Mayor Gaines cal led the meeting to order. Counci Imen present: Hoyt, Lea, KI ine, Fitzsimmons, Nickson, Aaby and Sonnemann. It was moved by Aaby and seconded by Nickson that the minutes of the August 15, 1966 Counci I Meeting be approved as mai led. MOTION CARRIED BIDS Bids were opened at 3 p. m. Thursday, August 25, 1966, for the purchase of a truck for the Cemetery Department as fol lows: FIRM SALES TAX TOTAL BID Va I I ey Motors Bothel I Chevrolet Cadi I lac Inc. 1988.76 1848.50 83.53 77.64 2072.29 1926.14 The Auburn Cemetery Board accepted the bid of Bothell Chevrolet Cadi Ilac, Inc. for the pick-up truck. It was moved by Sonnemann and seconded by Nickson that the acceptance of the bid of Bothel I Chevrolet Cadi I lac, Inc. for the pick-up truck by the Auburn Cemetery Board be confirmed. ROLL CALL VOTE: All Counci Imen voting YES. MOTION CARRIED PUBL 'C HEAR I NGS Mayor Gaines declared the publ ic hearing open on the Assessment Roll for L.I.D. No. 170. It was moved by Hoyt and seconded by Sonnemann that the public hearing be closed. MOTION CARRIED It was moved by Sonnemann and seconded by Lea that the Assessment Rol I of L. I .D. #170 be confirmed as presented to the City Counci I and that the City Attorney be instructed to draw up the necessary ordinance to implement same. MOTION CARRIED Mayor Gaines declared the publ ic hearing open on the request of John C. Frankhauser to rezone from M-2 to R-5 property located at 2121 D Street Southeast and legally described as in the City of Auburn, County of King, State of Washington, Tr I, EX the N 136.40' Trueson's 1st Addn. to Auburn, King County, according to plat rec. in Vol. 29 of Plats, Page 46 records of sd County, 19-21-5. The Auburn Planning Commission recommended that this request be granted as it is consistent with the over-al I development plan and the immediate surrounding property is zoned M-2. Wi Ibur Hanenberg, resident at 304 21st Street Southeast, spoke in opposition to this rezone. It was moved by Kline and seconded by Hoyt that the public hearing be closed. MOT I ON CARR 1 ED It was moved by Sonnemann and seconded by Aaby that we concur with the Planning Commissions recommendation and grant the request of John C. Frankhauser to rezone from M-2 to R-5 property located at 2121 D Street Southeast, and the City Attorney be instructed to draw up the necessary ordinance to implement same. 'C,:ü ~. ~ r-- ~ The Auburn Planning Commission recommended that this request be granted and recommend- ed that a cui de sac of min~mum City requirements be dedicated on the north end of S Street S.E. as this fits in with the over-al I comprehensive land use plan of the area and would not be detrimental to adjacent properties. It was moved by Hoyt and seconded by Nickson that the public hearing be closed. MOTION CARRIED It was moved by Kline and seconded by Nickson that we concur with the Planning Commission IS recommendation and grant the request of Harry W. Gates to rezone from R-2 to SPU (Church Purpose) property located at 2608 R Street Southeast and I the City Attorney be instructed to draw up the necessary ordinance to implement . same. MOTION CARRIED Mayor Gaines declared the public hearing open on the request of Mark A. 'Hedman to rezone from R-2 to SPU (apartments) property located on 27th and 0 Sts. S.E., and legally described as Lots 8, 9, 10, II, Auburn Evergreen Park, 30-21-5 EWM. The Auburn Planning Commission recommended that this request be granted per plot plan as presented as this fits in with the over-a I I comprehensive land use of the area and had adequate egress and access for traffic purposes. It was moved by Aaby and seconded by Nickson that the publ ic hearing be closed. MOT ION CARR 1 ED It was moved by Fitzsimmons and seconded by Aaby that we concur with the Planning Commission's recommendation and grant the request of Mark A. Hedman to rezone from R-2 to SPU (apartments) property located on 27th and 0 Sts. S.E., and the city attorney be instructed to draw up the necessary ordinance to implement same. MOTION CARRIED Mayor Gaines declared the public hearing open on the request of Leon E. Jones to rezone from R-3 to C-I property located at 1420 Enumclaw Highway, and legally I described as Lot #9, Lloyd A. Knowles 3rd Addn, according to plat rec. in Volume 49 of plats, page 66, King County, Washington. The Auburn Planning Commission recommended that this request be granted as it fits in with the over-a I I comprehensive land use of the area and with the pattern establish- ing along the Enumclaw Highway. Consideration should be given to the dedication of the 5feet bordering the Enumclaw Highway for future widening of this Highway. It was moved by Aaby and seconded by Hoyt that the public hearing be closed. MOTION CARRIED It was moved by Sonnemann and seconded by Hoyt that we concur with the Planning Commission's recommendation and grant the request of Leon E. Jones to rezone from R-3 to C-I property located at 1420 Enumclaw Highway, and the City Attorney be instructed to draw up the necessary ordinance to implement same. Mayor Gaines declared the public hearing open on the request of Jeff's Orphans Home to rezone from Unclassi fied to SPU (gravel removal) on two parcels of property, one north and one south of the West Hi I 1 Reservoir west of the West Val ley Highway, and legally described as The Nwi-NEi and the NW~-SE~, both in Sec I I, T 21 N, R 4 EWM comprising of TR I & 3 respectively. Frank Payne, representative of Jeff's Orphans Home, was present to answer any questions on the rezone. I It was moved by Hoyt and seconded by Nickson that the public hearing be closed. MOTION CARRIED It was moved by Kline and seconded by Nickson that the request of Jeff's Orphans Home to rezone from Unclassified to SPU (gravel removal) on two parcels of property, one north and one south of the West Hi I I Reservoir west of the West Val ley Highway be granted, and in effect only so long as Jeff's Orphans Home meèts the fol lowing provisions as recommended by the Auburn Planning Commission: I. Excavation not to exceed limits as shown on cross-section as submitted, and the City Attorney be instructed to draw up the necessary ordinance to implement same. It was moved by Nickson and seconded by Aaby that provisions I, 2, and 7 be amended as fo I lows: I. Travel roads to be oi led prior to their use. 2. A minimum 100 ft. buffer to be retained from al I abutting property. 7. No operation of mechanical equipment after dark on Sunday or Hol idays. Scarff for the vacation of an al ley running between B Street N.E. and Auburn Avenue between 5th and 7th Streets. It was moved by KI ine and seconded by Sonnemann that the publ ic hearing be closed. MOT ION CARR I ED It was moved by Lea and seconded by Hoyt that this request be denied. MOT ION CARR I ED CORRESPONDENCE The Auburn Cemetery Board submitted a request for an emergency ordinance to transfer $1200 from unbudgeted funds in the Cemetery Fund to the Equipment and Additions account in the 1966 Cemetery Department budget. It was moved by Sonnemann and seconded by Aaby that the aforemention appl ications be referred to the Planning Commission. The King County Commissioners submitted to the Counci I a Resolution adopted by them to the effect that the new bridge on 100th Avenue Southeast across the Stuck River, shal I be, upon completion, known and named the "Levi Bal lard Bridge." Submitted for approval was Change Order No.2 in the amount of $5,591.00 for West Interceptor Sewer Construction under EDA Contract No. 07-1-00109, contractor Frank Coluccio Construction Co., Seattle. I The Uti lity Committee and Acting City Engineer George Schuler recommended that this Change Order be approved. It was moved by Fitzsimmons and seconded by Sonnemann that Change Order No.2 be approved as recommended by the Acting City Engineer and Hi I I and Ingman, Consulting Engineers. It was moved by Fitzsimmons and seconded by Sonnemann that $200,699.82 be paid Frank Coluccio Construction Company, contractors, as shown on Engineer's Estimate No. I., ROLL CALL VOTE: AI I Counci Imen voting YES. MOTION CARRIED Richard E. Wolff, Consulting Engineer on the South and Southwest Water Lines, submitted an invoice for engineering services May I to August 20, 1966, in the amount of $2,326.74. It was moved by Fitzsimmons and seconded by Sonnemann that Richard E. Wolff be paid I $2,326.74 for engineering services May I to August 20, 1966 on the South and Southwest Water Lines. Wolff, consulting engineer for the South and Southwest Water Supply Lines, submitted Engineer's Progress Estimate No. I, showing a net amount of $106,181.87 due the Contractor G & J Construction Company as of August 23, 1966. It was moved by Fitzsimmons and seconded by Sonnemann that we concur with the recommendation of Richard E. Wolff and pay G & J Construction Company $106,181.87, as per Engineer's Progress Estimate No. I. ROLL CALL VOTE: AI I Counci Imen voting YES. MOTION CARRIED Hi I I and Ingman submitted an invoice dated August 23, 1966, in the amount of $3,083.49 for engineering services on the West Interceptor Sewer. It was moved by Fitzsimmons and seconded by Sonnemann that Hi II and Ingman be paid $3,083.49 for engineering services on the West Interceptor Sewer. ROLL CALL VOTE: AI I Counci Imen voting YES. MOTION CARRIED A Summons and Complaint was served on the City August 25, 1966, be George Dragness, Jr on behalf of his daughter Susyn Dragness, for $100,000 damages for alleged injuries ·1 sustained when the car in which she was riäing was involved in an accident on 57th and B Street Northwest. Mayor Gaines referred this matter to the Cities Liabi lity Insurance Company. A letter was received from several businesses on East Main Street protesting the unauthorized parking of taxi cabs on the south side of Main Street between Division and A Sts. Four property owners submitted petition requesting permission to circulate an annexation petition for property lying adjacent to the Northwest City Limits. Mayor Gaines referred this petition to the Annexation Committee. I I I AUBUR~ WASH I NGlON MONDAY SEPTEMB~~ 1966 1 r¡7 The Washington State Liquor Store #34 submitted a letter requesting the Counci I change the parking zone in front of their store from one hour parking to fifteen minutes. Mayor Gaines referred this request to the Street Committee. A letter from the Department of Conservation informed the City that any development within the Green River Flood Control Zone No.2 requires a flood control permit from the State. Mayor Gaines referred this matter to the Engineering Department. The Auburn Chamber of Commerce submitted a letter endorsing salary raises for city employees and advising the City that they wi I I cooperate in assisting the Mayor and City Counci I in efforts to find additional revenue to meet the Cities financing emergency. Mayor Gaines asked the Auburn Chamber of Commerce to back Initative #226. The Finance Committee made the fol lowing recommendations: I. That the Counci I authorize a General Obligation Bond Issue for Street Purposes in the amount of $2,000,000.00 be placed upon the bal lot for vote of the people, November 8. 1966. 2. That the request of the Cemetery Board to transfer by Emergency Ordinance $1200.00 from unbudgeted funds in the Cemetery Fund to the Equipment and Additions account in the 1966 Cemetery Department Budget. 3. That the sale for Water-Sewer Revenue Bonds be deferred unti I a more favorable time and that the City Treasurer be authorized to sol icit bids for the sale of warrants for interim financing in an amount not exceeding $/,125,000 to be redeemed within nine months from date of issue from the sale of said bonds. This recommendation stems from a recommendation by Blythe & Company, Bond Consultant to the City of Auburn. 4. It is recommended that the City Treasurer be authorized to purchase from the Fire Rei ief & Pension Fund, Local Improvement Warrants issued against Local Improvement District 168, 170 and 171, total ling $4.224.41. It was moved by Sonnemann and seconded by Aaby that the City Attorney be instructed to draw up the necessary Ordinance to transfer $1200.00 from unbudgeted funds in the Cemetery Fund to the Equipment and Additions account in the 1966 Cemetery Depart- ment Budget. MOT ION CARR I ED George A. Schuler, Planning Director, requested permission to attend the executive committee meeting of the Washington State Good Roads Association meeting in Yakima, September 7, 8, & 9. It was moved by Lea and seconded by Nickson that permission be granted George Schuler to attend the aforementioned meeting. MOTION CARRIED Alex Sonnichsen submitted a letter which advised the City that Heisserman Construction Company has completed the work on L.I.D. No. 170, but that he could not certify the job complete unti I repair has been made on some damage which resulted from a damaged water service. Alex Sonnichsen submitted a letter in which he informed the Counci I that damage to 33rd Street Southeast resulted from fai lure to repair two broken water services, and that the city was responsible for repair of same. Counci Iman Fitzsimmons stated that the Water-Sewer Committee would meet with Alex Sonnichsen at their meeting on September 15, 1966. The Auburn Planning Commission recommended that the request of John D. Wadkins to rezone from M-2 to R-5 property' located at approximately 3405 A Street Southeast be granted. It was moved by Sonnemann and seconded by Aaby that the City Clerk be instructed to call for a publ ic hearing to be held September 19, 1966 at 8 p. m. in the Counci I Chambers of the City Hal/on the request of John D. Wadkins to rezone from M-2 to R-5 property located at approximately 3405 A Street Southeast. I /v\OT I ON CARR I ED AUD I ENCE Mr. Larson, representative of Ravensdale Sportsmans Club, requested permission to hunt within the city I imits of Auburn. Mayor Gaines asked Counci Iman Sonnemann to meet with Mr. Larson in regard to this matter. Mr. Robert Burwel I stated that he was wi' ling to make the dedications as outlined by the Auburn Planning Commission on his property located on the west side of H Street Southeast. COUNCIL COAVAITTEE REPORTS COUNCILNAN HOYT - HOUSING ADVISORY COMMITTEE It was moved by Hoyt and seconded by Nickson, that a representative of the Bui Iding Department be granted permission to attend the Northwest District Meeting for Bui Iding Inspectors on September 16, 1966, at Yakima. COUNCILfMN LEA - STREET COMMITTEE Counci Iman Lea reported that there were approximately 20 persons who are violating I the cityls ordinance which requires the instal ration of ~ldewalks. It was moved by Lea and seconded by Hoyt that the City Attorney be instructed to take the necessary action to enforce this ordinance. NOT I ON CARR I ED COUNCILMAN KLINE - AIRPORT CO^~ITTEE Counci Iman Kline reported that we presently have the preliminary report on the Airport Feasibi lity Study and the preliminary cost breakdown. He reported that it was the recommendation of the Airport Committee that the Finance Committee took into the possibi I ity of putting $500,000 worth of G. O. Bonds on the November bal lot for a !Aunicipal Airport. E. between 21st St. S. E. and 25th St. S. E., and on 25th St. S. E., 23rd St. S. E. and 22nd St. S. E. between 0 St. S. E. and F St. S. E., bids to be opened September 22, 1966 at 3 p. m., specifications to be obtained from the office of the city clerk. MOT I ON CARR I ED It was moved by Sonnemann and seconded by Nickson that the request of Merritt Newson Construction Company for a Side Sewer License be approved. MOTION CARRIED It was moved by Sonnemann and seconded by Nickson that the request of Robert L. Anderson, Wong Restaurants, Inc., for a Cabaret License be approved. MOT I ON CARR I ED DEPARTMENT HEAD REPORTS WATER DEPARTN',ENT - ,JOHN HURT, WATER SUPER I NTENDENT John Hurt, Water Superintendent, reported that Phase I of State 2 of the West Side Water Line has been completed to the point where it has been activated. He also reported that Phase 2 of the West Side Water Line is almost completed from Ellingson Road to the South End of the Boeing Company. OLD BUSINESS It was moved by Hoyt and seconded by Nickson that the Kuzmer request for rezoning of property located at the Southwest corner of 12th Southeast and the Enumclaw Highway from N-S to C-3 be brought off the table. MOT ION CARR I ED Mr. Kuzmer restated his reasons for wanting this property rezoned. Mayor Gaines declared a 3 minute recess at 9:47 p. m. Knowles 2nd Addn. to the City of Auburn be granted subject to the owner agreeing to the fol lowing restrictive covenants: I. That a ten foot set back be observed on the South and West Side of the property. 2. That a three foot screening fence be placed on the South and West Side of the property. 3.
