WASHINGTON MONDAY DECEMBER 18. 1967 The regular meeting of the City Councl I of the City of Auburn convened at 8:00 p.m. in the Council Chambers of the City Hall. Mayor Gaines called the meeting to order. Councilmen present: Kline, Sonnemann, Bailey, Fitzsimmons, Blakeney, Darling and Nickson. I It was moved by Blakeney, seconded by Nickson, that the Minutes of the December 4, 1967 Council meeting be approved as mai led, with the fol lowing amendments: Page 4 should be amended to read: '~fter discussion on the various publication, it was moved by Nickson, seconded by Blakeney, that the bid be rejected and new bids be opened at the next Counci I meeting on December 18, 1967." Page 6 of the December 4, 1967 Minutes should be amended to read as follows: "It was moved by Fitzsimmons, seconded by Nickson, that the claims submitted on the Voucher Approval and Department Transfer List be approved." MOTION CARRIED PUBLIC HEARINGS Mayor Gaines declared the public hearing open on the Assessment Roll of L.I.D. No. 196 for curb and gutter, storm sewer and street surface on 21st Street ~.E. from H Street to K Street S.E. It was moved by Blakeney, seconded by Sonnamann, that the public hearing be closed. MOTION CARRIED It was moved by Blakeney, seconded by Sonnemann, that the City Attorney be instructed to draw up the necessary ordinance on the final assessment roll of L.I.D. No. 196. MOTION CARRIED Mayor Gaines declared the public hearing open on the request of Gertrude Ey to rezone property from Unclassified to M-2 at 31420 and 31820 West Valley Highway. (Rezone Request No. 53-67) I The Auburn Planning Commission recommends that this request be granted with the pro- vision that it be forwarded to the State Highway Department for their recommendation on same in conjunction with the Valley Freeway. Jack Hawkins, representing Gertrude Ey, explained the location of the property. It was moved by Blakeney, seconded by Sonnemann, that the public hearing be closed. MOTION CARRIED It was moved by Kline, seconded by Bai ley, that we concur with the Planning Commission's recommendations and instruct the City Attorney to draw up the necessary ordinance to provide for this rezoning. MOTI ON CARR I ED CORRESPONDENCE A Claim for Damages fi led by Sui livan, Redman and Winsor, attorneys for Claimant Carol Stevens for alleged damages to her person in the amount of $250,000 suffered in an auto- mobile acèident was read by City Clerk Williams. It was explained that the accident appears to have happened outside the City Limits. Mayor Gaines requested that the claim be turned over to the City Attorney. I It was moved by Blakeney, seconded by Nickson, that the fol lowing requests for zone changes be referred to the Planning Commission for public hearing: I. Nyles Van Hoosen, D.V.M., to rezone from R-2 to C- property located at 1910 Howard Road. 2. Mrs. Reuben Gaenz to rezone from R-I to R-4 property located at approximately 24th N.E. between "'" and "J" Streets. 3. James C. Downey to rezone from R-3 to C-I property located at 914 Enumclaw Hwy. MOTION CARRIED RECOMMENDATIONS The fol lowing change order was submitted for approval by City Engineer Poe: Change Order No.5, EDA Street Phase I, Select Contractors, Inc. Moss & Co., increase of $1,178.95 for 1397 plastic traffic buttons paid for by the State Hwy. Dept. It was moved by Kline, seconded by Sonnemann, that the increase be approved. ROLL CALL VOTE: A II Counc i Imen vot i ng YES. MOTION CARRIED Progress Estimate No.5 (final) to R. L. Moss & Co., for St. Impr. No. 83 (L.I.D. No. I 195) for $36,725.20. (excise tax report and Engineer's certification enclosed) It was moved by Kline, seconded by Nickson, that the progress estimate be approved as of this date, and if no liens or claims are fi led within 30 days after acceptance and upon receipt of clearance from the Tax Commission and Department of Labor and Industries the retained percentage be paid. ROLL CALL VOTE: AI I Councilmen voting YES. Progress Estimate No.2 to Hos.Bros. for Golf Course clearing for $1,135.66. It "was moved by Fitzsimmons, seconded by Blakeney, that progress estimate be approved with the amendment that the work have written approval of the Golf Course architect and City Engineer, and 10% retainage fee be withheld. ROLL CALL VOTE: KI ine, Sonnemann, Bailey, Fitzsimmons, Blakeney, Nickson, YES. Darl ing NO. MOTION CARRIED Petition for formation of L.I.D. No. 210, including sanitary sewers and side sewers on 20th St. S.E., Hemlock St. S.E. and west along the south border of Forest Vii la to Fir St. S.E. and then south to P.S.H. No.5. Engineer's certification states estimate of cost to be $17,614.98 and that signatures on petition constitute 64.14% total frontage and 64.89% of the total area in proposed district. It was moved by Blakeney, seconded by Fitzsimmons, that the City Attorney be instructed to draw up the necessary ordinance creating L.I.D. No. 210. MOTION CARRIED Request by City Engineer Poe for authorization to advertise for bids on L.I.D. No. 210. II It was moved by Fitzsimmons, seconded by Blakeney, that authorization be granted. MOTION CARRIED Request by City Engineer Poe for passage of a resolution to create an L.I .D. for sani- tary sewers on 21st St. S.E. from A St. S.E. to F St. S.E. and D St. S.E. from. 21st St. S.E. to 22nd St. S.E., and that Cal I for Public Hearing on this resolution be set for January 15, 1968. It was moved by Fitzsimmons, seconded by Blakeney, that the City Attorney be in- s.tructed.to draw up the necessary resolution to create this L.I.D. and Call for Public Hearing on this resolution be set for January 15, 1968. MOTION CARRIED I I I AU8URN. WASHINGTON DECEMBER 18. 1967 407 MONDAY Request by City Engineer Poe that the fol lowing amounts of vacations be carried over from 1967 to 1968: R. O. Scharf - 5 days. Wm. Baumgras - 6 days. It was moved by Nickson, seconded by Kline, that these requests be approved. MOTION CARRIED PROCLAMATIONS, APPOINTMENTS & ANNOUNCEMENTS Mayor Gaines announced that January 12th is the deadl ine to register for the coming election to be held February 13, 1968 on the Forward Thrust Program. He endorsed this program and recommended that the Council give it serious consideration. COUNCIL CONMITTEE REPORTS FINANCE COm~ITTEE - Councilman KI ine Report on Finance Committee meeting of December 13, 1967 was read by Chairman Kline. It contained a request by John Kél Iy that finance warrants purchased by the City Treas- urer be confirmed in the amounT of $8,974.41. . It also recommended that $26,927.50 be loaned from the Street Construction Fund to the Arterial Street Bond Redemption Fund to cover interest coupons due in 1967 and not previously provided for. It also con- tained the request of Pol ice Chief Darby for adding two I ines and a cal I director to TE 3-3050. POLICE & LICENSE CO^~\lTTEE - Counci Iman Sonnemann Chairman Sonnemann of the Pol ice Committee recommended passage of Resolution No. 293. HOUSING ADVISORY COfNAITTEE - Counci Iman Bai ley The Housing Advisory Committee recommended that the 1967 edition of the Uniform Bui Id- ing Code be adopted; they also recommended the adoption of a business and industrial use permit. Meetings of the Housing Advisory Committee have been scheduled for each Thursday fol lowing the second Counci I meeting of each month. STREET CONMITTEE - Counci Iman Blakeney Councilman Blakeney of the Street Committee explåined the 'Proposed name change for Auburn Avenue and the streets that would be affected. If the name change is going to take place it should be done so people concerned can be notified by February I, 1968, and before the new telephone directories are printed. It was moved by Blakeney, seconded by Nickson, that the City Attorney be instructed to draw up an ordinance setting aside 50 feet of "No Parking" in front of the De- partment of Motor Vehicles Office from Tuesday through Saturday each week. A recommendation wi II be made at the nexj' Counci I meeting regarding City personnel vacations. DEPARTMENT HEAD REPORTS Mayor Gaines introduced Don Cook as Librarian. NEW BUSINESS It was moved by KI ine, seconded by Blakeney, that City Treasurer Kelly be authorized to purchase finance warrants as I isted in the Finance Committee report. MOTION CARRIED It was moved by f<1 ine, s~conded by Blakeney, that $26,927.50 be loaned from the Street Construction Fund to the Arterial Street Bond Redemption Fund to cover interest coupons due in 1967 and not previously provided for, said loan to bear interest at the rate of 4% and be repaid on or before June 30, 1968. MOTION CARRIED It was moved by KI ine, seconded by Darl ing, that the expense of adding two I ines and a cal I director to TE 3-3050 be left to the discretion of Pol ice Chief Darby, so that if he deems it advisable he may spend a portion of his existing budget for this item. MOTION CARRIED Mayor Gaines announced that a Mayor Pro-Tem was to be elected. Blakeney nominated Councilman KI ine. Bailey nominated Councilman Sonnemann. Councilman KI ine was elected Mayor Pro-Tern by secret bal lot. 408 AUBURN. WASHINGTON MONDAY DECEMBER 18. 1967 BID OPENINGS & RECO^V^ENDATIONS Bids were received from the Seattle Post Intel I igencer and Auburn Globe-News for legal publicati~ns of the City of Auburn for the year 1968. After discussion Mayor Gaines appointed the fol lowing committee to study the bids and make a recommendation at the January 2, 1968 Council meeting: Chairman Nickson, Blakeney and Darl ing, with City Clerk Wit I iams and City Attorney Smythe in attendance. It was moved by Kline, seconded by Sonnemann, that a five minute recess be taken. MOTION CARRIED I ORDINANCES AND RESOLUTIONS It was moved by Blakeney, seconded by Nickson, that the City Attorney be authorized to read the ordinances and resolutions that appear on the agenda by title only. ROLL CALL VOTE: All Councilmen voting YES. MOTION CARRIED It was moved by Sonnemann, seconded by Blakeney, that Ordinance No. 2168 be taken off the table and reconsidered.
