"",:tJflr' ¡,' ',. .. Councilmen present: Hoyt, Lea, Kline, Fitzsimmons, Calkins, Aaby, and Sonnemann. Minutes of the previous meeting held July 6, 1965 were approved as mailed. CORRESPONDENCE The City Clerk read the Quarterly report of the Auburn Municipal Court showing $10,042.00 remitted to the city for the quarter ending June 29, 1965. I Mayor Gaines asked that the report be placed on file. Richard E. Wolff, consulting engineer, submitted the final payment due Austin Construction Company in the amount of $8,895.54 payable from the Water-Sewer Construction Fund. Since a claim of $603.20 had been filed against Bednorz Construction Co., a sub-contractor of the Austin Construction Co., it was suggested by City Attorney Smythe that $1,000 be withheld as a reserve to discharge this claim plus prospective attorney fees and court costs. It was moved by Fitzsimmons and seconded by Sonnemann that the final payment due Austin Construction Co., less the $1,000 reserve, be approved, making a net amount of $7,895.54 to be paid at this time from the Water-Sewer Construction Fund. ROLL CALL VOTE: All Counci Imen voting YES. N()TION CARRIED A petition was submitted to the Council, for formatIon of a Local Improvement District for installation of a two course bituminous surfacing 34 feet in width on H St. SE from 9th S to south line of Auburn Public library and on 9th St. SE from H St. E to east line of Auburn Public library, by W. T. Hagen, Charlotte Frank, Jessie Ray Webb and Auburn Public Library. City Engineer Hagestad's Certification accompanied I this petition estimating the cost to be $1,310.40 and certified that signatures constituted 71.9% of total assessable square footage; 78.5% of frontage and 71.9% of total area in proposed L.I.D. It was moved by Lea and seconded by Hoyt that the City Attorney be instructed to draw up the necessary Ordinance to implement the formation of this L.I.D. N()TION CARRIED John R. Bocek and Harold V. Ray submitted a petition for formation of a Local Improvement District for construction of an 811 sanitary sewer adjacent to property of petitioners running south from Enumclaw Highway to City limits, City Engineer Hagestad's certification estimated the cost of this improvement to be $8,890.00 and certified that the signatures represented 100% of total assessable square footage, frontage and area in said proposed L.t.D. It was moved by Kline and seconded by Calkins that the City Attorney be instructed to draw up the necessary Ordinance to implement the formation of this L.I.D. NDTION CARRIED A letter from Judge George Fiori requested the City guarantee wage payments under the Youth Corps enrollee program pending receipt of federal monies. The Finance Committee recommended that the City of Auburn guarantee wage payments under the Youth Corps enrol lee program for a period not to exceed four weeks, pending receipt of federal monies applied for. I The Finance Committee recommended that payment from the General Cumulative Reserve Fund be made for real property offered for sale by the General Services Administration. The cost of the property would be either $22,245.00 or $21,852.00 depending upon the width of road decided upon. The City Clerk read the recommendations of the Planning Commission. C. recommended that the request of John Bocek to rezone from R-2 to R-5 property located across from the Chinook School on the Enumclaw Highway be granted provided a 40 ft. buffer zone is retained on the south portion of this property. It was moved by Sonnemann and seconded by Calkins that the City Clerk be instructed to call for a public hearing to be held 8 p. m., August 2, 1965, on the request of John Bocek to rezone from R-2 to R-5 property located across from the Chinook School on the ~numclaw Highway. N()TION CARRIED The A. p. C. recommended that the request of Mack F. McEuen to rezone from R-3 to R-4 property located at 1309 M St. SE be denied because of extensive neighborhood opposition to this rezoning, same being detrimental to their respective properties. It was moved by Sonnemann and seconded by Calkins that the City Clerk be instructed to call for a public hearing to be held 8 p. m., August 2, 1965, on the request of Mack F. McEuen to rezone from R-3 to R-4 property located at 1309 M St. SEe NDTION CARRIED The A. P. C. reported that the request of C. A. Heisserman for Special Property Use to operate Auto Wreckinq Yard on property located on Second St. NW had been tabled for further study. Mayor Gaines asked that this information be placed on file and that the Council familiarize themselves with this request. The A. p. C. reported that the request of Harvey T. Brinkley to rezone from R-2 to C-3 and from R-2 to R-5 property located at 3804 Enumclaw Highway had been held In obeyance for further study of the street pattern for this area. Mayor Gaines asked that this report be placed on file. The A. p. C. recommended the approval of proposed amendments to Section 35 of Zoninq Ordinance, concerning the Board of Adjustments and amendments to Sections 15 and 17 of the Zoning Ordinance, concerning C-I and C-3 (Service Stations and Recreational Uses). It was moved by Sonnemann and seconded by Lea that the City Clerk be instructed to call for a public hearing to be held 8 p. m., August 2, 1965, on proposed amendments to Section 35 of Zoning Ordinance, concerning the Board of Adjustments and amendments to Sections 15 and 17 of the Zoning Ordinance, concerning C-I to C-3 (Service Stations and Recreational Uses) and on proposed amendment to Article 6, Section 36, Paragraph B-1 of Ordinance No. 1702 setting the fee for petitions to rezone or requests for Special Property Use at $50.00 and making additional provisions for Notices of Public Hearing where changes in boundaries are involved. NOTION CARRIED Peckenpauqh Druq Company submitted request to establish pay station for city utilities at their store. Mayor Gaines referred this request to the Water-Sewer Committee and City Treasurer John Kelly. Vernon C. Canfield submitted zone change application to rezone from R-3 to C-I property located at 1248 East Main. Mayor Gaines referred this request to the Planning Commission. MAYOR'S APPOINTMENT Mayor Gaines appointed Frank Wilber as new member to the Cemetery Board. It was moved by Calkins and seconded by Sonnemann that the appointment of Frank Wilber as new member to the Cemetery Board be approved. NDTION CARRIED AUD I ENCE Mr. A. C. Boelke, resident at 520 6th Street Southeast, informed the Council of damage to surface of "Ft! Street Southeast between 5th and 6th Street Southeast which needs repair. St. bids to be opened at 3 p. m., July 29, 1965. N.E., MOTION CARR I ED POLICE CO"^,,,ITTEE - COUNCILMAN KLINE I Counci Iman Kline reported on the Police Committee Meetinq held July 13, 1965. WATER-SEWER COMMITTEE - COUNCILMAN FITZSIMMONS It was moved by Fitzsimmons and seconded by Aaby that the City Clerk be instructed to call for bids for the construction of modifications to the existing sewage lagoon, bids to be opened August 12, 1965 at 3:00 p. m., specifications to be obtained from the offices of Carey and Kramer, Consulting Engineers, 1917 First Avenue, Seattle, Washington. MOT I ON CARR I ED LICENSE COMMITTEE - COUNCILMAN CALKINS Counci Iman Calkins reported that he had received a complaint aqainst dances at the Fratern i ty Ha II. EMPLOYEE BENEFITS COMMITTEE - COUNCILMAN AABY Councilman Aaby reported that the Employee Benefits Committee approved a system of pay ranqes for city employees other than elected officials and those covered by Civil service. These are based on five percent increases. No salaries were s-et and the system sets no time for pay increases to take effect. He reported that the committee would like Council approval on this method of pay ranges at this time so the department heads could use the schedule in working on the 1966 Budget. I It was moved by Aaby and seconded by Sonnemann that the pay ranges as proposed by the Employee Benefits Committee for city employees be approved. OOTION CARRIED DEPARTMENT HEAD REPORTS FIRE DEPARTMENT - FIRE CHIEF CALKINS Fire Chief Calkins reported that Firemen had attended the annual fire col leqe at Vancouver. Washinqton. He said that three men from the Auburn Fire Department placed in the top ten in tests given at the school, and one of these men had received the highest grade in the test. He also reported that the Auburn Fire Department placed fourth in the hose laying contest. WATER-SEWER DEPARTMENT - UTILITIES SUPERINTENDENT TOLLEFSON Uti Ii ties Superintendent Tollefson reported that the Auburn Water Department had received a safety award from the American Water Works Association. ORDINANCE NO. 1798 It was moved by Kline and seconded by Hoyt that Ordinance No. 1798 entitled "AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, DECLARING A PUBLIC EMERGENCY TO EXIST I 'AND APPROPRIATING THE SUM OF $2,000.00 FROM UNBUDGETED FUNDS IN THE CURRENT EXPENSE FUND OF THE CITY OF AUBURN, TO PROVIDE NECESSARY FUNDS FOR THE CHIEF OF POLICE TO ATTEND THE FEDERAL BUREAU OF INVESTIGATION LAW ENFORCEMENT SCHOOL IN WASHINGTON, D.C. be adopted. ROLL CALL VOTE: All Councilmen voting YES. NOTION CARRIED ORDINANCE NO. 1805 City Attorney Smythe read Ordinance No. 1805. City Engineer Hagestad introduced Ed Nowgroski and Abe Spear of the Auburn Industrial Center. Abe Spear, speaking for the Auburn Industrial Center, stated that they would like to see 100 ft. through street parallel ling Ginny Street. City Engineer Hagestad stated that Mel Tenant and Mr. Welch of Commonwealth were fully in accord with this plan, and that Superintendent of Schools Hayes Holeman stated that he thought the school district would dedicate the necessary 40 feet to the City of Auburn for the proposed street. It was moved by Sonnemann and seconded by Lea that Ordinance No. 1805 entitled "AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR THE PURCHASE OF CERTAIN REAL PROPERTY SITUATE WITHIN THE CORPORATE LIMITS OF THE CITY, TO PROVIDE ADDITIONAL PARK AND ROADWAY AREA FACiliTIES FOR THE CITY OF AUBURN, AND FOR ADDITIONAL GENERAL MUNICIPAL PURPOSES", be introduced and adopted. MOTION CARRIED ORDINANCE NO. 1806 It was moved by Sonnemðnn and seconded by Hoyt that Ordinance No. 1806 entitled "AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, RELATING TO AND PROVIDING FOR THE VACATION OF A PORTION OF A CERTAIN STREET SITUATE WITHIN THE CORPORATE LIMITS OF THE CITY OF AUBURN", be introduced and adopted. NOTION CARRIED RESOLUTION NO. 192 It was moved by Fitzsimmons and seconded by Sonnemann that Resolution No. 192 entitled "A RESOLUTION OF THE CITY OF AUBURN, WASHINGTON, GUARANTEEING THE PAYMENT OF ONE MONTHS' SALARIES FOR THE YOUTH CORPS EMPLOYEES OF THE CITY OF AUBURN FOR THE YEAR 1965" be introduced and adopted.
