Mayor Gaines called the meeting to order. Counci Imen present: Hoyt, Lea, Kline, Fitzsimmons, Nickson, Aaby and Sonnemann. It was moved by Nickson and seconded by Aaby that minutes of the previous meeting, held July 18, 1966, be approved as mai led. MOT ION CARR I ED PUBLIC HEARINGS Mayor Gaines declared the public hearing open on the request of Robert Burwel I to rezone from R-2 to R-3 property located on the west side of H Street Southeast north of 21st, legally described as See 19-21-5 the N 130' of S 264' of E~ of SE~ of NE~ of SW~ EX the E 30' thof. The Auburn Planning Commission recommended that this request be granted: To the North is R-4 zoning, the Junior High School is to the east and im- mediately west is R-4 and SPU zoning. Consideration should be given to the dedication of the east 15 ft. for the over-a I I development of H St. S.E. and the dedication of the north 25 ft. with a portion for cul-de-sac on the west and for the development of 20th St. Robert Burwel I stated that he was in the process of dedicating the east 15 ft. for the over-a I I development of H St. S.E., but was not in favor of dedicating the north 25 ft. with a portion for cul-de-sac on the west for the development of 20th Street unti I the property owner adjacent to his property made dedication of 25 ft. for this purpose. It was moved by Hoyt and seconded by Lea that the public hearing be closed. The Auburn Planning Commission recommended to the City Counci I that this request be granted as the petition inadvertantly omitted the legal description applicable to this property on a parcel previously rezoned R-2 to R-4. It was moved by Nickson and seconded by Aaby that the public hearing be closed. MOTION CARRIED I I I AUBURN, WASHINGTON MONDAY AUGUST I, 1966 U1 It was moved by Fitzsimmons and seconded by Kline that we concur with the Planning Commissions recommendation and grant the request of Wi I liam J. Edwards to rezone from R-2 to SPU property 'ocated between M St. $.E. and R St. S.E., subject to their application for building permit within one yè~r, if no bui Iding permit has been obtained within one year the property shal I revert back to its present zoning, and that the city attorney be instructed to draw up the necessary ordinance to implement same. MOTION CARRIED Mayor Gaines declared the public hearing open on the request of Robert Kuzmer to rezone from NS to C-3 property located at the S.W. cor. of 12th St. S.E. and the Enumclaw Highway, legally described as Lots I & 2, Blk. I, Lloyd A. Knowles 2nd Addn. to the City of Auburn. The Auburn Planning Commission recommended that this request be granted as it conforms to the pattern already established along the Enumclaw Hwy. regarding useage. Consideration should be given to dedication of 5 ft. on the N.E. boundary for future widening of Enumclaw Highway to provide a left turn lane. It was moved by Kline and seconded by Nickson that the public hearing be closed. MOTION CARRIED It was moved by Hoyt and seconded by Nickson that the request of Robert Kuzmer to rezone from NS to C-3 property located at the S.W. cor. of 12th St. S.E. and the Enumclaw Highway be tabled for further study. MOTION CARRIED Mayor Gaines declared the public hearing open on the request of W. Peters to rezone from R-2 to R-4 property located on the corner of 19th and H Sts. S.E., legally described as Lot #1, LaVelle Addition to the City of Auburn, Washington The Auburn Planning Commission recommended that this request be granted for the fol lowing reasons: There is a R-4 zoning to the west, requests for R-3 to the south, the Jr. High School is across the street, and this parcel of property is located on a corner with exposure to H St. S.E. and 19th St. S.E. and wi I I conform to the over-a I I development of the area. Consideration should be given to granting of a five ft. easement on the westerly boundary to extend the sewer south between 19th and 20th sts. S.E. It was moved by Aaby and seconded by Sonnemann that the public hearing be closed. MOTION CARRIED It was moved by KI ine and seconded by Fitzsimmons that the city attorney be instructed to draw up the necessary ordinance to grant the request of W. Peters to rezone from R-2 to R-4 property 'ocated on the corner of 19th and H Sts. S.E., subject to commencement of construction within one year, construction to be determined by inspection of the foundation and if construction has not been started within one year, the property shal I revert back to its present zoning. A~TION CARRIED Mayor Gaines declared the public hearing open on the request of Fred Poe to rezone from R-3 to C-I property 'ocated at 1428 Enumclaw Highway, legally described as Lot 7 & W 60' of Lot 6, Lloyd A. Knowles 3rd Addition to Auburn as recorded in Volume 49 pg. 66 of plats, records of King Co., WasHngton. The Auburn Planning Commission recommended that the request be granted as it conforms to the pattern established along the Enumclaw Highway. Consideration should be given to the dedication of the 5 ft. ðlong the southerly line abutting the Enumclaw Highway for the future widening of the Enumclaw Highway in order to provide a left turn lane. It was moved by Hoyt and seconded by Nickson that the public hearing be closed. MOTION CARRIED It was moved by Sonnemann and seconded by Aaby that we concur with the Planning Commissions recommendation and grant the request of Fred Poe to rezone from R-3 to C-I property at 1428 Enumclaw Highway. MOTION CARRIED 158 AUBURN, WASHINGTON NONDAY AUGUST I, 1966 cv ~~ Qð u~' Mayor Gaines declared the public hearing open on the request of Dave and Ruby Botting for vacation of a portion of 3rd St. N.E. lying between K & L Sts. N.E. :'!:~ Dave Botting Spoke in favor of the granting of this vacation. It was moved by Aaby and seconded by Sonnemann that the public hearing be closed. MOTION CARRIED It was moved by Lea and seconded by Kline that the request of Dave and Ruby Botting for vacation of a portion of 3rd St. N.E. lying between K & L Sts. N.E. be granted and the city attorney be instructed to draw up the necessary ordinance to implement same, and to determine if their are any uti lities or easements in the area. Counci Iman Lea reported that the Street Committee recommended that the request of Dave and Ruby Botting be amended to provide that the south 20 ft. on the existing south side of right-of-way be vacated. I It was moved by Aaby and seconded by Kline to table this request for further study. MOTION LOST It was moved by Sonnemann and seconded by Nickson to amend the motion so that the petition as submitted by Dave and Ruby Botting be modified to provide that the south 20 ft. on the existing south side of right-of-way be vacated in lieu of the 15 ft. requested. MOT ION CARR I ED MOTION AS AMENDED CARRIED Mayor Gaines declared the public hearing open on the request of United Homes for vacation of a portion of the Enumclaw Highway lying east of Dogmod Street. It was moved by Sonnemann and seconded by Nickson that the public hearing be closed. MOT I ON CARR I ED It was moved by Kline and seconded by Hoyt that the request of United Homes for I vacation of a portion of the Enumclaw Highway lying east of Dogmod Strêet be granted, and the city attorney be instructed to draw up the necessary ordinance to implement same. Counci Iman Lea reported that it was the recommendation of the Street Committee that this portion of the Enumclaw Highway be vacated. MOTION CARRIED CORRESPONDENCE Charles H. Dougherty submitted a request to extend sewer line from existing termination at Chinook School to serve property to East City boundary. Mayor Gaines referred this request to the Water-Sewer Committee. The Auburn Planning Commission recommended that the fol lowing requests be granted. The request of Gertrude Hintz to rezone from R-3 to C-I property at 1335 M Street Southeast. The request of Vivienne LaVel Ie Warner to rezone from R-2 to R-3 property in the 1900 block on H St. Southeast. The request of Jeff's Orphan Home to rezone from A-I to M-2 property located I on either side of the West Val ley Highway between the 2000 and 2800 blocks. It was moved by Kline and seconded by Nickson that the city clerk be instructed to cal I for a public hearing to be held 8 p. m., Monday, August 15, 1966 on the requests for rezoning submitted by Gertrude Hintz, Vivienne LaVel Ie Warner, and Jeff's Orphan Home. MOTION CARRIED The W. L. Scarff estate submitted a request for vacation of al ley lying between Auburn Avenue and B St. N.E. and between 5th St. N.E. and 7th St. N.E. It was moved by Sonnemann and seconded by Nickson that the city attorney be instructed to draw up the necessary resolution to cal I for a public hearing to be held 8 p. m., September 6, 1966, on this request for vacation of al ley. Thomas and Grace Thomas, husband and wife, July 27, 1966, Alternative Writ of Prohibition ordering city to desist and refrain from any further steps or proceedings whatever in the proposed annexation to the City of Auburn of the area between the south city I imits and Stuck River; also copies of Appl ication for Writ of Prohibition and Affidavit in Support of Application for Writ of Prohibition. Mayor Gaines referred these documents to the city attorney. Mayor Gaines cal led a meeting of the Annexation Committee to be held 7:30 p.m., Monday, August 8, 1966, on the Stuck River Annexation. Payment of the fol lowing vouchers from the Water Sewer Construction Fund for pro-rata share of street construction on 17th S.W. for detour route during construction of West Side Water Line and West Interceptor Sewer were submitted for counci I approval: Rainier Asphalt Paving Company Mi I es Company Heisserman Construction $4,630.44 55 I . 88 183.33 It was moved by Fitzsimmons and seconded by Nickson that the counci I approve payment of $4,630.44 to Rainier Asphalt Paving Company, $551.88 to Mi les Company, and $/83.33 to Heisserman Construction from the Water Sewer Construction Fund for pro-rata share of street construction on '7th S.W. for detour route during construction of West Side Water Line and West Interceptor Sewer. MOTION CARRIED A letter was received from the Department of Health, State of Washington, approving plans and specifications for the South West and South End Supply Line Water Main. Mayor Gaines asked that this letter be placed on fi Ie. Warren C. Gonnason, County Engineer, submitted a letter stating that the name of "Levi Sal lard Bridge" wi 1 I be presented to the County Commissioners for their approval in the near future, and inquiring if the City of Auburn desires to furnish a suitable plaque or tablet for the bridge. Submitted for approval was payment to Hi I I & Ingman for Engineering services for West Interceptor Sewer as of July 28, 1966, the sum of $3,960.07 from the Water-Sewer Construction Fund. It was moved by Fitzsimmons and seconded by Kline that Hi I I & Ingman be paid $3,960.07 from the Water-Sewer Construction Fund for Engineering services for West Interceptor Sewer, as of July 28, 1966. Grenier, assignee, $2500.00:Bednorz Constrùction Co., $400.00 on Apri I 29, 1966. The companies al lege that a col I ¡son between vehicles owned by each of them was caused by negligence on the part of the City of Auburn for fai ling to property maintain a stop sign at or near the intersection of 21st St., Howard Road and R St. Mayor Gaines referred these claims to the city attorney and city's liabi lity insurance agent. John D. Wadkins submitted a zone change application requesting property located on M St. north of 21st Street be rezoned from R-2 to R-3. It was moved by Sonnemann and seconded by Nickson that the request of John D. Wadkins to rezone from R-2 to R-3 property located on M St. north of 21st Street be referred to the planning commission. MOT I ON CARR I ED A petition was submitted for creation of a Local Improvement District for the construction of Excavation, Bal lasting, Storm Sewer, Curb & Gutter, 5 ft. Sidewalk, 8" Sanitary Sewer, 6" C.I. Water Mains & Fire Hydrants on 22nd St. S.E. between D & F St., 23rd St. S.E. between d & F St., 25th St. S.E. between D & F St., and the west side of F St. S.E. between 21st and 25th St. S.E. 160 AUBURN, WASHINGTON MONDAY AUGUST I. 1966 ~ ~,. ¡:» George A. MOT ION CARR I ED Monarch Investment Company submitted a letter requesting that a private engineering firm be retained by the city to perform the engineering work, preparation of bids, and site surveying for Local Improvement District for the improvement of 22nd Street I on 23rd Street and on 25th Street between "D" and "F" and the west side of "F" Street S.E. between 21st and 25th Streets S.E., Auburn. It was moved by Lea and secoroed by Sonnemann that the counci I concur with the request of Monarch Investment Company and retain a private engineering firm to perform the engineering work, preparation of bids, and site surveying for the proposed Local Improvment District. It was moved by Kline and seconded by Fitzsimmons that the motion be amended to include that the City Engineering Department shal I perform on sight inspection of the project. Beierlien spoke in protest to the proposed one-way street pattern for Main Street.
