WASHINGTON NONDAY MAY 15. 1967 a 01 The regular meeting of the City Council of the City of Auburn convened at 8:00 p. m. in the Council Chambers at the City Hall. Mayor Gaines called the meeting to order. Councilmen present: Hoyt, Lea, Kline, Fitzsimmons, Nickson, Sonnemann, and Aaby. It was moved by Aaby, seconded by Nickson that the public hearing be closed. MOT I ON CARR I ED It was moved by Aaby, seconded by Lea that the Assessment Roll of L.I.D. Harris and Lee Coffee, attorney in fact for Margaret K. Weber, questioned the amount of the assessment which exceeded the original estimate and the wording of the petition. Attorney Smythe explained the actual front footage charge was legitimate up to a 10% Increase over the estimated cost. Mayor Gaines declared a 5 minute recess at 8:18, reconvening at 8:23 p. m. It was moved by Kline, seconded by Hoyt that the public hearing be closed. I City Clerk Elisabeth Heritage read the peti tion for the formation of this L.I.D. NOT ION CARR I ED It was moved by Nickson, seconded by Hoyt that ~ezone Request No. 10-67 be granted subject to the finalization of plat (liThe White River Maisonsll), and the city attorney be instructed to draw up the necessary ordinance to provide for this rezoning. NOT I ON CARR I ED Mayor Gaines opened the general discussion on the Swanson rezone (No. 7-67) which had been tabled at the Apri I 3 meeting; taken off the table at the May I, 1967, meeting and continued to May 15th. Richard Kammeyer, representing the Swansons and Debland Development Company, present- ed a plot plan for the area showing proposed buffer zones and streets. City Clerk Elisabeth Heritage read a petition signed by twenty-five persons protest- I ing the granting of any apartment house zoning on the Swanson property and lane Johnson, attorney, submitted a simi lar petition signed by twenty-nine additional residents. A lengthy discussion fol lowed in which Eugene Sage, attorney representing the Sea Port Development Co.; Earl Johnson, 1725 M St. N.E.; Zane Johnson, attorney repre- senting area residents; Don Eddie, 1321 17th St. N.E.; Paul Pelland, 1401 17th St. N.E.; Dean Preston, 1307 0 St. N.E.; Delvin Laukala, 1306 0 St. N.E.; Leonard Garneau, 1326 0 St. N.E. and Paul Alexander, 1214 0 Sf. N.E. asked questions and stated their opposition. Mayor Gaines asked the City Clerk to read the pending motion made by Kline and seconded by Sonnemann at the Apri I 3, 1967, meeting. It read "that the request of Virgi I and Clarence Swanson to rezone from Unclassified and R-I to R-4 Property located East of IIMII St. N.E. between 14th and 22nd St. N.E. be granted as per the requirements of the Planning Commission." AUBURN. WASHINGTON NONDAY MAY 15. 1967 :303 With the approval of Counci Iman Sonnemann, Counci Iman Kline withdrew this motion. It was moved by Kline, seconded by Lea that the property lying South of a line which is the North line of the Jorgensen Cramer Addition extended easterly to east side of property line from R-4 to R-2 and that property lying north of the aforementioned line be rezoned from A-I to R-4, and the recipient of the rezone cause to instal I, grow, and maintain a twenty-five foot green belt along the east side of property line and along the south side of the property line which is adjacent to R-2 property which is not of this ownership. I It was moved by Nickson, seconded by Fitzsimmons that the motion be amended to replace the shelter belts with an R-2 area 100 feet wide along the east edge of the property bordering R-2 and along the southern edge of the property adjacent to R-2 which is not of this ownership. MOT I ON TO AMEM), LOST Planning Director Schuler presented his proposal for platting the area. It was moved by Sonnemann, seconded by Nickson that the motion be tabled. NDT ION CARR I ED CORRESPONDENCE A letter from John A. Cherberg, Lt. Governor, regarding legislation for cities passed by the Senate during this session of the Legislature was read. II Mayor Gaines asked that this letter be placed on file, Letters were received from the Department of Health and the Washington State Pollution Control Commission approving plans and specifications on L.I.D. No. 189. Mayor Gaines asked that copies of these letters be given to the Engineer, and the original letters be placed on file. The Auburn Planning Commission at their May 2, 1967 meeting made the following recommendations: I. That the request of W. Bowen to rezone from R-3 to C-I property located at 815 East Main be granted. (No. 22-67) 2. That the request of Lyle Manson to rezone from R-2 to C-3 property located at 504 9th St. S.E. be granted. (No. 21-67) 3. That the request of Fred Roberson to construct a two-story building in place of two one-story buildingÞon 31st St. S.E. between M & R Streets be denied. It was moved by Fitzsimmons, seconded by Nickson that the city clerk be instructed to cal I for a public hearing to be held 8 p. m. June 5, 1967, on the foregoing requests. MOTION CARRIED Neil Reitman submitted a petition for vacation of D St. S.E. between 25th & 26th and a portion of 26th Street S.E. It was moved by Lea, seconded by Fitzsimmons that the city attorney be instructed to draw up the necessary resolution cal ling for a public hearing to be held June 19, 1967, at 8 p. m. on the street vacation petition. MOTION CARRIED I A request for formation of L.I.D. No. 192 to construct curb & gutter, excavation, ballasting, asphaltic concrete surfacing & storm drainage on 21st St. S.E. between ItFIt and ItHII St. S.E. was received. Engineer1s Certificate stated estimate of said construction is $3,230.00; that the signatures represent 94.42% of the total frontage and area in said proposed L.I.D. It was moved by Lea, seconded by Sonnemann that the city attorney be instructed to draw up the necessary ordinance to create L.I.D. No. 192. MOTI ON CARR I ED A request for formation of L.I.D. No. 193 to construct excavation, ballasting, curb and gutter, storm drainage & asphalt concrete surfacing on M St. S.E. between 17th St. S.E. and a point 560 feet south of 17th St. S.E. was received. Engineer1s Certificate stated estimate of said construction is $6,720.00; that the signatures represent 100% of the total frontage and area in said proposed L.I.D. It was moved by Lea, seconded by Sonnemann that the city attorney be instructed to draw up the necessary ordinance to create L.I.D. No. 193. MOT ION CARR I ED A letter from the Department of Commerce and Economic Development was read stating that Auburn1s Planning Application has been recommended for approval. Mayor Gaines asked that this letter be placed on file. I Fred Poe, City Engineer, submitted the Final Assessment Roll of L.I.D. No. 176, in the amount .of $84,256.20, (Water Mains, Sanitary Sewers, Sidewalks and Street Improve- ments on F Street S.E., 25th Street S.E., 23rd Street S.E., 22nd Street S.E.) for consideration and public hearing. It was moved by Sonnemann and seconded by Nickson that the city clerk be instructed to call for a public hearing to be held 8 p. m. June 19, 1967, on the Assessment Roll of Local Improvement District No. 176. NOT ION CARR I ED Change Order No. I adding $250.00 to the contract on L.I.D. No. 181, was submitted for approval by the City Engineer. It was moved by Sonnemann, seconded by Fitzsimmons that Change Order No. I, L.I.D. No. 181, be approved. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED Engineer Fred W. Poe recommended the contract for L.I.D. No. 189 be awarded to King Construction Company for $4,009.50. It was moved by Sonnemann, seconded by Kline that King Construction Company be awarded the contract for L.I.D. No. 189 in the amount of $4,009.50. ROLL CALL VOTE: All Counci Imen voting YES. MOT ION CARR I ED Engineer1s Estimate No. I showing $8,450.46 due Dale M. Madden Construction Company for installation .of Utility Lines in the Levi Ballard Bridge was submitted for approval. It was moved by Fitzsimmons, seconded by Sonnemann that Dale M. Madden Construction Company be paid $8,450.46 for installation of Uti lity Lines in the Levi Ballard Bridge. MOTION CARRIED Engineer Fred W. Poe requested that al I bids for L.I.D. No. 182 be rejected, and the project be readvertised. It was moved by Kline, seconded by Fitzsimmons that all bids for L.I.D. No. 182 be rejected and readvertised. MOT ION CARR I ED City Engineer Fred Poe requested the city advertise for bids on L.I.D. Nos. 182, 188, 190 and 192. It was moved by Sonnemann, seconded by Lea that the city clerk be instructed to call for bids on L.I.D. Nos. 182, 188, 190 and 192, bid opening to be held May 31, 1967. MOTION CARRIED Engineer Fred Poe requested the city advertise for bids on Street Improvement No. 84 (widening of South Division, South of 3rd Street S.E.). It waS moved by Nickson, seconded by Aaby that the city clerk be instructed to call for bids on Street Improvement No. 84, bid opening to be held June 14, 1967. MOTION CARRIED A letter was received from H. W. Boddy, of 55 30th St. N.W., which complained about the model airplanes that are being flown in the field next to the sewage plant. Mayor Gaines stated that he would contact the model airplane club to see if he could remedy the situation. Green River Community College requested the opportunity to present a Law Enforcement Training Program to the City Counci I. Mayor Gaines invited these people to an interim counci I meeting on the 29th of May, and requested that Chief Darby be in attendance at this meeting. The Finance Committee recommended the following for approval: I. That a fund be established by the City of Auburn, to be known as the Golf Course Fund, that an appropriation be made in an amount not to exceed $50,000.00 for temporary financing of construction work in connection with the proposed golf course, and that the money be made available from the Water-Sewer Construction Fund as needed by the issue of interest bearing warrants. Repayment to the Water-Sewer Construction Fund would be made from sale of Revenue 80nds at a later date. It was moved by Sonnemann, seconded by Aaby that the city attorney be instructed to draw up the necessary ordinance to accomplish the foregoing recommendation. 2. That the City Treasurer be authorized to invest Street Construction Funds in obligations of the United States Treasury as fol lows: 30 days, $50,000.00 60 days, $200,000.00 90 days, $150,000.00 180 days, $1,000,000.00 :JOO AUBURN. '''j It was moved by Lea, seconded by Sonnemann that we concur with the recommendation of the Finance Committee and authorize the City Treasurer to invest Street Construction Funds in obligations of the United States Treasury as outlined. fNJT I ON CARR I ED 3. The mayor referred a request to the Finance Committee for an additional patrolman for the police department. The Finance Committee reported that the City of Auburn will receive approximately $20,000.00, monies appropriated by the state legislature for cities, and outlined unbudgeted expenditures in the amount of $25,800.00 which the city may be required to spend this year. I They suggested that priorities be developed before budgeting funds for the balance of the year. PROCLAMATIONS AND APPOINTMENTS Mayor Gaines appointed Torp Peluso and Ken Schoenfeld to the Golf Course Committee. Mayor Gaines proclaimed May 14 through May 20 as Public Works Week. AWIENCE Mr. Gillespie, representing the Office of King County Engineer, explained the Water- shed Work Plans Resolution and reported on progress of the project. Mr. Parker, representing the Puget Sound Governmental Conference, explained somewhat the activities of this organization. Mayor Gaines asked Mr. Parker to attend an interim council meeting at a later date to further explain plans of this organization. COUNCIL COMMITTEE REPORTS HOUSING ADVISORY COMMITTEE - COUNCILMAN HOYT Councilman Hoyt reported that a public hearing was held 8 p. m. Thursday night at I which time Harold Y. Hopkins, Executive Director of the Housing Authority of the County of King, Washington, outlined Cooperation Agreement for low-rent housing for the elderly and low-income fami les in the City of Auburn. He stated that there were no objections raised against said agreement. It was moved by Hoyt, seconded by Nickson that the mayor and city clerk be authorized to sign the Cooperation Agreement with The Housing Authority of the County of King, Washington, for low-rent housing. MOTI ON CARR I ED GOLF COLRSE COMM I TTEE - COUNC I LMAN AABY Counci Iman Aaby stated that the Golf Course Architects reported that in ten days to two weeks time they wi I I have the plans ready for the golf course. Councilman Aaby read a letter from Jack Sprenger, insurance agent, which stated they were not able to find a company which handled Professional Liagi lity Insurance for Golf Course Architects. Councilman Kline said he had an address of a company which handled this type of insurance. POLICE COMMITTEE - COUNCILMAN SONNEMANN I It was moved by Sonnemann, seconded by Aaby that the city attorney be instructed to draw up the necessary ordinance to provide for an additional employee in the Police Department. OLD BUSINESS Counci Iman Lea asked if United Homes Corporation was in violation of their covenant agreement on the apartments presently under construction on the east side of Auburn View Heights.
