The regular meeting of the City Counci I of the City of Auburn was held at 8:00 P. M. in the
Counci I Chambers at the City Hal I.
The meeting was cal led to order by Mayor Gaines
Counci Imen present: Hoyt, Lea, Kline, Fitzsimmons, Calkins, Aaby and Sonnemann.
Minutes of the previous meeting, held September 7, 1965 were approved as mai led.
CORRESPONDENCE
I The Green River Golf and Country Club, Inc. submitted a request for annexation.
ayor Gaines referred this request to Counci Iman Sonnemann and the Annexation Committee.

Val Rupeiks of Clark, Coleman & Rupeiks, Inc., submitted presentation of needs to update the
Comprehensive Plan of the City.
Mayor Gaines asked the City Attorney and Counci I members to consider ways of financing
this program.
Mark A. Hedman submitted a letter requesting the withdrawal of his Apri 1 15, 1965, application
to rezone from R-2 to R-4 property located at 27th and D Sts. S. E. (Tabled June 7, 1965)
It was moved by Hoyt and seconded by Calkins that the Hedman rezoning application be taken
off the table.
MOTION CARRIED
It was moved by Aaby and seconded by Kline that the request of Mark A. Hedman to withdraw
his Apri I 15\ 1965, application to rezone from R-2 to R-4 property located at 27th and D sts.
S. E. be granted effective September 20, 1965.
MOTION CARRIED
Harry D. White submitted a request to rezone from R-2 to R-4 property located at 605 29th
St. S. E.
III Mayor Gaines referred this request to the Pianning Commission.
The Auburn Planning Commission recommended that the petition of Vernon C. Canfield to rezone
from R-3, Residential, to C-I, Light Commercial property located at 1248 East Main be granted.
It was moved by Sonnemann and seconded by Hoyt that the City Clerk be instructed to cal I for
a public hearing to be held October 4, at 8 P. M. on the rezoning application of Vernon C.
Canfield.
MOTION CARRIED
The Auburn Planning Commission recommended that the petition of Robert L. Warburton to rezone
from M-2, Heavy Industrial, to R-5, MØbi Ie Home Park, property located at 900 29th St. S. E.
be granted.
It was moved by Sonnemann and seconded by Aaby that the City Clerk be instructed to cal I for
a public hearing to be held October 4, at 8 P. M. on the rezoning application of Robert L.
Warburton.
MOTION CARRIED
A writ of Mandamus was served on the City of Auburn, September 17, 1965, on behalf of
C. A. Heisserman, Realtor, requesting Court to require the City to grant realtor Special
Use Permit for auto wrecking yard at Second St. N.W.
iIIyor Gaines referred this matter to the City Attorney.
J. J. Rice submitted a zone chanqe application to the Counci I requesting change of zoning
from R-2 to C-3 on property located at Corner of F and 5th Sts. S.E.
Mayor Gaines referred this request to the Planning Commission.
Payment of 15% retainaqe in amount of $705.23 due Val ley Cement Construction Co. on contract
for installation of sanitary sewer, side sewer, Y's and manholes on M and 21st Sts. S.E.
was submitted for approval.

It was moved by Fitzsimmons and seconded by Aaby that Val ley Cement Construction Co. be
paid $705.23, which is the 15% retainage on the contract for installation of sanitary
sewer, side sewer, Y's and manholes on M and 21st St. S.E., as approved by the Engineering
Department.
ROLL CALL VOTE: AI I Counci Imen voting YES.
MOTION CARRIED
Payment of 15% retainaqe in amount of $180.87 due Glen Rockey Construction Co. on contract
for sanitary sewer replacement in alley between A St. N. E. and No. Division was
submitted for approval.
It was moved by Fitzsimmons and seconded by Sonnemann that Glen Rockey Construction Co. III
be paid $180.87, which is the 15% retainage on contract for sanitary sewer replacement
in alley between A st. N.E. and No. Division, as approved by the Engineering Department.
MOTION CARRIED
Hi II & Ingman, Consulting Engineers, submitted the final estimate on the contract with
W. J. Schade & Sons, Inc., for construction of the Lea Hi II Interceptor Sewer to the
Green River Community Col lege. They certified that the W. J. Schade contract for the
Lea Hi I I Interceptor Sewer had been completed; and asked that payment of $32,219.43 due
as of September 15, 1965 be approved; and that the 10% retainage of $16,134.44 be paid
within 30 days of September 20, 1965, upon receipt of releases from the Department of
Labor and Industries and the State Tax Commission.
R. B. Tollefson, utilities Superintendent, submitted recommendation that payment of
Progress Estimate No.5 as submitted by Hi I I & Ingman, Consulting Engineers, in favor
of W. J. Schade & Sons, Inc. be made subject to approval by the Water-Sewer Committee.
It was moved by Fitzsimmons and seconded by Calkins that the contract with W. J. Schade
& Sons, Inc., for construction of the Lea Hill Interceptor Sewer to the Green River
Community Col lege be accepted as complete, and that W. J. Schade be paid $32,219.43,
and that the 10% retainage of $16,134.44 be paid within 30 days of September 20, 1965,
upon receipt of releases from the Department of Labor and Industries and the State Tax
Commission.
ROLL CALL VOTE: All Councilmen voting YES.

Commonwealth Inc., submitted a request for the formation of a Local Improvement District
for the construction of water mains, fire hydrants and sanitary sewers in Division No. I
of Arbor Vista Addition.
It was moved by Kline and seconded by Fitzsimmons that the City Attorney be instructed
to draw up the necessary Ordinance to implement the formation of this L.I.D.
MOTION CARRIED
Harold A. Hagestad, City Engineer, submitted a request that Jack Lanqe. Bui Idinq Inspector
for the City of Auburn, be permitted to attend the 14th Annual Sui Idinq Officials Short
Course which wi I I be condùcted from November I thru 5 at Washington State University.
It was moved by Lea and seconded by Kline that this request be granted.
MOTION CARRIED
City Attorney Smythe submitted Opinion 65-16 on the question of whether the City Council
by ordinance or resolution can transfer idle or avai lable funds on a temporary loan
basis from one solvent operating fund of the city to another solvent operating fund.
Mayor Gaines asked that this written opinion be placed on fi Ie in the Clerk's Office.
COUNCIL COMMITTEE REPORTS

FIRE COMMITTEE - COUNCILMAN HOYT
Counci Iman Hoyt reported that no further burning has taken place near the Fort Muckleshoot
Trai ler Court, and that the fire permit obtained by the Skylark Trailer Vi Ilage had
expired.
STREET COMMITTEE - COUNCILMAN LEA.
Counci Iman Lea reported that 8th Street Northeast has been opened.

STREET COMMITTEE - REPORT (CON'f.)
He reported that the Street Committee had met with Bi I I Raven of Raven Transfer and
Storage, to discuss the left turn lane which has been established on 3rd Street N.W.,
and it was decided that this left turn lane should be removed. The committee had
instructed the Engineering Department to do some research regarding the widening of this
street.
He reported that Frank Wi Iber of Wi Iber Studio and Camera Shop had met with the Street
Committee regarding parking across from his business, and this matter referred to the
Engineering Department.
III WATER-SEWER COMMITTEE - COUNCilMAN FITZSIMMONS
It was moved by Fitzsimmons and seconded by Calkins that the City Clerk be instructed
to cal I for bids for the construction of water mains, fire hydrants and sanitary sewers
in Division No. I, Arbor Vista Addition, bids to be opened 3:00 P.M. Thursday,
October 7, 1965, specifications and bid forms to be obtained from the office of the
City Clerk, bids to be accompanied by a five percent bid bond or certified check.

PROPERTY IN THE CITY OF AUBURN, CHANGING THE ZONING CLASSIFICATION THEREOF FROM

PORTION THEREOF FROM R-2 TO R-5" be introduced and adopted.

OF CERTAIN REAL PROPERTY SITUATE WITHIN THE CORPORATE LIMITS OF THE CITY, TO PROVIDE
ADDITIONAL PARK AND ROADWAY AREA FACILITIES FOR THE CITY OF AUBURN, AND FOR GENERAL
MUNICIPAL PURPOSES; AND REPEALING ORDINANCES NO. 1805 AND 1818 OF THE ORDINANCES OF
THE CITY OF AUBURN, WASHINGTON, AND ALL OTHER ORDINANCES OR SECTIONS OF ORDINANCES IN

INCH CAST IRON WATER MAINS, FIRE HYDRANTS AND 8 INCH DIAMETER SANITARY SEWERS ON CERTAIN
PROPERTY SITUATE WITHIN THE CORPORATE LIMITS OF THE CITY OF AUBURN IN ACCORDANCE WITH
LOCAL IMPROVEMENT DISTRICT PETITIONS SIGNED BY A MAJORITY OF THE AFFECTED PROPERTY
OWNERS AND FILED WITH THE CITY CLERK OF SAID CITY; CREATING AND ESTABLISHING LOCAL

It was moved by Kline and seconded by Sonnemann that the request of C. A. Heisserman for
a Special Property Use Permit to operate an auto wrecking yard on property located on
Second St. N.W. be taken off the table.

Mayor Gaines declared a fifteen minute recess at 9:00 P.M.
After discussion by the Counci I, it was moved by Calkins and seconded by Kline that the
Special Use Permit Application of C. A. Heisserman to operate an auto wrecking yard on
property located on Second St. N.W. be denied on the basis that no specific plan for III
the use was before the. P 1 anni.ng COI1'in i ss i on at its pub I i c hear i ng, nor did the
Planning Commission in its recommendation approving the special use permit fully state
how the same was in conformity with the Comprehensive Land Use Plan of the City of Auburn.
