The meeting was cal led to order by Mayor Gaines. Counci Imen present: Hoyt, Lea, Kline, Fitzsimmons, Calkins, Aaby, and Sonnemann. Minutes of the previous meeting held Apri I 5, 1965 were approved as mai led. PUB LI C HEAR I NG Mayor Gaines declared the public hearing open on the petition of Ruth and Reinhart Klein for the vacation of a portion of the al ley alying between East Main and 0 Streets N.E. Kenneth Ingal Is, attorney in behalf of Reinhart and Ruth Klein asked that their petition for the vacation of this al ley be withdrawn. It was moved by Klein and seconded by Calkins that the public hearing be closed. MOTION CARRIED It was moved by Klein and seconded by Calkins that the withdrawal of the petition by Reinhart and Ruth Klein be accepted. MOTION CARRIED BIDS The following bid was opened at 3 p. m. Thursday, Apri I 15, 1965, for the sale of a Wemco Torque Flow Pump from the Water Dept. City of Enumclaw - - - - - - - - -Bid Sales tax Total $375.00 15.00 $390.00 It was moved by Fitzsimmons and seconded by Kline that the City of Enumclaw be awarded the bid for the sale of a Wemco Torque Flow Pump in the amount of $390.00, and the City Attorney be instructed to draw up the necessary Ordinance to implement sale. A letter from Park Commission requested the City authorize city clerk to cal I for bids for lighting on the 5th and K St. Sal I Field No.2. It was moved by Fitzsimmons and seconded by Klein that the city clerk be instructed to call for bids for lighting on the 5th and K St. Bal I Field No.2 bids to be opened 3 p. m. Thursday, Apri I 29, 1965, specifications to be obtained from the office of the city clerk, all bids to be submitted in writing and addressed to the Mayor and City Counci I, bids to be accompanied by a bid bond or certified check in an amount not less than 5% of the bid price. MOTION CARRIED 3'64 AUBURN. WASHINGTON OONDAY APRI L 19. 1965 Sixteen residents in the area of B Street Southeast between 8th and 9th Streets requested the City oil or otherwise hard surface this street. This petition was referred to the Street Committee. Clark, Coleman & Rupeiks submitted an invoice for contract payment on traffic and parking study in the amount of $3,000.00, to be made payable from L.I.D. Fund No. 155. It was moved be paid $3,000.00 parking study. ROLL CALL VOTE: by Lea and seconded by Sonnemann that Clark, Coleman & Rupeiks from L.I .D. Fund No. 155 for contract payment on traffic and A II Counc i Imen vot i ng YES. MOTION CARRIED Mark Hedman submitted a Zone Change Application to the council, requesting change in zoning from R-2 to R-4 property located at 27th and D Sts. S. E. (Approximately 8 lots). This Zone Change Application was referred to the Planning Commission. A letter was received from the Association of Washington Cities in regard to the need for a Memorandum of Understanding between the State Highway Department and cities for carrying out transporation studies and planning. A letter from the Washington State Highway Commission was received requesting a Memorandum of Understanding between State and Local Goverments for continuance of the Puget Sound Regional Transportation Study. Mayor Gaines stated there would be a Resolution read later in the meeting in regard to the Memorandum of Understanding. '_,..~-,../ A letter from Harold A. Hagestad, City Engineer, requested two new draftsmen for Public Works Department. Mayor Gaines stated that an Emergency Ordinance would be read later in the meeting in accordance with this request. A letter from the Washington State Pollution Control Commission approved the Lea Hi II Interceptor, Lateral Sewers and Lift Station Construction. A letter was received from Carey and Kramer, Consulting Engineers, regarding bid call for the Sewage Lagoon Nodification Project. It was moved by Fitzsimmons and seconded by Aaby that the City Clerk be instructed to cancel the call for bids for the Sewage Lagoon Nodification Project as requested by the Washington State Pollution Control Commission. MOTION CARRIED A letter from Parents Club of the Holy Fami Iy Church requested permission for license to sell safe and sane fireworks. This request was referred to the Fire Chief and License Committee. A letter was received from Health Officer, Naomi Pettengi II, regarding complaint of overflowing cess pool. This complaint was referred to the Uti lity Superintendent and City Attorney. A letter was received from Health Officer, Naomi Pettengil I, regarding overflowing septic tank. This letter was referred to the Uti lity Superintendent and City Attorney. A letter was received from Hugh G. Goldsmith and Associates in regard to road improvements in Forest Ridge Addition. Mayor Gaines proclaimed the week of Apri I 26 to 30 as Li fe Insurance Week. AUO I ENCE Kenneth Ingal Is, attorney representing Drive-In Restaurant Owners, requested the Counci I adopt an Ordinance al lowing police jurisdiction on private property such as Drive-In Restaurants, Super Markets, Tavern Parking Lots, etc. I Rolf Ludviksen explained the problems they are having with their Drive-Ins~ Mayor Gaines appointed Counci Iman Hoyt, Chief of Police Darby, and City Attorney Smythe to a committee to meet with Kenneth Ingal Is to discuss the possibi lity of adopting an Ordinance which would give the Police Department authority to maintain control on private property. COUNCIL COMMITTEE REPORTS STREET COMMITTEE - COUNCILMAN LEA Counci Iman Lea reported that the Street Committee is working on the replat of Sportsman Paradise. POLICE COMMITTEE - COUNCILMAN KLEIN Counci Iman Klein reported that the Police Committee was in favor of calling for bids for the purchase of two four door Sedans for the Police Department. liCENSE COMMITTEE - COUNCILMAN CALKINS It was moved by Calkins and seconded by Sonnemann that the New Moon Cafe be granted a Cabaret License for the year 1965. MOTION CARRIED III PURCHASING COMMITTEE - COUNCILMAN SONNEMANN It was moved by Sonnemann and seconded by Calkins that the City Clerk be instructed to cal I for bids for the purchase of two four door Sedans for the Police Department, bids to be opened 3 p. m. Thursday, Apri I 29, 1965, specifications to be made avai lable in the office of the City Clerk, al I bids to be on a firm bid basis, submitted in writing and addressed to the Mayor and City Counci I of the City of Auburn. MOTION CARRIED DEPARTMENT HEAD REPORTS PARK DEPARTMENT - PARK SUPERINTENDENT FREEMIRE Park Superintendent Freemire reported that Kenneth Fitzsimmons and Ted Lea had donated shrubs to the Park. FIRE DEPARTMENT - FIRE CHIEF CALKINS Fire Chief Calkins reported on the Yakima Command School attended by four firemen Apri I 12 to 15, 1965. ORDINANCE NO. 1762 I Pending. ORDINANCE NO. 1763 City Attorney Smythe read an amendment to Sec. 701 of the original copy of this ordinance as distributed to the Counci I. It was moved by Fitzsimmons and seconded by Kline that the reading of Ordinance No. 1763 be waived as al I the Counci 1 had received copies of this ordinance and were familiar with its contents. MOTION CARRIED RESOLUTION NO. 184 It was moved by Fitzsimmons and seconded by Calkins that Resolution No. 184 entitled "A RESOLUTION OF THE CITY OF AUBURN, WASHINGTON, TRANSFERRING THE SUM OF $2,000.00 FROM THE "WATER FUND" OF THE CITY OF AUBURN TO THE "WATER-SEWER CONSTRUCTION FUND" (LEA HILL), ON A LOAN BAS IS, TO PROVI CE NECESSARY FUNDS FOR MI SCELLANEOUS EXPENDITURES DUE IN SAID WATER-SEWER CONSTRUCTION PROJECT," be introduced and adopted. MOTION CARRIED RESOLUTION NO. 185 It was moved by Lea and seconded by Klein that Resolution No. 185 entitled "A RESOLUT ION OF THE CITY OF AUBURN, WASH I NGTON, APPROV I NG THE FORM OF THE MENlJRANDUM OF UNDERSTANDING BETWEEN THE HIGHWAY COMMISSION AND THE CITY OF AUBURN, AND AUTHORIZING ITS EXECUTION," be introduced and adopted. MOT I ON CARR I ED OLD BUSINESS Attorney Smythe reported that he had received the deeds from Massey for right-of-way on R Street Southeast extension, and that they could be recorded as soon as the city receives the agreement from the Game Farm. At that time the City should have all right-of-ways on R Street Southeast extension except for Sportsman Paradise. Counci Iman Klein discussed Engineering Costs on the Lea Interceptor Sewer. Mayor Gaines asked that Hi II and Ingman be asked to attend the next interim Council Meeting to be held Apri I 26, 1965 to explain the Engineering Costs on the Lea Hi II Interceptor Sewer. It was moved by Lea and seconded by Klein that the Planning Commission look into the matter of amending Sec. 11.16.090 D & G of the Auburn City Code which establishes the requirements for Special Property Use under C-I and C-2 Zoning. MOTION CARRIED Mayor Gaines stated that the Lyden property would be discussed at the next regular meeting of the Counci I. ~ NEW BUSINESS It was moved by Sonnemann and seconded by Aaby that John Kelly, city treasurer, be authorized to call for bids for the sale of up to $215,000 of revenue warrants for temporary financing of the Lea Hi I I project, to be redeemed within six months. MOTION CARRIED Counci Iman Klein asked that Resolution No. 170, "A RESOLUTION OF THE CITY OF AUBURN, WASHINGTON, CONCURRING WITH THE RECOMMENDATIONS OF THE WATERSHED COMMITTEE OF THE ASSOCIATION OF WASHINGTON CITIES OPPOSING THE EFFORTS OF FEDERAL GOVERNMENTAL AGENCIES IN ATTEMPTING TO OPEN MUNICIPAL WATERSHEDS FOR UNRESTRICTED ACCESS AND RECREATIONAL DEVELOPMENT WITHOUT REGARD TO THE ECONOMIC REQUIREMENTS OF THE AREAS AFFECTED AND CONTRARY TO THE RECOMMENDATIONS OF LOCAL INTERESTS AND PUBLIC HEALTH AUTHORITES," be reviewed, as he felt the City Counci I should take some action to help the residents of Lester. ~f)8 OONDAY APRIL 19. 1965 AUBURN, WASHINGTON CLAIMS It was moved by Fitzsimmons and seconded by Calkins that the claims as approved by the Audit Committee be paid.
