rossi to the Board of Park Commissioners. It was moved by Sonnemann and seconded by lea that the Mayor's appoint~ent of Dr. George Nickelsen, Frank Natsuhara and AI Rossie to the Board of Park Commissioners be approved. OOTION CARRIED Mayor Gaines appointed George Freemire as Park Superintendent. It was moved by Kline and seconded by Sonnemann that the Mayor's appointment of George Freemire as Park Superintendent be approved. MOTION CARRIED Mayor Gàines designated George Nickelsen as temporary Chairman of the Board of Park Commissioners and M. G. Schweikl, Cal Scarff, Gene Colburn and Martin Yourglich as associate members. Mayor Gaines appointed Ray Schumsky as a member of the Planning Commission to fi II a vacancy expiring in J~7. It was moved by Fitzsimmons and seconded by Kline that the Mayor's appointment of Ray Schumsky as a member of the Planl)-lng Commission be approved. Mr. VanWinkle was referred to the Street Committee and City Engineer. COUNCIL COMMITTEE REPORTS STREET COMMITTEE - COUNCilMAN lEA It was moved by lea and seconded by Sonnemann that Heisserman Construction I Company, Inc. be awarded the bid for the construction of concrete curb and gutter, - grading, ballasting and asphalt concrete surfacing on First Street N. NOTION CARRIED WATER-SEWER COMMITTEE - COUNCilMAN FITZSIMMONS Attorney Smythe read an agreement between the City of Auburn and School District No. 408 for providing water for the Green River Col lege. It was moved by Kline and seconded by Sonnemann that the Mayor and City Clerk be authorized to sign the agreement for providing water for the Green River Col lege. OOT I ON CARR I ED City Attorney Smythe read the agreement between the City of Auburn and School District No. 408 for providing sewer service for the Green River College. It was moved by Fitzsimmons and seconded by Sonnemann that the Mayor and City Clerk be authorized to sign this agreement for providing sewer service for the Green River College. ROll CAll VOTE: AI I Councilmen voting YES. NDTION CARRIED I It was moved by Fitzsimmons and seconded by Kline that W. J. Schade be awarded the contract for the lea Hi II intercepter Sewer line and lift Station as bid under Proposal III, $189,048.45. ROLL CAll VOTE: All Councilmen voting YES. OOTION CARRIED It was moved by Fitzsimmons and seconded by Sonnemann that all bid bonds be returned to the unsuccessful bidders upon the signing of the contract and receipt of a performance bond. NDTION CARRIED It was moved by Fitzsimmons and seconded by Kline that the City Clerk be authorized to cal I for bids for the sale of one used Wemco Torque Flow Pump with electric motor and foundation plate, bids to be opened at 3 p. m., Apri I 15, 1965. NDTION CARRIED It was moved by Fitzsimmons and seconded by Kline that the City Clerk be authorized to cal J for bids for construction of modifications to the existing Sewage lagoon, bids to be opened at 3 p. m., Apri I 27, 1965. MOT I ON CARR I ED ANNEXATION COMMITTEE - COUNCilMAN SONNEMANN I Counci Iman Sonnemann reported that he had received the Bocek Annexation Petition with the Engineer's Certificate that his department has examined the signatures on the petition and that said petition bears the signatures of the owners of 100 per cent in value, according to the assessed valuation for general taxation. WATER DEPARTMENT - UTilITY SUPERINTENDENT TOllEFFSON Utility Superintendent Tollefson reported that the Water Department Car had come in to the Dealer, and the Water Department Back-hoe had been delivered and the old back-hoe traded in.
