The regular meeting of the City Counci I of the City of Auburn convened at 8:00 p. m. in the Co unci I Chambers at the City Hal I. Mayor Gaines cal led the meeting to order. It was moved by Hoyt, seconded by Nickson, that the minutes of the July 3, 1967 Counci I Meeting be approved as mai led. MOTION CARRIED I BIDS Bids were opened 2 p. m. July 12, 1967, for street construction on PSH No.5 (Enumclaw Highway) from 6th St. S.E. (Echo Lake Hwy) to Howard Rd., under L.I.D. 195 & St. Imp. 83. BIDDER R. L. MOTION CARRIED Mayor Gaines declared the public hearing open on the Final Assessment Rol I for L.I.D. No. 179, sanitary sewer on 26th S.E. from 0 to F Sts. Oscar Johnson submitted a letter protesting his assessment. It was moved by Hoyt, seconded by Sonnemann, that the public hearing be closed. MOTION CARRIED It was moved by Sonnemann, seconded by Aaby, that the Assessment Rol I of Local Improvement No. 179 be approved as presented to the Counci I, and the city attorney be instructed to draw up the necessary ordinance confirming same. It was moved by Nickson, seconded by Sonnemann, that the public hearing be closed. MOT I ON CARR I ED It was moved by Nickson, seconded by Hoyt, that we concur with the Planning Commission's recommendation granting Rezone Request No. 30-67, excluding the easterly 100 ft. abutting Lot 3, Massey's 1st Addition, and instruct the city attorney to draw up the necessary ordinance to provide for this rezoning. MOT ION CARR I ED Mayor Gaines declared the public hearing open on the request of Fami Iy Investors to rezone from R-3 to R-4 property on F St. and 5th S.E., legally described as Lot I, 2, and 3, Block 20, Rai Iroad 2nd Addition to Auburn, Washington. (No. 31-67) The Auburn Planning Commission recommended this request be granted as it fal Is in the Comprehensive Plan for apartment houses, is across from C-3 zoning and adjacent to the main line rai Iroad property. MOTION CARRIED I It was moved by Kline, seconded by Nickson, that the public hearing be closed. It was moved by Kline, seconded by Hoyt, that we concur with the Planning Commissions' recommendation granting Rezone Request No. 31-67, and instruct the city attorney to draw up the necessary ordinance to provide for this rezoning. MOT ION CARR I ED Mayor Gaines declared the public hearing open on the request of Western Washington Corporation of 7th Day Adventists to rezone from R-2 to R-4 property on I St. N.E. between 9th and 10th, legally described as lots 12, 13, 14, 15, 16, and 17, Block 13, C. D. Hi Ilman's Auburndale Addition; LESS Streets, Division No.2, as per plat recorded in Volume 13, Page 92 records of King County, Washington. (No. 32-67) The Auburn Planning Commission recommended this request be denied as property is surrounded by R-2 zoning and fine homes. Connie Maiesis, representing Western Washington Corporation of 7th Day Adventists, protested the Planning Commission's decision to deny this request, and pointed out factors why he felt this rezoning should be approved. It was moved by Kline, seconded by Hoyt, that the public hearing be closed. MOT ION CARR I ED I It was moved by Kline, seconded by Nickson, that Rezone Request No. 32-67 be denied without prejudice. It was moved by Kline, seconded by Sonnemann, to table the motion. MOTION CARRIED Mayor Gaines declared the public hearing open on the request of Gertrude Hintz to rezone from C-I to C-3 property at 1335 M St. S.E., legally described as lots I, 2, and 3, of Knowles 3rd Addition LESS Street. (No. 33-67) The Auburn Planning Commission recommended this request be denied as property abutts residential property to the north, C-I to South, SPU for church use to East and R-I homes also to the East. Ann Hieggelke spoke in opposition to the requested rezone. It was moved by Hoyt, seconded by Sonnemann, that the public hearing be closed. MOTION CARRIED It was moved by Kline, seconded by Hoyt, that we concur with the Planning Commission's recommendation and deny Rezone Request No. 33-67. MOT I ON CARR I ED I Mayor Gaines declared the public hearing open on the request of John Wadkins to rezone from R-2 to R-3 properties on M St. S.E. behind the bowling al ley, legally described as lots 2, 4, 6, 12, and 14, Wadkins 2nd Addition to the City of Auburn in Section 19-21-5. (No. 65-66) The Auburn Planning Commission recommended this request be denied as it would constitute checkerboard zoning; also due to the quality of homes in the area. Ann Hieggelke, Mrs. Mathes, and Jesse Stamps, spoke agaínst the rezoning of this property. It was moved by Sonnemann, seconded by Hoyt, that the publ ic hearing be closed. MOTION CARRIED I Mayor Gaines declared the public hearing open on the request of J. Kane to rezone from R-2 to R-4 property at 21st and D Sts. S.E., legally described as the W~ of the NW-i~ of the SE~ of the SW-}¡ of See 19-21-5 E.I;V.M., EX the So. 415'; ALSO the N 130' of the S 415' of the W~ of the NW4 of the SE~ of the SW4 of Sec 19-21-5 E.W.M. EX roads; al I situate in the City of Auburn, County of King, State of Washington. (No. 28-67) The Auburn Planning Commission recommended that this request be granted provided the developer sign a restrictive covenant providing he would construct only the unit in accordance with plans on fi Ie with the Planning Commission. Les Jan, representing J. Kane, submitted Restrictive Covenant Agreement as requested by the Planning Commission. It was moved by Hoyt, seconded by Aaby, that the public hearing be closed. MOTION CARRIED It was moved by Nickson, seconded by Hoyt, that we concur in the recommendation of the Planning Commission and grant Rezone Request No. 28-67, and instruct the city attorney to draw up the necessary ordinance to provide for this rezoning. MOTION CARRIED CORRESPONDENCE I It was moved by Sonnemann, seconded by Nickson, that R. L. Moss Company be awarded the contract for PSH No.5 (Enumclaw Hwy) widening, L.I.D. No. 195, St. Improvement No. 83 for $189,130.50 subject to approval of State Highway Department as recommended by City Engineer Fred W. Poe. ROLL CALL VOTE: AI I Counci Imen voting YES. MOTION CARRIED Engineer's Certification that B. Robinson Construction Company contract for L.I.D. 188 has been completed in conformance with specifications and should be accepted by ci ty. It was moved by Nickson, seconded by Sonnemann, that the contract with B. Robinson Construction Company for L.I .D. 188 be accepted as of this date, and if no liens or claims are fi led within 30 days after acceptance and upon receipt of clearance from the Tax Commission and Dept. of Labor and Industries the retained percentage of $317.99 be paid. · ROLL CALL VOTE: AI I Counci Imen voting YES. MOT ION CARR I ED I Engineer's Certification that Dale M. Madden Construction Company contract for installation and testing of uti lities through the Levi Bal lard Bridge has been completed in conformance with specifications and should be accepted by city. It was moved by Sonnemann, seconded by KI ine, that the contract with Dale M. Madden Construction Company for installation and testing of utilities through the Levi Bal lard Bridge be accepted as of this date, and if no I iens or claims are filed within 30 days after acceptance and upon receipt of clearance from the Tax Commission and Dept. of Labor and Industries the retained percentage of $1,491.26 be paid. ROLL CALL VOTE: AI I Counci Imen voting YES. MOT I ON CARR I ED Recommendations of the Finance Committee made at their meeting July 13, 1967 were read as fo I lows: I. That the $12,000 for city's share of comprehensive survey be taken from General Cumulative Reserve Fund on a loan basis and repaid from Current Expense Fund, this item to be in the 1968 Budget. It was moved by Sonnemann, seconded by KI ine, that the city attorney be instructed to draw up the necessary emergency ordinance to implement the foregoing request. MOTION CARRIED 2. That city authorize a figure of $2,500 for use of city's facilities' for caring I and disposing of animals by the City of Kent for 1968, Kent to hire their own animal control officer. Mayor Gaines referred this matter to the Police Committee for study and recommendation. 3. That the counci I approve the offer of Blythe & Co. for issuance of Golf Revenue Bonds and authorize mayor and city clerk to sign agreement as presented. It was moved by Aaby, seconded by Sonnemann, that we accept the offer of Blythe & Co. for issuance of Golf Revenue Bonds and authorize mayor and city clerk to sign agreement as presented. It was moved by KI ine, seconded by Sonnemann, that the city attorney be instructed to draw up the necessary emergency ordinance to implement the foregoing request. MOTION CARRIED 5. Request of Mi Iburn & Levoy Lynch to rezone from R-3 to R-4 property at 17th and B St. S.E. 2. Request of Vera Gerard and Ted R. Alles to rezone from Unclassified to R-5. It was moved by Sonnemann, seconded by Aaby, that the foregoing request for zone change be referred to the Planning Commission. MOTION CARRIED A letter was received from Gene L. Colburn regarding trespassing on his property in the installation of sewer line. Mayor Gaines asked the City Engineer to write tAr. Colburn inviting him to the next Utilities Committee Meeting. A petition signed by 52 residents on Pike st. N.E. was read requesting change in city ordinance to permit parking up to 72 hours in residential area$. Henry Barnhouse and Mrs. Boone, both residents of Pike Street N.E., opposed the ticketing of automobiles parked on city streets in the residential areas for twenty-four hours. Mayor Gaines referred this matter to the Police Committee. Mi It Bauman, for B. G & P., Inc. Golf Course Design, Construction & Management Consultants, submitted a letter recommending that Hos Brothers Construction be awarded the bid for clearing and grubbing municipal golf course property, and that Kenny Knudtson commence discing with tractor and disc to be rented from Ben Korsten of Sumner, Washington. It was moved by Aaby, seconded by Sonnemann, that Hos Brothers Construction be awarded the bid for clearing and grubbing municipal golf course property for $4,455.00, and that the city rent a tractor and disc from Ben Korsten of Sumner so that Kenny Knudtson may commence discing immediately. ROLL CALL VOTE: Aaby, Sonnemann, and Nickson, YES; Hoyt, and Kline, NO. MOTION CARRIED Fire Chief Calkins submitted a letter to the counci I in which he reported that the Fireworks Stand of the Holy Fami Iy Parents Club and the Stand of White Shrine were not cleaned up by July 10, 1967 as required by ordinance. It was moved by Nickson, seconded by Sonnemann, that the $50.00 deposits for site clean up be refunded to Holy Fami Iy Parents Club and White Shrine, but that a letter be sent them pointing out that after this the ordinance wi 1 I be enforced if the clean up is not taken Care of in the time stipulated. MOT ION CARR I ED DEPARTMENT HEAD REPORTS Recreation Director Bruce Bi I Ie reported that Tom Hines, Evaluator for Life Time Sports Program, was in Auburn recently and had been impressed by our Park Faci lities and our Life Time Sports Program. He also reported on the activities of the Summer Recreation Program. I RECREATION DEPARTMENT - RECREATION DIRECTOR BRUCE BILLE OLD BUSINESS Planning Director George Schuler reported that the Engineering Department had checked to see that adequate driveways were provided for in the Gunderson Special Property Use Permi t. MOTION CARRIED Counci Iman Sonnemann reported the Annexation Committee had met with petitioners requesting permission to circulate an annexation petition for an area east of R St. S.E. It was moved by Sonnemann, seconded by Nickson, that the request to circulate an annexation petition for annexation of an area east of R St. S.E. be approved and that the petition include the provision that area assume the pro-rata share of the outstanding bonded indebtedness of the city. MOTION CARRIED It was moved by KI ine, seconded by Nickson, that the Rezone Request of Western Washington Corporation of 7th Day Adventists to rezone from R-2 to R-4 property on I St. N.E. between 9th and 10th be brought back to the flóor. Connie Malesis, representing the petitioner stated plans had been drawn up for the areas for one-story four-plexes and du-plexes with the advice of George Schuler, City Planning Director. Malesis presented a covenant providing that no structure would be erected or permitted to be erected other than those on plans and specifications on fi Ie with the Planning Commission of the City. With the permission of the second, Ted Nickson, KI ine withdrew the motion made I at the Counci I meeting July 17, 1967, to deny the request. It was moved by Sonnemann, seconded by Nickson, that the Rezone Request of Western Washington Corporation of 7th Day Adventists to rezone from R-2 to R-4 property legally described as Lots 12, 13, 14, 15, 16, and 17, Block 13, C. Mi Ilman's Auburndale Addition, Less Streets, Division No.2 as per plat recorded in Volume 13, Page 92, records of King County, Washington, be approved with the provisions included in the Restrictive Covenant, and the City Attorney be instructed to draw up the necessary ordinance to implement same. MOTION CARRIED Present to discuss the various phases of the municipal golf course project were: Robert Sims of Blythe & Co.; Bob Yeasting of Harper & Sons & Co.; Dr. Roy Goss and Glen Proctor of Goss, Bauman and Proctor, golf course designers. It was moved by Aaby, seconded by Sonnemann, that the Mayor and City Clerk be authorized to sign the contract with Blythe & Co. and Harper & Son & Co. to provide financial services and feasibi lity studies for the municipal golf club project. It was moved by Kline, seconded by Fitzsimmons, that provision that Blythe & Harper agree to purhcase the financing.
