Councilmen present: Hoyt, Lea, Kline, Fitzsimmons, Nickson, Sonnemann, and Aaby. It was moved by Hoyt and seconded by Aaby that the minutes of the March 20, 1967 Council Meeting and continued sessions of March 27 and 28, 1967 be approved as mailed. It was moved by Aaby and seconded by Nickson that the public hearing be closed. NOT I ON CARR I ED It was moved by Sonnemann and seconded by Aaby that the Assessment Roll of L.I.D. No. 167 as presented to the City Council be confirmed and the city attorney be Instructed to draw up the necessary ordinance. MOTION CARR I ED Mayor Gaines declared the public hearing open on the Assessment Roll of Local Improvement District No. 173. Keo K. Murakami submitted a letter oijecting to his assessment. Planning Director Schuler answered questions asked by Mrs. Elder and Mr. Worth Best about their assessments. It was moved by Hoyt, and seconded by Lea that the publ ic hearing be closed. INJT I ON CARR I ED Mayor Gaines declared the public hearing open on the request of Kenneth A. smith to rezone from R-3 to C-I property located on East Main and "M" Street N.E. legally described as Lots I and 2, Block C. It was moved by Aaby and seconded by Sonnemann that the public hearing be closed. NOTION CARRIED It was moved by Fitzsimmons and seconded by Sonnemann that we concur with the Planning Commissions recommendation and the city attorney be instructed to draw up the necessary ordinance to provide for rezoning from R-3 to C-I as requested. It was moved by Sonnemann and seconded by Nickson that the public hearing be closed. MOTION CARRIED It was moved by Kline and seconded by Nickson that we concur with the Planning Commission recommendation and the city attorney be instructed to draw up the necessary ordinance to provide for rezoning from A-I to ~I as requested. MOT I ON CARR I ED I Mayor Gaines declared the public hearing open on the request of L. S. Olenginski to rezone from Unclassified to R-3 property located on the NE corner of 22nd and "I" Street N.E., legally described as the East one half of Lots 32 and 33, Block 2, Maplewood Addition to the City of Awburn LESS the South 5 feet of Lot 33 deeded to the City for Street purposes. The Auburn Planning Commission recommended this request be granted; the area faits within the City's Comprehensive Plan; is situate across from R-4 zoning; Consideration should be given to the dedication of the 5 feet bordering on 22nd N.E. It was moved by Sonnemann and seconded by Aaby that the Public Hearing be closed. MOT I ON CARR I ED It was moved by Sonnemann and seconded by Aaby that we concur with the Planning Commissions recommendation and the city attorney be instructed to draw up the necessary ordinance to provide for rezoning from Unclassified to R-3 as requested. MOTION CARRIED I Mayor Gaines declared the public hearing open on the request of Virgil and Clarence Swanson to rezone from Unclassified and R-I to R-4 property located East of "M" Street N.E. between 14th and 22nd Street N.E., legally described as Brannon D. C. '37, beg at the NE corner of the si of sd D. C.; th W 825'; th S 1,110.58'; th S 45°00'0011 E 20' th E 392.5'; th S 1,056' to Co. Rd; th E 412.51 to the E In of sd D. The Auburn Planning Commission recommended the request be granted; the petitioner has agreed to dedicate the required streets (with exception of 19th) and will provide streets for surrounding area; the area falls within comprehensive plan of ci ty. Eugene Sage, attorney representing Seaport Development Company, and Steve Lone spoke in opposition to the grðnting of this rezone request. 27 8 AtJB~N, WASH I NGTON NDNDAY APR I L 3. 1967 c.ü ~ ~ -- ~ Olck Kammeyer and Kenneth Lane of Valley Land Office were present representing the Swansons and the buyer for the property. They explained that their request was submitted in form as recommended by the planning commission, and were in favor of this request being granted. It was moved by Kline and secQnded by Sonnernann that the pUblic hearing be closed. It was moved by Kline and seconded by Sonnemann that the request of Virgil and Clarence Swanson to rezone from Unclassified and R-I to R-4 property located East of tlM" Street N.E.between 14th and 22nd Street N.E. be granted as per the requirements of the planning commission. It was brought out that the Oepartment of Public Works had recommended to the I Planning Commission that the developer should submit to the City for consideration a preliminary plat showing the proposed width and street layout for the whole plat. It was moved by Lea and seconded by Nickson that the request of Virgil and Clarence Swanson to rezone be tabled until such time as the developer submits to the Oepartment of Public Works a preliminary plat of the area. NßT ION CARR I EO The following recommendations of the Auburn Planning Commission made at their March 21, 1967 meeting were read: I. That the request of Robert S. Graves to rezone from R-2 to R-3 property located at 1420 - 6th St. N.E. be denied. (No. 8-67) 2. That the request of W. J. Horn to rezone from R-I to SPU (apartments) property located on Harvey Rd. between loth & 12th N.E. be granted (No. 5-67) 3. That the request of E. Von Haartman to rezone from R-2 to SPU (apartments) property located at 909 29th St. S.E. be granted (No. 9-67) It was moved by Sonnemann and seconded by Nickson that the city clerk be instructed to call for a public hearing to be held 8 p. m. April 17, 1967, on the foregoing requests. NOTION CARRIED I A letter was received from City Clerk Elisabeth Heritage submitting her resigmation to be effective as of June I, 1967. Submitted for approval was the addition of S160.00 to the contract between the City and Western Monumental & Marble, Inc. for steel reinforcements in the Engrance Memoria1 and Vaults for the Auburn Cemetery making a total price of $4843.45 not including sales tax. tt was moved by Nickson and seconded by Sonnemann that the addition of $160.00 be made to the contract between the City and Western Monumental & Marble, Inc. for steel reinforcements In the Entrance Memorial and Vaults. ROLL CALL VOTE: All Counci Imen voting YES. ItAOTI ON CARR I EO A petition with forty signatures against annexation of South Auburn Garden Tracts was subm it ted. Mayor Gaines referred this petition to the annexation committee. City EÐgineer Fred Poe submitted a request for George Schuler and himself to attend the American Public Works Association meeting at Bellingham on April 12, 13, and 14. NJJTION CARRIED I It was moved by Lea and seconded by Aaby that this request be granted. Submitted for Approval: Recommendations of Fred Poe, City Engineer. I. Heisserman Construction Co., Final Progress Pa~ent for L.I.D. No. 179. It was moved by Fitzsimmons and seconded by Aaby that Heisserman Construction Co. be paid $727.91, Final Progress Pa~eAt for L.I.D. No. 179. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED a. Engineer's Certification of completion accompanied Final Payment for L.I.D. No. 179. No. 179 be accepted and if no leins or claims are filed within 30 days after acceptance and upon receipt of clearance from the Tax Commission and Department of Labor and Industries, the retained percentage of $471.05 be paid. That the contract for construction of Water Improvement No. 55 be awarded to Frank Coluccio Construction Co., Inc. for $53,530.14 not including the alternate. It was moved by Kline and seconded by Fitzsimmons that the bid bonds of all but the three lowest bidders be returned, and upon the signing of the contract and posting of the bond by the contractor the remaing bid bonds be returned.. Helsserman Construction Company, Final Progress Payment for L.I.D. No. 180. It was moved by FitzsImmons and seconded by Aaby that Heisseman Construction Company be paid $3,809.70, Final Progress Payment for L.I.D. No. 180 ROLL CALL VOTE: All Councilmen voting YES. Nl)T I ON CARR I ED I a. Engineer's Certification of completion accompanied Final Payment for L.I.D. No. 180. It was moved by Sonnemann and seconded by Aaby that the contract with Heisseman Construction Co. on L.I .D. No. 180 be accepted and if no leins or claims are filed within 30 days after acceptance and upon receipt of clearance from the Tax Commission and Department of Labor and Industries, the retained percentage of $608.90 be paid. ROLL CALL VOTE: All Councilmen voting YES. NOTION CARRIED City Engineer Fred Poe submitted Final Assessment Roll for l.I.D. No. 175, in the cnount of $13,983.95. (Water Mains and fire hydrants on "C" Street N.E. from 30th N.E. to 1716' north) It was moved by Sonnemann and seconded by Aaby that the city clerk be Instructed to call for a public hearing to be held 8 p. m. May I, 1967, on the Assessment Roll of Local Improvement District No. 175. NOT I ON CARR I ED Mayor Durrell R. McAbee of the City of Algona submitted a letter regarding the routing of the Valley Freeway through Auburn and Algona. I Mayor Gaines asked that he be given a copy of this letter and said he would hold a discussion meeting on same. J. J. Sleavin, professional engineer, submitted the preliminary plat of Meade Addition. It was moved by Nickson and seconded by Sonnemann that the preliminary plat of Meade Addition be referred to the Planning Commission. That the cost, (approximately $22,000.00), of the aerial photographic survey, be met $12,000.00 from the water fund and $10,000.00 from the street fund. It was moved by Sonnemann and seconded by Lea that the city attorney be instructed to draw up the necessary ordinance so that the cost, (approximately $22,000.00), of the aerial photographic survey, be met $12,000.00 from the water fund and $10,000.00 from the street fund as recommended by the Finance Committee. Mayor Gaines declared a recess at 9:10 p. m. I Mayor Gaines reconvened the meeting at 9:15 p. m. ROLL CALL VOTE ON MOTION (Aerial Photographic Survey) all Councilmen voting YES. NOT ION CARR I ED 2. That the Water Fund purchase LID Financing Warrants, and the LID Guaranty Fund Purchase Finance Warrants in the amount of $6,817.37 and $1,751.76 respectively. The Financing Warrants to be issued against LID's 176, I 78A, 179, 180, 183, 186 and 187. It was moved by Sonnemann and seconded by Nickson that we concur with the Finance Committee's recommendation that the Water Fund purchase LID Financing -Warrants, and the .LID Guaranty Fund purchase Finance Warrants in the amount $6,817.37 and SI,751.76 respectively, Financing Warrants to be issued against LID's 176, I 78A, 179, 180, 183, 186 and 187. NOT I ON CARR I ED 3. That the cost, (approxìmately $24,000.00) of the Sewer study be met from,the Water Fund, approximately $12,000.00 this year, and approximately $12,000.00 next year. It was moved by Sonnemann and seconded by Aaby that the city attorney be instructed to draw up the necessary ordinance to pay 50% of the cost of the I Sewer study (approximately $12,000.00) from the Water Fund.
