"'!G in the Counci I Chambers at the City Hal I. Mayor Gaines cal led the meeting to order. Counci Imen present: Hoyt, Lea, KI ine, Fitzsimmons, Nickson, Aaby and Sonnemann. Minutes of the previous meeting, held July 5, 1966, were corrected to read: "It was moved by Sonnemann and seconded by Nickson that the City Attorney be instructed to draw up the necessary Ordinance to implement the rezoning of property located on the Enumclaw Highway in the 3800 block from R-2 to R-4 as requested by John R. Stucker, and that the Planning Director be instructed to contact John R. Stucker in regard to I right-of-way dedications as amended in plot plan. MOTION CARRIED.II With this correction the minutes were approved as mai led. PUBLIC HEARINGS Mayor Gaines declared the public hearing open on the request of Joseph Boyce to rezone from R-2 to SPU (duplex & apartment use) property located on R St. S.E., legally described as the S~ of the N~ of the S~ of the SE~ of the NE~ Less Roads in 30-21-5 EWM. The Auburn Planning Commission recommended that this request be granted for the following reasons: I. It falls within the over-all plan of the area. 2. A mobile home park is to the west. 3. The game farm and M-I uses are to the east. 4. R-4 zoning is on the corner of 29th and M and directly north across the street is a nursing home. Consideration should be given to the dedication of a 50 ft. street east and west between M and R Sts. S.E. and a 50 ft. dedication north and south on the alignment of o St. to coincide with existing 0 St. in Sportman's Paradise Estates. It was moved by Kline and seconded by Nickson that the public hearing be closed. MOTION CARRIED It was moved by Aaby and seconded by Lea that we concur with the Planning Commissions recommendation and grant the request of Joseph Boyce to rezone from I R-2 to SPU (duplex & apartment use) property located on R St. S.E. It was moved by Nickson and seconded by Hoyt to amend the motion to include that the City Attorney be instructed to draft the necessary ordinance to implement same. MOTION CARRIED ORIGINAL MOTION AS AMENDED CARRIED. Mayor Gaines declared the public hearing open on the request of W. G. Nelson to rezone from R-2 to SPU property located at 25th and D Sts. S.E., legally described as the W 12' of Lot 2, Lot 3, 4, 5, 6, 8, 9, 10, II, and 12, Block 2, Hi len's Park Addition to Auburn. The Auburn Planning Commission recommended that the request of W. G. Nelson be granted for the following reasons: I. They fall within the over-all development plan of the area. 2. R-4 zonings are to the North and M-2 zoning to the West, with the stipulation that a buffer cyclone type fence with the redwood bats, not less than six feet, be erected along the east side of Lot 3 and south line of Lots, 3,4,5,6, 7, 8 and 9. Consideration should be given at Lots 9 and 12 to dedication of a 50 ft. minimum right-of-way for continuation of D St. between 25th and 26th and City Counci I institute the necessary vacation to accomplish the over-a I I development plan. The A. P. C. also suggests owner participation by L. I. D. or other means to improve I 25th S.E. between D and F Sts. Steve Anderson, representative of Monarch Investment Company, asked the Counci I to grant this rezone subject to W. G. Nelson signing an L.I.D. for improvements of 25th Street S.E. Frank Steward questioned the 50 ft. right-of-way for continuation of D St. between 25th and 26th. It was moved by Hoyt and seconded by Nickson that the public hearing be closed. It was moved by Kline and seconded by Nickson that the request of W. G. Nelson to rezone from R-2 to SPU property located at 25th and 0 Sts. S.E. be granted, subject to the recommendations of the Planning Commission and subject to a plan to develop 25th Street S.E., and the City Attorney be instructed to draw up the necessary ordinance to implement same. MOTION CARRIED Mayor Gaines declared the public hearing open on the request of D. E. Halvarson to rezone from R-2 to SPU property adjoing Nelson property on 25th and 0 Sts. S.E., legally described as Lot 7, Block 2, Hi len's Park Addition to Auburn. The Auburn Planning Commission made the same recommendation for the D.E. Halvarson rezone as were made for theW. G. Nelson rezone. It was moved by Nickson and seconded by Sonnemann that the public hearing be closed. NOTION CARRIED It was moved by Sonnemann and seconded by Aaby that we concur with the Planning Commissions recommendation and grant the request of D. E. Halvarson to rezone from R-2 to SPU property àdjoining Nelson property on 25th and 0 Sts. S.E., and the City Attorney be instructed to draft the necessary ordinance to implement same. MOTION CARRIED Mayor Gaines declared t~e public hearing open on the request of Michael M. Mahoney to rezone from SPU to R-4 2/3 property located at 19th and E Sts. S.E., legally described as the E~ of the SW~ of NE~ of SW~ S 389.75' and E 135' of W~ of SW~ of NE~ of SW~ EX S 389.79' and S 90' of E~ of NW~ EX Cty. Rd., al I in See 19, Twp 21 N 5 EWM LESS S 179' of the E 180'. The Auburn Planning Commission recommended that this request be granted as property fal Is within the over-al I development plan of the area which consists of R-4 and SPU zonings and conforms with buffer zoning. Consideration should be given to dedication of the South 30 feet for the future development of 20th st. S.E. It was moved by Kline and seconded by Hoyt that the public hearing be closed. NOTION CARRIED It was moved by Nickson and seconded by Aaby that we concur with the Planning Commissions recommendation and grant the request of Michael M. Mahoney to rezone from SPU to R-4 2/3 of property located at 19th and E sts. S.E., and the City Attorney be instructed to draft the necessary ordinance to implement same. NOTION CARRIED Mayor Gaines declared the public hearing open on the request of Frank Snopko for vacation of a portion of plat of Cedar Lanes No.3, Recorded in Volume 72 of plats, page 3, Records of King County, Washington, lying South of 21st st. S.E. and East of F St. S.E. It was moved by Hoyt and seconded by Nickson that the public hearing be closed. MOTION CARRIED It was moved by Kline and seconded by Sonnemann that the request of Frank Snopko for vacation of a portion of plat of Cedar Lanes No.3 be granted, and the City Attorney be instructed to draft the necessary ordinance to implement same. Bud Thomas, resident at 1404 37th Street S.E., questioned the validity of the petition as he believed that the property located at 208 37th Street Southeast owned by Geiszler, and property located 1334 37th Street Southeast owned by Ray had been sold prior to the circulation of the petition. Joyce Dinehart, resident at 604 37th Street S.E., said she felt this annexation had been misrepresented when the petition was circulated. It was moved by Kline and seconded by Sonnemann that the public hearing be closed. MOTION CARRIED It was moved by Sonnemann and seconded by Fitzsimmons that this area be annexed to the City of Auburn, and that the City Attorney be instructed to draft the necessary ordinance to implement this annexation, and the mayor be directed to convene a board of review on same. NOT I ON CARR I ED Mayor Gaines directed that a Board of Review be held Thursday at 8 p. m., July 28, 1966, to consider the annexation to the City of Auburn of an area located adjacent to the I South City Limits and North of Stuck River. CORRESPONDENCE Merlyn E. Danskin submitted a request for loading zone near east end of Sui Iding at 101-123 East Main. Mayor Gaines referred this request to the Street Committee. The Municipal Court of the City of Auburn submitted their report for June, 1966. Mayor Gaines asked that this report be placed on fi Ie. Wenatchee Aerie No. 204 of the Eagles expressed appreciation for hospitâ/ity shown visitors at the Youth Convention. Mayor Gaines asked that this letter be placed on fi Ie. A request for change of al I-day Parking to two-hour parking on South Second St. between A' Sf, S.W. and A Sf, S.E. and on South Division Sf, between 1st and 3rd Sts. was submitted by Ra-Mar, Inc. Mayor Gaines referred this request to the Street Committee. L. Cowdrick & Son, 4920 318th S., Auburn, submitted application for Side Sewer License. I Mayor Gaines referred this application to the License Committee. The Auburn Aerie Fraternal Order of Eagles expressed appreciation for cooperation of al I city departments during recent Youth Convention. Mayor Gaines asked that this letter be placed on fi Ie. MOTION CARRIED It was moved by Sonnemann and seconded by Lea that the City Clerk be instructed to cal I for a public hearing to be held 8 p. m., August 15, 1966, on the request of Auburn West Associates to rezone. Hagestad, City Engineer, submitted for public hearing the final assessment rol I for L.I.D. #171 (curb, gutter, excavation, ballasting, storm sewer, and asphaltic paving on 27th St. S.E. between D and F Sts. and D St. S.E. between 26th and 27th); also the final assessment rol I for L.I.D. #165 (water mains and fire hydrants on 116th S.L, 326th Place, 116th Place, and S.E. 320th) It was moved by Sonnemann and seconded by Hoyt that the City Clerk be instructed to cal I for a public hearing to be held e p. m., August 15, 1966, on the Assessment Rol Is of L. I . D. # I 71 and L. I . D. # 165. MOT ION CARR I ED Engineer's Estimate No.2 was submitted for approval showing$9,OI0.56 due Heisserman Construction Co., Inc. for work done on 8th Street S.E. contract, amount payable from L.I.D. No. 168 Fund. Harold A. Hagestad, City Engineer, submitted certification to the effect that work performed under L.I.D. #168 by Heisserman Construction Co., Inc. has been completed; and recommended that it be accepted by the City of Auburn and that retained percentage of $1,671.29 be paid after 30 days if no leins or claims are fi led against the contract. It was moved by Lea and seconded by Sonnemann that Engineer's Estimate No.2 in favor of Heisserman Construction Co., Inc. be approved, and Heisserman Construction Co., Inc. be paid $9,010.56 from L.I.D. No. 168 Fund for work on 8th Street S.E. contract. ROLL CALL VOTE: AI I Counci Imen voting YES. MOTION CARRIED National Bank of Commerce submitted a proposal to extend offer for interim financing of Water-Sewer Construction fund warrants to September 30, 1966, with interest after July 15, 1966, at a rate of 4% per annum. Gates submitted an application for Special Property Use for Church purposes on property located at 2608 R Street S.E. An application from Main Street Auburn Associates, N. W. Clein, General Partner, requested rezoning on property located on the corner of West Val ley Highway & West Main on the N.E. corner from A-I to C-3. Mayor Gaines referred both applications to the Planning Commission. Harold Hagestad, City Engineer, submitted final estimate on L.I.D. No. 170 (Arbor Vista) showing $22,294.17 due Heisserman Construction Co., Inc. I It was moved by Lea and seconded by Nickson that we concur with the Engineer's Estimate and pay Heisserman Construction Co., Inc. $11,481.70 from L.I .D. No. 170 Fund and $10,812.47 from the Arterial Street Fund for a total payment of $22,294.17. ROLL CALL VOTE: AI I Councilmen voting YES. Ingal Is, Attorney, fi led an Order For Issuance of Writ of Review and Temporary Injunction, Affidavit For Writ Of Review And Temporary Injunction, and Writ of Review in behalf of Dr. Herman R. Ansingh. Mayor Gaines asked that these documents be fi led with the City Attorney. A letter was received from the City of Tacoma in which they wished to ascertain whether the City of Auburn would be wi 1 ling to consider the sale of approximately 25 to 30 acres of property located in Section I I near the inrersection of South 55th Avenue and South 316th Street to the Tacoma Water Division. I Mayor Gaines referred this matter to the Water-Sewer Committee. Mrs. VanWoolery submitted a letter regarding the 4th & A Street S.E. Viaduct. Mayor Gaines asked that this letter be placed on fi Ie. Robert Driggers, President Auburn Cab Company, requested permission to move their present taxi stand to 24 East Main and also grant them another taxi stand aT their present address. They also made application for another taxi license for a 1965 Ford Fairlane, motor number 5K42T2928I I. Mayor Gaines referred the request for taxi stand to the Street Committee, and the application for taxi license to the License Committee. Hagestad, City Engineer, submitted a brief resume' of public works progress over the past two years, and subsequently tendered his resignation, effective August I, 1966. Mayor Gaines cal led for an interim Counci 1 Meeting to be held 7:30 p. m., Monday, July 25, 1966. AUDIENCE Frank Steward asked the Counci I to make 26th Street Southeast a deadend street. Mayor Gaines referred Mr. Steward to the Street Committee. COUNCIL COMMITTEE REPORTS STREET COmAITTEE - COUNCILMAN LEA Counci Iman Lea reported that the Street Committee has worked out a plan for a oneway traffic pattern in the City of Auburn, and unti I this plan is submitted to the State Highway Department they wi I I hold up action on traffic lights for the City. It was moved by Lea and seconded by Nickson that the City Attorney be instructed to draft the necessary Ordinance to implement a one-way traffic pattern for the City of Auburn. MOTION CARRIED Mayor Gaines asked that a copy of this plan be given to the Auburn Chamber of Commerce. AIRPORT COMMITTEE - COUNCI LMAN KLINE Counci Iman Kline reported that Northwest American Inc. had presented a report on their feasibi lity study to the Airport Committee, and asked that a preliminary design of the airport along with a cost estimate be made so they can further their study. It was moved by Kline and seconded by Fitzsimmons that the Mayor be authorized to sign an application for Federal Aid for Airport Construction. MOTION CARRIED LICENSE COMMITTEE - COUNCILMAN SONNEMANN It was moved by Sonnemann and seconded by Kline that Robert Driggers be granted taxi license for a 1965 Ford Fairlane, motor number 5K42T2928I I. MOTION CARRIED ANNEXATION COMMITTEE - COUNCILMAN SONNEMANN It was moved by Sonnemann and seconded by Aaby that approval be given to circulate a second petition for annexation of property North of the Auburn City Limits and that said petition should include the provision that the area wi I I assume its prorate portion of the existing bonded indebtedness of the City of Auburn. MOTION CARRIED Mrs. Thompson inquired if the area included in the original petition could be reduced in size by the counci I. City Attorney Robert Smythe said that this could be done. OLD BUSINESS The Finance Committee Report was read recommending that the Mayor and Clerk be authorized to sign the offer by the National Bank of Commerce to extend the financing agreement on Water Sewer Construction warrants unti 1 September 30, 1966, interest to be computed at 4% effective July 15, 1966. It was moved by Sonnemann and seconded by Hoyt that the proposal of National Bank of Commerce to extend the financing agreement on Water Sewer Construction warrants until September 30, 1966, interest to be computed at 4% effective July 15, 1966, be accepted and the Mayor and City Clerk be authorized to sign same. City Attorney Robert Smythe reported that he was in receipt of Quit Claim Deeds from Boyce, Brister and Hess, and an Easement for Water Main from Crouch. It was moved by Sonnemann, and seconded by Aaby that the City Attorney be instructed to record the aforementioned deeds and easement.
