Mayor Gaines called the meeting to order. Councilmen present: Councilman absent: Lea, Kline, Fitzsimmons, Nickson, Aaby and Sonnemann. Hoyt. Minutes of the previous meeting, held February 21, 1966, were approved as mailed. I PUBUC HEARINGS Mayor Gaines declared the public hearing open on the request of R. Fordice to rezone from R-2 to R-4 property located between 19th and 21st on F Street Southeast. The Auburn Planning Commission recommended that this request be granted because it conforms to the City's comprehensive land use plan. It was moved by Kline and seconded by Fitzsimmons that the public hearing be closed. MOTION CARRIED It was moved by Kline and seconded by Nickson that the request of R. Fordice to rezone from R-2 to R-4 property located between 19th and 21st on F Street Southeast be returned to the Planning Commission with the recommendation that a special property use be pursued. ROLL CALL VOTE: Kline, Fitzsimmons, Nickson, Aaby, and Lea, YES. Sonnemann, NO. MOTION CARRIED Mayor Gaines declared the public hearing open on the request of James P. Hawley to rezone from R-2 to R-4 property located on H Street N.E. between Fourth and Fifth. Robert Kuzmer, representing James P. Hawley, listed reasons why this property should be rezoned. I R. K. Calkins and Dick Messo spoke against the granting of this rezone. A petition signed by eleven residents in the area was submitted protesting the granting of this rezone. The Auburn Planning Commission recommended that this request be denied because it does not fit in with the over-all comprehensive land use plan of the City. It was moved by Lea and seconded by Nickson that the public hearing be closed. MOTION CARRIED It was moved by Lea and seconded by Aaby that decision on the request of James P. Hawley be held in abeyance until the next regular meeting of the Council. MOTION CARRIED Mayor Gaines declared the public hearing open on the request of Jones-McLaughlin to rezone from R-2 to R-4 property located on Harvey Road North of 12th Street Northeast. Leon Jones spoke in favor of the granting of this rezone. I The Auburn Planning Commission recommended that this request be granted because it conforms to the City's comprehensive land use plan provided, however, that the South 5 feet be dedicated to the City of Auburn for street purposes. It was moved by Aaby and seconded by Sonnemann that the public hearing be closed. MOTION CARRIED It was moved by Aaby and seconded by Sonnemann that we concur with the Planning Commissions recommendation and grant the rezone from R-2 to R-4 property located on Harvey Road North of 12th Street Northeast subject to the dedication of the South 5 feet to the City of Auburn for Street purposes. ROLL CALL VOTE: Aaby, Sonnemann, Lea, Fitzsimmons, YES. Kline, Nickson, NO. MOTION CARRIED Mayor Gaines declared the public hearing open on the request of Mardel Investment Company to rezone Parcel A from R-2 to C-l, Parcel B from R-2 to R-4, property located East of the East Valley Highway at approximate¡Y 17th Street Northeast. 7 8 AUBURN. WASHINGTON MONDAY MARCH 7, 1966 C'. :) ~r~,. ~JJi Mr. Reiber spoke in favor of granting this rezone. Mardel Investment Company submitted a letter authorizing the dedication of the necessary streets as requested by the Planning Commission. A. T. LaPlante, Ronya LaPlante, Malcolm Wight and Peter Fleck opposed this rezoning. Residents in the area of this property submitted a petition against the granting of this rezone. William Simmermon, representing Mardel Investment Company, stated why he felt this rezone should be granted. The Auburn Planning Commission recommended that this request be granted because it conforms with the Comprehensive Land Use Plan of the; City provided that the South 25 feet of the property ¡Ying between Auburn Avenue and I Street be dedicated to the City of Auburn for street purposes, together with a dedication of a 60 ft. right of way to continue I Street to said property owners Northerly boundary for street purposes. Also, that consideration should be given for didication of the NE portion as may be necessary for street as described in plan. I It was moved by Nickson and seconded by Kline that the Public Hearing be closed. MOTION CARRIED It was moved by Kline and seconded by Fitzsimmons that the request of Mardel Investment Company to rezone Parcel A from R-2 to C-l, property located East of the East Valley Highway at approximately 17th Street Northeast, be granted subject to the dedication of those right of ways recommended by the Planning Commission which abutt aforesaid parcel of land. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED It was moved by Nickson and seconded by Kline that the request of Mardel Investment Company to rezone Parcel B from R-2 to R-4, property located East of the East Valley Highway at approximately 17th Street Northeast, be denied. ROLL CALL VOTE: Niêkson, Sonnemann, Kline, YES. Lea, Fitzsimmons, NO. Aaby, ABSTAIN. MOTION CARRIED I Mayor Gaines declared the public hearing open on the request of Ruby Moroni to rezone from R-2 to R-4 property located on 8th $treet N.E. off Auburn Avenue. Mrs. Joy White spoke against the granting of this rezone. The Auburn Planning Commission recommended that this request be granted because it conforms with the Comprehensive Land Use Plan of the City provided that the N 30 ft. is dedicated to the City of Auburn for future development of 8th Street N.E. It was moved by Kline and seconded by Nickson that the public hearing be closed. MOTION CARRIED It was moved by Sonnemann and seconded by Fitzsimmons that we concur with the recommendation of the Planning Commission and grant the request of Ruby Moroni to rezone from R-2 to R-4 property located on 8th Street N.E. off Auburn Avenue subject to the dedication of the N 30 ft. to the City of Auburn for future development of 8th Street N.E. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Mayor Gaines declared the public hearing open on the request of Dr. G. Nickelsen to rezone Parcel 1 from R-2 to R- 3 and Parcel 2 from R-2 to R-4 property located at 7th I and F Streets N.E. The Auburn Planning Commission recommended that this request be granted because it conforms with the Comprehensive Land Use Plan of the City provided, however, that sufficient property be dedicated to permit 7th Street N.E. to be continued to the West line and E Street be extended South along the West boundary. It was moved by Nickson and seconded by Sonnemann that the public hearing be closed. MOTION CARRIED I I I AUBURN. WASHINGTON MONDAY MARCH 7. 1966 '19 It was moved by Sonnemann and seconded by Lea that this matter be tabled until the March 21, 1966 meeting of the Council in order for the Auburn Park Board and the Street Committee to make recommendation concerning this rezone. ROLL CALL VOTE: Sonnemann, Lea, Fitzsimmons, Aaby, YES. Kline, Nickson, NO. MOTION CARRIED Mayor Gaines declared the public hearing open on the request of Herman Nirschl to rezone from A-l to M-l property located at 4005 Auburn Avenue. The Auburn Planning Commission recommended that this request be granted because it conforms with the Comprehensive Land Use Plan of the City, keeping in mind, however, that on the future rezoning of Mr. Nirschl's property, dedications of right of way as originally designated in the initial proposal be provided. It was moved by Sonnemann and seconded by Kline that the public hearing be closed. MOTION CARRIED It was moved by Sonnemann and seconded by Fitzsimmons that we concur with the Planning Commissions's recommendation and grant the request of Herman Nirschl to rezone from A-l to M-l property located at 4005 Auburn Avenue. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Mayor Gaines declared the public hearing open on the request of United Homes Corporation to rezone from R-2 (SPU) to R-4 property located on the south side of PSH #5 East of Dogwood Street S.E. United Homes Corporation submitted convenant concerning height of structures to be built. The Auburn Planning Commission recommended that this request be granted because it conforms with the Comprehensive Land Use Plan of the City, provided that curbs and gutters and sidewalks be installed along the Enumclaw Highway and that a deceleration lane be improved as shown on the plot plan. It was moved by Fitzsimmons and seconded by Sonnemann that the public hearing be closed. MOTION CARRIED Mayor Gaines declared a five minute recess at 9:55 P.M. Mayor Gaines reconvened the meeting at 10:00 P.M. It was moved by Fitzsimmons and seconded by Lea that the Council concur with the recommendation of the Planning Commission and grant the request of United Homes Corporation to rezone from R-2 to R-4 property located on the south side of PSH #5 East of Dogwood Street S.E. subject to the installation of curbs, gutters, and sidewalks along the Enumclaw Highway, and deceleration lane as shown on the plot plan, and to the convenant limiting height of structures to be built on this property. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED CORRESPONDENCE The report of the finance Committee meeting held at 10 A.M. February 28, 1966, was read recommending approval of emergency ordinances to provide $6,000.00 for underground sprinkling system for GSA park area; approximately $10,000.00 for two additional patrolmen and approximately $5,000.00 for an assistant building inspector. The Washington State Highway Commission submitted a letter advising that a hearing will be held at 10 A.M. Wednesday, March 23, 1966, at Kent City Hall for a Federal Aid route to bypass the commercial areas in the City of Kent. Mayor Gaines asked that this letter be placed on file, and requested City Engineer Harold A. Hagestad to attend this meeting. KTNT-TV, Tacoma, submitted application for a Community Television Franchise along and across the public rights-of-way in the City of Auburn. Mayor Gaines referred this application to City Attorney Smythe, Councilman Aaby, Councilman Lea, and Councilman Kline. The final assessment rolls on L.I.D. Nos. 160, 162, and 163 were submitted to the Council for consideration and public hearing by City Engineer Harold A. Hagestad. 80 AUBURN. WASHINGTON MONDA Y MARCH 7. 1966 ~) ~'. QlI ;'~'. It was moved by Lea and seconded by Sonnemann that the City Clerk be instructed to call for public hearings on the final assessment rolls on L.I.D. Nos. 160, 162, and 163 to be held 8 p. m. April 4, 1966, in the Council Chambers at the City Hall. ~. ~.-, MOTION CARRIED The following Zone Change Applications were submitted to the Council: 1. The request of Ruby Gray to rezone from R-2 to R-4 property located at R Strèet N.E. and Eighth Street N.E. 2. The request of John M. Porter to r.ezone from R-2 to R-4 property located on Eighth Street N.E. I 3. The request of Francis E. Ballard to rezone from R-2 to R-4 property located at 21st and F Streets S.E. 4. The request of O. R. Chase and Associates to rezone property on the former Auburn Airport site: Parcel 1 from C-l to C- 3; Parcel 2 from LF to C- 3 and Parcel 3 from R-l to R-4. 5. The request of Myron M. Massey to rezone from A-l to R-4 property located at 29th and M Streets S.E. 6. The request of Henry B. Knickerbocker to rezone from R-l to R-4 property located on the North side of 8th N.E. 7. The request of Puget Sound Power Company to rezone from R-l to R-4 property located on M Street S.E. immediately south of Freeway. Mayor Gaines referred these requests to the Planning Commission. Auburn Lodge No. 1808, B. P. O. E. submitted letter requesting that 14th Street S.E. between Auburn Avenue and Harvey Road be vacated from 6 p.m. to midnight on March 14 through March 19, 1966, for parking spaces during their Anniversary Week observation. Mayor Gaines referred this request to the Fire Chief, Police Chief, and Chairman of I the Street Committee. A letter from Edgar C. Short expressed his appreciation for the fine paving-patch job at the intersection of Second Street and A Street. Ferguson's Tavern, 234 East Main Street, requested approval of Card Game License. This request was referred to the License Committee. ~Thomas E. Agee, attorney, submitted a letter regarding the bequest of $5,000 from ... Estate of Edward Hart for historical museum for the City. (.Mayor Gaines asked that a copy of this letter be given to the Historial Society, and that the matter be left in the hands of our city attorney. R. K. Calkins, Fire Department Chief, requested permission for himself and three captains of the department to attend a Command School for fire affairs in Yakima, April 11 to 14, 1966. It was moved by Sonnemann and seconded by Lea that Fire Chief Calkins, and three captains of the Auburn Fire Department be given permission to attend the COJTIIIIB.nd School in Yakima April 11 to 14, 1966. MOTION CARRIED PROCLAMATION I Mayor Gaines proclaimed March 6 through March 12 as Girl Scout Week and March 12th as the 54th Anniversary of Girl Scouting in the United States. COUNCIL COMMITTEE REPORTS STREET COMMITTEE - COUNCILMAN LEA It was moved by Lea and seconded by Sonnemann that the City Clerk be instructed to call for bids for the installation of curbs and gutter excavation ballasting, asphaltic surfacing, sidewalk, and storm sewer for L.I.D. #168, bids to be opened March 17, 1966, at 3 p.m. MOTION CARRIED I I I AUBURN. WASHINGTON MONDAY MARCH 7. 1966 81 It was moved by Lea and seconded by Sonnemann that the City Clerk be instructed to call for bids for installation of curbs and gutter excavation ballasting, asphaltic surfacing and storm sewer, bids to be opened March 17, 1966, at 3 p.m. L.I.D. No. 171. MOTION CARRIED It was moved by Lea and seconded by Sonnemann that the City Clerk be instructed to call for bids for one self-propelled paint striper for the Street Division, bids to be opened March 17, 1966, at 3 p.m. MOTION CARRIED AIRPORT COMMITTEE - COUNCIlMAN KUNE Councilman Kline reported on the last meeting of the Airport Committee when the matter of obtaining an Airport Feasibility Study was discussed. He stated that another meeting would be held March 10, 1966 at which time Mr. Frankfurter of Frankfurter and Associates will present the Committee with an estimated cost of such a study. He also reported that the Airport Committee would meet every 2nd Thursday of the month. POLICE & LICENSE COMMITTEE - COUNCILMAN SONNEMANN It was moved by Sonnemann and seconded by Nickson that William M. Nicoletta be granted a Cabaret License. MOTION CARRIED It was moved by Sonnemann and seconded by Fitzsimmons that the request of Ferguson's Tavern, 234 East Main Street, for Card Game License be granted. MOTION CARRIED It was moved by Sonnemann and seconded by Nickson that Auburn Aerie #2298, Order of Eagles, be granted permission to hold a parade on Saturday, June 25th starting 25 3 p.m. MOTION CARRIED Mayor Gaines asked that the request of Auburn Aerie #2298, Order of Eagles, for permissiom to use the City Park for sleeping facilities and events of the day during June 24, 25, and 26th, be put on the agenda for the next meeting of the Auburn Park Board. DEPARTMENT HEAD REPORTS PARK DEPARTMENT - PARK SUPERINTENDENT GEORGE FREEMIRE Park Superintendent George Freemire reported that Mrs. Theodore Lerch, daughter of the late Les Gove, donated $25.00 for the purchase of a pine tree to be planted in the Les Gove Memorial Park in memory of her father. He also reported that some new playground equipment had been installed in the Auburn City Park. FIRE DEPARTMENT - FIRE CHIEF CALKINS Fire Chief Calkins reported that a meeting of the Puget Sound Fire Fighters would be held 8 p.m. Tuesday, at the Fire Station, also, he reported that the Fire Department Ball will be held March 18, 1966. PLANNING DEPARTMENT - PLANNING DIRECTOR GEORGE SCHULER Planning Director George Schuler reported that he had received street dedications from George and Ethel Lyden, and Ruby Moroni. PUBUC WORKS DEPARTMENT - CITY ENGINEER HAROLD A HAGESTAD City Engineer Harold A. Hagestad reported that soil testing is to be started on the south end of the West Side Sewer Line Monday, and Hill & Ingman will start design on this as soon as the first tests are made allowing them to meet their deadline to apply for Federal Grant. City Engineer Harold A. Hagestad reported that 50% of the new Mercury Vapor Lights have been installed in the City. City Engineer Harold A. Hagestad reported that Utilities Superintendent Robert B. ROLL CALL VOTE: All Councilman voting YES. MOTION CARRIED OLD BUSINESS Councilman Kline stated the City Attorney had determined that the decision to return the R. Fordice Zoning Application back to the Planning Commission for consideration I for Special Property Use Permit did not come within the jurisdiction of the Council, therefore, it was moved by Kline and seconded by Nickson that this matter be reconsidere . MOTION CARRIED It was moved by Kline and seconded by Sonnemann that the Council rescind the motion referring the request of R. Fordice to rezone from R-2 to R-4 property located between 19th and 21st on F Street Southeast back to the Planning Commission. MOTION CARRIED It was moved by Sonnemann and seconded by Aaby that the Council concur with the reconnnendation of the Planning Commission and grant the request of R. MOTION CARRIED NEW BUSINESS City Attorney Robert Smythe reported that he was in receipt of an easement from Jeff's --f Orphans Home. It was moved by Fitzsimmons and seconded by Sonnemann that the Mayor and City Clerk be authorized to sign this easement and that the City Attorney be instructed to record same. MOTION CARRIED CLAIMS It was moved by Nickson and seconded by Fitzsimmons, that the claims as approved by the Audit Committee be paid. MOTION CARRIED There being no further business, the meeting was declared adjourned at 11:30 P.M. subject to the call of the Mayor.
