Mayor Gaines cal led the meeting to order. Councilmen present: Councilman absent: Hoyt, Blakeney, Kline, Fitzsimmons, Nickson, Sonnemann. Aaby. It was moved by Blakeney, seconded by KI ine, that the minutes of the October 2, 1967 Council meeting be approved as mailed. No. 185 for curb and gutter, storm drain and street surfacing on 7th Street Northeast between "F" and "G" N.E., continued from October 2, 1967 meeting. The Street Committee recommended that Mr. Calvin Radtke's assessment be reduced by 25'. It was moved by KI ine, seconded by Blakeney, that the City Council concur with the Street Committee's recommendation and instruct the City Attorney to prepare the modified final assessment rol I on L.I.D. MOTl ON CARR lED Mayor Gaines declared the public hearing open on the request of Nickum Properties to re- zone from C-I Commeréial to C-3 Commercial a parcel of land lying east of "M" Sf. S.E. and South of 17th St. S.E. (Rezone No. 37-67) The Auburn Planning Commission recommended that this request be granted as it wi I I conform to the comprehensive development plan for the area. It was moved by Blakeney, seconded by Fitzsimmons, that the publ ic hearing be closed. I MOTION CARRIED It was moved by Kline, seconded by Blakeney, that we concur with the Planning Commis- sion's recommendation granting Rezone Request No. 37-67, and instruct the City Attorney to draw up the necessary ordinance to provide for this rezoning. MOTION CARRIED Mayor Gaines declared the publ ic hearing open on the request of Christoph Geiszler to re- zone from Unci. to R-5, property located on 37th St. S.E. approximately 600' East of "A" St. S.E. (Rezone No. 43-67) The Auburn Planning Commission recommended that this request be granted as it wi I I con- form to the comprehensive development plan for the area. George Muttart objected to this rezone. It was moved by Blakeney, seconded by Fitzsimmons, that the public hearing be closed. MOT~ON CARRIED It was moved by Blakeney, seconded by Sonnemann, that we concur with the Planning Commission's recommendation granting Rezone Request No. 43-67, and instruct the City Attorney to draw up the necessary ordinance to provide for this rezoning. MOTION CARRIED I The Mayor declared the publ ic hearing open on the request of Donald L. Martindale to rezone from Unci. to R-5, property located at 404 37th Street S.E. (Rezone No. 45-67) The Auburn Planning Commission recommends this request be granted, as it wil I conform to the comprehensive development plan for the area. Consideration should be given to dedication of 30 ft. on the Westerly boundary for street purposes. It was moved by Blakeney, seconded by KI ine, that the public hearing be closed and that we concur with the Planning Commission's recommendation that Rezone Request No. 45-67 be granted and instruct the city attorney to draw up the necessary ordinance to provide for this rezoning. (Rezone No. 46-67) The Auburn Planning Commission recommends this request be granted, as it wi I I conform to the comprehensive development plan for the area, subject to safeguards recommended by them. It was moved by Sonnemann, seconded by Nickson, that the publ ic hearing be closed. I MOTION CARRIED It was moved by Sonnemann, seconded by KI ine, that we concur with the Planning Com- mission's recommendation granting Rezone Request No. 46-67, and instruct the city attorney to draw up the necessary ordinance to provide for this rezoning. MOTION CARRIED Mayor Gaines declared the publ ic hearing open on the request of United Homes Corporation to rezone from R-I to R-2 property known as Sherman Acres located East of Dogwood Street and North of Forest Vii la. (Rezone No. 48-67) The Auburn Planning Commission recommended this request be granted subject to safe- guards recommended by them. It was moved by KI ine, seconded by Nickson, that the publ ic hearing be closed, and that we concur with the Planning Commission's recommendation granting Rezone Request No. 48-67, and instruct the city attorney to draw up the necessary ordinance to pro- vide for this rezoning. (Request of Rudolph Burgener to rezone from Unci. to M-I property located in the 1400 block of the West Valley Highway) It was moved by Sonnemann, seconded by Nickson, that the City Clerk be instructed to cal I for a public hearing to be held at 8 p.m. November 6, 1967 on Rezone Request No. 50-67. MOTION CARRIED letter of Award of the American Automobile Association Pedestrian Safety Citation to the City of Auburn by the Automobile Club of Washington was read by Gene Wi I Iiams. Mayor Gaines referred this matter to our insurance agency. The fol lowing Zone Change Appl ications were submitted to the Council: I. Request of Gertrude Ey to rezone from Unclassified to M-2 property located at 31420 and 31820 West Valley Highway. 2. Request of lorin and Margaret Hildebrand to rezone from R-2 to R-3 property located at 1315 29th St. S.E. I 3. Archie Meade request to rezone from R-I and R-2 to R-4 property located south of 406 12th St. S.E. It was moved by KI ine, seconded by Fitzsimmons, that the foregoing requests for zone change be referred to the Planning Commission. MOTION CARRIED A contract from the Planning & Community Affairs Agency for Urban Planning Assistance Program between the City of Auburn, Clark Coleman and Rupeiks and the Planning and Community Affairs Agency. Planning Director's report on review of contract. It was moved by Kline, seconded by Blakeney. that the matter be tabled for further investigation. Mayor Gaines stated that we will take no further action on it at this time. Petition for formation of Local Improvement District No. 207, including water mains and fire hydrants on 27th St. N.E. & N.W. between B St. N.W. & Auburn Ave.; CSt. N.E. between 35th & 37th N.E., 28th St. N.E. between Auburn Ave. & I St. N.E.; "I" St. N.E. between 28th & 30th N.E. I. Engineer's Certification states estimate of cost to be $18,791.15 and that signa- tures on petition constitute 69.84% total frontage and area in proposed district. I It was moved by Kline, seconded by Sonnemann, that the city attorney be instructed to draw up the necessary ordinance to create l.I.D. No. 207. MOTION CARRIED A petition was submitted for the formation of local Improvement District No. 208, in- cluding sanitary sewer and appurtenances on Auburn Ave. between 26th St. N.E. and N. City Limits; 28th N.E. between Auburn Ave. & "I" St. N.E., 30th St. N.E. between Auburn Ave. & CSt. N.E., 37th St. N.E. between Auburn Ave. & B St. N.W., CSt. N.E. between 30th & 37th St. Mi.E.; "I" St. N.E. between 28th N.E. & 30th St. N.E. I. Engineer's certification states estimates of cost to be $140,507.01 and that signatures on petition constitute 75.40% total frontage and area in proposed district. It was moved by Kline, seconded by Sonnemann, that the city attorney be instructed to draw up the necessary ordinance to create l.I.D. No. 208. MOTION CARRIED It was moved by Sonnemann, seconded by Nickson, that the following recommendations submitted by City Engineer Fred W. Poe be approved: I. That we advertise for bids on l.I.D.s No. 207 and 208. MOTION CARRIED I 2. That the Milwaukee Railroad agreement for 15th St. S.W. crossing be accepted. It was moved by Sonnemann, seconded by Blakeney, that the Mayor and City Clerk be instructed to sign the same. MOTION CARRIED 3. That we call for a public hearing to be held on the following: a. L. I .D. No. 175 - Assessment No. 4 c. l.I.D. No. 176 - Assessment No. 10 d. L.I.D. No. 195 (St. Imp_ 83) to R. l. Moss & Co., $330.00 increase (fil I behind curb) be approved. It was moved by Sonnemann, seconded by Nickson, that Change Order No. I, L.I.D. No. 195 be approved. MOTION CARRIED 7. That R. L. Moss & Company be paid $41,890.11 on l.I.D. No. 195, (St. Imp. 83) as per Progress Payment No.3. It was moved by Kline, seconded by Blakeney, that Progress Payment No.3 be made. MOTl ON CARR I ED 8. That permission for Dick Scharf to attend "Building Officials Short Course" in Pullman, Washington, Oct. 30th through Nov. 3, 1967, be granted. It was moved by KI ine, seconded by Nickson, that permission be granted for Merle Kelly to attend "Bui Iding Officials Short Course" in Pullman Oct. 30th through Nov. 3, 1967. MOTl ON CARR I ED I 9. That Hil I, Ingman & Chase be hired to conduct comprehensive sol id wastes study in accordance with their proposal. It was moved by Fitzsimmons, seconded by'Blakeney, that the mayor and city clerk be authorized to sign a contract with Hill, Ingman & Chase to conduct a comprehensive solid wastes study. ROll CAll VOTE: All Councilmen voting YES. MOTION CARRIED 10. That Argentieri Constrûction Co. be awarded the contract for l.I.D. No. 203 in the amount of $18,721.10. It was moved by Fitzsimmons, seconded by Blakeney, that the contract for l.I.D. No. 203 be awarded to Argentieri Construction Company. ROll CALL VOTE: AI I Councilmen voting YES. Poe to hire the firm of R. P. McKiddy to perform the necessary surveying on 15th Sts. N.E. & N.W., and that the ^~yor and City Clerk be authorized to sign a contract for same. The Street Committee has been considering name changes for Auburn Avenue from the North City limits to its intersection with "C" St. N.E., "C" Sf, N.E. from its intersection with 9th S.E., East to its intersection with the Enumclaw High- way, Enumclaw Highway Southeasterly to the Southeast City limits. It was suggested that Auburn Avenue be changed to Auburn Way North and Auburn Way South as a through street through Auburn, which is confusing otherwise. I No action was taken by the Council. CODE COMMITTEE Councilman Nickson reported that various pari iamentary procedures are being studied. OLD BUSINESS A. Proposal from East Valley Construction, Inc. for remodel of court office was r~ad. It was moved by Sonnemann, seconded by Blakeney, that East Val ley Construction remodel the court office at a cost of $1,456.00, plus sales tax. ROLL CALL VOTE: AI I Councilmen voting YES. MOTION CARRIED B. Recommendation of the Planning Director that Rezone Request No. 63-66 (Main Street Auburn Associates request to rezone from A-I to f^-I property located at the intersection of Main Street and the ',vest Valley Freeway) was brought off the table. It was moved by Sonnemann, seconded by KI ine, that the recommendation be tabled at this time. MOTION CARRIED I After discussion, it was moved by KI ine, seconded by Blakeney, that the item appear on the next regular agenda.
