The meeting was cal led to order by Mayor Gaines. Counci Imen present: Hoyt, Lea, Kline, Fitzsimmons, Calkins, Aaby and Sonnemann. Minutes of the previous meeting, held October 18, 1965 were approved as mai led. BIDS Bids were opened at 3 P.M. October 28, 1965, in the Counci I Chambers as fol lows: LES GOVE PARKING LOT CONSTRUCTION Heisserman Construction Co. $8,764.45 plus sales tax 30 days time LID #162 "Oil SE BETWEEN 33RD AND 37TH ST. BALLFIELD Amount $1274.00 $1880.00 Tax $53.51 $78.96 Total $1327.51 $1958.96 Guarantee Cashier Ck. $63.70 5% Bid Bond PUBLIC HEAR I NG Mayor Gaines declared the public hearing open on the request of Herman M. Nirschl to rezone from A-I Agricultural, to M-I, Light Industrial, property located on the East Valley Highway. The Auburn Planning Commission recommended that this request be granted subject to the fol lowing provision: The So. 30 feet be dedicated for continuation of 37th St. NE; also that a 60 foot right-of-way be dedicated to continue CSt. NE north to connect to an existing street of the county north of Mr. Nirschl's property which lies outside of the corporate limits of the city. It waS moved by Calkins and seconded by Hoyt that the public hearing be closed. MOTION CARRIED It was moved by Lea and seconded by Calkins that the request of Herman M. Nirschl to rezone from A-I to M-I property located on the East Val ley Highway be granted subject to the provision as recommended by the Auburn Planning Commission. MOT I ON CARR I ED Mayor Gaines declared the publ ic hearing open on the request of Harry D. White to rezone from R-2, Residential, to R-4, Multiple Family Residential, property located at 605 29th St. SEe The Auburn Planning Commission recommended that this request be granted with the provIsion that the north 25 feet of the property be dedicated to the City for right-of-way. It was reported that Mr. White had presented a deed for the north 25 feet of the property for right-of-way to the City. It was moved by Calkins and seconded by Hoyt that the public hearing be closed. MOTION CARRIED It was moved by Calkins and seconded by Aaby that the request of Harry D. White to rezone from R-2 to R-4, property located at 605 29th St. SE be granted subject to the Planning Commissions recommendation. NOTION CARRIED 34 AUBURN, WASHINGTON NONDAY NOVEMBER I. 1965 :~ o CORRESPONDENCE Harold Hagestad, City Engineer, submitted for approval Estimate No.3 in favor of the Heisserman Construction Co., retained percentage on contract for 8th St. NE, & Harvey Road to R St. NE, in the amount of $1,546.38. It was moved by Lea and seconded by Calkins that Heisserman Construction Co. be paid $1,546.38 which was the retained percentage on contract for 8th St. NE, and Harvey Road to R St. NE, subject to receipt of releases from the Tax Commission and Department of Labor and Industries. ROLL CALL VOTE: AI I Councilmen voting YES. MOTION CARRIED I The Auburn Park Board recommended the Counci I award bid for construction of the Les Gove Parking Lot to the Heisserman Construction Co. at bid price of $8,764.45 and to award bid for backstop and Fencing of the 5th and K Sts. Bal I Park to Evergreen Fence Co. at bid price of $1274.00. It was moved by Kline and seconded by Fitzsimmons that Heisserman Construction Company be awarded the bid for construction of the Les Gove Parking Lot at bid price of $8,764.45 as recommended by the Park Board. ROLL CALL VOTE: AI I Counci Imen voting YES. MOTION CARRIED It was moved by Sonnemann and seconded by Aaby that the bid bond be returned to McBride Fence Company after receipt of signed contract from the Evergreen Fence Company. MOTION CARRIED A letter from Auburn Aerie No. 2298, F.O.E., congratulated the City for spearheading Veterans Day Parade. Mayor Gaines asked that this letter be placed on file. A letter from Mrs. James E. Wood protested punch boards in the City. A petition requested formation of an L.I .D. for water mains and fire hydrants on 30th NE between Auburn Avenue and B St. NW. I Mayor Gaines asked that this letter be placed on fi Ie. This petition was accompanied by certification from Harold A. Hagestad, City Engineer, which stated the petition contained the signatures of 71.10% of the private property owners abutting 30th St. NE and NW between Auburn Avenue and B St. NW; that the City's Water-Sewer Department is obligated to the balance of the area which consists of the Water-Sewer Department Disposal Plant property and the two portions abutting Auburn Avenue on the North and South sides of 30th whose assessments are paid under Water District No. 80. It was moved by Sonnemann and seconded by Fitzsimmons that the City Attorney be instructed to draw up the necessary Ordinance to implement the formation of this L.I .D. MOTION CARRIED J & B Construction Company submitted a zone change application requesting zone change on property located on 7th and F Sts. NE. Mayor Gaines referred this application to the Planning Commission. A letter from the Cemetery Board requested approval of a lozn of $3,000.00 from the Cemetery Endowed Care Fund, repayment to be made within a two year period. It was moved by Sonnemann and seconded by Calkins that the request of the Cemetery Board for approval of a loan of $3,000.00 from Cemetery Endowed Care Fund, repayment to be made within a two year period be granted. ROLL CALL VOTE: AI I Counci Imen voting YES. I MOTION CARRIED R. B. Tollefson, Uti lity Superintendent, submitted a letter stating that the easement granted by Mrs. Ruby fAoroni for construction of a water line may be cancel led as water line to service her property has been completed. It was moved by Fitzsimmons and seconded by Calkins that the City Attorney be instructed to draw up the necessary document to vacate this easement and the Mayor and City Clerk be authorized to sign same. MOTION CARRIED I I I AUBURN, WASHINGTON NOVEMBER I. 1965 35 NONDAY Contracts were received for Financial Consulting Services from Blythe & Company, Inc. and McLean & Company. Mayor Gaines referred both contracts to the Finance Committee, and asked that copies of these contracts be given to the Water-Sewer Committee. MAYOR'S PROCLAMAI IONS Mayor R. E. Gaines issued a proclamation designating November I I, 1965 as Veterans' Day in the City of Auburn. Mayor Gaines issued a proclamation designating the week of November 7 through 13, 1965, as American Education Week for the City of Auburn. AUD I ENCE Wi I liam Murphy appeared before the Counci I regarding storm sewer and sanitary sewer which border his property on 28th Street Southeast. Mayor Gaines asked Mr. Murphy to attend the next Water-Sewer Committee meeting to be held November 10, 1965, at 8:00 P.M. Mrs. Everett appeared before the Counci I regarding the installation of sidewalk on her property located on J Street Northeast. Mayor Gaines asked Mrs. Everett to attend the next Street Committee meeting. COUNCIL COMMITTEE REPORTS FIRE COMMITTEE - COUNCILMAN HOYT It was moved by Hoyt and seconded by Lea that Fred McPherson Company be awarded the bid for a Home Monitoring System for the Fire Department. ROLL CALL VOTE: AI I Counci Imen voting YES. MOTION CARRIED STREET COMMITTEE - COUNCILMAN LEA It was moved by Lea and seconded by Sonnemann that Heisserman Construction Company be awarded the bid for street improvements on "0" Street SE between 33rd and 37th St. SE under LID #162 at bid price of $12,173.48 plus sales tax. MOTION CARRIED WATER-SEWER COm^ITTEE - COUNCILMAN FITlSlmAONS Counci Iman Fitzsimmons reported that consulting engineers on the West Side Sewer Line are making application for 30% matching Federal funds on the project. It was moved by Fitzsimmons and seconded by Kline that the Mayor be authorized to sign the application for 30% matching fund on the West Söe Sewer Line Project. MOTION CARRIED Counci Iman Fitzsimmons reported that the City's Consulting Engineers on the sewer work are making application for funds for a Comprehensive Plan. LICENSE COMMITTEE - COUNCILMAN CALKINS Counci Iman Calkins reported he had received application from B & R Amusement Company for Class B Amusement device at Jack's Tavern, 2425 Auburn Avenue. It was moved by Calkins and seconded by Fitzsimmons that the application of the B & R Amusement Company for Class B amusement device at Jack's Tavern be approved. MOTION CARRIED ORDINANCE NO. 1831 It was moved by Lea and seconded by Hoyt that Ordinance No. 1831 entitled "AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON AMENDING SECTION 9.14.010 OF THE AUBURN CITY CODE, SAID SECTION 9.14.010 RELATING TO AND PROVIDING FOR THE DESIGNATION OF ARTERIAL HIGHWAYS SITUATE WITHIN THE CORPORATE LIMITS OF THE CITY OF AUBURN, PURSUANT TO SECTION I OF ORDINANCE NO. 1740 OF THE ORDINANCES OF THE CITY OF AUBURN; AND REPEALING SECTION 12 OF ORDINANCE NO. 1750 AND SECTION 32 OF ORDINANCE NO. 1429, be adopted. MOT ION CARR I ED ORDINANCE NO. 1833 I It was moved by Calkins and seconded by Hoyt that Ordinance No. 1833 entitled "AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON DECLARING A PUBLIC EMERGENCY TO EXIST, CREATING AN "L.I.D. 155 COURT EXPENSE ACCOUNT: IN THE MAINTENANCE AND OPERATION CLASSIFICATION, GENERAL GOVERNMENT DIVISION, CURRENT EXPENSE FUND, AND APPROPRIATING THE SUM OF $4,000.00 FROM UNBUDGETED FUNDS IN THE CURRENT EXPENSE FUND OF THE CITY OF AUBURN TO SAID ACCOUNT," be adopted. MOTION CARRIED ORDINANCE NO. 1834 It was moved by Kline and seconded by Aaby that Ordinance No. 1834 entitled "AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON PROVIDING FOR THE REZONING OF CERTAIN PROPERTY IN THE CITY OF AUBURN, CHANGING THE ZONING CLASSIFICATION THEREOF FROM R-2 TO R-4," be introduced and adopted. MOTION CARRIED I ORDINANCE NO. 1836 It was moved by Fitzsimmons and seconded by Calkins that Ordinance No. 1836 entitled "AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR THE IMPROVEMENT OF A PORTION OF A CERTAIN STREET IN THE CITY OF AUBURN, BY THE CONSTRUCTION AND INSTALLATION OF 611 CAST IRON WATER MAINS AND FIRE HYDRANTS, CREATING AND ESTABLISHING LOCAL IMPROVE- MENT DISTRICT NO. 167; PROVIDING THE METHOD OF ASSESSMENT IN SAID DISTRICT AND THE MODE OF PAYMENT THEREOF, AND CREATING A LOCAL IMPROVEMENT DISTRICT FUND,., be introduced and adopted. MOTION CARRIED ORDINANCE NO. 1837 It was moved by Calkins and seconded by Kline that Ordinance No. 1837 entitled fAN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, REGULATING WRECKING AND JUNKYARDS SITUATE WITHIN THE CORPORATE LIMITS OF THE CITY, PROVIDING FOR THE ISSUANCE OF PERMITS THEREFOR, AND PRESCRIBING PENALTIES FOR THE VIOLATIONS OF THE PROVISIONS OF THIS ORDINANCE," be introduced. MOTION CARRIED OLD BUS I NESS I Rev. Lawson asked that the motion to direct the Mayor to order the punchboards be removed by November I, 1965 be brought off the table. It was moved by Aaby and seconded by Lea that the City Counci I vote a non-concurrence with the tolerance policy. ROLL CALL VOTE: Hoyt, Lea, Kline, and Aaby, YES; Fitzsimmons, Calkins, and Sonnemann, NO.
