The regular meeting of the City Counci I of the City of Auburn was held at 8:00 p.m. ~
in the Co unci I Chambers at the City Hal I.
Mayor Gaines cal led the meeting to order.

previous meeting, held August I, 1966: It was moved by Sonnemann and seconded by
Aaby that we concur with the Planning Commissions recommendation and grant the request
of Fred Poe to rezone from R-3 to C-I property at 1428 Enumclaw Highway.

Bids were opened at 8 p. m. August I I, 1966, for installation of curb and gutter,
excavation, bal lasting, storm drainage and two course bituminous surfacing on lOth
Street Northeast between K and M Streets, (L.I.D. #174) as follows:

sales tax. Work to begin within 4 days after proposal is accepted and
completed within 30 days. A 5% bid bond accompanied the bid.

Mayor Gaines declared the public hearing open on the Assessment Rol I of L.I .0. No.171
It was moved by Sonnemann and seconded by Hoyt that the publ ic hearing be closed.

It was moved by Sonnemann and seconded by Nickson that the Assessment Rol I of
L.I.D. No. 171 be confirmed as presented to the City Counci I and that the City
Attorney be instructed to draw up the necessary ordinance to implement same.

Norris E. Norwood submitted a letter objecting to assessment because of
incorrect footage.
John Hurt, Water Supervisor, reported that the fottage on Norris E.

Paul Siebert, representative of Investment Exchange Corporation, explained
plans for this property.
Jim Duncan, representative of Leo Dai Iy & Associates, presented shopping
center design proposed for property.
Dick Lang, representative of Investment Exchange Real Estate, explained
their need for rezoning the property at earliest possible date.
The Auburn Planning Commission recommended to the City Counci I that the
request of Auburn West Assoc. to rezone from M-I to C-3 be granted on the
portion lying North of PSH #2 with consideration being given to a road on
the periphery of the property with a 30 ft. dedication on the East and
sufficient right-of-way on the south side for a ful I street on the South
side. On the parcel lying south of the PSH #2, consideration should be
given to the dedication of the street presently under construction as
fi led on the plans submitted by the applicant.
It was moved by Aaby and seconded by Nickson that the public hearing be closed.

It was moved by Nickson and seconded by Aaby that we concur with the recommendation
of the Planning Commission and grant the request of Auburn West Associates to
rezone from ~I to C-3 property located on East side of the West Val ley Highway,
North and South of the Echo Lake Cut-off, and the City Attorney be instructed to
draw up the necessary ordinance to implement same.
It was moved by Kline and seconded by Nickson that action on the request of Auburn
West Associates to rezone be tabled.

Mayor Gaines declared the public hearing open on the request of Wi I lis R. Hal I,
Joan C. Hal I, Maxine M. Benson and Robert B. Benson to vacate a portion of Henry
Road lying south of 8th St. N.E. and east of Pike St. N.E., legally described
as that portion of Henry Road (County Road #528) lying south of a line parallel
to and 30' south of the north line of the NE~ of Section 18, Township 21 North,
Range 5 E.W.M. and east of a line paral leI to and 345 west of the east I ine of
aforesaid NE~ of Section 18, Township 21 North, Range 5 E.W.M.
It was moved by Kline and seconded by Aaby that the public hearing be closed.

Northerly half to the City of Auburn Water-Sewer Department.

Mayor Gaines declared the public hearing open on the request of Gertrude Hintz to
rezone from R-3 to C-I property at 1335 M St. S.E., legally described as Lots I, 2
and 3 of Lloyd A. Knowles 3rd Addition LESS St. 19-21-5.

The Auburn Planning Commission recommended to the City Counci I that the
request of Gertrude Hintz to rezone from R-3 to C-I be granted as this
conforms to the pattern established along the Enumclaw Highway. Consider-
ation, however, should be given to the dedication of the southerly five
(5) feet abutting the Enumclaw Hwy. for the future widening of the Enumclaw
Highway in order to provide a left turn lane.
It was moved by Sonnemann and seconded by Lea that we concur with the Planning
Commissions recommendation and grant the request of Gertrude Hintz to rezone
from R-3 to C-I property at 1335 M Street S.E., and instruct the City Attorney to
draw up the necessary ordinance to implement same.

Mayor Gaines declared the public hearing open on the request of Vivienne LaVel Ie
Warner to rezone from R-2 to R-3 property in the 1900 block on H St. S.E.,
legally described as lots 4 & 5 LaVelle Addn. to Auburn & S 165' of N 296' of
W 161' of E 330' of SE~ of NE~ of swk 19-21-5.
The Auburn Planning Commission recommended to the City Counci I that the
request of Mrs. Warner be granted to rezone from R-2 to R-3 as it fits in with
the over-a I I use of the area, has proposed R-3 zoning to the South, R-4 zoning
to the North and to the SW, and SPU to the NW. Consideration, however, should
be given to the dedication of the South 25' with a portion for cuI de sac on
the west for the development of 20th Street.
It was moved by Hoyt and seconded by Sonnemann that the public hearing be closed.

It was moved by Aaby and seconded by Sonnemann that we concur with the Planning
Commissions recommendation and grant the request of Vivienne LaVel Ie Warner to
rezone from R-2 to R-3 property in the 1900 block on H St. S.E., and instruct the
City Attorney to draw up the necessary ordinance to implement same.

Mayor Gaines declared the public hearing open on the request of Jeff's Orphan
Home to rezone from A-I to ~2 property located on the east side of the West Val ley
Highway between the 2000 and 2800 blocks, legally described as the SE4 of the NE~
of Sec II, the W~ of the NW~ and that por of the SE4 of the NW4 Iy W of the PSERwy
r/w Sec 12 T 21 N R 4 EWM.
The Auburn Planning Commission recommended to the City Counci I that the
request of Jeff's Orphans Home to rezone from A-I to M-2 be granted as it
conforms with the Comprehensive Plan as approved by the Planning Commission
for this area. Consideration should be given to the Southerly 10 feet of
the SEk of the NE4 of Sec 11-21-4 LESS the South 20' thof.
George Schuler, Acting Engineer, reported that he had received a letter from
the firm of Bogle, Gates, Dobrin, Wakefield & Long, attorneys for Jeff's
Orphans Home, in which they stated that the trustees of Jeff's Orphans Home
have no power to comply with the request for dedication of the Southerly 10
feet.
It was moved by Kline and seconded by Hoyt that the public hearing be closed.

to rezone from A-I to M-2 be amended to include only that portion of property lying
East of the West Val ley Highway, and that this request be granted, and the City

A Summons and Complaint was fi led August 4, 1966, by lane Johnson on behalf of
Marian Kansanback for $50,000.00 damages for alleged injuries sustained in a
collision between her car and a patrol car driven by Patrolman Ernie Mi Iler
October 20, 1965.
Mayor Gaines referred the Summons and Complaint to the City's Insurance Company
and the City Attorney.
CATV Consultants submitted a letter regarding request for a Community Antenna
Television System Franchise from the City of Auburn.
Mayor Gaines referred this request to the Telecable Committee.
The office of the State Auditor submitted to the Counci I comments regarding the
recent audit of the 1965 City of ALburn fiscal records.
Mayor Gaines asked that this letter be placed on fi Ie.
Dorothy E. and Kenneth A. Embery submitted a Zone Change Application to rezone from
R-2 to R-4 property in the 700 block fronting on R St. N.E.
It was moved by Sonnemann and seconded by Nickson that the application of Dorothy
E. and Kenneth A. Embery be referred to the Planning Commission.

Submitted for approval was Engineer's Final Estimate showing $757.35 due Heisserman
Construction Company from L.I.D. No. 170
It was moved by Lea and seconded by Nickson that Heisserman Construction Company
be paid $757.35 from L.I .0. No. 170 Fund as per Engineer's Final Estimate.

The Auburn Chamber of Commerce submitted a letter to City Counci I stating the
Board of Directors has designated their preference for Plan #4 of two way traffic
on Second Streets S.W. and S.E. with stop signals at A and C Streets; also two way
traffic on Main St. and signals at A and C on First St. N.W. and N.E.
Mayor Gaines appointed the fol lowing people to a committee to work with the
Street Committee in devising a traffic pattern plan for the downtown area:
Police Chief Hugh Darby, Planning Director and Acting Engineer George
Schuler, Ed Ryan, Dave Botting, and Dick Dahlager.

The Auburn Chamber of Commerce submitted a letter requesting permission for the
Retai I Trade Bureau to operate a ride concession at the Washington Grade School
Grounds August 23, to 27, permission having already been obtained from the Auburn
School Administration.
It was moved by Sonnemann and seconded by Aaby that permission be given the Retai I
Trade Bureau to operate a ride concession at the Washington Grade School Grounds
Augus t 23 to 27.

Melby Trai ler Service submitted a letter requesting city water and sewer services
for a Mobile Home Park on leased Indian property on the Enumclaw Highway adjacent
to the city limits.
Mayor Gaines referred this request to the Utilities Committee.

Counci Iman Sonnemann announced that the Uti Ii ties Committee wi I I hold a meeting
8 p. m. Wednesday, August 24, 1966, in the Engineering Office.
George A. Schuler, Acting City Engineer, submitted a letter to the counci I
recommending the acceptance of the bid submitted by Heisserman Construction Co.,
Inc. on LID #174 for the installation of curb and gutter, excavation, ballasting,
storm drainage and 2 course bituminous surfacing on lOth st. N.E. between K and
M St. N.E., for a total amount of $8,065.68.
A petition was submitted requesting formation of a Local Improvement District
for the construction of a two course bituminous surfacing and necessary grading
on "M" St. N.E. between 12th and 14th Sf. N.E.
Beorge A. Schuler, Planning Director, submitted certification that the signatures
contained on the petition constitutes 71.62% of the total frontage and 66% of the
total area in the proposed improvement district.
It was moved by Lea and seconded by Hoyt that the City Attorney be instructed to
draw up the necessary ordinance to create a Local Improvement District for the
construction of a two course bituminous surfacing and necessary grading on "M"
St. N.E. between 12th and 14th St. N.E.

bids to be opened 3 p. m., August 25, 1966.

John Hurt, Water Supervisor, reported on the progress of the installation of
the 16" water main to West Side South End Stage Tv..o.
RECREATION DEPART^~NT - BRUCE BILLE RECREATION DIRECTOR
Bruce Bi I Ie, recreation director, reported that Friday was the last day of
the play ground program.
Mayor Gaines expressed his appreciation to Bruce Bi I Ie for having secured the
services of the Seattle Repertory Theater.
OLD BUSINESS
Counci Iman Sonnemann reported that the Annexation Committee had met with the
people in the area of the proposed Stuck River Annexation.
City Attorney Robert Smythe reported that the attorneys for the people opposing
the annexation of the Stuck River area have agreed to a continuance of the hearing
date on this annexation until October.
Robert Kuzmer submitted a letter informing the Counci I of the restrictive
covenants on Lots I & 2, Blk. I, Lloyd A. Knowles 2nd Addn. to the City of Auburn,
property which he has requested be rezoned from NS to C-3.
Robert Kuzmer submitted Quit Claim Deed for street purposes as recommended by the
Planning Commission on Lot I.

City Attorney Robert Smythe reported that he had the contract for engineering
services for the design and construction of Local Improvement District No. 176
ready for signature.
It was moved by Lea and seconded by Aaby that the Mayor and City Clerk be authorized
to sign a contract with Fred Poe, Civi I Engineer, for engineering services on
Local improvement District No. 176.
