HomeMy WebLinkAbout09-07-1965 12 AUBURN, WASHINGTON NONDAY SEPTEMBER 7. 1965 The regular meeting of the City Counci I of the City of Auburn was held at 8:00 P.M. in the Counci I Chambers at the City Hall. The meeting was cal led to order by Mayor Gaines. Counci Imen present: Hoyt, Lea, Kline, Fitzsimmons, Calkins, Aaby and Sonnemann. Minutes of the previous meeting, held August 16, 1965, were approved as mailed. PUBLI C HEAR I NGS Mayor Gaines declared the public hearing open on the request of H. S. Jones to rezone from R-4 Residential to C-I Commercial, property located at 2nd & Division St. The Auburn Planning Commission recommended this request be granted as it wil I conform to the comprehensive land use of the area. There being no discussion, it was moved by Calkins and seconded by Hoyt, that the public hearing be closed. MOTION CARRIED It was moved by Kline and seconded by Calkins, that the request of H. S. Jones to rezone from R-4 Residential to C-I Commercial, property located at 2nd & Division St. N. be granted. MOT ION CARR I ED Mayor Gaines declared the public hearing open on the request of Wi Iliam Berens to rezone from R-2 Residential to C-I Commercial, property located at 2236 Auburn Avenue. The Auburn Planning Commission recommended this request be granted as it wil I conform to the comprehensive land use of the area. There being no discussion, it was moved by Calkins and seconded by Hoyt, that the public hearing be closed. MOT ION CARR I ED It was moved by Lea and seconded by Calkins, that the Counci I concur with the recommendation of the Planning Commission and grant the request of Wi I liam Berens to rezone from R-2 to C-I, property located at 2236 Auburn Avenue. NOT ION CARR I ED Mayor Gaines opened the public hearing on the request of Harvey T. Brinkley to rezone from R-2 Residential to C-3 Commercial and R-5 Mobile Home Park, property located at 3804 Enumclaw Highway. The Auburn Planning Commission recommended this request be granted on both parcels to a depth of 250 feet perpendicular from the north line of the Enumclaw Highway. There being no discussion, it was moved by Aaby and seconded by Calkins, that the public hearing be closed. MOTION CARRIED It was moved by Aaby and seconded by Sonnemann, that the Counc i I concur wi th the Planning Commissions recommendation and grant the request of Harvey T. Brinkley to rezone from R-2 Residential to C-3 Commercial and R-5 Mobile Home Park to a depth of 250 feet perpendicular from the north line of the Enumclaw Highway, property located at 3804 Enumclaw Highway. Heisserman for I a Special Property Use Permit to operate an auto wrecking yard on property located on Second St. N.W. Jodie Frese submitted a petition signed by two hundred thirty-six residents of the area opposing the granting of this Special Property Use Permit. Kenneth Ingal Is, Attorney representing C~ A. Heisserman, sited reasons why this Special Property Use Permit should be granted. I I I AUBURN, WASHINGTON NONDAY SEPTEMBER 7. 1965 1 iJ Mrs. Elmer Davis spoke in opposition to the granting of this request. A letter was received from the Auburn School Board of Directors pointing out the possibi Ii ties of traffic hazard, noise and smoke damage which may result if this permit is granted. The Auburn Planning Commission recommended this request be granted subject to the City Engineer's approval of the plan for this use as being in compliance with the requirements as set forth in Section 19 of the City of Auburn Zoning Ordinance. Planning Director Schuler referred the Counci I to Section 32 of the City of Auburn Zoning Ordinance which set up"the industrial performance standards, of which the auto wrecking yard would have to conform. Mr. Davis pointed out that the County had passed legislation prohibiting burning of this nature. Mary Rice asked the Counci I to use their discretion in deciding this request. It was moved by Kline and seconded by Lea that this matter be tabled for further study. NOTION CARRIED CORRESPONDENCE Blythe & Co., Inc. submitted a letter to the Counci I summarizing the results of the recent sale of $665,000 Water and Sewer Revenue Bonds, 1965. Mayor Gaines ordered the letter filed. Payment of 10% retained in the amount of $2,340.94 on the contract of Val I~Co-op for installation of sprinkling system at the Les Gove Park was submitted for approval. The Park Board submitted a letter to the Council requesting approval of this payment. It was moved by Sonnemann and seconded by Kline, that $2,340.94 which was the 10% retained on the contract for installation of sprinkling system at the Les Gove Park, be paid Valley Supply Co-op. ROLL CALL VOTE: AI I Councilmen voted YES. MOTION CARRIED Payment of Engineer's Progress Estimate No.4 to W. J. Schade & Sons of $60,619.32, which is the amount due as of August 20, 1965 on the Lea Hil I Interceptor Sewer less 10% retained, was submitted for approval. A letter from H. A. Hagestad, City Engineer, and R. B. Tollefson, Uti lities Superintendent, recommended that Progress Estimate No.4 and Change Order No. I be approved. It was moved by Fitzsimmons and seconded by Calkins, that W. J. Schade & Sons be paid $60,619.32, which is the amount due as of August 20, 1965 on the Lea hi I I Interceptor Sewer less the 10% retained, and that the Mayor and City Clerk be authorized to sign Change Order No. I. ROLL CALL VOTE: AI I Counci Imen voted YES. MOTION CARRIED Harold A. Hagestad, City Engineer, submitted a Comprehensive Street Program to the Counci I for consideration and Public Hearing. It was moved by Lea and seconded by Kline, that the City Clerk be instructed to call for a public hearing on the Comprehensive Street Program to be held October 4, 1965 at 8 p. m. in the Council Chambers at the City Hal I. MOTION CARRIED Forty-four residents of the Fort Muckleshoot Trai ler Court submitted a petition to the Counci I requesting that Karl L. Warburton, manager of Skylark Trai ler Vii lage, 900 29th St. S.E. be restrained from further burning of brush and logs which may damage or constitute a fire hazard to Mible Homes in the Court; also that noise nuisance caused by early morning bulldozing be prohibited. Mayor Gaines referred this petition to the Fire Committee. 14 AUBURN. WASHINGTON NONDAY SEPTEMBER 7. 1965 w ~ ~ "'- "'!3 Notification was received from the City of Kent stating they wish to continue the present agreement for dog warden services for the year 1966 at annual rate of $4,500. Counci Iman Kline stated that the Police Department found it hard to administer control over the dog warden when he is working outside the jurisdication of the City of Auburn. Mayor Gaines asked that this letter be placed on fi Ie. A letter was received from Richard Haag Associates outlining their views as to land- scape architectural fees due them for services rendered for the Les Gove Park. Mayor Gaines asked that this letter be placed on fi Ie, and stated that further meetings I would be held on this. The Municipal Code Committee, State of Washington, submitted a letter to the council requesting the city's participation in thinking and drafting of the proposed model Municipal code. Mayor Gaines instructed the City Clerk to answer this letter and then place it on file. He also asked all city officials to work with the Munitipal Code Committee. The Val ley Regional Planning Commission submitted a report of the activities of their committee during the past year. Mayor Gaines asked that this letter be placed on file. The Washington Surveying and Rating Bureau submitted to the Council their report of the acceptance test conducted on the 1,250 g.p.m. pumper recently delivered by Mack Trucks, I nc. Mayor Gaines asked that this report be placed on fi Ie. Engineer's Estimate HI in favor of Heisserman Construction Company was submitted to the Counci I for approval, showing amount due on the R st. N.E. Contract as of August 31, 1965, less the 10% retained, as $5,126.00. It was moved by Lea and seconded by Sonnemann, that Engineer's Estimate #1 be I approved, and Helsserman Construction Company be paid $5,126.00 for work on the R St. N. E. contract. ROLL CALL VOTE: AI I Counci Imen voted YES. NOTION CARRIED A petition for formation of an L.I.D. for water Mðins and fire hydrants on S. E. 316th between,tI6thc8Qd(i24th;. on S. ELH6tb~betweén'316thaM¡326th place; on S. E. 326th place between 114th and 116th and on S. E. 320th between 116th and 118th, was submitted to the Counc i I. Accompanying this petition was City Engineer Harold A. Hagestad's certification that said estimate of cost and expenses on the proposed L.I.D. HI65 is $29,116.01, and that the aggregate actual valuation of the real estate, including 25% of the actual valuation of the improvements in the proposed L.I.D. according to the valuation last placed upon it for the purposes of general taxation is $50,415.00, and that the signatures contained on the petition submitted for proposed L.I .D. #165 constitutes 52.54% of the total frontage in said proposed improvement district, and 54.74% of the total área i I1såi·d ptoposedimpròvement d.rs tr i ct. It was moved by Fitzsimmons and seconded by Sonnemann, that the City Attorney be instructed to draw up the necessary Ordinance to implement this L.I.D. MOTION CARRIED The Auburn Cemetery Board submitted a request to borrow $10,000 from the Cemetery Endowed Care Fund for cemetery improvements, this amount to be repaid within a seven year period. I The Auburn Finance Committee recommended this request be approved. I I I AUBURN, WASHINGTON NfJNDAY SEPTEMBER 7, 19651 5 It was moved by Kline and seconded by Calkins, that the City Attorney be instructed to draw up the necessary Ordinance to implement the loan of $10,000 from the Cemetery Endowed Care Fund to the Cemetery Fund for cemetery improvements, this amount to be repaid within a seven year period. MOTION CARRIED A letter was received from the State Department of Health approving Addendum No. I of the Lagoon Modifications Project. Mayor Gaines asked that this letter be placed on fi Ie. R. B. Tollefson, Utilities Superintendent, requested permission for John Hurt to attend the Ninth Inland Empire Waterworks School at Pullman, Washington, from September 13 thru 15, 1965. It was moved by Kline and seconded by Calkins, that this request be granted. MOTION CARRIED Harold A. Hagestad, City Engineer, requested permission for George Schuler to attend the executive committee meeting of the Washington State Good Roads Association to be held in Bellingham, Washington, September 14, 16, and 17, 1965. It was moved by Lea and seconded by Kline, that this request be granted. MOTION CARRIED The Auburn Park Board requested permission for Park Superintendent George Freemire, and Planning Director George Schuler to attend the Interagency Committee on Parks and Recreation meeting to be held at Lake Chelan on Friday, September 10, 1965. It was moved by Aaby and seconded by Fitzsimmons, that this request be granted. MOTION CARRIED Herman M. Nirschl submitted a zone change application requesting zoning reclassification from A-I Agriculture to M-I Light Industrial on property located at 4005 Auburn Avenue. Mayor Gaines referred this application to the Planning Commission. AUD I ENCE Victor Graham, representative of the Committee for Civic Center, presented a proposal to construct a Civic Auditorium which would seat 7500 people. He stated the committee was applying for Federal Funds to conduct a Comprehensive Study of the project . MAYOR'S PROCLAMATION Mayor Robert E. Gaines proclaimed September 13, 1965 as World Law Day for the City of Auburn. COUNCIL CO,WAITTEE REPORTS WATER-SEWER COMMITTEE - COUNCILMAN FITZSI~NW)NS Counci Iman Fitzsimmons reported the Water-Sewer Committee had received correspondence concerning a Municipal Airport and it had been held in abeyance. It was moved by Fitzsimmons and seconded by Kline, that Hi I I & Ingman be aged to make a feasibi lity report regarding a sewer line for the Boeing Plant, subject to a negotiated contract. ROLL CALL VOTE: AI I Counci'men voting YES. MOTION CARRIED It was moved by Fitzsimmons and seconded by Sonnemann that Richard E. Wolff, Consulting Engineers, be asked to make a feasibility report regarding a water line for the Boeing Plant, subject to a negotiated contract. ROLL CALL VOTE: AI I Counci Imen voting YES. NOTION CARRIED ORDINANCE NO. 1819 I It was moved by Lea and seconded by Fitzsimmons that Ordinance No. 1819 entitled "AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, AMENDING SECTION 9.22.130 OF THE AUBURN CITY CODE, SAID SECTION 9.22.130 RELATING TO THE DESIGNATION OF NO PARKING AREAS WITHIN THE CORPORATE LIMITS OF THE CITY OF AUBURN, PURSUANT TO SECTION 13 OF ORDINANCE NO. 1465 OF THE CITY OF AUBURN, be introduced by title only. NOTION CARRIED Mayor Gaines asked that a copy of Ordinance No. 1819 be given to each Councilman. ORDINANCE NO. 1820 It was moved by Fitzsimmons and seconded by Calkins that Ordinance No. 1820 entitled "AN ORD I NANCE OF THE CITY OF AUBURN, WASH I NGTON, PROVI DING FOR THE I NSTALLATlON AND CONSTRUCTION OF WATER MAINS AND FIRE HYDRANTS ON S. E. (16th BETWEEN 312th AND 320th; ON S. E. 116th BETWEEN 320th AND 116th PLACE; ON S. E. 116th PLACE BETWEEN 116th AND 112th; AND ON S. MOT I ON CARR I ED I OLD BUSINESS Attorney Smythe reported that he had received satisfaction of the Claim of Lien filed with the King County Auditor against the property owned by the City of Auburn by the Bednorz Company. It was moved by Sonnemann and seconded by Aaby that the City Attorney be instructed to record this satisfaction of the Claim of Lien. MOTION CARRIED CLAIMS It was moved by Sonnemann and seconded by Calkins, that the claims as approved by the Audit Committee be approved.
