Mayor Gaines cal led the meeting to order. Counci Imen present: Hoyt, Lea, Kline. Fitzsimmons, Nickson, Aaby and Sonnemann. It was moved by Nickson and seconded by Sonnemann that the minutes of the October 17, 1966 Counci 1 Meeting be approved as mai led. MOT ION CARR I ED BIDS I Bids were opened at 3 p. m. Schuur to annex property located adjacent to the easterly marginal I ine of the existing city I imits to the City of Auburn. It was moved by Aaby and seconded by Sonnemann that the public hearing be closed. MOTION CARRIED I It was moved by Sonnemann and seconded by Aaby that the city attorney be instructed to draw up the necessary ordinance to implement the annexation of this property to the City of Auburn. MOTION CARRIED Mayor Gaines declared the public hearing open on the petition of We I Is B. McCurdy, Trustee, for vacation of J. W. Lund Road lying between primary State Highway No.2 and south city limits. It was moved by Sonnemann and seconded by Aaby that the public hearing be closed. MOT ION CARR I ED It was moved by Lea and seconded by Hoyt that the city attorney be instructed to draw up the necessary ordinance to implement the vacation of J. W. Lund Road. MOT ION CARR I ED Mayor Gaines declared the publ ic hearing open on the request of J. VanHaartman and R. Skaftum to rezone from R-2 to R-4 property located at 3437 Enumclaw Highway, and legally described as the S 250' of the W~ of the E~ of the SE~ of the swk of the I SW~ of Sec 21 T 21 N, R 5 EWM and adj prop. The Auburn Planning Commission recommended to the City Counci I that the request of J. VanHaartman and R. Skaftum be granted, as it I ies adjacent to R-4, R-5 and C-I properties abutting the Enumclaw Hwy. and is the remainder of property recently zoned R-4, provided, however, consideration is given to the Sly 25' to continue the proposed road which wi I I connect with Forest Ridge Drive on the West and the Enumclaw Hwy. on the East. MOTION CARPIED Mayor Gaines declared the public hearing open on the request of Frank Pfulg to rezone from A-I to SPU (Gravel Removal) property West of West Val ley Highway and South of Primary State Highway No.2, and legally described as that por of the S~ of the NW~ of the NEtt of Sec 23 T 21 t~, r~ 4 EWM, situate in King Co., Wn., lying W of paved hwy.; less the N 160' thof. The Auburn Planning Commission recommended to the City Counci I that the request of Frank Pfulg be granted with the following provisions being in effect: I. No processing of gravel is to be done on the site. 2. AI I excavations are to be covered with top soi I, seeded and planted to eliminate erosion. 3. Necessary bonds. as required by the City Attorney, are to be posted to guarantee restoration. 4. This permit is granted for a five year period. 5. There wi I I be no operation of mechanical equipment after dark or on Sundays or Ho lid ays . 6. The removal wi I I conform to King County Quarry and Mining requirements. 7. Excavation shal I not exceed the limits, as shown on the cross-section as sub- m i t t ed . It was moved by Hoyt and seconded by Nickson that the Public Hearing be closed. MOT ION CARP ED It was moved by Aaby and seconded by Nickson that the city attorney be instructed to draw up the necessary ordinance to implement this rezone subject to the special provisions as provided by the Planning Commission. It was moved by Aaby and seconded by Sonnemann to amend the motion by deleting the portion which requires all excavations to be covered with top soi I. MOT I ON CARR I ED MOT 10f\J AS AtAENDED CARR I ED Mayor Gaines declared the publ ic hearing open on the request of Elmer Spencer to rezone from A-I to SPU (Gravel Removal) property located West of the West Val ley Highway and South of Primary State Highway f\Jo. 2, legally described as the N 160' of the S~ of NW;!¡ of NE;~ lying W of State Rd. #69. Sec 23 T 21, R 4 ¡::WM, Co. of King, State of Wn. The Auburn Planning Commission recommended to the City Counci I that the request of Elmer Spencer be granted with the fol lowing provisions being in effect: I. Elmer Spencer submitted a letter asking that provision No.2 requiring "all excavations be covered wi th top soi I, seeded and planted to el iminate erosion" be modi fied to read "all excavations are to be seeded or planted to eliminate erosion." It was moved by Aaby and seconded by Sonnemann that the public hearing be closed. MOT ION CARR I ED Mayor Gaines declared the publ ic hearing open on the request of Ivan Pinyan to rezone from R-2 to R-4 property located on I St. N.t:. between 8th and lOth Sts., legally described as Lots 12, 13, 14, 15, 16 and 17, Blk 13, Hi Ilman's Auburndale Addition Division #2. The Auburn Planning Commission recommended to the City Counci I that the request of Wafter Schlumpf be granted, as this would represent the best possible usage of this area and the zoning is compatible with adjacent properties. Consideration, however. should be given to the dedication of the Westerly 30 ft. of that portion abutting East Valley Highway and the Easterly 30 ft. of the portion abutting "C" Street N.:::. for the continuation and development of "0" Street N.E. Mr. Kuzmer, representative for Mr. Schrumpf, stated that al I necessary deeds for dedications would be furnished the city within the next few days. The Auburn Planning Commission recommended to the City Counci I that the request of R. L. It was moved by Aaby and seconded by Nickson that the publ ic hearing be closed. MOT I ON CARR I ED CORRESPONDENCE I The Auburn Cemetery Board submitted a letter to the city council notifying them of a new schedule of prices for services and for sale of grave space. S.E. MOT I ON CARR I ED A Summons and Complaint was fi led against the City of Auburn Nov. 4, 1966, by Robert J. Grenier, representing Diesel Oi I Sales Co. d/b/a Rainier Asphalt for alleged damages to a vehicle damaged in a col I ision with a vehicle owned by Bednorz Construction Co., April 29,1966, in the intersection of 21st St., Howard Road and P Sf, Complaint alleges cause of accident was due to negl igence of City to fai I to maintain a traffic control stop sign at or near the intersection. Copies of this summons and complaint were sent to the insurance carriers and the city attornej'. Wi I I iam Murphy submitted a request to reconsider sidewalk issue involving his property at 3315 0 St. S.E. J. V. Lange, Street Supervisor, submitted a request to attend the Fourth Annual Road and Street !\\aintenance School, t~ovember 9,10 and 11th. at Sf, f\artin's College in Olympia. It was moved by Lea and seconded by Sonnemann that this request be granted. MOTION CARRIED The League of Women Voters submitted an invitation to attend a publ ic meeting at 8 p. m., November 16, at Little Theater of the Auburn High S ci'i 00 I where problems and opportunities of "our rapidly growing community" will be discussed. Mayor Gaines urged the counci I to attend. Hugh R. Darby, Auburn Chief of Pol ice, submitted a request for permission to extend the 7 day balance of his 1966 vacation to 1967. MOTION CARRIED 210 /\UE3URN, WASH I f\JGTON MONDAY NOVEMBER 7 1966 ~_____o,___,__,~._._ c.ü ~ ~ ¡.,. ~ The counci I received a request signed by 96 Auburn businessmen representing approximately 100% of the downtown core area requesting Main Street remain a two-way street unti I the effects of the completed Val ley Freeway and proposed signal lights can be measured; that the city join in an appeal to State Highway Commission for light at 2nd and C St., and if necessary city offer to share cost of said light with the State; that efforst be made to get the ~atter on the November Agenda of the Highway Commission. Letters from the Auburn Chamber of Commerce and Citizens Committee also favored that Main Street remain two-way. Mayor Gaines referred this matter to the Street Committee. It was moved by Kline and seconded by Nickson that the work performed under L.r .0. #172 by King Construction Co., Inc. be accepted, and if no liens or claims are filed within thirty days after acceptance, the balance due the contractor of $2,669.76 be paid. MOT ION CARR I ED George Schuler, planning director, submitted a request that he be paid for his 1966 annual vacation as he has found it impossible to take his vacation. It was moved by Aaby and seconded by Fitzsimmons that Mr. Schuler's request be granted, and that he be paid for his 1966 annual vacation. MOT I ON CARR I ED The Engineering Dept. recommended that the city award contract to low bidder, Sleads Septic Systems, for constructicn for L.I.D. No. 178A, at bid of $7,097.85 plus any appl icable sales tax. It was moved by Nickson and seconded by Sonnemann that Sleads Septic Systems be awarded the bid for construction for L.I .D. No. 178A, at bid of $7,097.85 plus any applicable sales tax. MOT I ON CARR I ED The Town & Country Restaurant submitted an appl ication for card table license. MOT I ON CARR I ED DEPARTMENT HEAD REPORTS JACK LANGE, STREET SUPERVISOR - STREET DEPARTMENT Jack Lange, street supervisor, requested permission for a member of the safety com- mittee to attend the 17th Annual Governor's Industrial Safety Conference No. 17 and 18 in Olvmpia. It was moved by Sonnemann and seconded by Hoyt that a representative of the safety committee be sent to the 17th Annual Governor's Industrial Safety Conference Nov. 17 and 18 in Olympia, after receiving approval of the mayor. MOTION CARRIED I NEW BUSINESS Robert Smythe, city attorney, reported that he had received a letter from Alex Sonnichsen which noted that the fence on the east side of the 5th & K Street Sal I Field, adjoining on the west of Lot I, French's Addition to the Town of Slaughter, was placed 9 feet west of lot as platted, and that he felt the property owner of Lot I, French's Addition undoubtedly has ownership of this property by adverse possession. It was brought out that several other lots were simi larly affected. Mayor Gaines referred this matter to the Street Committee and the Park Board.
