Mayor Gaines called the meeting to order. Counci Imen present: Hoyt, Lea, Kline, Fitzsimmons, Nickson, Sonnemann, and Aaby. It was moved by Hoyt, seconded by Nickson, that the minutes of the May 15, 1967 Council Meeting be approved as mailed. MOT I ON CARR I ED BIDS II Bids opened 2 p. m. May 31, 1967 were read as follows: L.I.D. No. 190, Excavation, Ballasting Embankment, Curb and Gutter and Asphaltic Concrete Pavement on 4th Street Southeast between C and D Streets. BIDDER Heisserman Construction Select Contractors Doolittle Construction All bids were without sales tax and BID $5,861.00 $6,665.50 $8,840.00 each was accompanied by a 5% Bid Bond. L.I.D. Bowen to rezone from R-3 to C-1 property at 815 E. Main Street, legally described as Lot 3, Blk I, Poplarwood Addn. to the City of Auburn. (No. 22-67) II The A. P. C. recommended this r~quest be granted as it conforms with the Compre- hensive Plan of the City and is in a commercial zone. Consideration should be given to dedication of Northerly five feet for street widening. It was moved by Hoyt, seconded by Lea, that the public hearing be closed. MOTION CARRIED It was moved by Kline, seconded by Hoyt, that Rezone Request No. 22-67 be granted and the city attorney be instructed to draw up the necessary ordinance to provide for this rezoning. Mayor Gaines declared the public hearing open on the request of Lyle Manson to rezone from R-2 to C-3 property at 504 9th Street S.E. and legally described as Lot 9, Blk. 4, Walnut Lawn 2nd Addn. to Auburn, together with an 8 ft. strip of the vacated alley adj. sd lot on the south side thof. Lots 10, II & 12, Blk. 4, Walnut Lawn 2nd Addn. to Auburn, together with all of vacated al ley adj. sd lots on the south; also the N 100' of that por of Gov. Lot 5, Sec 19, T 21 N R 5 EWM, lying Sly of sd vac. alley & betwn the Sly production of the W boundary of sd lot 10 & of the E boundary of sd lot 12; EX that por of lot 12 conveyed to the State of Wash. for State Road No.5, by deed rec. under aud. file no. 1926766; and Ex those por of Lots 10, I I & 12, condemmed for Prim. MOTION CARRIED It was moved by Aaby, seconded by Hoyt, that Rezone Request No. 21-67 be granted, and the city attorney be instructed to draw up the necessary ordinance to provide for this rezoning. MOT I ON CARRI ED Mayor Gaines declared the public hearing open on the request of Fred Roberson to construct a two-story building in place of two one-story buildings on 31st Street S.E. between M and R Streets, and legally described as The H! of the E! of the N! of the S! of the SEk of the NEk in Sec 30 T 21 N R 5 E, in King County, Wash. LESS roads. (No. 23-67) The A. P. C. recommended this request be denied. It was felt the change would be detrimental to the transitional plan of the area; construction under way to the west is one-story and development of property on the south of 31st Street S.E. is planned for single story construction. Fred Roberson explained reasons for requesting this change. It was moved by Hoyt, seconded by Nickson, that the public hearing be closed. II MOTION CARRIED It was moved by Kline, seconded by Aaby, that the SPU Request No. 23-67 be granted, and the city attorney be instructed to draw up the necessary ordinance to provide for this Special Property Use. MOT ION CARR I ED Mayor Gaines declared the public hearing open on the Petition for Annexation to the City of Auburn of property located at 106 R Street Southeast. It was moved by Sonnemann, seconded by Nickson, that the public hearing be closed. MOTION CARRIED It was moved by Sonnemann, seconded by Nickson, that upon receipt of waiver of review proceedings from the Mayor, Chairman of the Board of County Commissioners, and School District, the city attorney be instructed to draw up the necessary Ordinance to provide for this annexation. MOTI ON CARR I ED AlD I ENCE Ralph Burr, resident at 811 26th Place Southeast, presented a petition to the Council I signed by twenty-one residents of the area surrounding the two lots owned by Albert Carlson at 27th and H St. S.E. requesting the City of Auburn deny Carlsons permit to move two older homes onto said lots. A discussion followed in which Ralph Burr and Otto Sterbinsky stated their opposi- tion to allowing these older homes to be moved into the area. Councilman Kline pointed out items which would have to be done in order to bring the house up to code, and estimated cost of this work to be $5,000. Attorney Smythe explained that the buildings could be re-evaluated and the bond premium raised. He also stated that if the Building Inspector deemed it appropri- ate he could increase the house moving permit. II II II AUBURN, WASHINGTON 31H NDNDAY JUNE 5, 1967 Ralph Hamlin, resident at 308 Clay Street Northwest, stated there was a drainage problem on the West side of Clay street and asked that some action be taken to elevate the condition. City Engineer Fred Poe said they were planning to make a survey to see what could be done to improve the situation. The Pastor of the Auburn Missionary Baptist Church said he would like to install church signs on streets, and asked what proceedure he should followiin doing this. Mayor Gaines referred him to City Engineer Fred Poe. CORRESPONDENCE Farwest Novelty Company submitted application for Master License to operate Pinball machines, and Val ley Amusement submitted application for Master License to operate Juke Box machines. Mayor Gaines referred both applications to the License Committee. Letters were received from the Washington State Pollution Control Commission and State Department of Health approving plans and specifications for Sanitary Sewer Extensions - L.I.D. No. 182 and sting plans and specifications for the pump station should be submitted for review and approval after bids have been received. Mayor Gaines asked that these letters be placed on fi Ie, and that a copy of same be given to the Engineering Department. The Auburn Planning Commission recommended that the request of Dr. H. T. Hughes to rezone from R-3 to C-I property at S. E. Corner of Main and L Streets S.E. (No. 24-67) be granted. It was moved by Sonnemann, seconded by Nickson, that the City Clerk be instructed to cal I for a public hearing to be held 8 p. m. Monday, June 19, 1967, on Rezone Request No. 24-67. MOTION CARRIED Fred W. Poe, City Engineer, submitted a letter requesting permission to purchase an additional car for Public Works, cost of which is to be shared as fol lows: Engineering 20%; Street Department 40%; and Water Department 40%. It was moved by Sonnemann, seconded by Nickson, that this request be granted. MOTION CARRIED City Engineer Fred Poe recommended Frank Coluccio Construction Company, Inc. be paid $573.10 payment in full for Water Improvement No. 56. It was moved by Kline, seconded by Aaby, that Frank Coluccio Construction Company, Inc. be paid $573.10 payment in full for Water Improvement No. 56. ROLL CALL VOTE: All Counci Imen voting YES. MOTION CARRIED Engineer's Certification of completion accompanied estimate. It was moved by Sonnemann, seconded by Kline, that the contract with Frank Coluccio Construction Company, Inc. for Water Improvement No. 56 be accepted as of this date. MOTION CARRIED City Engineer Fred Poe submitted Progress Payment No. I in favor of Heisserman Construction Company, in the amount of $3,168.90, for work on L.I.D. No. 185. Poe submitted Engineer's Certification that work by the Frank Coluccio Construction Company, Inc. on Water Improvement No. 55 has been completed and recommended it be accepted by the City. It was moved by Kline, seconded by Fitzsimmons, that the contract with Frank Coluccio Construction on Water Improvement No. 55 be accepted as of this date, and if no liens or claims are filed within 30 days after acceptance and upon receipt of clearance from the Tax Commission and Dept. of Labor and Industries the retained percentage of $5,749.21 which includes sales tax be paid. ROLL CALL VOTE: All Councilmen voting YES. MOT ION C ARR I ED Change Order No. I, Frank Coluccio Construction Co., Inc. for EDA Central Valley Water Line, Project No. EDA 07-1-00108, increasing contract price in the amount of $1,423.33 was submitted for approval by City Engineer Fred W. Poe. It was moved by Sonnemann, seconded by Nickson, that Change Order No. I, Frank Coluccio Construction Co., Inc. for EDA Central Valley Water Line, ProJect No. EDA 07-1-00108, increasing contract price in the amount of $1,523.33 be accepted. ROLL CALL VOTE: All Counci Imen voting YES. MOTION CARRIED II City Engineer Fred W. Poe recommended contract for L.I.D. No. 190 be awarded to Heisserman Construction Company for $5,861.00. It was moved by Lea, seconded by Sonnemann, that Heisserman Construction Company be awarded the bid for L.I.D. No. 190 for $5,861.00, and the mayor and city clerk be authorized to sign the contract. MOTION CARRIED It was the recommendation of the City Engineer that Bert Robison Construction Co. be awarded the bid for L.I.D. No. 188 for $3,227.00 plus tax. It was moved by Sonnemann, seconded by Kline, that Bert Robison Construction Co. be awarded the bid for L.I.D. No. 18e for $3,227.00 plus tax, and the mayor and city clerk be authorized to sign the contract. MOTION CARRIED City Engineer Fred W. Poe recommended Heisserman Construction Company be awarded the contract for L.I.D. No. 192 for $7,748.75. It was moved by Lea, seconded by Nickson, that Heisserman Construction Company be awarded the bid for L.I.D. No. 192 for $7,748.75, and the mayor and city clerk be authorized to sign the contract. MOTION CARRIED I City Engineer Fred W. Poe recommended that Pease & Sons be allowed to withdraw their bid on L.I.D. No. 182, and that Holt Construction Company dba King Construction Company be awarded the contract for L.I.D. No. 182 for $72,785.95 plus tax. It was moved by Fitzsimmons, seconded by Sonnemann, that Pease & Sons be allowed to withdraw their bid on L.I.D. No. 182, due to an error in the calculation of their bid. MOTION CARRIED It was moved by Fitzsimmons, seconded by Sonnemann, that Holt Company dba King Construction be awarded the bid for L.I.D. No. 182 and the mayor and city clerk be authorized to sign the contract. No. 194 for construction of curb and gutter, excavation, bal lasting, asphalt concrete surfacing, storm drainage and tree removal on 13th St. S.E. between Band C Streets was submitted by seventeen property owners. Engineer's Certification stated estimate of said construction to be $11,440.00; that signatures on petition represent 80.77% of the total frontage and area within proposed district. It was moved by Lea, seconded by Fitzsimmons, that the city attorney be instructed to draw up the necessary ordinance to create L.I .D. No. 194. MOTION CARRIED A request for formation of L.I .D. No. 195 for curb and gutter and storm sewers on Enumclaw Highway from C Street S.E. and the Enumclaw Highway between the N. p. Ry right of way and M Street S.E. was received. Engineer's Certificate stated estimate of said construction is $28,686.36; that the signatures represent 51.68% of the total frontage and area in said proposed L.I.D. It was moved by Lea, seconded by Sonnemann, that the city attorney be Instructed to draw up the necessary ordinance to create L.I.D. No. 195. N()TION CARRIED A petition was received requesting formation of L.I.D. No. 196 for construction of curb and gutter, storm sewer and street surfacing on 21st Street S.E. from H to K Streets. Engineer's Certificate stated estimate of said construction is $4,500.30; that the signatures represent 89.74% of total frontage and area in said proposed L.I.D. It was moved by Lea, seconded by Nickson, that the city attorney be instructed to draw up the necessary ordinance to create L.I .D. No. 196. MOTION CARRIED A request for formation of L.I .D. No. 197 for construction of curb and gutter, storm drain and asphalt concrete paving on 17th Street S.E. between A and M Streets was received. Engineer's Certificate stated estimate of said construction is $20,092.48; that the signatures represent 69.04% of total frontage and area in said proposed L.I.D. It was moved by Nickson, seconded by Sonnemann that the city attorney be instructed to draw up the necessary ordinance to create L.I.D. No. 196. MOT ION CARR I ED An Invoice in the amount of $4,976.38 for engineering services for Street Improvements C Street and 15th Street 5. W. for month of April - EDA Project 07-1-00107 was submitted by Hil I & Ingman. It was moved by Sonnemann, seconded by Nickson, that Hil I & Ingman be paid $4,976.38 for engineering services for Street Improvements on C Street and 15th Street S.W. for Month of April - EDA Project 07-1-00107. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED The Auburn Chamber of Commerce requested permission to use alternate parking spaces on Main Street on June 9 and 10 for their tlSai I in the Sun" promotion by the Auburn Retai I Trade Bureau. It was moved by Aaby, seconded by Hoyt, that the Auburn Chamber of Commerce be given permission to use alternate parking spaces on Main Street on June 9 and 10 as requested. It was moved by Lea, seconded by Nickson, that the motion be amended so that permission be granted subject to approval of the City Engineer, Fire Chief and Po lice Ch I e f. MOTION CARRIED MOTION AS AMENDED CARRIED 316 AUBURN. WASHINGTON NONDAY JUNE 5, 1967 Eugene H. Sage of Julin, Fosso and Sage submitted a letter stating his client, Seaport Development Company, has examined Mr. Schuler's proposal of plan for rezon- ing Swanson property and has no objectiòn to:this proposal. Letters were received from the Department of Health and the Washington State Pollution Control Commission approving plans and specifications on L.I.D. No. 184. Mayor Gaines asked that copies of these letters be given the Engineering Department and then placed on file. The Washington State Pollution Control Commission and the Department of Health submitted a letter approving plans and specifications on L.I .D. No. 186. Mayor Gaines asked that these letters be placed on file and a copy be given to the Engineering Department. Dr. R. Blaine Bramble submitted a request for two-hour parking on north side of 2nd Street N. E. between Auburn Avenue and B Street. Mayor Gaines referred this request to the Street Committee. The second petition for annexation of property located between the South City Limits and Stuck River was received. Accompanying the petition was Engineer's Certification that the petition contained signatures of owners of property constituting 75.49% in value of the property within the area proposed to annex. It was moved by Sonnemann, seconded by Aaby, that the second petition for annexation of property located between the South City Limits and Stuck River be accepted, and the city clerk be instructed to call for a public hearing to be held 8 p. m. C. for the ICC final hearing June 13th on the Northern Pacific - Great Northern-Chicago Burlington & Quincey II Ra i I road merger. Mayor Gaines referred this request to the Finance Committee. Mrs. Van Woolery submitted a letter protesting condition of A Street Southeast. Mayor Gaines asked that a copy of this letter be given to the Engineer Department and a copy be mai led to Governor Evans and then placed on fi Ie. APPO I NTMENTS Mayor Gaines stated Elisabeth Heritage has agreed to remain as City Clerk through July 31st and recommended her resignation which she submitted earlier, be accepted as of that date. It was moved by Nickson and seconded by Hoyt, that Elisabeth Heritage's resignation as City Clerk be accepted as of July 31, 1967. MOTION CARRIED Mayor Gaines appointed Gene Williams as City Clerk effective as of August I, 1967, at a salary of $975.00 per month. It was moved by Nickson, seconded by Aaby, that the Mayor's appointment of Gene Williams as City Clerk effective as of August I, 1967, at a salary of $975.00 per month be confirmed. MOT I ON CARR I ED PROCLAMA T ION Mayor Gaines proclaimed the month of June, 1967, Youth Opportunity Month for the City of Auburn. COUNCIL COMMITTEE REPORTS LICENSE COMMITTEE - COUNCILMAN SONNEMANN It was moved by Sonnemann, seconded by Fitzsimmons, that Farwest Novelty Company be granted a Master License to operate Pinball machines, and Valley Amusement be granted a Master License to operate Juke Box machines in the City of Auburn. DEPARTMENT HEAD REPORTS RECREAIION DEPARTMENT - BURCE BILLE RECREATION DIRECTOR Recreation Director Bruce Bille reported on activities of his department. OLD BUSINESS It was moved by Kline, seconded by Fitzsimmons, that the Swanson Rezone be brought back to the fl60r of the council for consideration. MOTION CARRIED II Planning Director Schuler briefed the council on proceedings of the Swanson Rezone. Dick Kammeyer reviewed their plat proposal as presented at the last meeting of the City Council May 15, 1967. The counci Imen yielded the floor so that the fol lowing could speak: Attorney Sage, representing the Sea Port Development Company, stated that they would be in favor of the plat as proposed by Planning Director Schuler, but were opposed to plat as presented by Mr. Kammeyer. Mr. Pelland and Mr. Johnson, residents of the area abutting the Swanson property, asked questions concerning buffering of their property from apartments. Councilman Kline moved for the previous question. Mayor Gaines asked the City Clerk to read the pending motion made by Kline and seconded by Lea at the May 15, 1967, meeting. It read "that the property lying South of a line which is the North line of the Jorgensen Cramer Addition extended easterly to east side of property line from R-4 to R-2 and that property lying north of the aforementioned line be rezoned from A-I to R-4, and the recipient of the rezone cause to install, grow, and maintain a twenty-five foot green belt along the east side of property line and along the south side of the property line which is adjacent to R-2 property which is not of this ownership. II ROLL CALL VOTE ON MOTION: Kline, Fitzsimmons, Aaby, YES; Nickson, Sonnemann, Hoyt, Lea, NO. MOTION LOST It was moved by Sonnemann, seconded by Nickson, that the McLaughlin Rezone Request be brought off the table. MOT I ON CARR I ED The counci Imen yielded the foloor so that the following could speak: George McLaughlin was asked questions as to type of construction planned for the property. George Schuler, Planning Director, explained his views on this rezone request. Mayor Gaines asked the City Clerk to read the pending motion made by Lea and seconded by Aaby at the May I, 1967, meêting. It read Itthatwecóhcur with the Planning Commission's recommendation and grant the rezone request No. 20-67 of George McLaughlin, and the city attorney be instructed to draw up the necessary ordinance to provide for this rezoning." II Mayor Gaines then asked the City Clerk to read the pending amendment to the motion as made by Nickson, and seconded by Hoyt at the May I, 1967, meeting. It read "to amend the motion to rezone from R-2 to R-3 the two parcels of property which border M Street, and to deny the rezone from R-2 to R-3 on the two parcels at the rear of the property." WASHINGTON NONDAY JUNE 5, 1967 ûJ :r:_ C3 ORDINANCE NO. 2071 þ;:,~ It was moved by Fitzsimmons, seconded by Nickson, to table Ordinance No. 2071 until such time as a bonding company has been contacted who would buy these bonds. MOT ION CARR I ED ORDINANCE NO. 2074 It was moved by Nickson, seconded by Sonnemann, that Ordinance No. 2074 entitled "AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, DECLARING A PUBLIC EMERGENCY TO EXIST AND APPROPRIATING THE SUM OF $4,515.00 FROM UNBUDGETED FUNDS IN THE CURRENT EXPENSE FUND OF THE CITY OF AUBURN, TO PROVIDE NECESSARY FUNDS FOR THE EMPLOYMENT I OF A NEW PATROLMAN IN THE POLICE DEPARTMENT OF THE CITY OF AUBURN," be adopted. ROLL CALL VOTE: Nickson, Aaby, Sonnemann, Hoyt, Lea, Fitzsimmons YES; Kline, NO. MOT I ON CARR I ED Mayor Gaines vetoed Ordinance No. 2074 making the following statement: "Taking into consideration the financial situation of the city, I feel obliged to veto this ordinance. It is impossible to accurately estimate the 1967 income for the city this early in the year but at this time it would appear that the $20,000 anticipated from the State due to the recent legislation is about all of our surplus funds. Some anticipated revenue is exceeding the estimate but other sources apparently are falling short. There are certain unbudgeted demands which seem certain: $6,000 to cover the increased cost of insurance; $4800. for the Green River Valley Transportation Plan; $3000 for a radio frequency for Police and $12,000 for funds to match a Federal grant to bring the city's comprehensive plan up to date. I realize the Police Department could use additional assistance but I also feel we should as far as psssible live within our income. I also feel the Police Department has not been overlooked as we have added four additional patrolmen II and one clerk--matron to the department in the past 14 months. For these reasons, I feel it would be unwise to make this additional appropriation at this time."
