Klontz on rezone from C-I & R-I to C-3 property located at the SE corner of Auburn Avenue and 22nd St. N.E. and legally described as Lots I, 2, and 3, Joseph E. Klontz 2nd Addition. (Rezone No. 35-67) The Auburn Planning Commission recommended this request be granted, as it conforms to the comprehensive development plan for Auburn Avenue, with consideration being given to the dedication of the Westerly 5 feet for future widening of Auburn Avenue. It was moved by Hoyt, seconded by Sonnemann, that the public hearing be closed. MOTION CARRIED It was moved by Sonnemann, seconded by Hoyt, that we concur with the Planning Commission's recommendation granting Rezone Request No. 55-67, and instruct the city attorney to draw up the necessary ordinance to provide for this rezoning. (Rezone No. 36-67) The Auburn Planning Commission recommended this request be denied and further recommended the petitioners be granted a R-3 zoning to conform to the comprehensive land use existing on the West side of "R" St. S.E. Forty-two property owners living within two hundred feet of the DePietro-Anderson property submitted a petition protesting the rezone. Chester Dove, representing Mr. DePietro and Mr. Anderson, requested the Counci I take I action to approve this rezone. E. R. Hanson and Marian Holt spoke in oppostion to the proposed rezoning. It was moved by KI ine, seconded by Nickson, that the public hearin~ be closed. MOTION CARRIED It was moved by Kline, seconded by Nickson, that property lying on the East side of "F" St. S.E. in the 100 block be rezoned from Unclassified to R-3 (Rezone No. 36-67), and instruct the city attorney to draw up the necessary ordinance to provide for this rezoning. MOTION CARRIED Mayor Gaines declared the publ ic hearing open on the request of REDI GAS SERVICE OF AUBURN, INC., to rezone from R-2 to M-I property located at the NW corner of West Main and Clay Street and legally described as Lots 6, 7, 8 and 9, Block D, Lunn's Garden Tracts to Auburn. (Rezone No. 38-67) The Auburn Planning Commission recommended this request be granted, as it conforms to Comprehensive Industrial Development Plan for the area, with consideration being given to the dedication of the Easterly 10 feet for future widening of Clay Street. It was moved by Blakeney, seconded by Hoyt, that the public hearing be closed. II MOTION CARRIED It was moved by Hoyt, seconded by Blakeney, that we concur with the Planning Commissions recommendation granting Rezone Request No. 38-67, and instruct the city attorney to draw up the necessary ordinance to provide for this rezoning. MOTION CARRIED Mayor Gaines declared the public hearing open on the request of Robert W. Bozich to rezone from R-2 to SPU (duplex) property located on Hemlock Street S.E. in the 2400 block and legally described as Lot D, Kitchel I IS Addition. (Rezone No.40-67) The Auburn Planning Commission recommended this request be granted as property lying to the West is being uti lized in a nonresidential use (FAA Center) and the proposed use would not be detrimental to the surrounding area, provided, however, that al I R-2 setbacks shal , be conformed to. The fol lowing persons submitted letters protesting the Bozich rezone: Elmer E. Kern and Darlene G. Kern, 2520 Hemlock Walter Lindula and Doris A. Lindula, 2510 Hemlock Street S.E. Carl Rodlund, 2440 Hemlock Street Dewey B. Richards, 2310 Hemlock Street George K. Breckenridge and Tracy H. Breckenridge, 2610 Hemlock St. S.E. I Walter Lindula, Elmer Kern, and Mrs. Lindula spoke in opposition to the Bozich rezone. A document appointing Walter Lindula lawful attorney for George K. Breckenridge for the express purpose of resisting any zoning changes which would in any way effect real property now owned by George K. Breckenridge was presented to the Counci I. It was moved by Aaby, seconded by Sonnemann, that the public hearing be closed. MOT I ON CARR I ED Mayor Gaines declared the public hearing open on the petition of Arnold R. Gal Ii, Vm. D. Noble, Mrs. Blaine Noble, and Dale E. Dawson for vacation of al ley between 24th and 26th Sts. N.C. east of "I" St. N.E. and legally described as Beginning at a point on the east line of Lot I, Block 2, Maplewood Addition to Auburn, said point being 20 feet south of the NE corner of Loti; th South along the east line to a point 12 feet north of the SE corner of Lot 16, Block 2 Maplewood Addition to Auburn; thence east paral lei with the south I ine of aforesaid Block 2 ten feet; thence North paral lei with the east I ine of aforesaid Block 2 608 ft; th West to the point of beginning. Situate in the City of Auburn, County of King, State of Vlashington. It was moved by Hoyt, seconded by Nickson, that the public hearing be closed. MOTION CARRIED It was moved by Aaby, seconded by Nickson, that the al ley between 24th and 26th Sts. N.E. east of "I" St. N.E. be vacated, but that the city retain the ten foot uti lity easement for future development of the sewer. NDT I ON CARR I ED CORRESPONDENCE A letter was received from Thomas R. Garlington of Skoog, Mul I in and Cooper, lawyers representing Valley Cement Construction, Inc., protesting the award of bid on L.I.D. No. 200 to Heisserman Construction Company. Mayor Gaines reported that City Attorney Smythe had answered their letter. Letters were received from the Water Pollution Control Commission and Department of Health approving plans for Sewer Extensions, Lift Station, Water Main Extensions and Force fAain for Green River Gardens Subdivision No. I; Sewer Extension - L.I .D. No. 195; and Sanitary Sewer Extension - L. I .D. No. 198. Mayor Gaines asked that these letters be placed on fi Ie, and that copies of same be given the Engineeri~g Department. The Auburn Planning Commission made the fol lowing recommendations at a public hearing held August 22, 1967. I. That the request of Carl Cruson to rezone from R-2 to SPU (apartments) property located on the South side of 29th St. S.E., 300 feet East of "M" St. S.E. be granted. (Rezone No. 98-66) 2. That the request of Mi Iburn & Levoy Lynch to rezone from R-3 to R-4 property located on the N.t.. corner of 17th and "B" Sts. S.E. be granted. (Rezone No. 41-67) It was moved by KI ine, seconded by Blakeney, that the city clerk be instructed to cal I for a public hearing to be held 8 P.tA. September 18, 1967, on the foregoing requests to rezone. MOTION CARRIED The fol lowing Zone Change Applications were submitted to the Counci I: I. Request of Rudolf Burgener to rezone from Unclassified to M-I property located on West Val ley Highway North of South 328th St. 2. Request of Everett C. Bush to rezone from R-2 to R-4 property located at 508 21 s·t St. S. E . It was moved by Sonnemann, seconded by Nickson, that the foregoing requests for zone change be referred to the Planning Commission. MOTION CARRIED It was moved by Sonnemann, seconded by Aaby, that contracts with Heisserman Construction Company, Inc. for L.I.D. 194 and L.I.D. 196 be accepted as of this date, and if no liens or claims are fi led within 30 days after acceptance and upon receipt of clearance from the Tax Commission and Department of Labor and Industries the retained percentage of $946.15 on L.! .D. 194 and retained percentage of $1696.78 on L.I.D. 196 be paid. MOTION CARRIED A petition was submitted for the formation of Local Improvement District No.203, water Mains on 108th Avenue S.E. from the Lea Hi 1 I Road to S.E. 320th Street and S.E. 314th Place and S.E. 315th Place. Engineer's certification stated estimate of cost to be $19,438.90 and that signatures on petition constituted 71.96% total frontage and 74.48% total area in proposed district. It was moved by KI ine, seconded by Sonnemann, that the city attorney be instructed to draw up the necessary ordinance to create L.I .D. No. 203. MOT ION CARR I ED City Engineer Fred W. Poe submitted the Final Assessment Rol I for L.I .D. No. 185 in the amount of $6,532.23 and the Final Assessment Rol I for L.I .D. No. 192 in the amount of $7,974.98 for consideration and public hearing. It was moved by Sonnemann, seconded by Nickson, that the City Clerk be instructed to call for a publ ic hearing to be held at 8 p.m., October 2, 1967, on the Final Assessment Roll of L. I .D. No. 185 and the Final Assessment Roll for L.I.D. No. 192. I MOTION CARRIED A claim for damages was fi led, August 28, 1967, by Donovan Parret against the City of Auburn for damages to his automobile sustained in an accident involving his car and Police N\otorcycle driven by Patrolman Murray Board. Mayor Gaines referred this matter to our Insurance Company. I I I AUBumL,_~'JASH IJ4GTON MONDAY SEPTEMBER 5, 1967 36 a Letters were received from 41 property owners and 9 rental residences on fA st. N.E. to Harvey Road and t,\ St. S.E. from ¡\\ain Street to the Rai Iroad overpass requesting a 25 mi Ie speed limit, increased law enforcement, restriction of gravel & cement trucks from around the clock use and reduction of truck maximum speed to an enforced 20 mi les per hour on M Street. George Pittman, and Mrs. Robert Eastling explained problems in the area, and requested the counci I take action on their requests. Mayor Gaines said he \>IIOuld notify the N.i les Company of the petitions received, and would ask Police Chief Darby to heavily patrol the area. A letter received from the Green River Ramblers Trai ler Club thanked the City for the use of the Isaac Evans Park, and expressed appreciation to Park Superintendent George Freemire for his courteous help. AUD I ENCE Val Rupeiks, of Clark Coleman Rupeiks, Inc., discussed the preparation of a preliminary policy staterìent for the Comprehensive Plan. COUNCIL CO~\ITTEE REPORTS HOUSING ADVISORY COMN\ITTEE - COUNCIL^~N HOYT It was moved by Hoyt, seconded by Sonnemann, that Dick Scharf be granted permission to attend a Bui Iding Officials Meeting in Richland September 14 and 15. MOT I ON CARR I ED A letter was received from Goss, Bauman and Proctor, golf course designers, recommend- ing that Heisserman Construction Company, Inc. be awarded bid for Equipment Rental for Grading and Shaping at the Green River Golf Course in the amount of $20,600.00; that Lloyd's of Washington be awarded bid for Earth Moving and Soi I Mixing at the Green River Golf Course in the amount of $36,770.00; and that bids for Grass Seed and Ferti I izer not be awarded at this time, unless some provision is made with the companies to store same. It was moved by Blakeney, seconded by Fitzsimmons, that awarding of contracts for \>IIOrk on the Green River Golf Course be tabled for futher study. MOT I ON CARR I ED NEW BUS I NESS Counci Iman KI ine asked that consideration be given to adopting "rules of order" and appointing a parliamentarian for the City Counci I. Mayor Gaines referred this matter to the Code Committee for consideration and recommendation. City Attorney Smythe reported he was in receipt of the fol lowing documents: Easement for Right of Way from Helen and Frank Norman Slope Easement from Frank and Teresa Pfulg Quit Claim Deed for Street Purposes from Leonard L. Brannan Quit Claim Deed for Street Purposes from Claude, Fred L, and Clara May Brannan; and Caroline Mae Cornwel I. It was moved by Aaby, seconded by Kline, that the city attorney be instructed to record the aforementioned documents. MOTION CARRIED I CLAIMS It was moved by Kline, seconded by Nickson, that the claims as approved by the Audit Committee be paid.
